This office has conducted a review of the subject requests
for 401 Certifications and offers the following comments and
recommendations.
A review of the supporting information submitted from Vulcan
Materials indicates that the total wetland acreage to be impacted
is approximately 1.25 acres. Of this 1.25 acres the supporting
information indicated that the delineated wetlands are of low
value consisting mostly of intermittent stream channels, a minor
J perennial tributary, and a portion of one isolated wetland.
Therefore, it is recommended that the 401 Certification be issued
for this project.
Upon review of the supporting information for the N. C. DOT,
Charlotte Outer Loop project, it appears that mitigation-was
voluntarily proposed. This Office has no objection to this
proposal except that a 1:1 ratio trade does not seem appropriate
considering the present value (see memo attached concerning the
same wetlands under a different 401 Certification request) of the
wetlands. A mitigated area of equal size would probably take
years before its usefulness and structure would equal that of the
present wetland.
Based on our evaluation, it is recommended that the 401
Certification be issued. However, this office would like to see
at least a 1.5:1 ratio of mitigation approved before permit
issuance and clearing be kept to an absolute minimum.

Interchange with NC 51 to Interchange with Rea

Project No. 3.1670102; DOA Action ID. 1199'20001-1
The 404 Permit ovas issued for this project on May 19;
1992. As a result of t:le unintentional omission of this
permit from the project contract, several permit conditions
were violated when ccnstruction was initiated. On March 3,
1993, the contractor ,vas directed to stop construction until
the work was brought into compliance with the permit. As of
April 7, 1993, the violations were corrected and the
contractor was advised to resume work.
In order to avoid another violation, construction of the
mitigation areas at Mallard Creek would have to be initiated
by May 19, 199° (Special Condition No. 3). Detailed planning
of the site preparations, planting and monitoring programs
for these sites has been delayed due to the aforementioned
coordination errors. Additionally, NCDOT is currently
studying alternative designs and alignments for the Mallard
Creek Church Road widening project. The road will be widened
either as an urban curb-and-gutter on 100-foot right-of-way
or a rural roadway with shoulders on 150-foot right-of-way.
NCDOT expects to make a recommendation on one of these
alternatives by September, 1993. The mitigation sites will

be based upon a worst-case scenario of this project's impacts
on these properties. The acreage thus derived will be
credited toward the 22.2 acres required for wetland
mitigation.
In order to integrate the Mallard Church Creek Road
project into the mitigation plan, and to improve the chance
of success of the mitigation sites, additional time beyond
the May 19, 1993 deadline will be necessary for planning.
NCDOT expects to finalize plans for both of the Mallard Creek
properties so that planting can be conducted during the fall
and winter of 1993. This will allow us to take full
advantage of the 1994 growing season. NCDOT hereby requests
a six-month extension of the deadline to begin construction
of the mitigation sites at Mallard Creek.

1992. As a result of the unintentional omission of this
permit from the project contract, several permit conditions
were violated when construction was initiated. On March 3,
1993, the contractor was directed to stop construction until
the work was brought into compliance with the permit. As of
April 7, 1993, the violations were corrected and the
contractor was advised to resume work.
In order to avoid another violation, construction of the
mitigation areas at Mallard Creek would have to be initiated
by May 19, 1993 (Special Condition No. 3). Detailed planning
of the site preparations, planting and monitoring programs
for these sites has been delayed due to the aforementioned
coordination errors. Additionally, NCDOT is currently
studying alternative designs and alignments for the Mallard
Creek Church Road widening project. The road will be widened
either as an urban curb-and-gutter on 100-foot right-of-way
or a rural roadway with shoulders on 150-foot right-of-way.
NCDOT expects to make a recommendation on one of these
alternatives by September, 1993. The mitigation sites will

be based upon a worst-case scenario of this project's impacts
on these properties. The acreage thus derived will be
credited toward the 22.2 acres required for wetland
mitigation.
In order to integrate the Mallard Church Creek Road
project into the mitigation plan, and to improve the chance
of success of the mitigation sites, additional time beyond

On 26 February 1992, David Foster, Cherri Smith and I
visited the proposed mitigation site on Mallard Creek at Mallard
Creek Church Road for the above mentioned project at the
suggestion of Steve Lund from the Asheville Office of the Corps
of Engineers. We examined the flood plain area south of Mallard
Creek Church Road (proposed mitigation site) as well as that on
the north side of the road (see sketch below).
The area south of the road does not have hydric soils. I
estimate from soil corings that the elevation of the site would
need to be lowered by about 1 1/2 feet in order to have the
hydric soil within 12 inches of the surface. I believe that this
would be essential in order to create a wetland on this site.
Topsoil stockpiling and tree replanting would probably be
advisable.
In addition, there is a ditch running parallel to the stream
at the base of the valley side slope. This ditch presently
carries urban runoff to the edge of Mallard Creek Church Road
where it then flows into Mallard Creek. After lowering of the
floodplain elevation, this water could be diverted to flow across
the floodplain in order to provide additional treatment of this
water.

We also identified an area north of the road which has
hydric soils although the area is now a hay field. This area
occupies about 3.0 acres. This site may be an additional
mitigation area for DOT to use for highway projects in this area.
Wetland restoration on this site could also restore a treed
corridor along Mallard Creek.
As you stated in your 16 September 1991 letter, final
mitigation plans will be forthcoming. To date, I have not
received these plans. I believe that our findings on the
mitigation site should be used by N.C. DOT to modify your
mitigation plans for this project as appropriate. Please contact

Transportation, Division of Highways, for Department of the Army authorization
and a State Water Quality Certification to place fill material in the
waters/wetlands of McAlphine and McMullen Creeks associated with construction
of a controlled-access, 4-lane divided roadway, a section of the Charlotte
Outer Loop, between North Carolina Highway 51 and Johnston Road Extension,
Charlotte, Mecklenburg County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in accordance
with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by December 10, 1991, the
District Engineer will deem that waiver has occurred.

STATE HIGHWAY ADMINISTRATOR
SUBJECT: Mecklenburg County - Charlotte Outer Loop from
Interchange with NC 51 to Interchange with Johnston
Road Extension; T.I.P. No. R-0211DA; State Project
No. 8.1670102
The North Carolina Department of Transportation proposes
to construct a new controlled-access, 4-lane divided roadway
from NC 51 to Johnston Road. This 2.4-mile roadway will
ultimately be incorporated into the 16.6-mile southern
segment (Interstate 77 to US 74 Connector) of the Charlotte
Outer Loop. The Charlotte Outer Loop concept included
contributions from the Charlotte-Mecklenburg Planning
Commission, the Technical Coordinating Committee and the
Transportation Advisory Committee. The proposed action is
included in the Charlotte-Mecklenburg Comprehensive Plan and
the Charlotte-Mecklenburg Urban Area Thoroughfare Plan, and
will provide a necessary connector through a rapidly
developing urban area. The plan has been adopted by the City
of Charlotte, Mecklenburg County, and the Towns.;of Matthews,
Mint Hill, and Pineville.
NC 51 is a major collector in North Carolina's
functionally classified highway system. Design year 2000
traffic assignments to NC 51 and the proposed I-77/US74
Connector indicate combined volumes of up to 53,000 vehicles

per day. NC 51 cannot accommodate volumes of this magnitude,
even with extensive improvements. other circumferential
facilities in the study area lack continuity and are
generally restricted in alignment and in lane width. The
inability of the existing road network to accommodate growing
traffic demand has been the basis for determining the need
for the proposed action. The new facility (I-77/US 74
Connector) is expected to prevent an annual average of 278
accidents, including 3.8 fatalities, by the year 2000.
Two major streams, McAlpine Creek and McMullen Creek,
which drain into the Catawba River, run perpendicular to the
project corridor and will be crossed by the proposed work.
Stream relocation will not be required, but wetlands takings
will be associated with filling in floodplains at the
crossings. Both of these creeks are designated as Class C
waters by the North Carolina Division of Environmental
Management (DEM).
McMullen Creek, with an average daily flow of 16 c.f.s.
and a drainage area of 15.6 square miles, is to be bridged.
Filling of 5.5 acres of bottomland hardwoods adjacent to the
stream will be necessary to the roadway design. This system
has previously been disturbed by sanitary sewer construction.
McAlpine Creek, with an average daily flow of 75 c.f.s. and a
drainage area of 74 square miles, will also be bridged.
Filling of 3.4 acres of good-quality bottomland hardwoods at
this intersection will be required. Bridge pilings will be
placed above ordinary high water in both streams.
Several major alternatives, which included construction
of a freeway on new location versus upgrading of existing
roadways in the area, were considered for improving traffic
flow within the region. The results of this analysis are
summarized below:
Upgrade Existing NC 51 to Freeway Standards - This
proposal would involve grade-separation of intersections
with major crossroads and construction of additional
lanes on NC 51. The construction of new access roads
would be required, and many current access points to NC
51 would be eliminated. This proposal would also impact
McMullen and McAlpine Creeks. It was rejected because
of the high economic and social cost of relocating
existing homes, businesses, and institutions.
Reduced Facility Alternative - This proposal provides
for widening existing NC 51 to a four-lane divided
facility. Bypasses would be provided at Pineville and
Matthew. Intersections at McMullen and McAlpine Creeks
would require filling in adjacent wetlands. This
alternative was rejected because it would not meet
travel demands in the project corridor.
No-Build Alternative - This strategy was not selected
due to the projected growth in travel demand for the
subject corridor.
Postponement of Proposed Action - Future traffic demand
in the NC 51 corridor is not expected to decrease or to
be diminished by use of regional transit. Delay of the
proposed improvements would exacerbate existing and
future traffic congestion.
Freeway on New Location - A four- to six-mile-wide
corridor for the I-77/US 74 Connector was initially
studied, with critical areas quickly eliminated by
anticipated high impact potentials. Ten new location
assignments within a refined corridor were investigated
and described in the Draft and Final Environmental
Impact Statements and presented at Corridor Public
Meetings and Hearings. Since the desired connector
would run east-west, while McMullen and McAlpine Creeks
run north-south, all alternatives studied would involve
bridging of these two streams at some location. The
proposed alignment, Alternative 3, represents efforts to
avoid social impacts to communities to the south of
Charlotte, to minimize impacts to historic properties
and natural resources, and to minimize relocation of
homes and businesses.

Mitigation proposed for the 8.9 cres of wetland impacts
at McMullen and McAlpine Creeks it include restoration of a
10.0 acre property transected by llard Creek. The site,
owned by the Mecklenburg County Park and Recreation
Department, has been impacted by clearing and cultivation as
1l'? a hay field. In order to add this property to Charlotte's
j Greenway System, NCDOT proposes to restore wetland vegetation
and to provide a boardwalk for public access to the site.
The Land Acquisition Subcommittee of the Mecklenburg County
Park and Recreation Department has approved this proposal,
and will transmit to us a map of the desired boardwalk path
subsequent to approval by Mecklenburg County in October. The
attached Mitigation Plan and Mitigation Plan Drawings depict
the planting plan and methods for restoring wetlands to the
site. The final plans for this mitigation/greenway site,
along with pertinent correspondence from the Mecklenburg
County Park and Recreation Department, will be forwarded to

you upon completion. In the interim, please begin processing
of the attached application.
The Final Environmental Impact Statement for the I-77/US
74 Connector was approved by the Federal Highway
Administration on August 17, 1981. Application is hereby
made for an Individual DOA Permit pursuant to Section 404 of
the Clean Water Act. By copy of this letter, a request for
401 Water Quality Certification by the DEM is also made.

PUBLIC NOTICE
The North Carolina Department of Transportation, Division of Highways,
Post Office Box 25201, Raleigh, North Carolina 27611-5201, has applied for a
Department of the Army (DA) permit TO PLACE FILL MATERIAL INTO APPROXIMATELY
8.9 ACRES OF FORESTED WETLANDS ADJACENT TO McMULLEN AND McALPINE CREEKS TO
CONSTRUCT A 2.4-MILE SEGMENT OF THE CHARLOTTE OUTER LOOP HIGHWAY SOUTH OF
CHARLOTTE, Mecklenburg County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plane submitted with the
application show the proposed placement of suitable borrow material into
approximately 8.9 acres of bottomland hardwood wetlands to form approach fills
for highway crossings of McMullen and McAlpine Creeks. Fill in wetlands at
McMullen Creek would measure approximately 1,250 feet long and 190 feet wide
or about 5.5 acres on both sides of the creek. The channel would be bridged
by a 190-foot long structure. Affected wetlands at McMullen Creek would
consist primarily of seasonally flooded, broad-leaved deciduous forest
vegetated with green ash, boxelder, American elm, sycamore, sugarberry and
sweet gum. A smaller amount of semipermanently flooded, broad-leaved
deciduous forest vegetated with green ash, black willow, buttonbush and swamp
dogwood would also be impacted. Proposed fill in wetlands at McAlpine Creek
would measure approximately 590 feet long and 250 feet wide or about 3.4 acres
on both sides of the creek. The channel would be bridged by a 320-foot-long
elevated structure. Wetlands adjacent to McAlpine Creek consist of seasonally
flooded, broad-leaved deciduous forest vegetated with similar species to the
McMullen Creek wetlands but generally more mature. The purpose of the
proposed work is to construct a new, controlled-access, 4-lane divided roadway
from N.C. Highway 51 to a future intersection with Johnston Road Extension.
No timetable has been given for the extension of Johnston Road. Ultimately
this 2.4 mile roadway is to be incorporated into the 16.6 mile southern
segment of the charlotte Outer Loop from Interstate Highway 77 on the west to
U.S. Highway 74 on the east. Plans showing the proposed work are included
with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No

DA permit will be issued until the coordinated State viewpoint on the proposal
has been received and reviewed by this agency, nor will a DA permit be issued
until the North Carolina Division of Environmental Management (DEM) has
determined the applicability of a Water Quality Certificate as required by
PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and, if so, the conditions under
which it will be allowed to occur are therefore determined by the outcome of
the general balancing process. That decision should reflect the national
concern for both protection and utilization of important resources. All
factors which may be relevant to the proposal must be considered including the
cumulative effects thereof. Among those are conservation, economics,
aesthetics, general environmental concerns, wetlands, cultural values, fish
and wildlife values, flood hazards, flood plain values, land use, navigation,
shore erosion and accretion, recreation, water supply and conservation, water
quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and, in general, the needs and welfare

of the people. For activities involving the placement of dredged or fill
materials in waters of the United States, a permit will be denied if the
discharge that would be authorized by such permit would not comply with the
Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the
preceding sentence and any other applicable guidelines or criteria, a permit
will be granted unless the District Engineer determines that it would be
contrary to the public interest.
Generally, the decision whether to issue this DA permit will not be made
until the North Carolina Division of Environmental Management (DEM) issues,
denies, or waives State certification required by Section 401 of the Clean
Water Act. The DEM considers whether or not the proposed activity will comply
with Sections 301, 302, 306, and 307 of the Clean Water Act. The application
and this public notice for the DA permit serve as application to the DEM for
certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The DEM Management plans to take final action in the issuance of the Clean
Water Act certification on or after December 7, 1991.

Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,

In response to your correspondence of November 21, 1991,
we have enclosed a copy of the Final Environmental Impact
Statement prepared for the proposed Interstate 77 - US 74
Connector from I-77 to US 74 (Independence Boulevard) in
Charlotte, Mecklenburg County. This new multi-lane freeway
will ultimately comprise the southern section of the
Charlotte Outer Loop, but also has independent utility and is
needed whether or not the remainder of the loop is
constructed. The document describes alternatives to
development of this project, as well as various location
alternatives considered for the roadway. As a result of
extensive planning studies conducted for this project, the
proposed alignment was considered to have the fewest impacts
on environmental quality and existing social features of the
area, while meeting the designated transportation goals.
The proposed extension of Johnston Road to tie in with
the Charlotte Outer Loop has been removed from NCDOT's
planning. However, the relocation of US 521 (Lancaster
Highway) from the North Carolina/South Carolina State Line to
the Charlotte Outer Loop, at the same point of intersection,

remains part of the Transportation Improvement Program
(T.I.P. No. R-2242, State Project No. 8.1672401). A Federal
Environmental Assessment was submitted for the US 521
Relocation project on January 23, 1990. Right-of-way
acquisition and survey work are currently underway for this
project, but refined roadway design of this roadway between
the state line and Outer Loop intersection has not been
completed. The design of the Charlotte Outer Loop/US 521
Intersection has been completed, and the permit application
for this work will be submitted this year. Wetland impacts
associated with the remainder of the US 521 relocation will
be addressed when they can be precisely quantified.
Permit applications for wetland impacts identified with
the remaining segments of the Charlotte Outer Loop, from the
intersection with the US 521 relocation to US 74, will
follow the present submittal. Following permitting of the
Outer Loop/US 521 Intersection, the Connector can be
constructed up to NC 16, a viable traffic intersection.
The project has been broken into segments due to in-house
time schedules and budgeting constraints. The document
prepared for the entire I-77/US 74 Connector illustrates the
comprehensive planning and research used in selecting the
final design and location for all segments included in this
planning process. The EIS also describes design features and
construction measures which will be incorporated to minimize IA
local wetland impacts. Please retain this copy of the EIS u(
for your reference when reviewing successive permit
applications for this project. The remaining impacts will be
associated with the segment from East of the NC 16
Interchange through the US 74 Interchange. Permitting of
this segment will be conducted as soon as possible.
It should be noted that elimination of the proposed
Johnston Road extension will prevent an additional crossing
of McAlpine Creek. Furthermore, there will be no wetland
impacts requiring permits in 4.8-mile segment of the
I-77/US 74 Connector from East of the Interchange with US 521
Relocation through the Interchange with NC 16. As originally
planned, this segment would have required two crossings of
Flat Branch. The alignment has been shifted to avoid these
stream crossings in an attempt to minimize wetland impacts.
It would have been impossible to entirely avoid stream
crossings in the design of the I-77/US 74 Connector, as there
are several systems which run roughly perpendicular to this
east-west corridor. The segment included in this proposal
illustrates this point, as McMullen and McAlpine Creeks run
perpendicular to the study corridor for over six miles.
Bridging of these creeks was unavoidable, so there was no
completely upland alternative.
Please append this information to the existing
permit application for this project. As you requested, a
copy of this letter, and a copy of the EIS, will be sent to
the Division of Environmental Management for processing of
the 401 Water Quality Certification.

This Office has conducted a review of the subject requests
for 401 Certifications and offers the following comments and
recommendations.
A review of the supporting information submitted from Vulcan
materials indicates that the total wetland acreage to be impacted
is approximately 1.25 acres. Of this 1.25 acres the supporting
information indicated that the delineated wetlands are of low
value consisting mostly of intermittent stream channels, a minor
perennial tributary, and a portion of one isolated wetland.
Therefore, it is recommended that the 401 Certification be issued
for this project.
Upon review of the supporting information for the N. C. DOT,
Charlotte Outer Loop project, it appears that mitigation was
voluntarily proposed. This Office has no objection to this
proposal except that a 1:1 ratio trade does not seem appropriate
considering the present value (see memo attached concerning the
same wetlands under a different 401 Certification request) of the
wetlands. A mitigated area of equal size would probably take
years before its usefulness and structure would equal that of the
present wetland.
Based on our evaluation, it is recommended that the 401
Certification be issued. However, this office would like to see
at least a 1.5:1 ratio of mitigation approved before permit
issuance and clearing be kept to an absolute minimum.

This Office has conducted a review of the documents
submitted for this project and offers the following comments and
recommendations.
The proposed sewer relocations are a direct result of the
construction of a proposed segment of Interstate 485 (outer loop)
south of the City of Charlotte. Due to the location of the
proposed interstate, main sewer outfalls entering the McAlpine
Creek Wastewater Treatment Plant need to be moved. It should be
noted that if the interstate is not constructed or does not
effect the subject wetlands then the 401 water quality
certification should be voided; and a statement as such should be
included in the certification.
A wetland rating sheet (attached) was completed for the
39-inch McMullen Creek outfall to determine the value of the
associated wetlands. The outfall almost centered these wetland
areas which rated 54% as shown on the rating sheet. The 10-inch
McMullen Creek and 54-inch McAlpine Creek outfalls were not rated
and did not appear as if they would have a significant wetland
impact. Both crossed wetland areas, but if the clearing corridor
for the sewer line construction is kept to a minimum a
significant impact is not expected. The parallel 54-inch and
60-inch Sugar Creek outfalls are also not rated. The Sugar Creek
outfall is to be relocated to higher ground, and only a small
portion appeared to be in a low value wetland.

inability of the existing road network to accommodate growing
traffic demand has been the basis for determining the need
for the proposed action. The new facility (I-77/US 74
Connector) is expected to prevent an annual average of 278
accidents, including 3.8 fatalities, by the year 2000.
Two major streams, McAlpine Creek and McMullen Creek,
which drain into the Catawba River, run perpendicular to the
project corridor and will be crossed by the proposed work.
Stream relocation will not be required, but wetlands takings
will be associated with filling in floodplains at the
crossings. Both of these creeks are designated as class C
waters by the North Carolina Division of Environmental
Management (DEM).
McMullen Creek, with an average daily flow of 16 c.f.s.
and a drainage area of 15.6 square miles, is to be bridged.
Filling of 5.5 acres of bottomland hardwoods adjacent to the
stream will be necessary to the roadway design. This system
has previously been disturbed by sanitary sewer construction.
McAlpine Creek, with an average daily flow of 75 c.f.s. and a
drainage area of 74 square miles, will also be bridged.
Filling of 3.4 acres of good-quality bottomland hardwoods at
this intersection will be required. Bridge pilings will be
placed above ordinary high water in both streams.
Several major alternatives, which included construction
of a freeway on new location versus upgrading of existing
roadways in the area, were considered for improving traffic
flow within the region. The results of this analysis are
summarized below:
Upgrade Existing NC 51 to Freeway Standards - This
proposal would involve grade-separation of intersections
with major crossroads and construction of additional
lanes on NC 51. The construction of new access roads
would be required, and many current access points to NC
51 would be eliminated. This proposal would also impact
McMullen and McAlpine Creeks. It was rejected because
of the high economic and social cost of relocating
existing homes, businesses, and institutions.
Reduced Facility Alternative - This proposal provides
for widening existing NC 51 to a four-lane divided
facility. Bypasses would be provided at Pineville and

:,!atth:2w. Intersections at McMullen and McAlpine Creeks
`r7ouid require filling in adjacent wetlands. This
alternative was rejected because it would not meet
travel demands in the project corridor.
No-Build Alternative - This strategy was not selected
due to the projected growth in travel demand for the
subject corridor.
Postponement of Proposed Action - Future traffic demand
in the NC 51 corridor is not expected to decrease or to
be diminished by use of regional transit. Delay of the
proposed improvements would exacerbate existing and
future traffic congestion.
Freeway on New Location - A four- to six-mile-wide
corridor for the I-77/US 74 Connector was initially
studied, with critical areas quickly eliminated by
anticipated high impact potentials. Ten new location
assignments within a refined corridor were investigated
and described in the Draft and Final Environmental
Impact Statements and presented at Corridor Public
Meetings and Hearings. Since the desired connector
would run east-west, while McMullen and McAlpine Creeks
run north-south, all alternatives studied would involve
bridging of these two streams at some location. The
proposed alignment, Alternative 3, represents efforts to
avoid social impacts.to communities to the south of
Charlotte, to minimize impacts to historic properties
and natural resources, and to minimize relocation of
homes and businesses.
Mitigation proposed for the6 .9 acres of wetland impacts
at McMullen and McAlpine Creeks will include restoration of a
10.0 acre property transected by Mallard Creek. The site,
owned by the Mecklenburg County Park and Recreation
Department, has been impacted by clearing and cultivation as
a hay field. In order to add this property to Charlotte's
Greenway System, NCDOT proposes to restore wetland vegetation
and to provide a boardwalk for public access to the site.
The Land Acquisition Subcommittee of the Mecklenburg County
Park and Recreation Department has approved this proposal,
and will transmit to us a map of the desired boardwalk path
subsequent to approval by Mecklenburg County in October. The
attached Mitigation Plan and Mitigation Plan Drawings depict
the planting plan and methods for restoring wetlands to the
site. The final plans for this mitigation/greenway site,
along with pertinent correspondence from the Mecklenburg
County Park and Recreation Department, will be forwarded to

The Final Environmental Impact Statement for the I-7711US
74 Connector was approved by the Federal Highway
Administration on August 17, 1981. Application is hereby
made for an Individual DOA Permit pursuant to Section 404 of
the Clean Water Act. By copy of this letter, a request for
401 Water Quality Certification by the DEM is also made.

Attached are copies of Roadway Design drawings depicting
proposed work at the Nationwide Permit sites along the
project corridor. Additionally, we have included a copy of a
Mecklenburg county tax map illustrating property owned by the
Mecklenburg County Park and Recreation Department. The
County owns the 35.93 acre property on the southeast corner
of the Mallard Creek Church Road/US 29 intersection. The
property is transected by Mallard Creek, with soccer fields
on the north side of the property, and a mowed field on the
south side. The Park and Recreation Department has agreed to
allow use of the entire southern side of the property, and
the Board of County commissioners is also expected to approve
this proposal on May 18, 1992. We believe that approximately
12 acres of bottomland hardwoods can be restored on this
site, in addition to the formerly proposed 4.5 acres of
wetlands creation on the southwest corner of this
intersection.
