This permit shall be effective from the date of issuance until rescinded,) and shall be subject to the conditions and limitations as specified therein. This cover letter shall be considered a part of this permit and is incorporated therein by reference. Please send Don Price or Jeff Menzel a copy of the "notice to proceed" issued to your contractor for this collection system extension. Please pay particular attention to Permit Condition 3 which requires that the wastewater collection facilities be properly operated and maintained in accordance with 15A NCAC 2T .0403 or any individual system-wide collection system permit issued to the Permittee. Permitting of this project does not constitute an acceptance of any part of the project that does not meet 15A NCAC 2T; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast-Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable;a-,nless specifically mentioned herein. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This permit shall become voidable unless the wastewater collection facilities are constructed in accordance with the conditions of this permit; 1.5A NCAC .0200; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting materials unless specifically mentioned herein. 2. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The wastewater collection facilities shall be properly maintained and operated at all times. The Permittee shall maintain compliance with an individual system-wide collection system permit for the operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2T .0403: a. The sewer system shall be effectively maintained and operated at all times to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed and shall be actively maintained. c. An operation and maintenance plan shall be developed and implemented. d. Pump stations that are not connected to a telemetry system shall be inspected every day (i.e. 365 days per year). Pump stations that are connected to a telemetry system shall be inspected at least once per week. e. High-priority sewer lines shall be inspected at least once per every six-month period of time. f. A general observation of the entire sewer system shall be conducted at least once per year. g. Inspection and maintenance records shall be maintained for a period of at least three years. h. In the event there is a desire for the wastewater collection facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division accompanied by documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 5. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 6. Upon completion of construction and prior to operation of these permitted facilities, a certification, a copy of the construction record drawings, as well as supporting design calculations for any pump stations permitted as part of this project shall be received from a North Carolina-licensed Professional Engineer certifying that the facilities have been installed in accordance with this permit; 15A NCAC 2T; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting of Pump Station and Force Main adopted June 1, 2000 as applicable; and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. A copy of the construction record drawings, indicating the facilities constructed in the phase being certified, shall be submitted with each partial certification. Mail the Engineer's Certification, one copy of the "Construction Record Drawings," and one copy of the supporting design calculations to the Non-Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 7. A copy of the construction record drawings shall be maintained on file by the Permittee for the life of the wastewater collection facilities. 8. Failure to abide by the, conditions and limitations contained in this permit; 15A NCAC 2T.; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an enforcement action by the Division, in accordance with North Carolina General Statutes §143- 215.6A through §143-215.6C. 9. In the event that the wastewater collection facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement facilities. 10. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (local, state and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. 11. Noncompliance Notification: The Permittee shall report by telephone to a water quality staff member at the Asheville Regional Office, telephone number (828) 296-4500, as soon as possible, but in no case more than 24 hours or on the next working day, following the occurrence or first knowledge of the occurrence of either of the following: 2 PFRMIT NO W00n15561,Jown of Franklin Riverview Pump Station and Force Main September 15, 2011 a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of-all or any portion of the influent to such station or facility. Voice mail messages or faxed information is permissible but this shall not be considered as the initial verbal report. Overflows and spills occurring outside normal business hours may also be reported to the Division of Emergency Management at telephone number (800) 858-0368 or (919) 733-3300. Persons reporting any of the- above occurrences shall file a spill report by completing Part I of Form CS-SSO (or the most current Division approved form), within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to ensure that the problem does not recur. Per Condition 1(2), Part II of Form CS-SSO (or the most current Division approved form) can also be completed to show that the SSO was beyond control. Application Fee - Submit a check in the amount of $480 made payable to: North Carolina Department of Environment and Natural Resources (NCDENR). Checks shall be dated within 90 days of application submittal. ❑ C. Certificates of Public Convenience and Necessity — If the application is being submitted in the name of a privately-owned public utility, submit two copies of the Certificate of Public Convenience and Necessity (CPCN) which demonstrates that the public utility is authorized to hold the utility franchise for the area to be served by the sewer extension. If a CPCN has not been issued, provide two copies of a letter from the North Carolina Utilities Commission's Public Staff that states that an application for a franchise has been received, that the service area is contiguous to an existing franchised area, and/or that franchise approval is expected. The project name in the CPCN or letter must match that provided in Item A(2)a of this application. ❑ D. Operational Agreements—Submit one original and two copies of a properly executed operational agreement, as per 15A NCAC 02T .0115, if the application is submitted by a private applicant and will be serving residential or commercial lots (e.g., houses, condominiums, townhomes, outparcels, etc.) that will be sold to another entity. If the applicant is a home or property owner's association, use Form HOA 02/03. If the applicant is a developer, use Form DEV 02/03. EVEN IF THE PROJECT MAY BE TURNED OVER TO A MUNICIPALITY UPON COMPLETION, FORM DEV 02/03 IS REQUIRED. ❑ E. Downstream Sewer, WWTF Capacity and Flow Tracking/Acceptance — FORM FTSE 10/07 (Flow Tracking/Acceptance for Sewer Extension Permit Applications) is required with every application. The applicant (and owners of downstream sewers, pump stations and/or treatment facilities submitting FORM FTSE-10/07) certifies that, to the best of their knowledge, the addition of the volume of wastewater to be permitted in this project has been evaluated along the route to the receiving treatment plant, and that the flow from this project will not cause capacity related sanitary sewer overflows or overburden any downstream pump station en route to the receiving wastewater treatment plant. Where the applicant is not the owner of the downstream sewer, submit two copies of FORM FTSE 10/07 from the owner of the downstream sewer and owner of the WWTF, if different. The flow acceptance indicated in FORM FTSE-10/07 must not expire prior to permit issuance and must be dated less than one year prior to the application date. Submittal of this application and FORM FTSE-10107 indicates that owner has adequate capacity and will not violate G.S. 143-215.67(a). Intergovernmental agreements or other contracts will not be accepted in lieu of project-specific FTSE 10/07. ® F Map—Submit an 8.5-inch by 11-inch COLOR copy of a USGS Topographic Map of sufficient scale to identify the entire project area and the closest surface waters. Each map or maps must show the location of the sewer line and pump stations and be of reproducible quality. Flow Direction — Many wastewater treatment systems are entering into agreements for regionalization efforts and emergency treatment capacity. Parts of the system are installed so that the wastewater flow can be directed to more than one treatment facility. If this is the case with this project, please indicate in 13(12) and give the permit number of the second treatment facility. ® J. Certifications—Section C The application must be certified by both the applicant and the design engineer who is a North Carolina Registered Professional Engineer (PE). The applicant signature must match the signing official listed in Item A(1 b). It was stated the replacement remedied the problem. [April] - Experiencing problems with pressure and delivery on Bar screen wash water. 63) Since April meeting COMPLETED the Horizontal Directional Drill under the river! This has been a difficult and time consuming endeavor. Refer to comment 46) from earlier reports. 64) At May meeting IFS asked if there had been any spills or bypasses of sewerage since last meeting, Owner, HCC and Engineer stated there had been none. 65) At May meeting HCC requested an expeditious review of the air piping and the expansion joints submittals. 66) Spare Parts status - IFS requested a discussion item be added to the agenda in May. Please be prepared to discuss status of spare parts at June meeting. CONSTRUCTION INSPECTION Observations of HCC work done since last inspection of March includes but is not limited to o through May meeting—completed demolition of old digester o formed and poured concrete footing of new digester o began forming walls of digester o COMPLETED HDD (Horizontal Directional Drill) under the river! This has been a difficult and time consuming endeavor. Due to limits on the SRF funding, these change orders (nos. 2 & 3) were reviewed for permitting and were not reviewed for loan or grant eligibility. CO#4 regarding Pump Station site layout modifications is being executed. Please submit CO#4 to IFS when completed and submit with half size drawing and with the change order checklist provided earlier. CO#5 will address headworks modifications, 18" plug valve, barscreen washwater piping modifications, electrical and fiber optic matters, the EQ basin mutitrode and a weather related contract time extension. Pipe has been pressure tested before launch as it is laying on ground at plant site. The HD pipe will be tested again once HDD is completed. [Feb] - several (drilling) heads have been lost but final push is now to proceed and should be completed within the next few working days. For the record the "Canadian expert's" recommendations were not effective. [Nov.] -the expert from Canada did visit job site and recommended deeper directional drill to mitigate potential for fracking breakout. Option will cost - $200k additional, Engineer and Owner will evaluate environmental risks vs. costs. Decision will be made very soon as timely completion of project is dependent on this work. HCC (Hickory Construction) is to provide MSDS on the fracking agent which is thought to be bentonite. The horizontal directional drill (HDD) under the river has not gone well, HCC reported there have been 6 attempts. Rock type and vertical restraints have made the HDD difficult. HCC states they have obtained expert on- HDD out of Canada who will be in town week of October 22 to help resolve. 48) March update: revised plans were provided to IFS. [Feb.] IFS still requests revised grading drawing(s) for this area. [Nov]-please provide revised drawing, in pdf format. The grading plan will be revised around EQ basin, please provide copy to IFS. 49) March update: revised plans on pump station infrastructure relocation were provided to IFS. Costs are being negotiated. [Feb.] -it was decided to move the proposed location of the new pump station. Please provide latest drwg to IFS. [Nov]- the matter is still under review, Owner and Engineer will meet week of Nov. 19 and make a decision. HCC indicates with a shift of 20+ft., a savings could be effected and operational phasing out of the old pump station could be enhanced. Engineer will evaluate, there may be wetlands implications and/or NC DOT issues. 53) March update: inspector stated he took care of situation that day. IMPORTANT- After meeting Horton of IFS walked the WWTP construction site and then visited the pump station construction site on NC28/Bryson City Rd. where it was noticed that contractor was discharging silt laden sump water to the adjacent wetlands without intervening silt fence, silt pond or a silt bag. G. Horton called Inspector Jerry Wells on cell phone to advise him of this situation which he did, but then lost reception. Please be prepared to discuss resolution of this matter at April meeting. 54) March update: HCC is removing sludge from digester and hauling to limits to adjacent landfill and disposing of overage to facility in Georgia. That is approximate 3 loads per day to the adjacent landfill and 1 to 2 loads per day to Georgia. At Feb. meeting the handling of sludge was discussed. Owner expressed concerns on where and rate of transfer to the oxidation ditch. 55) March update: Hickory has begun working on Saturdays. [Feb] - Hickory stated they may begin working Saturdays in order to return to schedule. 56) IFS hereby requests the NC Rural Center's Keith Krzywicki acknowledge receipt of this report and confirm the Rural Center wishes to continue receiving these reports. 57) IFS asked if there had been any spills or bypasses of sewerage since last meeting, Owner, HCC and Engineer stated there had been none. 58) Owner should submit change orders if seeking IFS participation in cost changes and an adjustment to the contract completion dates. RFI status Requests for Information - current - Project Schedule- a revised schedule was handed out at the February meeting. That schedule indicated a Substantial Completion date of September 26, 2013, but this must be adjusted by change order. Thus far an extension of time via CO#1 changes the completion date to June 13, 2013. No additional time has been sought or submitted to IFS to extend that completion date. Hence the completion date of June 13, 2013 remains the official Final Completion date. HCC however indicated they are on schedule with the "new" September date. Submittals status - all submittals have now been approved, only record revisions are outstanding. It was previously suggested by IFS that spare parts handling and manufacturer's O&Ms be added to the agenda. HCC (Hickory Construction) is to provide MSDS on the fracking agent which is thought to be bentonite. Owner expressed concerns on where and rate of transfer to the oxidation ditch. 55)Hickory stated they may begin working Saturdays in order to return to schedule. CONSTRUCTION INSPECTION G. Horton was unable to attend progress meeting in January and understands there was no meeting in December. A written clarification is warranted. Project Schedule- a schedule was handed out at the November meeting. The schedule contains Substantial Completion date of June 12, 2013 and Final Completion date of July 12, 2013. HCC indicated they are on schedule. Submittals status - submittals are current, Hickory stated that all major equipment has now been deliver to job site or to Hickory's property. It is now suggested that spare parts handling and manufacturer's O&Ms be added to the agenda. Engineer feels extra compensation is warranted. Refer to drwg S 103. 48) November update: please provide revised drawing, in pdf format. Mildner, HCC expressed concern that this delayed decision is eating into the float on the schedule, hence may affect completion date if decision delayed further. There was a lengthy discussion at the October meeting regarding changing the site plan of the pump station. HCC indicates with a shift of— 20+feet, a savings could be effected and operational phasing out of the old pump station could be enhanced. Owner and Engineer are hereby advised of that. The EQ basin passed the leak test but is still under observation. previously the 18" pipe under the EQ basin tested satisfactorily. Other pipe is yet to be tested. Record Drawings status -there have been no significant annotations needed on As-Buiits which were viewed by IFS in November. [Sept] - matter is resolved, however IFS still requests related correspondence be provided to IFS. IMPORTANT - There have been some early concrete breaks below the anticipated strength. Please prepare to discuss this matter fully at September meeting. Engineer asked for letter from HCC and/or their concrete supplier regarding the strength of the suspect concrete. Cores may be necessary. Provide copies of relevant reports to IFS prior to September meeting via email and pdf. 40) Oct. update: this is a repeat request, please provide requested documentation. [Sept.] - HCC repaired integrity of waterstop via long process of moving reinforcement steel in order to provide access for chipping out concrete and "mortaring in" the waterstop. This issue resulted in RFI#12, a copy of RFI and related correspondence it to be provided to IFS. IMPORTANT - A vertical waterstop came out on one of the wall pours, a run of- 5 ft. from 4 ft. to 9 ft. above F/F. Location on tank is - 3 o'clock, using north as 12 o'clock. Access to resolve is virtually impossible. Please discuss resolution of this matter at September meeting. 44) HCC provided updated and final "Approved" schedule at the October meeting. The schedule contains Substantial Completion date of June 12, 2013 and Final Completion date of July 12, 2013. 45) The digester cleanup was discussed and it is likely there is - 3 feet depth of grit to be removed. As of today there are no critical outstanding submittals. [August] Hickory Constr. will provide an updated schedule at September meeting. There has been 6 versions, sticking point is timing of taking down digester. HCC can take digesters if it gives 30 days notice, if it is shown on schedule in proper sequence and if done around January 2013. [July]-another Construction schedule is being prepared/updated. Owner wants the 30 days available for digester related work shown as around Feb. 15 instead of the Jan. 22 date. 9) Sept. update:IFS received suitable statement and has filed it with project records. [August] IFS still awaiting response. [July]-Engineer stated they will send written/letterhead statement signed by the Engineer attesting to the scope of work. IMPORTANT - IFS requests Owner and Engineer read the description of eligible work herein and confirm at next meeting in writing that the Scope of Work is accurate and as approved. 38) Sept. update: a NEMA 3R has been approved. Issue arose on control panels at pump station, specifically NEMA 4X SS was specified but supplier contends NEMA 31Z only can be provided. Engineer and HCC are to check the facts. Refer to drawings numbers E105 & E-602. 39) Sept. update: matter is resolved, however IFS still requests related correspondence be provided to IFS. IMPORTANT - There have been some early concrete breaks below the anticipated strength. Please prepare to discuss this matter fully at September meeting. Engineer asked for letter from HCC and/or their concrete supplier regarding the strength of the suspect concrete. Cores may be necessary. Provide copies of relevant reports to IFS prior to September meeting via email and pdf. 40) Sept. update: HCC repaired integrity of waterstop via long process of moving reinforcement steel in order to provide access for chipping out concrete and "mortaring in"the waterstop. This issue resulted in RFI#12, a copy of RFI and related correspondence it to be provided to IFS. IMPORTANT - A vertical waterstop came out on one of the wall pours, a run of— 5 ft. from 4 ft. to 9 ft. above F/F. Location on tank is — 3 o'clock, using north as 12 o'clock. Access to resolve is virtually impossible. Please discuss resolution of this matter at September meeting. 41) Referring to drawing S101, HCC asked if it made any difference whether the columns are round or square. Engineer stated it made no difference. 42) Color submittals have been provided to Owner and Engineer by HCC. 43) HCC noted and Owner acknowledged there can be no septic tank discharges during pipe installation in the vicinity beginning Sept. 26. IMPORTANT -This topic should be discussed at each meeting until a plan of action is determined. 34) August update:property access/permission has been obtained for HCC to proceed on boring under river for force main work, it was reported. [June]-HCC advises they are having difficulty with local landowner regarding performing the force main bore under the river. Commissioners may have to condemn in which case it may be September before HCC is able to do work. Upon approval of SOV by Owner and or Engineer, it is requested SOVs be provided to Gerald Horton in electronic spreadsheet format,preferably excel. 5) June update:pending. IFS requested list of ALL subcontractors proposed or intended to work on project, including Prime Contractor. IFS received list at meeting however, please update and note thereon which are DBE or MBEs, if any. 6) June update: no interviews yet conducted. Davis Bacon [DB] interviews and compliance are required on this project. Refer to attached guidance and interview form. This same form will be filled out again with help from the Owner towards the end of the project. 7) June update: IFS has been provided a set of half sized drawings. IFS, at today's meeting, requested a conformed half size set of drawings. 9) June update:please provide written statement at July meeting. IMPORTANT- IFS requests Owner and Engineer read the description of eligible work herein and confirm at next meeting in writing that the Scope of Work is accurate and as approved. 10) June update: submittal log was provided at June meeting, RFI and RFP logs not yet initiated. IFS requested logs of submittals, RFIs, RFPs etc be kept and brought to Progress meetings for discussion. IFS is not requesting copies of these logs at this time. 11) June update: done. Though not required by IFS, IFS recommended contractor take videos of routes and structures prior to initiating work. 15) June update: items were posted. Contractor was advised to post OSHA, EEO, Labor, wage rates & other notices at a staging area or construction office in proximity of the work. 21) June update: there were 3 and they were approved according to Engineer. Engineer or Owner shall confirm at first progress meeting how many addenda there were and that all were approved by IFS. 24) June update: testing will be performed by BLE. Testing is the responsibility of the Owner and the testing firm(s) as of date of Precon were yet to be determined. 25) June update: this comment 25) in Precon report was not relevant to this project. 27) June update: McGill should address this at next meeting. Hickory asked which NOAA weather station Engineer will use. Engineer will respond. 29) At June meeting, Owner (Jay Gibson) stated they wish to review certain submittals, generally equipment submittals. They stated they would not hold up approvals. 30) Engineer stated at June meeting they would send ALL RFIs to Owner. 31) HCC-Mildner asked Owner to check sludge levels. HCC is concerned when the digester area would be available for their work. This work needs to be addressed in contractors schedule and Owner needs to accommodate, but maintenance of treatment is critical around the digester levels and operations. IMPORTANT - This topic should be discussed at each meeting until a plan of action is determined. 32) HCC via an RFI will advise how they intend to place the precast wetwell on a slab vs. placement on#57 stone. A related handout was passed out at June meeting for discussion. Gerald Horton accompanied Ben Cathey on "windshield" tour to pump station site and WWTP after the meeting. 19. IFS asked if NC Dept. of Labor personnel with OSH (safety) had been invited to Preconstruction meeting, they had not. 20. Engineer stated that all approvals, encroachments, and permits have been obtained. 21. Engineer or Owner shall confirm at first progress meeting how many addenda there were and that all were approved by IFS. 22. Engineer advised that sales tax statements must be included with each of contractor's progress payment request. 23. Engineer stated that all pay requests must be approved by inspector before they will be further processed. 24. Testing is the responsibility of the Owner and the testing firm(s) as of date of Precon were yet to be determined. 25. Owner discussed critical work sequencing and that contractor must adhere to restrictions regarding work at the City Park. Also critical are the crossings of Tar River, refer to drwgs FM8 &FM10 and to Engineer's meeting minutes. 26. If materials or equipment are stored off site or out of Right of Ways, and reimbursement therefore are sought, then Owner or Engineer should provide an affidavit attesting extant. 27. Hickory asked which NOAA weather station Engineer will use.'Engineer will respond. 28. There was an allowance included for SCADA in the bid documents. Role of the Construction Inspection Group (CIG) 1. Conduct periodic inspections of the project. 2. Review change orders for necessity and reasonableness to determine eligibility for loan funding. 3. Purpose: a. To ensure that the overall objectives of the loan or grant are realized. b. To monitor administration of the loan and/or grant to ensure the project is executed in accordance with State regulations and loan and/or grant conditions. c. To ensure contract compliance and construction in accordance with NC DENR approved contract documents. d. To advise and offer assistance to the loan and/or grant Recipient. r Town of Franklin 'reconstruction Meeting of WWTP,Riverview Pump Station &Force Main Improvements May 1,2012 Project No. CS 370 524-03 Page 5 of 7 CHANGE ORDERS Refer to attached change order checklist. IFS "Approval" of a changer order is not necessary to proceed on the work because a change order is a modification of the agreement between the Owner and the Contractor. However, a determination as to eligibility(sometimes termed "approval")is required for IFS to participate in the funding of the change order. Should Owner wish to ascertain that the work item(s) are eligible for funding they should ask, and if additional information is needed then IFS will advise. CIG (Construction Inspection Group) INSPECTIONS 1. Prior notice may be given; however, unannounced inspections may also be conducted. 2. Inspections will be concerned with administrative matters and construction matters/activities. 3. During inspections, CIG may wish to review, observe and/or discuss: o files and status of shop drawings, submittals, o inspector's field reports, o status of record(as-built) drawings, o status of: Requests for Information (RFIs), Requests for Proposals (RFPs) o revised construction schedules, o records of testing of materials, soils, concrete, equipment, and o pending or executed change orders documentation for completeness and accuracy. 4. The Division of Water Quality(DWQ) and IFS requests that all equipment and materials on job site be properly stored, stockpiled, and protected. Improper storage of materials and equipment may result in recommendation to reduce reimbursement amount. The job site(s) shall be maintained in an acceptable manner. 5. Safe working conditions should be maintained at all times. CIG will discuss potential or apparent safety violations. If warranted or deemed necessary, CIG will attempt to take prompt action by notifying authoritative on-site personnel and may notify State and/or OSHA regional representatives of any noted conditions which appear to be life endangering or threatening of serious injury. Safety is the sole responsibility of the Contractor. 6. Results of the inspection will be discussed at the job site during or upon completion of the inspection. 7. Formal copies of the inspection report will be sent to the Loan Recipient (Owner), the Engineer and to other parties, only if so requested. 8. CIG asks to be notified when the Engineer or Owner plan to schedule a pre pre-final and/or the final inspection(s). IFS requests a copy of punch list(s). In order to close out the project,IFS must conduct a final inspection. Recipient's (Owner) and Engineer's responsibility 1. The Owner and Engineer should become familiar with their responsibilities as defined in the Code of Federal Regulations Part 40 CFR. 2. Comply with the Loan conditions. 3. Comply with the WQ and/or NPDES permit conditions. Owner payment request 1. Before first reimbursement request will be processed, the Owner must provide NC IFS executed engineering contract(s) and executed Construction contract(s). 2. Owner should provide the NC IFS inspector with Schedule(s) of Values (SOV) and Construction (Progress) Schedule for each construction contract. Schedule of Values should correlate with Bid items or construction costs as applicable. Providing the SOV in electronic format, excel or other spreadsheet would be appreciated. Owner should submit all payment requests to the NC IFS section with backup documentation as needed to support the payment reimbursement request. 4. Owner should be aware of the following payment milestones: 4.1. Before first reimbursement can be made, Contract Documents must be approved. 4.2. Closing cost must be paid. 4.3. Prior to 90% Disbursement-All tax must be reported. 4.4. Before final reimbursement- Engineer's Certification of Completion must be received. 5. The Contractor's pay request should coincide with the items on the bid form or approved schedule of values. 6. Do submit/report sales tax with each pay request. The sales tax report should indicate the time period that is covered. The reimbursement amount will be reduced by the sales tax amount at the 90% milestone. The sales tax is included in the Owner's loan or grant amount. Therefore, the Owner should be prepared to cover this amount until they receive reimbursement. If the contractor makes no purchases and has no sales tax to report for the period,regardless, the sales tax report should be submitted or indicate "No sales tax to report this period." 7. If requesting reimbursement/payment for materials stored on site, invoice(s) must be provided to document material cost. Such materials shall be stored safely and securely on site or in a bonded location(s). An affidavit from the Engineer may be requested by IFS for stored items and materials stored at each off-site location(s). ENVIRONMENTAL PROTECTION The Owner is advised that the protection of the environment is a loan and/or grant requirement. It is for Owner, Contractor(s), Engineer and other participating entities to comply with all environmental pollution control programs established by the Local jurisdiction, the State, and the EPA. These expectations include, but are not limited to: 1. Continued proper conveyance and treatment of Owner's wastewater during construction. 2. Protection of existing trees, shrubs, and grass, public infrastructure and private property. 3. Dust control atof haul roads, excavation areas, work areas, and borrow areas and keeping public roads clean of construction debris and soil. 4. Submission of, adherence to, and compliance with the erosion and sedimentation control plan approved by the applicable State or local agency. 5. Proper disposal of all solid and hazardous wastes encountered or generated as part of the project. 6. Notifying the NC Division of Water Quality(DWQ) field office in Asheville, NC, telephone: , (828) 296-4656 to report an oil or hazardous substance spill or other environmental emergency caused by any party. The responsible party shall take the initiative to report the matter promptly and to initiate containment and cleanup activities. 7. Because this is an environmental project, it is expected that the Contractor(s) and sub contractors collect and properly dispose of litter, trash and debris generated by workmen on the project or on the site and along routes of the work. At March meeting it was reported there had not been any additional settlement and that a "fill moon" was observed through all manhole to manhole sections. November 2011 update: - the settled section of the re installed sewer appears to be stable. CG&L hereby notifies Macon County that verification of the stability of this segment will be required as a condition of project closeout. [August] -remedy proposed and implemented and as of August 2011 the portion of sewer line appears to be stable. Work stopped in December [2010] until a remedy could be implemented for the portions of the sewer that settled. Refer to comment 38 in previous reports. Work resumed in late March [2011]. Remedy consists of filter fabric, with geo-grid, filled with#57 stone, pipe laid, the encased with the filter fabric. At meeting it was revealed that daily elevation checks indicate the solution is working. 42.At March 2012 meeting County manager indicated he wished to set up meeting in Raleigh with IFS on March 21, 22 or 23 to discuss completing reclaimed water portion of project and budget. [August]-Macon County did discuss revising scope of work related to the reclamation portion of the work with Dan Blaisdell, former Chief CG&L, however it appears no final resolution of the matter was made. By copy of this letter to Kim Colson, Chief CG&L the matter should be reconsidered and a determination made. [April] -Due to budget Owner is yet to finish work at landfill. It is strongly advised and recommended that Owner discuss resolution thereof with CG&L and Regional office of DWQ. 43. March update:for the record - none of the requested information or maps noted below has been provided. Please provide at next meeting or at Final inspection. Nov. update: CG&L requested color map of entire project route at today's (Nov. 2011)meeting. Also, CG&L requested updated half sized drawings of revisions. [ Aug]- routing at Shaw has been revised. CG&L requests Engineer or Owner provide relevant drawings in half size. GGP has asked [Dec. 2010] Owner to assist in rerouting a portion of the work at Shaw. This reroute would be beneficial to all parties. 47.March update: schedule not obtained, however as of today's[Mar. 9] meeting GGP needs punch list, lacks making some tie-ins, is still trying to successfully test the force main,pumps and the Industrial Park Pump Station and has yet to complete work at landfill. McGill's Jerry Wells stated he would prepare punch list next week[week of March 121. IMPORTANT-IFS requests copy of the punch list as soon as it is prepared. Gary's Grading &Pipeline Co., Inc. (GPP) provided construction schedule at the Nov. 29 meeting and stated it is their goal to complete project by New Years day and would work 74days per week to accomplish this, excluding Christmas day. 49.March update: Owner obtained assurances from DOT protecting integrity of new sewer line at bridge piers. IMPORTANT - GPP pointed out to Owner that NC DOT is doing bridge work over a portion of the newly installed line work and may be causing damage for which GPP states they cannot be expected to honor their warranty on that portion of work due to the potential for damage or distortion to segments where the bridge contractor(CW Matthews, Atlanta) has been crossing the shallow 24" sewer line. Mr. Jack Horton then went and retrieved relevant correspondence regarding their encroaching on the newly laid sewer line. Discussions ensued. CG&L strongly recommended that County hold NC DOT accountable and responsible for any damage or potential damage to the sewer and that the County require DOT to inspect the line via TV or other means to validate the lines integrity or damage. 50. For the record - the original contract completion date was November 30, 2010. The present contract completion date, revised by Change Order#8, remains at July 29, 2011. Gary's Grading&Pipeline Co., Inc: (GPP) provided construction schedule at the Nov. 29 meeting and stated it is their goal to complete project by New Years day and would work 7 days per week to accomplish this, excluding Christmas day. 48. IMPORTANT - CG&L hereby advises Owner that completion of the project as approved in the Loan and in the Grant agreements is expected. Specifically, this means that all the work of the reclaimed water [landfill] portion of the project covered under the Grant must be completed in its entirety before final payments can be made. Failure to complete all elements of project as approved via permits,ATAs, loan and grant agreements, etc. will jeopardize funding amount. Please note that the Clean Water State Revolving Fund (CWSRF)program is priority based system which includes adhering to a schedule for submittal of applications through contracting. Therefore, in order to maintain assurance of fundiniz an Authority to award must be obtained by June 1, 2012 and all contracts must be executed by July 2, 2012. If any of these milestones are not met, you must reapply if you wish to seek CWSRF funding for this project. The CWSRF program accepts applications twice per year and projects are funded based on priority and availability of funds. All encroachments, easements, agreements, and plan approvals must be obtained prior to receiving Authority to Award. If the Recipient does not maintain the court-sanctioned schedules which extended the compliance date for complying with the final effluent limits established in the NPDES Permit, then project costs incurred will not be eligible for Revolving Loan payments. Your project is subject to the one-year performance certification requirements. By this, you are required on the date one year after the completion of construction and initial operation of the subject treatment facilities, to certify, based on your consulting engineer's advisement, whether or not such treatment works meet the design performance, specifications and the permit conditions and effluent limitations. In accordance with the Federal Regulations, the Recipient is required to assure compliance with the OSHA safety regulations on the subject project. In complying with this regulatory responsibility, the Recipient should, by letter, invite the Bureau Chief, Education Training and Technical Assistance Unit,NC OSHA Division, 1101 Mail Service Center, Raleigh,NC 27699- 1101 at (919) 807-2890, to participate in the Preconstruction Conference to assure that proper emphasis is given on understanding and adhering to the OSHA regulations. C. G. S. 133-3 (ratified July 13, 1993). The administrative review and approval of these plans and specifications, and any subsequent addenda or change order, do not imply approval of a restrictive specification for bidding purposes; nor is it an authorization for noncompetitive procurement actions. Any addenda to be issued for subiect project plans and specifications must be submitted by the Recipient such that adequate time is allowed for review/approval action by the State and for subsequent bidder action prior to receipt of bids. It is mandatory for project facilities to be constructed in accordance with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractors'responsibilities shall be in complying with these Acts. Prior to entering into any contract(s) for construction, the recipient must have obtained all applicable project Permits from the State, including an Authorization to Construct and/or Non- Discharge Permit. While rejection of all bids is possible, such action may be taken only with prior State concurrence, and only for good cause. A goal of 8% of the contract price is established for Minority Business Enterprise (MBE) participation in this project, and a goal of 5% of the contract price is established for Women's Business Enterprise (WBE)participation in this project. The Recipient and Bidders shall make a good-faith effort to assure that MBE's and WBE's are utilized, when possible, as sources of goods and services. I am in favor of this project and wish the Town success in its attempt to arrange funding. I have had extensive involvement in regards to this Sewer. The Town of Franklin was experiencing sanitary sewer overflows (SSO's) from the Crawford Branch Sewer when I first came to work in State government and they continue to exist through today. One of the problems associated with the present Crawford Branch Sewer is a low gradient at its lower end, which causes sewer solids to accumulate in this segment, which leads to blockages. Modern material and construction techniques will substantially reduce infiltration and inflow. Again, I wish the Town success in its endeavors to replace the Crawford Branch Sewer. We discussed solutions being considered by the Town of Franklin to stop the storm water induced SSOs along this section of the Little Tennessee River. It is my suggestion that the Town of Franklin consider entering into a Special Order by Consent (SOC). A SOC is appropriate when pollution control facilities need to be constructed to abate an environmental violation. The document is essentially a contract between anyone needing to build such pollution control facilities and the North Carolina Environmental Management Commission (EMC). An SOC commits that person to build specific pollution control facilities in accordance with an agreed upon time schedule. In return the EMC agrees too withhold Civil Penalties for the environmental violation being abated so long as the terms and conditions of the SOC are met. Attached is a copy of the form to be used to apply for a SOC. You may find a discussion of SOCs in North Carolina General Statute 143-215.2. Additionally 15A North Carolina Administrative Code 02 H.1200 (see attached) offers additional discussion on this subject. SOCs are subject to public notice and represent a serious commitments.. A SOC contains stipulated penalties to be imposed upon the missing of any date or failure to comply with any condition. Critical items to be absolutely certain of in advance of applying for a SOC include: ® the type pollution control facilities to be built, the time required to design, bid, and construct those facilities, © the funding source, ® any and all time requirements associated With obtaining those funds. At that time, you had requested that I put in writing some of our efforts to address the infiltration and inflow (I&I) problems associated with our sewer collection system. As we have noted, the town has, through its consulting engineering firm, conducted a Sanitary Sewer System Infiltration and Inflow Study, dated May 2005. From that, McGill Associates and the town worked together to develop a five-year Capital Improvement Plan to address items that were detailed in the study. At this time, the town is in the midst of securing funding to complete those improvements. We realize that the repeated sanitary sewer overflows at the same manhole on the Little Tennessee River Greenway have raised concerns with DWQ, and we also realize that penalties and fines are likely forthcoming for continuing spills at that same location. Please understand that we are working as quickly as possible to correct our I&I issues and thus hopefully reduce and/or prevent these kinds of overflows in the future. Thanks for discussing with us the "special order of consent" option that might be available to us with regard to the overflows, and we will discuss this with our elected leadership.
