Haywood County Dear Mr, Pryor: The Division of Water Quality (DWQ) has reviewed your application for a No Exposure Certification for Exclusion (NE) for the subject facility. Based on the information provided, several site visits conducted by Ms. Susan Wilson of the Asheville Regional Office, and results of upstream and downstream sampling, the NE has been approved. DWQ is also hereby rescinding your current permit Certificate of Coverage, NCG210021. Please note that you are obligated to maintain no -exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a NE, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. Your NE does not expire. In order to help assure that your facility stays in compliance with all of the conditions in the Certification, you must self -recertify your facility at least annually. Please see the attachment for information on self - recertification. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. Results of the upstream and downstream sampling conducted at your site on October 13, 2011 are attached (please keep these for your records). You may get a past due invoice — apparently that is an automatically generated letter. However — you may disregard (at least until she retires at the end of the year!). No consequences of the late invoice based on may conversations with Fran. Anyway -- my plan is to get out there during a rain event and sample. Please do your qualitative (observational) monitoring in the meantime. And our regional lab may not be shut down July 1— so that is good for me for sampling! Thanks. I hate to bother you, but I was wondering if you could help me with a billing issue re. a permittee holding a general permit. Their invoice is due 7/7/2011 (NCG210021) Oaks, Ltd. I've been working with them to rescind their permit — but I need to get a grab sample from them first (during a rain event). It's kind of been my fault that it hasn't been rescinded earlier. was wondering if you could extend their billing date 2- 3 months. I'm pretty sure before then that I will have justification to rescind their permit. It's not like it's a large invoice — but every penny counts for folks, appreciate any help! Thanks, Susan Susan A. I've attached the analytical portion of the general stormwater permit. If you guys would collect a sample upstream of your site (where the creek comes through your property upstream) and downstream of your site (at the last drop inlet on your property) and analyze for pH, Chemical Oxygen Demand, and Total Suspended Solids during a representative stormwater event — that would give us a better idea if your site is having any impact on the stream itself. We'd really like to have seasonal representation on that data (meaning at least one sample during a representative storm event prior to June 301h and one sample during July 1S` to December 31"). Although if you guys can get a sample in this month and then maybe towards the end of June — I'd consider that as seasonal. If you would send your analytical results directly to me (address below) —that would be great. If you or your consultant or lab have any questions — give me a ring. Thanks much.
