A[4**AV ?EHNR ? 191983 GROJ SUBJECT: Issue of anadromous fish resource in Jonaquin Creek, Carteret County In response to your question as to whether there is an anadromous fish resource in Jonaquin Creek, Carteret County, at the point upstream that the Department of Transportation proposes to replace bridge #5 on SR 1300, I have discussed the issue with staff of the Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC). Linda Mercer of DMF assured me that there was no anadromous fish resource in Jonaquin Creek, but reaffirmed their hope, expressed earlier in written comments to this Division (attached), that the bridge is replaced with another span instead of culverts. David Yow of the WRC wanted to confirm that with Distict Biologist Bennett Wynne, but was unable to reach him. The National Marine Fisheries Service, in a letter to Col. Tulloch of the U.S. Army Corps of Engineers, Wilmington District, dated June 29, 1993 (copy attached), stated a concern about the dependency of anadromous species on the Neuse River and its tributaries as forage, spawning, and nursery areas. " They seem to be alluding more to the area in general rather than the specific area in question. I tried to call Ron Secchler of NMFS to discuss this with him, but was unable to reach him. I believe that DMF data would show that there are areas in the Neuse basin that are much more valuable in terms of habitat for anadromous species than Jonaquin Creek might be. As DMF has very good knowledge of the resource in that area and equally reliable data to support their assertion, it is likely that their data would not support a finding that a water quality certification should be denied because of an anadromous fish resource at that location. Jonaquin Creek is designated as a primary nursery area, an area important to the development of juvenile finfish, crabs, and shrimp. The marsh surrounding Jonaquin Creek provides nutrients and serves as a sediment trap for the estuarine system. The potential for culverts to impede water flow as they fill with sediment could have a negative effect on the marsh system. Department of Transportation (NCDOT) is requesting authorization of work pursuant to Nationwide Permit #14. The proposed work consists of excavating and filling wetlands associated with the Neuse River, Carteret County, North Carolina. The proposed work consists of the replacement of a bridge on State Road 1300 over Jonequin Creek with two 103-inch-high by 71-inch- wide corrugated steel pipe arch culverts. The culverts will be approximately 70 feet in length. This work would result in the filling of 0.02 acre of salt marsh, and the excavation of approximately 0.02 acre of wetlands. Many anadromous specie tributaries as forage, include striped bass sapidissima), alewife (Alosa aestivalis), oxyrhynchus). s are dependent upon the Neuse River and its spawning, and nursery areas. These species (Morone saxatilis), American shad (Alosa (Alosa pseudoharenctus), blueback herring and Atlantic sturgeon (Acipenser We are concerned that this project, as proposed, would have more than a minimal impact on anadromous fishery resources because the proposed culverts may impair upstream spawning migrations. In recent years, there has been an unprecedented decline in the harvest of anadromous fish in North Carolina. Probable causes for this decline include water quality degradation, habitat iNelson, D.M., E.A. Irlandi, L.R. Settle, M.E. Monaco, and L.C. Coston-Clements. 1991. Distribution and Abundance of Fishes and Invertebrates in Southeast Estuaries. ELMR Rept. No. 9. NOAA/NOS Strategic Environmental Assessments Division, Rockville, MD. 177p. 7 destruction, and reduced access to historical spawning grounds .2 Spawning of blueback herring and alewife occurs in upstream river swamps and smaller tributaries above the tidal zone of river systems.3 Highway culverts are the second most common blockage of anadromous fish spawning migrations on small streams.4 In addition to the impacts to anadromous fishery resources, the proposed work would remove a small but important area of salt marsh habitat. These areas are important for the continued fishery production in that they provide feeding and nursery areas for a variety of estuarine dependent fishes and crustaceans including Atlantic croaker (Micropogonias undulatus), spot (Leiostomus xanthurus), mullet (Mil cephalus), flounders (Paralichthys spp.), shrimp (Peneaus spp.), and blue crab (Callinectes sapidus). Furthermore, these areas support a diverse invertebrate community and produce large quantities of detritus, both of which are an integral part of the complex food web involving higher marine organisms. In view of the above, we believe that this project would have more than a minimal impact on NMFS trust resources. Therefore, we recommend that this project be advertised as a public notice to allow for a more thorough review by resource agencies. In addition, we recommend that the NCDOT replace the existing bridge with a bridge of similar dimensions. On May 10, 1993, an application package was distributed to the office of Coastal Management (OCM) with the request that the above-referenced project be authorized under the appropriate Coastal Area Management Act (CAMA) permit. On July 7,1993, we received acknowledgement of receipt of our application on June 15, and stated that it was adequate for processing with a projected deadline of August 30, 1993. On August 30, 1993, we received a letter from OCM extending the processing deadline an additional 75 days, until November 12, 1993. On August 11, 1993, we received notification from the Army Corps of Engineers (COE) that National Marine Fisheries Service (NMFS) concerns had caused the permit to be elevated to individual status, but on September 9, we received authorization from the COE under Nationwide 14. On August 19, 1993, we received Water Quality Certification from the Division of Environmental Management. Due to the concerns expressed by the Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC) we have reevaluated the design of the above-referenced project. As communicated to us by Stephanie Briggs of OCM, on September 27, 1993, their concerns were as follows; that. due to the Primary Nursery status of this area, the potential for diminished biological productivity exists due to the impedance of flow as a result of filling and culvert installation; and that the existing navigational clearance should be preserved. The cost of a 60' spanning structure is estimated to be $90,000, while the cost of a 40' spanning structure would be approximately $60,000. Forty feet is the minimum length possible for this site. The proposed culverts are estimated to cost $19,000. We feel that the cost of the bridge options are prohibitively high and thus we have attempted to mitigate by changing the design to maximize navigation clearance and to minimize the length of the proposed culvert by using endwalls. The proposed alternative utilizes endwalls to reduce the length of the culverts from 70' to 40', and eliminate filling in wetlands. By raising the culverts' elevation we were able to match the existing bridges' clearance elevation. We hope that these changes will satisfy the concerns expressed by WRC and DMF, as mentioned in your letter dated October 6, 1993. By copy of this letter, we request that the Corps of Engineers and Division of Environmental Management review the proposed modified design and advise us as to the status of the Nationwide permit and Water Quality Certification. Briggs SUBJECT: Issue of anadromous fish resource in Jonaquin Creek, Carteret County in response to your question as to whether there is an anadromous fish resource in Jonaquin Creek, Carteret County, at the point upstream that the Department of Transportation proposes to replace bridge #5 on SR 1300, I have discussed the issue with staff of the Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC). Linda Mercer of DMF assured me that there was no anadromous fish resource in Jonaquin Creek, but reaffirmed their hope, expressed earlier in written comments to this Division (attached), that the bridge is replaced with another span instead of culverts. David Yow of the WRC wanted to confirm that with Distict Biologist Bennett Wynne, but was unable to reach him. The National Marine Fisheries Service, in a letter to Col. Tulloch of the U.S. Army Corps of Engineers, Wilmington District, dated June 29, 1993 (copy attached), stated a concern about the dependency of anadromous species on "the Neuse River and its tributaries as forage, spawning, and nursery areas. " They seem to be alluding more to the area in general rather than the specific area in question. I tried to cull Ron Secchler of NMFS to discuss this with him, but was unable to reach him. I believe that DMF data would show that there are areas in the Neuse basin that are much more valuable in terms of habitat for anadromous species than Jonaquin Creek might be_ As DMF has very good knowledge of the resource in that area and equally reliable data to support their assertion, it is likely that their data would not support a finding that a water quality certification should be denied because of an anadromous fish resource at that location. NARRATIVE DESCRIPTION: The NC Department of Transportation proposes to replace Bridge #5 over Jonaguin Creek on SR 1300, south of the community of Merrimon in Carteret County. SR1300 is a paved secondary two-lane road serving several small communities in the area. SR1300 crosses over Jonaquin Creek near its headwaters by way of a bridge approximately 60' long. Waters at the project site are classified as 'SA' and 'PNA' by the Division of Environmental Management and are open to shellfishing. NC DOT proposes to replace the bridge with two (2) 103" x 71" corrugated steel pipe culverts approximately 70' in length. An area approximately 45' long x 5' wide of highground would be excavated for the installation of the culverts. Approximately 320 sq. ft. of coastal wetlands and '404' wetlands would be filled. FIELD INVESTIGATION REPORT: NC DOT - SR1300 - JONAQUIN CREEK PAGE #2 9.. NARRATIVE DESCRIPTION: The NC Department of Transportation proposes to replace Bridge #5 over Jonaguin Creek on SR 1300, south of the community of Merrimon in Carteret County. SR1300 is a paved secondary two-lane road serving several small communities in the area. SR1300 crosses over Jonaquin Creek near its headwaters by way of a bridge approximately 60' long. Waters at the project site are classified as 'SA' and 'PNA' by the Division of Environmental Management and are open to shellfishing. NC DOT proposes to replace the bridge with two (2) 103" x 71" corrugated steel pipe culverts approximately 70' in length. An area approximately 45' long x 5' wide of highground would be excavated for the installation of the culverts. Approximately 320 sq. ft. of coastal wetlands and '404' wetlands would be filled. Approximately 1400 sq. ft. of Public Trust Area would be filled from the installation of the culverts and associated backfill. Prior to the installation of the culverts, an approx. 67' long x 21' wide x P deep area of creek bottom would be excavated. 10. ANTICIPATED IMPACTS: NC DOT proposes to replace an existing bridge over Jonaquin Creek with two (2) 103" x 71" corrugated steel pipes approximately 70' in length. Approximately 320 sq. ft. of coastal wetlands consisting mainly of black needlerush, Spartina patens, and Spartina cynosuroides, plus some '404' type species would be filled. Approximately 1400 sq. ft. of Public Trust Area would be filled from the installation of the culverts, plus the associated backfill. Approx. 225 sq. ft. of highground and approx. 1,400 sq. ft. of creek bottom would be excavated. The approx. 55 cu. yds. of mostly mud and silt material will be hauled-off the site. Jonaquin Creek narrows at the project site to approximately 20' wide and finally dead- ends not far upstream from the bridge. The bridge clearance presently is approximately 3' at NWL.
