Reference your June 15, 1993 application for Department of the Army
authorization to pave and widen SR 1936, along Hunting Creek, near Morganton,
in Ike County;'. North Carolina. As part of the project, two culverts will be
replaced and extended. No wetlands will be impacted by the work. This
project has been coordinated with the NC Wildlife Resources Commission (WRC).
On January 1, 1992, we renewed general permit no. 198200031, (copy
enclosed), that authorizes the placement of fill material associated with the
construction, repair, or replacement of bridges across navigable waters and
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Your proposed work is authorized provided it is accomplished in strict
accordance with the enclosed conditions. Please read the enclosed permit to
prevent an unintentional violation of Federal law. As this Department of the
Army general permit does not relieve you of the responsibility to obtain any
other required approvals, you should contact appropriate State and local
agencies before beginning work.

Upon review of your request for 401 Water Quality Certification to place fill material 0.1 acres of
wetlands or waters which are tributary to Hunting Creek for road improvement located at SR 1936 in
Burke County as described in your submittal dated 15 June 1993, we have determined that the
proposed fill can be covered by General Water Quality Certification No. 2732 issued January 21, 1992.
A copy of the General Certification is attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 14.
if this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this Certification. This request must be in the
form of a written petition conforming to Chapter 1508 of the North Carolina General Statutes and filed
with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

I am attaching a straight line diagram with erosion
control plan, an application form for a nationwide permit,
and a county map section relative to the paving of SR 1936,
Butler Loop Road, in Burke County.
Butler Loop Road is presently 16 to 18 feet wide. We
propose to pave the road 18 feet wide and increase the
typical section. The proposed typical section is also
attached. Grading will be light to moderate.
We propose to extend/replace two pipe with live streams
at survey station 25+00 and survey station 38+05.
By a copy of this letter, we are asking Chris Goudreau,
North Carolina Wildlife Resources Commission District
Fisheries Biologist, to comment directly to you concerning
the nationwide permit request.
Also, by copy of this letter, I am sending seven copies
of this application package to the Division of Environmental
Management.
