Clearly indicate Stormwater and/or mine dewatering outfalls on the Mining Site Plan map. Response: The Stormwater and/or mine dewatering outfalls are shown on the Mining Site Plan map. 2. The submitted plan refers to a 10 foot buffer (first paragraph) and 100 foot buffer. Please correct the inconsistency. Response: The buffers vary since the wetland areas are so small but no buffer will be less than 100 feet. 3. Include a copy of US Army Corps of Engineers wetland delineation or approved from a survey by W.D. Daniels, Jr. from 1998. Any certification from that long ago will have expired. Please contact the USAGE or a consultant qualified to perform a wetland delineation. An approval by the USACE is required, and documentation must be submitted with the Pumping O&M Plan. Styron. To get to the mine from NC FIWY 70 in Newport, travel west on Nine Foot Road (SRI 124) approximately 4 miles and turn south on Nine Mile Road (SR1124) and travel approximately 1 mile, then turn west onto Anna Wink Road. The latitude is N34°47'04", longitude W76°56'08". The mine itself will have a surface area of approximately 10 acres and a depth of 12 feet at completion. A 30 foot buffer will be maintained along the property boundary, and a 100 foot minimum buffer will be maintained along the western wetland boundary until approval is obtained to fill the isolated wetlands. Dewatering Dewatering will take place as needed but will not occur on a daily basis. The pump to be used is approximately 10 I-lP and delivers around 300 gpm maximum. The pump will pump to a temporary ditch that will discharge to a sediment trap that will flow to a vegetated Swale that will eventually discharge to the western prong of the Newport River. In order to reduce effects to the wetlands, the dewatering operation will be held to flow less than 100,000 GPD. Assuming that the pump operates at 300 gpm, the run time can be computed as follows: 100,000 gpd/(300 gal/min x 60 minlhr) = 5.5 hrslday By limiting the pump time to 5.5 hrslday and the excavation to 12 feet, along with maintaining a minimun 100 foot buffer, no adverse effects on the wetlands are anticipated. The Skaggs analysis attached shows the lateral effect to be 78.6 ft. Discharge Monitoring The mine area generally has good clean sand up to a depth of 12 feet. We propose to have personnel monitor the discharge a minimum of once per day when excavating from 0 to 10 feet and a minimum of twice per day when excavating from 10 to 12 feet. It's going to be tough to always say that we will permit things in a particular manner. A lot of projects end up having something unique about them and we need to be ready to handle those in the right manner to make sure we are protecting the environment, even if it means holding the permits until all issues are resolved. When a conditional permit is acceptable to each of us I think it is okay to pursue:it and in this case I think, at least in the central office, we all feel that it is okay. What Janet and I discussed doing is we will wait on issuing our permit until Judy is ready to issue the Mining Permit: We will go ahead now and write a letter to the applicant telling him he needs to be working on the pumping plan, wetlands delineation, etc. When we each issue or permits the dewatering will be contingent on them getting the pumping plan in place and approved by the WiRO. I'm sorry I didn't have a chance to talk to you a little more than just saying hello at the meeting last Wednesday. I had international visitors that week and had swapped leave around to be there that day, but my time was limited. It was nice to finally meet you in person, though! I am getting back to two mining NPDES discharge applications on my desk. This one is the Anna Wink mine in Carteret County (Newport), proposed by Larry Styron. Mine dewatering water will discharge to the Southwest Prong of Northwest Creek, class C waters in the White Oak River basin. Isolated wetlands are shown on the mine plan sheet, " r. along with 100' buffers. I'm not sure who delineated those, though; in question #23, the applicant answered "no" to whether or not he was required to obtain a wetlands delineation from the USACE. Because these are isolated, maybe not. If he didn't, it will be required to get them delineated to complete an adequate Pumping 0&M Plan. Do you know the status of the Mining Permit, or should I check with Judy Wehner? Mr. Styron included a one page Pumping 0&M Plan, but it's not very thorough (and it includes a major typo when he referenced a "10 foot" buffer instead of a "100 foot" buffer.) He's going to have to provide more detail. There is also no information about any planned wells for monitoring the wetlands as mining proceeds. In the past, we have relied heavily on the regional staff and their wetlands expertise to assist the applicant in pulling together an acceptable O&M Plan before dewatering can begin. The 0&M Plan doesn't have to be approved before we issue the Certificate of Coverage (COC), but we would advise that the Plan has to be (re)submitted to you all for approval within 60 days after we issue the permit. Sometimes WiRO would advise us to hold off onAssuing the COC until they knew the applicant understood what was involved, so please let me know if you'd rather that we hold off on issuing the COC. This is Wilmington's call. If you want 6s to move forward with the COC, I can include some guidance points on what needs:to.be part of the Pumping 0&M Plan in the issuance letter. The only thing we really have on this in the Central•Office is from a 2008 draft internal guidance. document that Linda Willis put together on the NCG02 permit --that's attached for you. It's out -dated in some aspects (for example, ATC requirements don't apply anymore), but the 0&M Plan component section is helpful. We don't have an awful lot of experience with reviewing O&M Plans here in CO, but some DWR counterparts in WiRO may be able to help. Bethany and others.in the Regional Central Office NPDES group: I know each regional office is attempting to find its way as a result of the consolidation of Stormwater/NPDES into DEMLR, but I will address the Wilmington Regional Office. We do not have a lead for NPDES issues (our NPDES Engineer position is vacant), but we currently have the inspector of each county and/or county subset to be responsible for addressing mining inquiries. For the time being, we will continue to do so for all other NPDES inquiries as well. That inspector will attempt to answer your question, or at least to learn who can answer your question (at the very least come to me) and contact the staff of Water Resources for questions or technical assistance as the need arises. Styron. To get to the mine from NC HWY 70 in Newport, travel west on Nine Foot Road (SR1124) approximately 4 miles and turn south on Nine Mile Road (SRI 124) and travel approximately 1 mile, then turn west onto Anna Wink Road. The latitude is N34°47'04", longitude W76°56'08". The mine itself will have a surface area of approximately 10 acres and a depth of 12 feet at completion. A 30 foot buffer will be maintained along the property boundary, and a 10 foot buffer will be maintained along the western wetland boundary. Dewatering 13L Dewatering will take place as needed but will not occur on a daily basis. The pump to be used is approximately 10 HP and delivers around 300 gpm maximum. The pump will pump to a sediment trap and will eventually discharge to the western prong of the Newport River. In order to reduce effects to the wetlands, the dewatering operation will be held to flow less than 100,000 gpd. Assuming that the pump operates at 300 gpm, the run time can be computed as follows: 100,000 gpd/(300 gal/min x 60 min/hr) = 5.5 hrs/day By limiting the pump time to 5.5 hrslday and the excavation to 12 feet, along with maintaining a 100 foot buffer, no adverse effects on the wetlands are anticipated. 7�----- Discharge Monitoring The mine area generally has good clean sand up to a depth of 12 feet. We propose to have personnel monitor the discharge a minimum of twice per day when excavating from 0 to 10 feet and a minimum of once per hour when excavating from 10 to 12 feet.
