This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality (DWQ) may require modification or revocation and reissuance of the Certificate of Coverage. Please be aware that mine dewatering at your site has the potential to impact wetlands adjacent to your mining pit areas. You have indicated to DWQ at our meeting on February 7, 2012, that you do not believe that your mine dewatering and mining expansion will affect wetlands at this site. Note that removal of use of jurisdictional wetlands is prohibited; removal of hydrology of jurisdictional wetlands is a violation of wetland standards. The water quality standards for wetlands found in Title 15A North Carolina Administrative Code 2113 .0231 require that "Hydrological conditions necessary to support the biological and physical characteristics naturally present in wetlands shall be protected to prevent adverse impacts on: C. The chemical, nutrient and dissolved oxygen regime of the wetland; D. The movement of aquatic fauna; and F. Water levels or elevations". The specific requirements for mine dewatering at facilities near wetlands can be found in the text of the attached permit. For new or expanding mine sites, or modifications to existing permitted mine sites, permittees need an approved Operation and Monitoring (O&M) Plan before mine dewatering discharges occur; discharging mine dewatering wastewater from those sites without Plan approval will be subject to enforcement action. If your mining activities expand or modifications are proposed, you must work with the Wilmington Regional Office to submit and approve an Operation and Monitoring plan prior to these changes to your mine site. T his site will discharge mine dewatering wastewater to a receiving stream (Gales Creek) designated as Sheilfishing Waters (SA), High Quality Waters (HQW), and a Primary Nursery Area (PNA), Circle P- Styron Pit will discharge from the same location and will be permitted under a transferred permit from the previous owner. This permit was originally permitted in 1996 and currently allows a discharge to these waters. DWQ understands from our meeting with you on February 7, 2012, that the discharge from Circle P- Styron Pit will be approximately half the volumetric flow rate as the previous owner's at the same location. DWQ supports that reduction in discharge. Please note that any nem discharges to SA, HQW, PNA waters will be subject to a wastewater discharge volume. Any and all discharges to SA, HWQ, PNA waters are subject to more stringent TSS limits. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater nol combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. Additionally, new coastal stormwater management rules (SESSION LAW 2008-211) were implemented October 1, 2008. From DWQ's conversation with you in our meeting on February 7, 2011, DWQ understands that you do not intend to increase impervious surfaces at your mine sites. Please note that if you do increase or add additional impervious surfaces which create stormwater runoff, you may be required to apply for an additional Coastal State Stormwater Permit. It's a good approach at addressing a difficult project with some tough issues. I do think that we will have a tough time with the last paragraph on the first page that requires the 0&M plan development before he can discharge. He will argue that Styron was discharging for years before and didn't have an O&M and he proposes to discharge less than Styron. Since this one is existing and was previously permitted I think we should take that into consideration. I talked with Al a little about how WaRO was handling O&M plans for existing mines. He indicated that they were not actively pursuing O&M in these cases unless the mine was going to DLR for a mine expansion (or potentially if a violation was to occur that was attributable to the discharge). I agree that this is the way we should be addressing existing mines and I think we talked about this some in our call a few days ago. I'd like to know what you guys think and how we might be able to address this in the letter. I think about it some and see if I can come up with some language. It's possible that paragraph #2 that spells out all the wetland issues may be the basis of what we need. I think it's important that we have consistency on how we address them, but I think upon renewal is an appropriate time as well as if they modify their permit. It was an oversight in this office that the existing mines discharging to SA or HQW classified streams were permitted without ensuring compliance with our 213 rules. We have been able to address O & Ms where wetlands are concerned at any time since the last permit renewal in 2010 which indicated that 0 & Ms may be needed. Styron's permit was not actively renewed, but that pit is still under the last permit revision requirements imposed in Jan 2010. Furthermore, I would like for management to work through the 0 & M with Mr. Parker because I doubt we will require him to meet the 7Q10 flow limit and I think a discharge from a pit that doesn't meet our rules should be approved by management. I have NO INTENT to dewater the Circle P Farm(16-72) to the Styron Pit(16-21) and then discharge to surface waters. I DO NOT understand where that is coming from. Yes, I talked to DLR(Ms. Ashley Rogers & Ms. Judy Wehner) in Oct. 2011 when I was transferring the Styron pit(16-21) over if they wanted me to combine and they said to keep it separate because Circle P FARM PIT(16-72) was not complete and approved. They advised it might be feasible down the road. Circle P Farm Permit(16-72) has nothing to do with the issue at hand —that permit is designed, approved, bonded, received and is acceptable to me and all approving agencies. I am wanting to continue the Styron Permit(16-21) which has been approved and bonded and transferred to me in Oct. 2011, told by Linda Lewis I would be grandfathered on two occassions that I would be allowed to discharge just as Mr. Styron has done for FIFTEEN YEARS PLUS. Now, after the Oct. 2011 transfer without any other notification by any State Branch, I am being ask to sample discharge, apply for a new dicharge with you and now you advise that I may have to apply for another new State Stormwater Permit that was begun in 2008. Why was Mr. Styron not requested to do water sampling for DWQ, apply for a discharge permit with you division and get the 2008 stormwater permit? When will this end and how many more "after the fact" permits must I get? My frustrations are continuing to build with this confusion on the end of the State? Never did, I imply the entire borrow pit would only be two feet in depth ... why would anyone go through what I have for the last year(time and money) to do that? We all concluded that discharging into the creek was not an option and I redirected my efforts in the design of the new borrow pit discharging into an existing partially completed pond on the Styron farm next to me. I have always stated that the new pit would be approximately 15 feet in depth and that is what my application showed in May 2011. The new borrow pit is not adjacent to any creek or wetlands what so ever, just like we discussed in the field with Joann. This permit 0&M requires that I maintain a 7.25ft. freeboard in the Styron receiving pond in order not to overflow and allow for rain events. Your first paragraph talks about maintaining the Stryon pit no lower than 7 ft., not draining the wetlands and monitoring by use of a overflow weir was not discussed and does not apply because this is a closed loop system with no discharge..this pond will be receiving water not discharging. My permit was approved(Permit No.16-72) along with the 0&M plan and there is no issue with this permit at all. I do not plan to start this borrow or sever ors and I do not understand why you even broom g 'it up. Last y I was told t` o register my water withdraw with DWR an'd th-e"withidraw rate_a_pproved was �47,916 gpd which is the same as y permit with R. ��� After submitting my new pit application in May, 2011, I proceeded in purchasing the Styron farm(90 acres) and closed on it in August, 2011. Part of the new permit process was showing proof that I owned the Styron pond where I was potentially discharging my wastewater and that it was in fact a closed loop system. Now to the issue at hand. Before I purchased the Styron farm and before I had DLR transfer the original Styron borrow pit permit(16-21), I conferred with you several times to make sure that 1 would be able to continue pumping just as Styron had for 15+ years and you said yes I would. Based upon that, I had DLR transfer the permit effective Oct. 3,2011. I emailed you on Dec. 14, 2011, as a courtesy and ask if there was anything else I needed to do because I was ready to begin dewatering the Styron pit in order to complete it. That is when you,told me to monitor the effluent and I would hear from Jennifer Jones about a discharge permit. I did hire a lab to do the monitoring even though Mr. Styron was never required to do so. Then Ms. Jones sends me 30+ pages of instructions and a 9 page application for a NCG020000 for a National Pollutant Discharge Permit. I applied for that permit on Jan. 24, 2012 and expressed my suprise & concern to Ms. Jones, yourself and she shared them with Mr. Bennett. As stated previously to all, if I was informed during the permit transfer or afterwards, I would have been able to work on versus finding out after the fact and after the transfer. In your Dec. 15, 2011 email response to me about other after the fact requirements needed for the original Styron permit. You stated that the Styron pit could only discharge 50% of the 77Q10 flow and you estimate based upon your site visit last Summer the creek had a flow of 40,000gpd leaving the Stryon pit to discharge 20,000gpd. I did contact Mr. Weaver of USGS amd ask for his opinion based on USGS info for this site and he responded there was no data available. To comply with this requirement of 20,000gpd or 13.88gpm it will take 613 days to dewater the 2.5 acre borrow pit 15ft deep not allowing for rain or groundwater infiltration. I sent you a picture of 1/6 hp basement pump that produces 12.00 gpm through a 3/4 garden hose. I know the 0&M is to protect the wetland and shellfish 2 miles away, but this is not reasonable. I agreed Monday to voluntarily do monthly water sampling for the first month even though it is only required quartley and then adjust from there in order to protect the environment from discharge, but I need the ability to pump at a higher rate in order to develope the existing Styron pit. Mr. Styron has been pumping for many years using a 12" vertical turbine pump discharging at a very high rate, no water quality monitoring and no discharge permit. I do not plan to use that type pump and I will be willing to be reasonable on the discharge rate and do required monitoring, but 20,000gpd will not work. The submersible pump is better sized and appears to be the way to go, your calculations look good. You need to specify how you will insure the quality of the discharge will meet the permit limits for SA waters. Since you will pump to the Styron Pit, indicate where on the map you will introduce that discharge (and logically it needs to be introduced -the farthest point from the outlet from the pit so you have adequate settling time). Revise your 0 & M for monthly monitoring and state that if the fecal counts are below 14 FCC/100 mL, then you will reduce monitoring to quarterly. If any subsequent quarterly test is greater than 14, you will immediately contact DWQ with the results and discuss any modification to the monitoring plan in accordance with DWQ's instruction and implement more frequent monitoring at DWQs request. If this occurs, I'll visit with Shellfish Sanitation and determine whether the levels you are discharging are a threat for closing the shellfish waters. I'll find out at that point too whether you will need more frequent monitoring. Monthly may not be often enough based on the fecal levels. By law, we cannot permit a discharge that removes a use for surface waters and certainly not the taking of shellfish. This is why I was really encouraging you to go non discharge. I'll need some help from Shellfish to determine what levels may be a problem. I'm hoping maintaining a low discharge flow will help provide some protection if the levels of bacteria are high. . . although by law dilution is not supposed to be used to control pollutant levels. Tidal effects too in the creek can make a difference. Your discharge can have a greater effect during low tide than high. Shellfish Sanitation has some monitoring stations in that creek and we'll have to cross that bridge when we get to it. . . so I can't make any promises on what we may require when we get to that point. Let's hope we don't have a problem. You'll need to follow up on the Fecal data once you've submitted samples so the lab doesn't drag their feet for weeks before they report to you. You need to specify that you will be willing to modify the 0 & M if the results of the fecal testing prove problematic for the shellfish resource. Linda did not visit 16-21 at that time. **correct** He may have been able to discharge pit to pit without a discharge since his intent to mine at the new site (16-72 Circle P) was to create a wetland for a duck impoundment for hunting and that he wouldn't be digging very deep at all .. maybe a few feet, thus perhaps he could handle the need to dewater with the Styron Pit, but he would have to demonstrate that to us via the 0 & M.** 4. There was no DWQ permit for 16-72, so Linda was not able to write up an inspection report for it. **correct, he hadn't gotten that far because he was working on getting a permit from DLR at that point.. which is when I advised him to let DLR know that the new permit he was applying for would be discharging wastewater to the Styron Pit** 5. He then called me in January (he may have spoken to me before, but I don't think he did) and said that he needed to get a permit, Linda hadn't told him until now (or a couple of weeks ago) that he needed a permit to discharge, and what did he need to do. He was angry, and said this was holding up his business, and how frustrated he was etc. etc. etc. **Mr. Parker was advised to take care of the ownership issue- I told him where the form was on our website* * 8. 1 told him that he needed to apply for a permit (because he didn't tell me that he already had a permit) and what he needed to do. Mr. Parker needs to work on his 0&M plan as there are most likely wetland issues as Linda and Joanne Stienhouse have not had a chance to visit 16-21 yet, and the site plan I have is rife with wetland areas. **correct** SO — I see two routes for Mr. Parker: 1) He can keep the application in for a new permit. We will need to send it to Shell fishing for their review as is standard for new discharges to SA waters. We will not collect the old fees from Mr. Parker in this scenario. 2) Mr. Parker can renew the old permit NCG020317. He will need to pay old back permit fees, but, since it is an old permit and previously permitted, we will not send the review to Shellfishing for their review. Because, if they want all this taken care of under one permit, then we are dealing with one permit. Also, they would be the determining factor on which permit would accommodate this activity if only one permit would suffice (a modified Styron permit or a new Circle P permit that included the Styron Pit). how we would proceed on our end in a large way depended upon how DLR would handle this one. So.. until knowing that... it was all somewhat up in the air. I surmised if two permits would be pursued, then we would not need to have an NPDES permit for the Circle P permit (since they aren't discharging directly to surface waters), and we already have an NPDES permit for the Styron Pit (which had allowed discharges to surface waters). What we needed was a one stop meeting with DLR, Mr. Parker, Joanne S (wetland specialist), CO permitting staff and myself in one meeting. MINING PERMIT EXPIRATIGN DATE: December 16, 2015 Page 3 Expiration Date This permit shall be effective from the date of its issuance until December 16, 2015. Conditions This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: OPERATING CONDITIONS: A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental -Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Division of Water Quality to secure any necessary stormwater permits or other approval documents. 2. A. Any mining process producing air contamination emissions shalt be subject to the permitting requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. During mining operations, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. A. Sufficient buffer (minimum 30 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. B. A 30-foot buffer, as indicated in Operating Condition No. 3A, shall be re- established in a timely manner along all permit boundaries and waterways and wetlands if a lesser buffer exists. C. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. 4. A. Adequate mechanical barriers including but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. Page 4 B. All drainage from the affected areas around the mine excavations shall be diverted internal to said excavations. C. Diversion ditches and sediment traps shall be constructed and maintained (in lieu of silt fence) to prevent sedimentation of nearby wetlands. In addition, adequate outlet protection shall be installed and maintained at the discharge points to prevent erosion and off -site sedimentation. D_ Mining activities shall be conducted as indicated on the mine map last revised January 10, 2007 and received by the Land Quality Section on September 27, 2011. 5. A. All mining permit boundaries (90.7 acres) shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. B. All buffer zones along waterways, wetlands, and property lines shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. 6. The angle for graded slopes and fills shall be no greater than the angle, which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of sedimentation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. A. Sufficient buffer (minimum of 30 foot undisturbed) shall be maintained between any excavation and any mining permit boundary to protect adjacent property. B. A 30-foot buffer, as indicated in Operating Condition Nos. 3A and 9A, shall be re- established in a timely manner along all permit boundaries and waterways and wetlands if a lesser buffer exists. 10. A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. Page 5 B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor belts 3. wire cables 4. v-belts 5, steel reinforced air hoses 6. drill steel D. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal: 1. the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and, 5. verification that a permanent vegetative groundcover will be established. E. No off -site generated land clearing and inert debris shall be allowed within the 90.7-acre permit area without having first obtained a modification from the Land Quality Section to allow such activities. 11. An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 12. A. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit or any approved revision to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. B. No off -site generated land clearing and inert debris shall be allowed within the 90.7-acre permit area without having first obtained a modification from the Land Quality Section to allow such activities. Page 6 13. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $28,900.00 Irrevocable Standby Letter of Credit, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 14. A. Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. B. Pursuant to N. C. G. S. 70 Article 3, `The Unmarked Human Burial and Human Skeletal Remains Protection Act," should the operator or any person in his employ encounter human skeletal remains, immediate notification shall be provided to the county medical examiner and the chief archaeologist, North Carolina Division of Archives and History. Page 7 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation schedule, the planned reclamation shall be to restore the mine excavation to a lake area and to grade and revegetate the adjacent disturbed areas. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. The lake area shall be excavated to maintain a minimum water depth of four feet measured from the low water table elevation. Page 8 B. The side slopes to the lake excavation shall be graded to a 3 horizontal to 1 vertical or flatter to the water line and 2 horizontal to 1 vertical or flatter below the water line. C. Any areas used for wastepiles, screening, stockpiling -or other processing shall be leveled and smoothed. D. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Condition Nos. 10A through 10E. E. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Revegetation Plan: After site preparation, all disturbed land areas shall be revegetated as per the following: Permanent Seeding Specifications Dates Species Rate, Lbs/Acre February 15 - April 1 Kobe Lespedeza 10 Bahiagrass 50 Redtop 1 Winter rye (grain) 15 April 1 - July 31 Common Bermuda 50 August 1 - October 25 Lespedeza (unscarified) 30 German millet 40 October 25 - February 15 Rye (grain -temporary) 120 Soil Amendments Lime: 2000 Ibslacre or follow recommendations from a soil test Fertilizer: 1000 Ibslacre 8-8-8 or 10-10-10, or follow recommendations from a soil test. Mulch: All seeded areas shall be mulched using small grain straw at a rate of 2000 Ibslacre and anchored appropriately. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch grass, Indian grass, bluestem and gamma grass. Page 9 In addition, the permittee shall consult with a professional wildlife biologist with the N.G. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. This permit, issued to Larry W. Never did I imply the entire borrow pit would only be two feet in depth... why would anyone go through what I have for the last year(time and money) to do that? We all concluded that discharging into the creek was not an option and I redirected my efforts in the design of the new borrow pit discharging into an existing partially completed pond on the Styron farm next to me. I have always stated that the new pit would be approximately 15 feet in depth and that is what my application showed in May 2011- The new borrow pit is not adjacent to any creek or wetlands what so ever, just like we discussed in the field with Joann. This permit O&M requires that I maintain a 7.25ft. freeboard in the Styron receiving pond in order not to overflow and allow for rain events. Your first paragraph talks about maintaining the Stryon pit no lower than 7 ft., not draining the wetlands and Monitoring by use of a overflow weir was not discussed and does not apply because this is a closed loop system with no discharge —this pond will be receiving water not discharging. My permit was apprcved(Permit No.16-72) along with the O&M plan and there is no issue with this permit at all. I do not plan to start this borrow pit for several years and I do not understand why you even brought it up. Lastly, I was told to register my water withdraw with D➢iR and the withdraw rate approved was 47,916 gpd which is the same as my permit with DLit. After submitting my new pit application in May, 2011, I proceeded in purchasing the Styron farm(90 acres) and closed on it in August, 2011. Part of the new permit process was showing proof that I owned the Styron pond where I was potentially discharging my wastewater and that it was in fact a closed loop System, Now to the issue at hand. Before I purchased the Styron farm and before I had DLR transfer the original Styron borrow pit permit(16-21), I conferred with you several times to make sure that I would be able to continue pumping just as Styron had for 15f years and you said yes I would. Based upon that, I had DLR transfer the permit effective Oct. 3,2011. I emailed you on Dec. 14, 2011, as courtesy and ask if there was anything else I needed to do because I was ready to begin dewatering the Styron pit in order to complete it. That is when you told me to monitor the effluent and I would hear from Jennifer Jones about a discharge permit. i did hire a lab to do the monitoring even though Mr. Styron was never required to do so. Then Ms. Jones sends me 30-r pages of instructions and a 9 page application for a NCG020000 for a National Pollutant Discharge Permit. I applied for that permit on Jan. 24, 2012 and expressed my suprise & concern to Ms. Jones, yourself and she shared them with Mr. Bennett. Wetlands and 2. SA Shellfishing waters I brought Jo with me on our site visit to ensure that there were no wetlands in close proximity to your new proposed mine "Circle P" that we would be concerned about protecting due to your dewatering. If you will recall, you indicated you were mining to create a wetland for a waterfowl impoundment and would not need to dig very deep. So let me ask you at this point, how deep did you indicate you would excavate on your permit from DLR? We weren't expecting anything deeper than a couple feet. Is this still the case? If it is greater than 20 feet deep, we may have a concern for wetlands or the creek that is located adjacent to this pit. You also indicated to protect wetlands around the Styron Pit (because there are wetlands within close proximity) that you would maintain a certain water level in the Styron Pit at all times to protect the nearby wetlands from draining (which would work) and that you could control the level using the elevation of the overflow weir from that pit. All that must be spelled out in writing in your O & M. I would think maintaining the level of water in the Styron pit no lower than 7 feet from the surface would protect wetlands in the nearby vicinity, but I'll have Jo confirm. If you decide to dig ® deeper say over 20 feet in the Circle P pit, we may need you to put in monitoring wells in wetlands near that pit. Now, concerning SA shellfishing waters. . You specified a discharge of 20000 gallons per day. Please indicate in detail how you will ensure this to be so and define how you will monitor that daily and document it. The submersible pump is better sized and appears to be the way to go, your calculations look good. You need to specify how you will insure the quality of the discharge will meet the permit limits for SA waters. Since you will pump to the Styron Pit, indicate where on the map you will introduce that discharge (and logically it needs to be introduced the farthest point from the outlet from the pit so you have adequate settling time). Revise your 0 & M for monthly monitoring and state that if the fecal counts are below 14 FCC/100 mL, then you will reduce monitoring to quarterly. If any subsequent quarterly test is greater than 14, you will immediately contact DWQ with the results and discuss any modification to the monitoring plan in accordance with DWQ's instruction and implement more frequent monitoring at DWQs request. If this occurs, I'll visit with Shellfish Sanitation and determine whether the levels you are discharging are a threat for closing the shellfish waters. I'll find out at that point too whether you will need more frequent monitoring. Monthly may not be often enough based on the fecal levels. By law, we cannot permit a discharge that removes a use for surface waters and certainly not the taking of shellfish. This is why I was really encouraging you to go non discharge. I'll need some help from Shellfish to determine what levels may be a problem. I'm hoping maintaining a low discharge flow will help provide some protection if the levels of bacteria are high. . . although by law dilution is not supposed to be used to control pollutant levels.
