Dear Mr. Cox:
In accordance with your application for a discharge permit received on October 16, 2007,
we are forwarding herewith the subject certificate of coverage to discharge under the subject
state -- NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Please be aware that mine dewatering at your site has the potential to impact adjacent
wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found
in Section C, Part 1 of your permit (Part III Page 5 of 9). You must have an_apt►roved
Operation and Monitoring Plan before mine dewatering discharges occur at your facility.
Discharging mine dewatering wastewater without Plan approval will be subject to enforcement
action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington
Regional Office within 60 days of your receipt of this permit. Contact Linda Willis at the
Wilmington Regional Office at (910) 796-7215 for more information about the approval
process.
Please note that mine dewatering wastewater includes wet pit overflows caused solely
by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of
this water (and any stormwater commingled with it) is subject to the effluent limitations in this
permit.
This general pen -nit allows the discharge of stormwater and certain types of wastewater
from your facility. In your application, you specified that only mine dewatering water would be
discharged from this facility. if separate point -source discharges of stormwater occur (i.e.,
Stormwater not combined with mine dewatering water), you will be required to adhere to theNo"`hcarolin,

I got their updated o & m and requested they modify their o & m plan to monitor the
monitoring wells weekly (not just quarterly) and that they flag the wetlands
boundaries as well as their 50 foot boundary lines to ensure no digging is in the
undisturbed buffer. DLR likely has issued the mining permit last Monday.

The Division of Water Quality (DWQ) in the Wilmington Regional Office received the O & M p—T—an—s-76rTlIe
following projects; NKT Projects No. 07144 (Old New Britton Road Mine, received December 20), 06148 (Henry
Bryant Mine, received December 20), and 06188 (Hardee Sand Mine, received November 30). Each of the O &
M plans have been reviewed and the following comments are provided for your consideration:
NKT Project No.'07144: K NCtaoa 0"703
1. - Please provide a USGS quadrant map with an overlay of the mine site. The USGS map is helpful in
identifying any blue line streams or potential wetlands outside the boundary of the mine site. The map
should be large enough to accommodate the identification of the access roads, excavation area, settling
basins, spoil piles, undisturbed buffers, and level spreader locations. The map provided showed
wetlands mostly within the mine site (proper) but left some uncertainty that wetlands had been identified
outside the mine site (specifically to the north of the mine site). ,DWQ is interested in the protection of all
wetlands, including those located.outside the mine site boundaries. .
2. Provide a copy of the delineation certified by the US Army Corp of Engineers or a letter from the
USACOE indicating concurrence with the wetland boundaries identified on the map provided.
3. Monitoring wells should be of sufficient number to provide data on hydrology of each wetland that has the
potential to be impacted by dewatering activities. The monitoring wells should be of sufficient depth to
demonstrate wetland hydrology. Use of existing wells that are 40-50 feet deep are too deep to
demonstrate wetland hydrology and should not be used to demonstrate whether wetland impacts are
occurring. Placement of the monitoring wells should be in the wetlands, just outside the undisturbed
buffer. The two monitoring wells identified on the map are located outside the wetland boundaries and
are not shallow monitoring wells.
4. Mining roads or -berms should not be built within the 50' undisturbed buffer, since an undisturbed buffer
refers to an area that has not been disturbed. Building a road or berm is a disturbance.
5. The number of level spreaders and their locations should provide recharge to all wetlands that have the
potential of being impacted by dewatering activities.
6. Include in the O & M plan a statement that requires the permittee to discontinue dewatering activities
immediately and contact DWQ upon noticing any impacts to surface waters or significant changes in
wetland hydrology and vegetation due to dewatering and will not resume dewatering until DWQ has
conducted an inspection of the mine site. DWQ will be notified if the daily flow exceeds the projected flow
or pump rates are increased to any level spreader exceeding those, identified in the.plans.
7. Please provide the calculations (including -any assumptions made) that demonstrate the accuracy of the
projected daily discharge of water that will need to be removed from the mine excavation pit. Please
account as well for the contribution to flow from stormwater. Explain how adequate settling will be
achieved during the early stages of digging (and dewatering) when the size of the pit is too small to
provide adequate settling.
8. The flow and pump rates and dimensions of level spreader and stilling basin need to be identified in
writing in the text of the O & M plan.

located on the east side of the mine site exceeds 8% (calculated to be 16%). Please identify an alternate
location for this level spreader where the down gradient slope (50' from level spreader) does not exceed
8%.
6. Any mining roads or berms should not be built within the 50' undisturbed buffer, since an undisturbed
buffer refers to an area that has not been disturbed. Bui#ding a road or berm is a disturbance.
7. Please provide the calculations (including any assumptions made) that demonstrate the accuracy of the
projected daily discharge of water that will need to be removed from the mine excavation pit. Please
account as well for the contribution to flow from stormwater. Explain haw adequate settling will be
achieved during the early stages of digging (and dewatering) when the size of the pit is too small to
provide adequate settling.

in the plan. Please be sure monitoring wells are within the wetlands in as close a proximity to the
undisturbed buffer as possible, but not in the buffer.
4. Mining roads or berms should not be built within the 50' undisturbed buffer, since an undisturbed buffer
refers to an area that has not been disturbed. Building a road or a berm is considered a disturbance.
5. Please provide a minimum length of 13' for each level spreader. The plan does not identify the length of
the level spreader in the design (attachment C2). The number of level spreaders and their locations
should provide recharge to all wetlands that have the potential of being impacted by dewatering activities.
6. Any mining roads or berms should not be built within the 50' undisturbed buffer, since an undisturbed
buffer refers to an area that has not been disturbed. Building a road or berm is a disturbance.
7. Please provide the calculations (including any assumptions made) that demonstrate the accuracy of the

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for Old New Britton Road Mine on October 16, 2007. The
application included a copy of an associated application for a mining permit submitted to the Division of Land
Resources (DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an
associated mining permit from DLR. Our office will process your stormwater permit application once a DLR
mining permit has been issued for your project.
We received one set of plans for the proposed mine. Please also provide two additional sets of the plans
previously submitted.
Please also be aware that if your project is located near wetlands, your NPDES permit will require
dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities
near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available on
our website, http://h2o.enr.state.nc.us/su/Forms_Documents.htm. See Section C, Part I of the permit on the
page labeled, "Part III Page 5 of 9".. An approved Operation and Monitoring Plan is required for NPDES-
permitted mining facilities. Discharging mine dewatering wastewater without Plan approval will be subject to
enforcement action. A Plan for your facility must be submitted to the Wilmington Regional Office within 60
days of your receipt of an NPDES permit. We encourage you to contact Linda Willis at the Wilmington
Regional Office at (910) 796-7215 to address any wetland concerns for your facility in order to ensure a
successful NPDES application review.

2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the
maps along with their corresponding (approximate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those
activities that are intended to be conducted during the life of the mining permit. All maps must be
of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a
minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including easements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.

C. PROTECTION OF NATURAL RESOURCES
1. Describe in detail the sequence of events for the development and operation of the mine and reference the
sequence to the mine map(s). Attach additional sheets as needed.
The mine barrow area will be cleared and grubbed. Mining will begin at the east end of the mine and
progress to the west. The area will be reclaimed upon project completion.
2. Describe specific erosion control measures to be installed prior to land disturbing activities and during
mining to prevent offsite sedimentation (include specific plans for sediment and erosion control for mine
excavation(s), waste piles, access/mine roads and process areas), and give a detailed sequence of installation
and schedule for maintenance of the measures. Locate and label all sediment and erosion control measures
on the mine map(s) and provide typical cross-sections/construction details of each measure. Engineering
designs and calculations shall be required when needed to justify the adequacy of any proposed measures.
The entire project site will be surrounded by an existing vegetated buffer to act as a filter for any
surface sediment movement. Since the mine is a pit, movement of sediment from the pit will be
negligible.

a. A buffer will be required between any mining activity and any mining permit boundary or fight -of -
way. It may be an unexcavated buffer {no excavation, but roadways. berms and erosion &
sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance
within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note
that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary
or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer
may be needed depending on site conditions. Show all buffer locations and widths on the mine
map(s).
A minimum buffer of 50' will be maintained.
b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities
within the mining permit boundaries and any natural watercourses and wetlands unless smaller
undisturbed buffers can be justified. Depending on site conditions, a buffer wider than 50 feet may
be needed.

technical justification can be provided to allow steeper slopes.
Side slope excavations will not extend 2 to 1. Wide enough buffers exist between the mine
and adjacent property lines to ensure no violation of boundaries.

b. Provide a cross-section on the mine map(s) for all fill slopes (berms, wastepiles, overburden
disposal areas, etc.), clearly indicating the intended side slope gradient, installation of any benches
and/or slope drains (with supporting design information) if needed, and the method of final
stabilization.
A side slope of 2 to I or flatter will be maintained.
In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes including
specifications for benching and sloping. Cross -sections for all cut slopes must be provided on the
mine map(s).

D. RECLAMATION PLAN
1. Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate
the sequence and general methods to be used in reclaiming this land. This must include the method of
reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment
of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. This
information must be illustrated on a reclamation map and must correspond directly with the information
provided on the mine map(s). In addition, design information, including typical cross -sections, of any
permanent channels to be constructed as part of the reclamation plan and the location(s) of all permanent
channels must be indicated on the reclamation map.
The area will be reclaimed as a wooded area with soil road access. Pit banks will be grassed
and allowed to re -vegetate with naturally occurring tree and shrub species. Haul roads will
remain for access to the area for future timbering purposes.
2. Is an excavated or impounded body of water to be left as a part of the reclamation? Yes X No
If yes, illustrate the location of the body(s) of water on the reclamation map and provide a scaled
cross-section(s) through the proposed body(s) ofwater. The minimum water depth must be at least 4 fect,
measured from the normal low water table elevation, unless information is provided to indicate that a more

owners of record, both public and private, of all tracts of land that are adjoining the mining permit boundary; if an
adjoining tract is owned or leased by the applicant or is owned by the lessor of the mine tract, all owners of record of
tracts adjoining these tracts must be notified (that are within 1,000 feet of the mining permit boundary). In addition,
the mine operator must also notify the chief administrative officer of the county or municipality in which any part of
the permitted area is located. Any person may file written comment(s) to the Department at the above address
within thirty (30) days of the issuance of this Notice or the filing of the application for a permit, whichever is later.
Should the Department determine that a significant public interest exists relative to G.S. 74-51, a public hearing will
be held within 60 days of the end of the 30-day comment period specified above.
A copy of the permit application materials are on file and available for public review during normal
business hours at the above listed address as well as at the appropriate regional office. For information

other changes are considered major modifications.
