had received some analytical results in the mail for your quarterly monitoring event in
August of this year. Thank you for your inquiry concerning the reporting requirements.
regret it has taken some time to get back to you concerning this matter. Enclosed are
your analytical results for your files (please keep these records in your files for at least 5
years from the date the samples were collected).
I recorded the sample results on an annual summary DMR for your convenience to help
you see where and how you should be recording your data. I don't know if you
collected samples for the first half of the year (January through June), but your
monitoring requirements are QUARTERLY, so please be sure to remember to collect
samples. If you did not pump any wastewater from the pit during a given quarter, you
may state as much on the DMR by writing in "no discharge for the quarter". You must
also document in your stormwater pollution prevention plan that no pumping had
occurred during that particular quarter. In the case that no pumping is occurring, the
Division would expect the level of water in the pit to reflect no pumping activity. Don't
forget to collect your fourth quarter samples to remain compliant with your permit. Be
sure to collect your 41h quarter samples before December 31, 2012.
Please review the enclosed DMR. If you conducted additional sampling, please include
that data (if samples were collected during.the first and second quarters of 2012). If not,
please ensure in the future that you remain compliant with the quarterly monitoring

requirements. I enclosed a copy of the annual summary DMR without any writing on it
so that you will have a template for use in the future. The annual summary report must
be mailed in to the Division of Water Quality no later than March 15E of each year.

Also, before sending in the DMR, it must be signed by the permittee. You should
compare the limits in your permit (Part III, table 8 on page 14 of 16) with the analytical
data reported for your sample results from the laboratory to determine if your discharge
has exceeded any of the limits, if so, you will need to check the box on the front page of
the annual DMR, indicating "yes" to limit violations. In the case of exceedances, you
must send a copy of the DMR to the Wilmington Regional Office within 30 days. If you
check "no", no further action is required at that time.
In order to avoid limit violations, it is best to avoid any dewatering within several days of
any rain event. You can judge the quality of the water in the pit prior to discharge, as
well, to avoid pumping when the water is very turbid:
You should read your permit every year so that you remain familiar with the permit
requirements. Please do not forget to maintain your stormwater pollution prevention
plan which includes annual certifications, employee training requirements, annual
review of the stormwater pollution prevention plan and facility inspections.
Documentation of these events are required by the stormwater pollution prevention

Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands.
The specific requirements for mine dewatering at facilities near wetlands can be found in Part III,
Section E of your permit. You must have an approved Operation and Monitoring Plan
before mine dcwatering discharges occur at your facility., Discharging mine dewatering
wastewater without Plan approval will be subject to enforcement action. An Operation and
Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within
60 days of your receipt of this permit. Contact Linda Willis ai the Wilmington Regional Office
at [phone] for more information about the approval process.
This site will discharge to a receiving stream designated as High Quality Waters (HQW) and
a Primary Nursery Area (PNA). As a result, a more stringent TSS limit and a more stringent
volume for wastewater discharges applies.
Additionally, new coastal stormwater management rules (SESSION LAW 2008-211) were
implemented October 1, 2008. Due to these new rules you may be required to apply for an
additional Coastal State Stormwater Permit. Please contact Kelly Johnson in the Wilmington
Regional Office at 910- 796-7345 to determine if you will be required to submit an application
for this additional permit.
This permit does not affect the legal requirements to obtain other permits which may be required by
DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable

Your facility is currently covered for stormwater discharge under General Permit NCG020000. This permit expires on
December 31, 2009. The Division staff is currently in the process of renewing this permit. When a draft is available for notice
and public comment, it will be posted on our website at http://h2o.enr.state.nc.us/su/publicnotice.htm, Please continue to
check this website to review and comment on proposed changes to the permit. Once the permit is reissued, your facility
would be eligible for continued coverage under the reissued permit.
To assure consideration for continued coverage under the general permit, you must apply to the Division of Water Quality
(DWQ) for renewal of your permit. Enclosed you will find a Permit Coverage Renewal Application Form (Side One of attached
sheet). The application must be completed and returned by ]ultr 17. 2009. Letters confirming our receipt of the completed
application will not be sent.
Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without
coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in
assessments of civil penalties of up to $25,000 per day. Our records indicate that your facility has outstanding
annual fees in the amount of $100.00. We cannot renew your permit coverage until you have corrected this situation.
We have enclosed copies of the unpaid invoices that must be returned with payment. Failure to pay annual fees is a violation
of your permit and may result in revocation of your permit coverage.
"No exposure exclusion" is now available to industrial facilities in any of the categories of "storm water discharges associated
with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e.
the facility industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion.

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed Rescission

when the rescission process has been completed. Please note that the attached sheet has two different forms (front and
back). Fill out Side One for permit renewal or Side Two for permit rescission. Only one side should be completed.

In accordance with your application for a discharge permit received on May 23, 2005 we
are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or

This general permit allows the discharge of stormwater and certain types of wastewater

Hi Jonathan. I just spoke to the Land Quality inspector (who, in turn, had just
spoken with whomever you spoke w/ in LQ). Basically, that NOV was for not having the
NCG020000. He (Trent James) said issuance of this NCG would satisfy their
requirement/compliance. No bothers at all. If there's anything else I need to do (or

Hey Wes - sorry to keep bothering you on this Smyrna Mine facility. I realized
after our last email that this site drains to SA waters, and I also don't really
have any drawings to show how they're going to debater (which isn't a requirement
but it helps). So I went down to look at the DLR drawings for the mining permit
submittal, and they had in the file a NOV for the site. It was issued back in
February and among other things the inspector saw that the were doing dewatering
into the wetlands and there was visible sediment in the wetlands. They were given
30 days to address the NOV, but DLR didn't have anything on record that shows that
they responded to the NOV. The lady I talked to in DLR was going to talk with the
inspector to see if knew anything else about the site.
I'm assuming that we still want to issue to the permit, but I'd like to follow up
with DLR to see if they've addressed their concerns. I wanted to make sure you
knew about this, and if you have any concerns or comments just let me know. JD

accordance with the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources, hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and incorporated as part of
;V E this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. This permit is
expressly conditioned upon compliance with all the requirements of the approved Reclamation
Plan. However, completed performance of the approved Reclamation Plan is a separable
obligation, secured by the bond or other security on file with the Department, and may survive
the expiration, revocation or suspension of this permit.
This permit is not transferable by the permittee with the following exception: If another
operator succeeds to the interest of the permittee in the permitted mining operation, by virtue
of a sale, lease, assignment or otherwise, the Department may release the permittee from the
duties imposed upon him by the conditions of his permit and by the Mining Act with reference
to the permitted operation, and transfer the permit to the successor operator, provided that
both operators have complied with the requirements of the Mining Act and that the successor
operator agrees to assume the duties of the permittee with reference to reclamation of the
affected land and posts a suitable bond or other security.
In the event that the Department determines that the permittee or permittee's successor is not
complying with the Reclamation Plan or other terms and conditions of this permit, or is failing
to achieve the purposes and requirements of the Mining Act, the Department may give the
operator written notice of its intent to modify, revoke or suspend the permit, or its intent to
modify the Recjamation Plan as incorporated in the permit. The operator shall have right to a
hearing at a designated time and place on any proposed modification, revocation or
suspension by the Department. Alternatively and in addition to the above, the Department
may institute other enforcement procedures authorized by law.
Definitions
Wherever used or referred to in this permit, unless the context clearly indicates otherwise,
terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49.
Expiration Date
This permit shall be effective from the date of its issuance until March 24, 2013.
Conditions
This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to
the following conditions and limitations:
QPERATING CONDITIONS:
A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission.

2.
B. Any stormwater runoff from the affected areas at the site shall be in accordance
with any applicable permit requirements and regulations promulgated by the
Environmental Protection Agency and enforced by the N.C. Environmental
Management Commission. It shall be the permittee`s responsibility to contact the
Stormwater Section, Division of Water Quality, to secure any necessary
stormwater permits or other approval documents.
A. Any mining process producing air contamination emissions shall be subject to the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission and enforced by the Division of Air Quality.
B. During mining operations, water trucks or other means that may be necessary
shall be utilized to prevent dust from leaving the permitted area.
3. A. Sufficient buffer (minimum 50 foot undisturbed) shall be maintained between any
affected land and any adjoining waterway or wetland to prevent sedimentation of
that waterway or wetland from erosion of the affected land and to preserve the
integrity of the natural watercourse or wetland.
B. Any mining activity affecting waters of the State, waters of the U. S., or wetlands
shall be in accordance with the requirements and regulations promulgated and
enforced by the N. C. Environmental Management Commission.
4. A. Adequate mechanical barriers including but not limited to diversions, earthen
dikes, silt check dams, silt retarding structures, rip rap pits, or ditches shall be
provided in the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or into any lake, wetland
or natural watercourse in proximity to the affected land.
B. All drainage from the affected areas around the mine excavations shall be
diverted internal to said excavations.
C. Mining activities shall be conducted as indicated on the mine maps dated May
2001 with the following stipulations:
1. Mine dewatering shall be limited to less than 100,000 gallons per day.
2. Any discharge shall pass through an adequately designed sedimentation
control structure before leaving the permitted area through a stabilized
outlet to prevent offsite sedimentation and turbidity.
3. Perimeter berms shall be increased from two feet to six feet for visual
screening purposes.
4. Buffer zones along all permit boundaries shall be increased to 25 foot
unexcavated and buffer zones along any wetland areas within the permit
boundaries shall be increased to 50 foot undisturbed.

All affected area boundaries (14.53 acres) shall be permanently marked at the site on
100 foot intervals unless the line of sight allows for larger spacing intervals.
The angle for graded slopes and fills shall be no greater than the angle which can be
retained by vegetative cover or other adequate erosion control measure, structure, or
device. In any event, exposed slopes or any excavated channels, the erosion of which
may cause off -site damage because of siltation, shall be planted or otherwise provided
with ground cover, devices or structures sufficient to restrain such erosion.
7. The affected land shall be graded so as to prevent collection of pools of water that are,
or likely to become, noxious or foul. Necessary structures such as drainage ditches or
conduits shall be constructed or installed when required to prevent such conditions.
8. A. Existing vegetation or vegetated earthen berms shall be maintained between the
mine and public thoroughfares whenever practical to screen the operation from
the public.
B. Perimeter berms shall be increased from two feet to six feet for visual screening
purposes.
9. Sufficient buffer (minimum of 25 foot unexcavated) shall be maintained between any
excavation and any mining permit boundary to protect adjacent property.
10. A. No on -site disposal of refuse or other solid waste that is generated outside of the
mining permit area shall be allowed within the boundaries of the mining permit
area unless authorization to conduct said disposal has first been obtained from
both the Division of Waste Management and the Land Quality Section,
Department of Environment and Natural Resources. The method of disposal
shall be consistent with the approved reclamation plan.
B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated
on -site and directly associated with the mining activity may be disposed of in a
designated refuse area. All other waste products must be disposed of in a
disposal facility approved by the Division of Waste Management. No petroleum
products, acids, solvents or their storage containers or any other material that
may be considered hazardous shall be disposed of within the permitted area.
C. For the purposes of this permit, the Division of Land Resources considers the
following materials to be "mining refuse" (in addition to those specifically listed
under G.S. 74-49 (14) of the N.C. Mining Act of 1971):

D. If mining refuse is to be permanently disposed within the mining permit boundary,
the following information must be provided to and approved by the Division of
Land Resources prior to commencement of such disposal:
1. the approximate boundaries and size of the refuse disposal area;
2. a list of refuse items to be disposed;
3. verification that a minimum of 4 feet of cover will be provided over the
refuse;
4. verification that the refuse will be disposed at least 4 feet above the
seasonally high water table; and,
5. verification that a permanent vegetative groundcover will be established.
An Annual Reclamation Report shall be submitted on a form supplied by the
Department by February 1 of each year until reclamation is completed and approved.
12. The operator shall notify the Department in writing of the desire to delete, modify or
otherwise change any part of the mining, reclamation, or erosion/sediment control plan
contained in the approved application for a mining permit or any approved revision to it.
Approval to implement such changes must be obtained from the Department prior to on -
site implementation of the revisions_
13. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $12,800.00
surety bond, is sufficient to cover the operation as indicated in the approved application.
This security must remain in force for this permit to be valid. The total affected land
shall not exceed the bonded acreage.
14. A. Authorized representatives of the Division of Archives and History shall be
granted access to the site to determine the presence of significant archaeological
resources.
B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human
Skeletal Remains Protection Act," should the operator or any person in his
employ encounter human skeletal remains, immediate notification shall be
provided to the county medical examiner and the chief archaeologist, North
Carolina Division of Archives and History.

APPROVED RECLAMATION PLAN
The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition
on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a
separable obligation of the permittee, which continues beyond the terms of the Mining Permit.
The approved plan provides:
Minimum Standards As Provided By G.S. 74-53
The final slopes in all excavations in soil, sand, gravel and other unconsolidated
materials shall be at such an angle as to minimize the possibility of slides and,be
consistent with the future use of the land.
2. Provisions for safety to persons and to adjoining property must be provided in all
excavations in rock.
3. All overburden and spoil shall be left in a configuration which is in accordance with
accepted conservation practices and which is suitable for the proposed subsequent use
of the land.
4. No small pools of water shall be allowed to collect or remain on the mined area that are,
or are likely to become noxious, odious or foul.
5. The revegetation plan shall conform to accepted and recommended agronomic and
reforestation practices as established by the North Carolina Agricultural Experiment
Station and the North Carolina Forest Service.
6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein
incorporated. These activities shall be conducted according to the time schedule
included in the plan, which shall to the extent feasible provide reclamation simultaneous
with mining operations and in any event, provide reclamation at the earliest practicable
time after completion or termination of mining on any segment of the permit area and
shall be completed within two years after completion or termination of mining.
RECLAMATION CONDITIONS:
9. Provided further, and subject to the Reclamation schedule, the planned reclamation
shall be to restore the mine excavations to lake areas and to grade and revegetate the
adjacent disturbed areas.
2. The specifications for surface gradient restoration to a surface suitable for the planned
future use are as follows:
A. The lake areas shall be excavated to maintain a minimum water depth of four
feet measured from the low water table elevation.

B. The side slopes to the lake excavations shall be graded to a 3 horizontal to 1
vertical or flatter to the water line and 2 horizontal to 1 vertical or flatter below the
water line.
C. Any areas used for wastepiles, screening, stockpiling or other processing shall
be leveled and smoothed.
D. No contaminants shall be permanently disposed of at the mine site. On -site
disposal of waste shall be in accordance with Operating Condition Nos. 10.A.
through D.
E. The affected land shall be graded to prevent the collection of noxious or foul
water.

Whenever possible, disturbed areas should be vegetated with native warm season
grasses such as switch grass, Indian grass, bluestem and gamma grass.
In addition, the permittee shall consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance post -project wildlife habitat at the site.
4. Reclamation Plan:
Reclamation shall be conducted simultaneously with mining to the extent feasible. In
any event, reclamation shall be initiated as soon as feasible after completion or
termination of mining of any mine segment under permit. Final reclamation, including
revegetation, shall be completed within two years of completion or termination of
mining.
