With a copy of this letter, we are also requesting a
concurrence letter from the Wildlife Resources Commission and
requesting issuance of 401 Water Quality Certification from the
N. C. Division Of Environmental Management.
We have attached a site location map, and a sketch of planned
activities. A stringent erosion and sedimentation control
program will be implemented during the project construction and
every effort will be made to complete work in a timely manner.
Our personnel are available to assist with your evaluation of

Upon review of your request for Water Quality Certification
to place fill material in wetlands or waters which are tributary
to Sugar Tree Branch for located at SR 1341 in Ashe County, we
have determined that the proposed fill can be covered by General
Water Quality Certification No. 2745 issued January 21, 1992. -A
copy of the General Certification is attached., This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 3.

Stream crossing along S.R. 1341 (Sugar Tree Branch
Rd.) on sugar tree branch in Ashe County
Dear Mr. Thomas,
The letter of request is in reference to the former permit
No. 1992011872 issued May 1, 1992 along SR 1341 in Ashe
county, asking for a revision of same to include an
additional pipe and eliminate the armoring of stream in one
location.
Since we received the initial permit, we have determined that
an alignment change and additional pipe be included to
provide a safe travel way for this project.
At survey station 9+00 through station 9+50 it is impossible
to provide a safe travel way due to the close proximity of an
existing dwelling located on one side and the streams
location on the other side.
Attached you will find copy of correspondence along with
drawings and cross sections of proposed pipe installation
provided me by D. K. Miller county maintenance engineer in
Ashe County.
By copy of this letter I am asking Mr. Joe Mickey, Jr., of
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning
this revision of the 404 Nationwide Permit request.
I am asking Mr. Mickey to comment directly to me concerning
the Trout water buffer zone encroachment.
Also by copy of this letter, I am requesting authorization to
proceed with this revision under Section 401 of the Clean
Water Act from the Division of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your
early review and consideration of this revision request will
be greatly appreciated.

Subject= Alignment Change and Addition of Pipe on
SR 1341--A

This memo serves as a request to add 80' of 95"x67" arch pipe
and change the purposed alignment of SR 1341-A from sta. 8+75
to sta. 10+00. Under the current alignment a situation
exists that presents an eminent danger to the traveling
public if the road is constructed as staked. Due to the
close proximity of an occupied home which is 15' from the
purposed centerline and the adjacent stream which is also
from 14' to 15' of the purposed center line we were unable to
shift either way to provide safe passage between sta. 9+00
and sta. 9+50 of this project. The purposed pavement width
is 18' (2-9' lanes) but due to the poor horizontal alignment
created by the home and the creek in this area a school bus
or any large single axle vehicle would have to cross the
centerline to keep their wheels from dropping off of the
pavement. The shoulder width on the fill side will be only 1
foot wide with a dropoff of 4 to 5 feet into the stream. We
considered a paved boulevard section on the northbound lane
but the alignment still could not be improved enough to
provide safe passage for these type vehicles. The only safe
alternative, and one that was discussed during the right of
way negotiations was the installation of a pipe which would
allow the road to be shifted to provide a safe alignment.
This proposal was also approved by Doug Tetzlaff and if
implemented it will improve the situation greatly. Mr. Loyd
Mitchell signed the right of way agreement thinking that a
pipe would be installed. Unfortunately he forgot to have the
pipe included in his agreement but I did tell him we would
install it after he bought it to my attention. His sole
reason for requesting the pipe was to provide a safe passing
area because he recognized as a former road builder that a
very hazardous curve was in the making.

Attached you will find some sketches of my proposal for
changing the alignment in this area. With the proper erosion
control measures, in this case silt screens and armoring of
exposed slopes, this pipe can be installed with little or no
impact on downstream aquatic resources.
As you will note on the attached sketches the pipe size was
provided to me by Dan D. Holderman, PE from a hydrographic
survey conducted by our Raleigh Office. Inlet and outlet
protection can be accomplished by class II rip rap armor 24
inches thick with fabric liner around the pipe at both ends
with it extending on the upstream portion to the abutments
of a private bridge and downstream for a distance of 30' on
the west side of the stream and 25' on the eastside. Two
maximum size silt screens can be installed downstream of the
pipe to catch any sediment disturbed.
Please review the attached sketches and if they meet your
approval, please request this addendum to the proper channels
so we will be able to proceed with construction.
