The information below is slightly different than what you report from Resco, but I don't think it makes any difference at this point. Our letter of 41212012 notified Resco that they had not renewed their COC #NCG020157 which had expired 12/31/2009; in response to our letter, we received Resco's application for renewal on 4 13 2012, signed by Randy Thomas, Plant Manager. • We processed that late application, and our letter of 11/20/2012 to Alex Ford transmitted the re -issued COC dated 11/20/2012, signed by me, and valid through the expiration date of the General Permit, 12/31/2014; Federal rules governing our program establish that if a permittee has made timely application for renewal but the permitting agency (us) is late in delivering the renewed permit coverage, then the permittee is obligated to continue to abide by the expired permit until the agency can deliver the renewed coverage. During this period the permittee is not at risk of "discharging without a permit." Essentially, federal rules anticipate our current circumstance and provide protection for the permittee: it's not his fault that we are late delivering the permit coverage after 12/31/2014. 1 presume that Resco made timely application in response to our emails to all NCG02 permittees earlier in 2014. Our emails instructed our permittees to go on-line and provide updated contact information, and to indicate whether they wish to renew coverage. We used Randy Thomas' email address provided in Resco's renewal application from 411312012, and subsequently confirmed to us via a nom%wnership change form signed by Mr. Thomas on 61612014. A point of clarification may be helpful for Resco: The General Permit that they have to comply with now is the version issued 1/1/2010 (with expiration date of 12/31/2014), which is still posted on our website. The prior version valid through 12/31/2009 is no longer relevant, and has not been relevant to Resco since we re -issued coverage to them in November 2012. You may want to advise them to be sure they are adhering to the most current version of NCG02 (the 2010-2014 version.) I note that our database shows that Resco has paid all annual fees from 2007 to date. We should have no bureaucratic complications from past due fees, as we sometimes do when folks forget to renew their permit coverage. So, going forward from this point: • According to our records, Resco is not currently in danger of discharging without a permit since the 2010-2014 permit coverage remains in effect by virtue of our delay, and their timely application for renewal. (I presume.) • Our website reports that we will be re -issuing NCG02 with no changes on 2/2/2015 for a short period, and then reissuing it for the remainder of the normal five-year period on 6/1/15. Essentially the short period buys us more time to allow us to put the proper effort into the reissued NCG02. Since Resco's general permit (NCG020000) expired 12/31/14 Resco is concerned about the status of their Certificate of Coverage (COC) which expired in 2010. I was told that the facility has submitted two renewal applications since the COC expired in 2010 and they are concerned about their compliance status since a new COC has not yet been issued. Based on your voicemail it sounds like the facility may continue to operate under their expired and continued COC (No. NCG020157) until a new one is issued. Would you mind confirming this in writing with a reply to this email? Your help is greatly appreciated.
