I am in receipt of your letter dated August i, 2016 regarding the above referenced Stormwater Permit.
Please be advised that I worked for Dallas Harris Real Estate Construction, Inc. approximately January
1998 until approximately September 2003. 1 was a weekly paid employee, and never an owner or
stockholder, nor did I receive compensation other than my weekly payroll check. My position was one
of strictly office administration, mostly bookkeeping, and other office duties as needed. At no time was I
involved in decision making regarding the construction, development of land or lots, nor undeveloped
land. At my departure I received no cash compensation, nor was I gifted any land, developed or
undeveloped.
To this extent I have no knowledge or responsibility for Mr. Harris's current or past Stormwater Permits.

Dear Mr. Harris and Ms. Whitlow:
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will
remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this
letter references DEMLR as the Division responsible for issuance of the subject permit.
On .hone 34...2.016, the Wilzninpton RegioJna.l Office of the Division of Energy Mineral and Land Resources
conducted a fil- review of Covil ; tags II located off Covil Farm Road in New Hanover County in response to an
inquiry about the use of permeable pavement and the maximum BUA limit on one of the lots in Vantage Point.
The project is currently operating under Stormwater Management Permit Number SW8 940814 last issued to
Dallas Harris Real Estate Construction on September 11, 1998. The permit allows for the development of 158
single family lots under the 25% low density option, with a curb outlet swale system. The built -upon area for each
lot is limited as follows: the 80 lots in Pepper Tree @3,930 ft each; the 44 lots in Wessex @4,830 ft each; and
the 34 lots in Vantage Point @6,480 ft2 each.
On July 11, 2016, DEMLR conducted a compliance inspection of the project. As indicated on the attached
Compliance Inspection Report, the file review and site inspection has revealed the following deficiencies:
1. The administrative dissolution of Dallas Harris Real Estate Construction, Inc., on August 13, 2010, for
failure to file an annual report is considered an ownership change. The Division was not notified of this
ownership change and the permit has not been transferred to a Homeowner's Association. Per Conditions
1I.10 and 111.5 of the permit, it is the permittee's responsibility to request to modify the permit prior to any
transfer of ownership and to submit a formal permit transfer request to the Division in order to transfer the
permit to a new owner (i.e., the HOA). If the corporation has not been reinstated, then under NCGS 57D-
2-01(e) and NCGS 57D-6-07, the corporation is required to "wind up" its affairs, distribute its assets and
discharge its liabilities, which include the stormwater permit.
2. The permittee did not submit a copy of the recorded deed restrictions to the Division within 30 days, as
required by Condition 11.5 of the permit. The Division located and downloaded copies from the New
Hanover County Register of Deeds website. Unfortunately, several of the permit -required deed restriction
statements listed in Condition 11.5 of the permit have not been recorded. An amendment will need to be
drafted, approved and executed to add the missing statements. Once the amended deed restrictions have
been approved by the membership, they must be recorded and a copy of the recorded document must be
submitted to the Division within 30 days of that record date.
3. The swales on Lounsberry Court appear to be steep -sided and overgrown drainage ditches rather than 5:1
grassed curb outlet treatment swales.
4. Sidewalk has been added down one side of Fisherman Creek Drive and halfway down both sides of
Enston Way, in Vantage Point. Neither the approved road details nor the application show or account for
any sidewalk within the right-of-way.

To address these compliance issues, please provide / perform the following:
1. Please initiate the transfer of the permit from the dissolved corporation to the HOA(s). The permit
currently covers 3 separate subdivisions, Wessex (formerly Snug Harbor 11), Vantage Point (formerly
Covil Point) and Pepper Tree (unchanged). Each of these subdivisions appears to have a separate HOA:
a. Pepper Tree at Covil Estates HOA, Inc., c/o Community Solutions;
b. Wessex at Covil Estates HOA, Inc., c/o Dave Sweyer, Jr. and Melisa Gallison;
c. Vantage Point at Covil Estates HOA, Inc., c/o Dave Sweyer, Jr.
Having three HOA's will make it difficult, but not impossible, to transfer this permit. Options include
transferring the permit to all three HOA's as co-permittees, with their specific responsibilities outlined in
the permit; or submitting a request to modify the permit and break it up into 3 separate permits, one for
each HOA. The HOA's can be co-permittees for the initial transfer and then the HOA's can submit a
request later to split up the permit into 3 separate permits.
2. The currently recorded deed restrictions are missing the second half of Condition II.5.a., and the entirety
of Conditions II.5.c, II.5.d. and II.5.e. As a third parry beneficiary of the covenants to the extent necessary
to enforce the stormwater permit conditions, the State of North Carolina is requiring that you prepare an
amendment to the deed restrictions which proposes to add these missing statements as listed in Condition
I1.5 of the permit. Please follow the amendment procedure outlined in Article XI Section 5 of the current
recorded declaration of covenants, conditions and restrictions for each subdivision, which appears to
require a 2/31d's majority vote of the lot owners to approve of the amendment.
3. The currently recorded deed restrictions limit the built -upon area per lot to a slightly lesser amount than
was permitted, as follows: Pepper Tree @ 3,510 ft2 each; Wessex @4,800 ffz each; and Vantage Point
@6,400 ft' each. In addition, the recorded plat for Vantage Point (DB 38 PG 203) appears to show one
less lot recorded than was permitted (34 permitted vs. 33 recorded). In total, there is approximately
44,040 ft2 of BUA (on paper) that might be available to the HOA's to be reallocated to any lots that need
additional BUA, and to deal with the added sidewalk in Vantage Point.
4. Please perform any necessary maintenance on the swales to restore them to design condition.
5. Please submit a modified permit application to deal with any BUA overages and to address the
unapproved addition of sidewalk in Vantage Point. Please include the following supporting documents
and information as part of the modified permit application package:
a. Calculate and verify the total amount of BUA that has been freed up due to recording less BUA
per lot and due to the loss of one lot in Vantage Point. Reallocate this BUA to those lots that need
it and to deal with the added sidewalk in Vantage Point;
b. Record the missing deed restriction statements and the new BUA per lot allocations via an
approved amendment;
c. Verify that no piping has been added beyond what is already shown on the approved plan.
d. Verify that all curb outlet swales are a minimum of 100' long, with 5:1 (H:V) or flatter side
slopes; a longitudinal slope no steeper than 5%; can carry the peak flow from a 10 year storm in a
non -erosive manner and maintain a dense vegetated grass cover, as stipulated in Condition I.6 of
the permit;
Please note that the Division sent this letter to Rodney Q. Harris on July 12, 2016. Mr. Harris responded by letter
received July. 25, 2016, (copy attached) indicating that he left the company in 1997 and has no further
responsibility in this matter. You are both the only officers in the corporation from the last several years of annual
reports filed by Dallas Harris Real Estate Construction, Inc. through the 2005 fiscal year, therefore, the
responsibility for this permit falls to you. Please call the Division to schedule a meeting -with Division staff and
representatives from all 3 HOA's and their management companies, to discuss these issues and to determine a
suitable path forward. The permit must be modified first and then determined to be in compliance by the Division
and then transferred to the HOA(s).
It is the responsibility of Dallas Harris Real Estate Construction, Inc. to complete, sign and submit one of the two
name/ownership change and permit transfer forms which are available on the Division's website at
permits/forms, to this Office along with the required documentation listed on the form. The Division can transfer
the permit to the HOA under the provisions of SL 2011-256 with just your signature on the "HOA
Name/Ownership Change Form", if you can provide documentation that the project was developed under Chapter
47F, the Planned Community Act and if the project is determined to be in compliance.

The provisions of Session Law 2011-256, include:
A. The subdivision was made subject to the requirements of Chapter 47F, aka the Planned Community Act.
B. The permittee has submitted a completed and signed HOA Permit Transfer document;
C. The permittee has submitted a copy of the recorded deed conveying the common areas of the subdivision to
the Association;
D. The Division has made a determination that the project is in compliance with the permit. This determination
must be made in writing no more than 90 days prior to the transfer. Documents that the permittee needs to
submit in order for the Division to make that determination of compliance include:
1) A copy of the designer's certification that the curb outlet swales were constructed per the approved plans
and are being operated and maintained in accordance with the O&M agreement;
2) A copy of the recorded deed restrictions;
3) Verification that the permitted maximum built -upon area per lot has not been exceeded on any lot. The
permittee's review records, county tax records and/or lot surveys can be used for this. Any overages or
additions such as the sidewalk on Fisherman Creek Drive and Enston Way, need to be resolved;
4) Verification that more than 50% of the lots have been conveyed to individuals (not builders). Copies of
the deeds of conveyance are acceptable. Where there are many lots, the permittee may create a chart
listing the lot number, lot address, owner's name, conveyance date and deed book and page number.
If any of the subdivisions was not made subject to the Planned Community Act then you must use the longer 4-
page "Name/Ownership Change Form" in order to transfer the permit to the three respective HOA's. This form
requires the signature of both the "current permittee" (Benjamin K. Harris, Vice President representing Dallas
Harris Real Estate Construction, Inc.) and the "proposed permittee", i.e., all three HOA's, on the form. Each HOA
can sign a separate page 3 of 4 from the form. The permittee is required to address the compliance issues prior to
transfer of the permit. Alternatively, the HOA can elect to accept the permit "as is" (in writing) and agree to
address the compliance issues later. The Division is willing to work with the HOA's as their time and finances
allow, to resolve the compliance issues.
.Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or
the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement action including
the assessment of civil penalties.

I received your letter dated July 12, 2016 in reference to the Stormwater Permit for
the neighborhoods of Pepper Tree, Wessex and Vantage Point in Covil Estates.
As you noted in that letter the permit was held by Dallas Harris Real Estate
Construction, Inc. Although I was employed by Dallas Harris Real Estate
Construction, Inc. from July 1992 to May 1997 I never owned any portion of nor
had any interest in the company.
Although I received some of the developed lots upon my departure as payment for
services I provided between 1992 and 1997, I never owned any undeveloped
property, common area nor did I participate in or have knowledge of any
development activities that continued under Dallas Harris Real Estate
Construction, Inc. or any other Dallas Harris companies after my departure in May
of 1997.
In light of the foregoing information, I am sure you will agree that I am not in a
position to help remedy the situation as stated in your letter. Please consider this
my response to your letter.

Inspection Summary:
The permit covers three separate subdivisions, Wessex, Pepper Tree and Vantage Point. Each subdivision has a
separate HOA, which is a difficulty that needs to be overcome for transfer. The permit may need to be split up into 3
separate permits and then transfer each permit to the applicable HOA.
The recorded deed restrictions are missing some of the permit -required statements. An amendment will need to be
prepared, approved, executed and recorded to add the missing statements.
A sidewalk along one side of Fisherman Creek Drive in Vantage Point has been added without benefit of an approved
permit modification. The built -upon area associated with this sidewalk will need to be accounted for. It may be debited
against the BUA limit assigned to that lot, or it may need to be debited against the BUA limit for all of the lots in
Vantage Point.
The 2 curb outlet swales on Lounsberry Court in Pepper Tree are overgrown with trees, bushes and vegetation and
appear to have sideslopes that exceed the 5:1 maximum allowed.
The curb outlet swale located between Lots 2 and 3 in Wesssex could not be evaluated for compliance due to the large
amount of overgrown vegetation.
The permittee has dissolved their corporation and conveyed the common areas, but did not submit a request to transfer
the permit.

As part of my research for drafting up the letter that will be sent to Mr. Harris, I discovered 2 things
that might help Ms. Hixon with her BUA situation. Vantage Point was recorded with one less lot than
was permitted, which frees up a minimum of 6400 sf of BUA, and the recorded BUA limit for all of the
lots is less than the permitted BUA limit, which frees up even more BUA. I estimated that there was
about 40,000 sf of BUA available. This amount assumes that everyone is in compliance with their
BUA limit and that Mr. Harris did not commandeer that 6400 sf BUA for his own lot in Vantage Point.
If Mr. Harris took that 6400 sf when he recombined lots, or if any lots are over, then the amount of
extra BUA available will decrease. This means that there might be some amount of BUA leftover that
Ms. Hixon could have reallocated to her lot by a permit modification, instead of having to borrow
some from a neighbor.
In order to assist Ms. Hixon (and any other lot owners within the Pepper Tree, Wessex and Vantage
Point subdivisions) in utilizing this extra BUA, the three HOA's must first become copermittees of
record by accepting the stormwater permit. Then, the HOA's as copermittees, can request to modify
the permit, or split up the permit, identify those lots that are over the limit or that will need additional
BUA in the future, and reallocate the leftover BUA accordingly.

Thank you for the information, Ms. Hixon.
Ms. Buongiorno, I will be sending you a letter which will present the options for Wessex HOA to
officially take over the administration of the stormwater permit requirements from the original
developer. If you are not the president or vice-president of the association, then the Division would
appreciate it if you would pass on the letter, when you receive it, to the appropriate person. The ARC
is probably already implementing the permit requirements of making sure the lots do not exceed their
maximum BUA limit and that the curb outlet swales remain open and are not piped. A blank
Name/Ownership Change form will be included with that letter, which needs to be completed. If Mr.
Harris is no longer available or refuses to sign the form or if we can't locate him, then the Division will
work with the HOA to resolve any compliance issues. I do not recall seeing any compliance issues,
but an inspection will be done to confirm.
One of the problems that will need to be addressed is the fact that Mr. Harris included Wessex,
Vantage Point and Peppertree under this one permit, SW8 940814. If there are different associations
for each of these subdivisions, we will need to figure out how to split up the permit requirements for
each association. The permit can be structured so that the specific conditions which apply to each
association are clearly spelled out.

explained the permit you referred to is in the name of `Dallas Harris Real Estate Construction, Inc."
and although I did work for that company at the time of the permit I no longer (since April 1997) have
any association with the company.
I did as you requested and returned the package that was forwarded to me back to Dallas Harris
Real Estate Construction, Inc. to the attention of Ed Mitchell. It was returned the day following our
phone conversation that I believe was on February 9a'. It was returned to the same address that was on
your letter. Since the letter was forwarded to me from Mr. Mitchell I am sure the address is still

The report summarizes the findings of a recent inspection of the projects stormwater controls conducted on
January 20, 2000, to determine compliance with Stormwater Permit Number SW8 940814 issued on September

erosion control plan. we find the plan to be acceptable.
Please be advised that a copy of the approved soil erosion
plan and a copy of issued grading permit must be available
at all times at the site -
New Hanover County's Soil Erosion and Sedimentation control
program is performance oriented. Requiring protection of the
natural resources and adjoining properties. If following
the commencement of the project it is determined that the
plan is inadequate to meet the requirements of the New
Hanover County Soil Erosion and Sedimentation Control
ordinance, this office may require revisions in the plan and
its -implementation to insure compliance with the ordinance.
Recognizing the desirability of early coordination of

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection Report".
The report summarizes the findings of a recent inspection of the project's stormwater controls conducted on April
3, 1998 to determine compliance with Stormwater Permit Number SW8 940814 issued on August 12, 1996.
A summary of the findings and comments are noted under Section 6 of the report. Please inform this
Office in writing before May 3, 1998 of the specific actions that will be undertaken and the time frame required
to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement

1. Swale location not per approved plan.
2. Existing swale appears to be less than 100 feet as required by the regulations.
3. Existing swale not at 5:1 as required by the regulations.
B. The use of existing undisturbed, natural drainage areas as part of the stormwater system is being
discussed. The approved plans did not indicate these areas as existing natural drainage.

2. Inspection Date: August 9, 1996
Weather Conditions: Warm, sunny
3. Comparison of Approved plans vs. As -Built: See comments below.
4. Maintenance Problems @Vantage Point/Wessex:
a. The concrete curb cut of the swale at the end of Cotesworth, between Lots 19 and 20, is
severely undercut. The swale itself is not defineable, has not been stabilized with the
seeding mixture specified on the plan and is eroding and filling with silt.
b. The swale between Lots 16 and 17 is also in need of additional stabilization, per the
approved plan.
C. The swale between Lots 2 and 3 needs definition and stabilization.
d. The swale between Lots 31 and 32, on Pier Point Drive is eroding at the bottom of the side
slopes and silting up.
e. As in Snug Harbour I, the concrete flumes shown on the plan have not been constructed,
altering the approved drainage for the project.
5. PE Certification Received? N/A Recorded Deed Restrictions Received? NO
6. Comments:
a. Please vegetate, stabilize, and grade the swales per the approved plans.
b. Either construct the concrete flumes per the plans, or submit revised plans, calculations,
application and $225.00 application fee.

I found the enclosed marked up plan for Pebble Cove in my junk with a note on it to return it to
Phil Tripp, but since Phil is no longer with you, I will return it to you.
Additionally, I have also reviewed an old file that my database indicated had not received a
Certification of Compliance yet- Snug Harbour @Covil Estates. In reviewing the file, I read some of my
letters to you and the last one dated February 10, 1995 indicated that our calculation differences were
ignorable and that the Certification would be forthcoming. Apparently, I got busy and forgot to issue the
Certification, so the project is deemed permitted; however, I would like to go ahead and forward the
permit, for your and Mr. Harris's records. Attached please find the Stormwater Management Permit for
Snug Harbour @Covil Estates. I have added a condition to the O & M Plan concerning the condition of
the swales when they are turned over to the Home Owner's Association.
