Dear Mr. Phillips and Mr. Wojoski,
On behalf of TRI Pointe Homes, we are requesting authorization from the USACE to use NWP 29
for 31 If of temporary stream impacts and 0.039 acres of temporary wetland impacts for
construction of the offsite sewer connection to service the Johnson Pond Subdivision project. We
are also requesting a 401 WQC from NCDWR for the above referenced impacts, as well as a Neuse
River Riparian Buffer Authorization for 3,119 sf of permanent impacts to Neuse River Riparian
Buffers.
The project is ±21.0 acres in size and is located at 6208 Johnson Pond Road in Fuquay-Varina,
Wake County (Latitude: 35.614699°N; Longitude:-78.757759°W). The project is located on the
following three parcels:
Subdivision:
• Wake Co. PIN: 0677280622 - 4.87 ac
• Wake Co. PIN: 0677186533 - 16.03 ac
Offsite Sewer:
• Wake Co. PIN: 0677284996 - 0.22 acres within 8.34 ac parcel
The project is located in the Neuse River basin (HUC: 03020201) and onsite waters drain to
Terrible Creek. The Water Quality Classification for Terrible Creek is B;NSW, and the Stream
Index Number is: 27-43-15-8-(1).
Proposed Proiect
The purpose of the proposed project is to construct a residential townhome subdivision to meet
the demand for residential housing in Fuquay-Varina.
The proposed project consists of the construction of 59 townhome lots/units, internal access
roads, stormwater management and utilities, including an offsite sewer connection and
improvements to an existing walking trail.

The offsite sewer connection is necessary to connect the onsite sewer to the existing Town of
Fuquay-Varina sewer line located on the east side of Johnson Pond Road.
The proposed improvements to the existing walking trail consist of the construction of a section
of greenway trail with elevated boardwalk through the wetlands (Wetland A) and over Stream 2.
The greenway trail and boardwalk will be constructed within an existing unimproved walking trail
with a small pedestrian bridge over Stream 2. The proposed greenway/boardwalk will connect to
the existing unimproved walking trail that extends farther south. The boardwalk will be
constructed through top -down construction, and no equipment will be operated within the
wetlands in order to avoid temporary impacts to the wetland. The boardwalk will span the entirety
of Stream 2, with pilings installed outside of the banks of the stream, thereby avoiding impacts to
Stream 2.
The project will be constructed using traditional commercial construction equipment and
techniques.
Proiect History
The USACE issued a PJD (SAW-2019-00956) for the project site on 1/28/2020. A copy of the
PJD has been provided as an attachment.
All streams depicted on the USGS and Wake County Soil Survey were determined to be present
in the field. Therefore, subjectivity to Neuse River Riparian Buffers was conceded, and a formal
NCDWR Buffer Determination was not requested.
Proposed Impacts
The proposed impacts consist of 31 If of temporary stream impacts and 0.039 acres of temporary
wetland impacts necessary for construction of the sewer connection in order to connect the onsite
sewer to an existing sewer line. Upon completion of construction, the temporary wetland impact
area will be restored to natural grade and seeded with a wetland seed mix to provide temporary
stabilization until natural recruitment permanently revegetates the area. The temporarily
impacted stream channel area will be restored to pre -construction contours and the banks will be
stabilized with biodegradable matting to provide temporary stabilization until natural recruitment
permanently revegetates the stream banks. No matting will be placed on the stream bed.
The entire 30' easement will be mowed and maintained in perpetuity, resulting in 0.039 acres of
permanent wetland conversion impacts.
The establishment of a 30' utility easement for the sewer connection and perpetual
maintenance/mowing of the entire 30' easement will result in permanent impacts to the buffer,
which are an Allowable use.

Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
Proposed impacts have been minimized to those necessary for the sewer crossing to connect the
onsite sewer to the existing sewer line east of Johnson Pond Road. There are no proposed impacts
associated with construction of the townhome development itself.
The sewer crossing has been designed to cross the stream and wetlands perpendicularly to
minimize impacts.
Wetland and stream impacts for the greenway trail have been avoided the use of an elevated
boardwalk through Wetland A and over Stream 2, which will be constructed using top -down
construction to prevent equipment from being operated within the wetlands. Additionally, by
aligning the greenway trail and boardwalk within the existing walking trail, removal of vegetation
to accommodate the trail has been minimized and possibly avoided. In the event that additional
vegetation needs to be cut to accommodate the boardwalk, vegetation will be cut/trimmed by
hand and removed from the wetlands.
Access during construction will occur from uplands. Silt fencing will be installed around all
disturbed areas to prevent loss of sediment into adjacent waters.
Mitigation
The proposed wetland and stream impacts are temporary and permanent wetland conversion
impacts are less than 0.10 acres, and therefore mitigation is not proposed.
Proposed permanent riparian buffer impacts will result from sewer construction, which is an
"Allowable" use and therefore buffer mitigation is not required.
The current request is for 31 If of temporary stream impacts, 0.039 acres of temporary wetland
impacts and 3,119 sf of permanent buffer impacts (see the attached maps and PCN for details).

Entry". The notes specify that WA0565 was determined to be ineligible in 2014; CH 98-0457; WA Co Rpt #540.1; R-2721. WA0565 is not located
within the project boundary and will retain sufficient vegetative screening and will not be impacted by the proposed residential development.

BUFFERS IF THERE IS ANY CONSTRUCTION WITHIN 50 FEET OF THE EDGE OF THE BUFFER. THIS MUST BE DONE PRIOR TO
STARTING ANY CLEARING, AND MUST BE DONE TO OBTAIN A CERTIFICATE OF COMPLIANCE. IF THE DEVELOPER HAS RECEIVED
APPROVAL TO WORK IN THE FIRST 20 FEET OF THE BUFFER, THEN THE LAST 30 FEET BOUNDARY SHALL BE MARKED IN THE
