Salisbury St Raleigh, NC 27604 Raleigh, NC 27604 Reference: Cameron & Associates Tract Buffer Restoration Plan -Tract 1 Vance County, NC Dear Ms. Myott and Mr. Smith: As described in your Notice of Violation (NOV) dated November 7, 2006, personnel from your office inspected a portion of stream channel and adjacent riparian buffer on the referenced property. The NOV details the identification of un-permitted impacts to the existing riparian buffer along an unnamed tributary to Poplar Creek as well as an unnamed tributary to that unnamed tributary. Additionally, an unauthorized stream crossing had been installed. Following this inspection, Soil & Environmental Consultants, PA (S&EC) was engaged by Mr. Keeter to assist in the coordination with your office, the resolution of the violation, and the development of a Buffer Restoration Plan for the aforementioned impacts. On December 6, 2006, personnel from our Design Group visited the site to observe site conditions. While onsite, we observed the characteristics of the site and surrounding area, verified surface and channel flow conditions, evaluated buffer impacts along the reach, and observed existing property boundaries, structures, utilities, and water conveyance structures. In a Notice of Continuing Violation issued on December, 21, 2006, it was noted by DWQ that a stream determination appeal would be granted, however, all required responses (as indicated by the previous NOV) would still be required. An extension was requested by Cameron & Associates. The purpose of this letter is to summarize our findings regarding buffer impacts that have occurred along the subject reach and describe in detail our plan for its restoration. 0 ~~~~`~ F FEB ~ p 2u, ~ I l7EfVR - WATER Ct,-' ~!_ 'API:TLAND,@A+~ASTQR-~"~ `"';.1~,;,i.'+ Site Description The local project site, which consists of approximately 11.3 acres, is located east of the 158 Bypass and north of Interstate 85, in Vance County, NC. One stream exists onsite. One, an unnamed tributary of an unnamed tributary of Poplar Creek (Reach 1), runs generally to the southwest until its confluence with an unnamed tributary of Poplar Creek (Reach 2), which runs from north to south. Reach 2 is not within the property boundary, however, its buffer is. Both streams are currently buffered in their entirety onsite (with the exception of CP&L power easements) at this time. The buffer determination for Reach 1 (above the power easement) is currently being appealed. Based on a conversation onsite with Cyndi Karoly of DWQ on February 8, 2007, the upper portion of Reach 1 will not be addressed in this submittal. Based on site conditions, the buffer determination appeal has been postponed until the growing season. A restoration plan, if required, will be addressed after that time. Onsite Observations From our site observations, approximately 500 feet of Reach 1 has had vegetation removed from Zones 1 and 2. This area totals approximately 1.258 acres of buffer. The impacted buffer areas have been labeled as "Buffer Impact 1" on the enclosed Figure 1. Zones 1 and 2 of the buffer have been labeled on the enclosed site survey (Figure 2). Zone 1 totals approximately 0.806 acres. Zone 2 totals approximately 0.452 acres. Approximately 800 feet of the Reach 2 has had vegetation removed from Zone 2. This area totals approximately 0.308 acres of buffer. The impacted buffer areas have been labeled as "Buffer Impact 2" on the enclosed Figure 1. Zone 2 of the buffer has been labeled on the enclosed site survey (Figure 2). Zone 2 impacts total approximately 0.308 acres. As cited in the NOV, fill material (to include mostly logs and debris) has been placed in the stream channel on Reach 1 in order to construct a temporary crossing for heavy equipment. The location of this stream crossing is labeled as "Temporary Crossing" on the enclosed Figure 1. Representative photographs of the impacted areas are attached as Site Photos 1 through 3. The impacted areas and acreages are shown on the attached site surveys provided by Cawthorne & Associates. Buffer Restoration Plan A planting plan has been developed for the impacted buffer areas. All impacted areas within Zone 1 (approximately 0.806 acres) along the UT of Poplar Creek will be over- planted with native tree and shrub species to include: 2 S ecies Common Name Betula ni ra River Birch Ca inus caroliniana Ironwood Cornus orida Do wood Chionanthus vir inicus Frin etree Fraxinus enns lvanica Green Ash Liriodendron tuli i era Tuli Po lar Platanus occidentalis S camore uercus hellos Willow Oak uercus michauxii Swam Chestnut Oak The majority of the trees shall consist of bareroot seedlings, tublings, or containerized (1 gallon) seedlings (approximately 232 stems) evenly distributed amongst at least three (3) of the species listed above. Twenty (20) percent of trees planted (approximately 58) will be balled and burlapped not less than 1.5-inch to 2-inch caliper nursery stock. Tree and shrub species will be randomly intermixed on roughly a 10 foot by 10 foot spacing to gain the desired density of 320 stems per acre. Impacted areas of Zone 2 (approximately 0.76 acres) of the UT to Polar Creek will be revegetated with grass species only and will remain a maintained lawn, which is an exempt use in Zone 2 according to the Tar-Pamlico Riparian Buffer Rules. Diffuse flow will be maintained into the buffer. S&EC will provide necessary supervision during planting operations to ensure the general intent of the restoration plan is met. Stream Stabilization Plan The section of stream impacted by the unauthorized crossing (approximately 30 feet in length) will be repaired, stabilized and revegetated. Fill material in the stream channel will be removed and transported away from the stream. Stream banks will be graded to a slope of 3:1, covered with erosion control matting, seeded with appropriate erosion control grasses, and over planted with live stakes. Live stakes will consist of one or more of the following species: S ecies Common Name Corms amomum Silk Do wood Salix caroliniana Carolina Willow Salix ni ra Black Willow Sambucus canadensis Elderbe Live stakes will be a minimum of 24 inches in length with a diameter of at least 1/2 of an inch at the base (see Figure 2). Future Monitoring & Maintenance Once restoration plan operations have been completed, we understand that the restored buffer areas are to be monitored for three years, or less if deemed appropriate by NCDENR-DWQ. Monitoring should consist of a qualitative planting survivability evaluation. We recommend these monitoring visits be conducted on an annual basis (during the growing season) after the completion of the planting. A brief letter report and photographs will be provided to NCDENR-DWQ following each monitoring visit or at the end of each monitoring year.
