The need for additional retail space in Holly springs is driven by this rapid growth. This site was initially selected for the accessibility to surrounding roadways both current and future. The owners desired a development that would serve the needs of Holly Springs and surrounding communities and yet have a minimal impact on the environment. The owners have employed a professional design team who has utilized modern design techniques to ensure a minimal impact on the environment throughout the building process and maintenance upon completion. Alternative sites were considered in the service area which consists of the NC 55 corridor in Holly Springs. The requirements for development were: • Adequate access for a regional retail center to serve Holly Springs and surrounding communities. • A site where the required utilities are in place that precludes the need for additional impacts for long utility connections. • Access to the nearby 1-540 corridor which is just north of the adjacent closed landfill site. • To be large enough to accommodate the proposed scope of development. • That could be improved to a marketable state to justify lot prices to keep the lot sizes large. • Improvements would justify a return on investment. • Could be developed with minimal impact on the environment when compared to other sites with comparable hydrogeologic characteristics. Because of the wish of the Springs Investors to sell the property for a development which would be the highest and best use at a fair market price and to create a development that would keep environmental impacts to the property to a minimum the development plan required the creation of lot sizes that would generate revenues to make the land purchase viable. After researching the area it was determined that no other sites met the aforementioned criteria. Page 7A The site selected and property in the surrounding area is shown on Figure 1 below in red along with the streams shown on the Wake County iMaps site. While many of the "blue lines" shown below are not intermittent or perennial streams as defined by either the NCDENR rules or the US Army Corp of Engineers guidelines and as noted by the approved jurisdictional determination on the site they do indicate that all of the property in the area have geology that is eroded and has ephemeral channels, as well as intermittent and perennial streams. These features result in perched water and ephemeral flow immediately following rainfall. As such the Wake County iMaps show a number of features that only flow during rainfall events (See Figure 3 Below). However, the Town of Holly Springs and the NCDOT indicated that the location of the parcel made it conducive to the extension of the Holly Springs Connector Parkway. The majority of the impacts of the project are due to the extension of this roadway which would have occurred at or near these locations whether regardless of the development of the property. Avoidance and minimization has been achieved by moving the Parkway as far south as possible. This reduced the amount of streams impacted by the roadway project. The impacts of the roadway have been reduced by using retaining walls where possible as well as using buried culverts to facilitate pathways for aquatic life. All of the commercial developments and access roadways were placed on high ground where possible and were planned for areas of the site that minimized impacts to jurisdictional streams either for NCDENR rated intermittent or perennial streams or Corp of Engineers rated intermittent or perennial streams. Water quality has been protected by using Best Management Practices as required by the Town of Holly Springs in accordance with the 2007 NC DENR Best Management Practices Manual which is the most recent version. The development is also providing 30 feet buffers on both sides of the intermittent and perennial streams in accordance with the Town of Holly Springs storm water rules. The storm water BMPs will include ponds for nitrogen reduction and stormwater control in accordance with the ordinances of the Town of Holly Springs which are similar to the Neuse River Rules. The following items are required with the first construction drawing submittal associated with this Master Plan: a. This project is located in an area that is subject to the Town's policy on flood studies. The following items are required prior to the construction drawing approval for each phase: a. An Environmental Development Permit will be required b. This project will be required to meet the Town's new TN requirements for stormwater and pay a stormwater fee-in-lieu for any TN reduction requirements not met on the site. The Final Stormwater Management Plan must be approved and stormwater fee-in-lieu paid. 14. The following items have not yet been fully addressed due to difficulty of resolving transportation related issues with NCDOT. The developer has been working with NCDOT for over a year to resolve some of the issues, however they are not resolved as of this date of staff report preparation. Wilson, P.E. of ATC Associates visited the site observed the site and the low lying areas. A determination was made of the wetlands in accordance with the Corps of Engineers (COE) 1986 method. A determination was made of the streams using the North Carolina Division of Water Quality (NCDWQ) stream determination form method. The site is located in the Little Creek watershed in the Haw/Cape Fear River Basin and is not subject to any of North Carolina's stream buffer rules. However, the Town of Holly Springs has a buffer rule which requires a 30 feet buffer on each side of the stream. The site is shown as having streams on both the Wake County Soil Survey and the USGS map (see attached maps). Based on the site investigation there are some wetlands areas on site primarily adjacent to the stream locations and in some areas the only wetland areas will be the stream bank to bank. Because the Town of Holly Springs has a buffer rule which requires a 30 feet buffer on each side of the stream all of the wetlands will be contained within the buffer. See Attached maps for illustration. Based on the preliminary site layout and meetings with you we anticipate the design for the site has employed minimization and avoidance have been employed to limit wetlands impacts to less than 1/2 acre and stream impacts to less than 300 linear feet at the Wetlands Determination - Holly Springs Site Oak Creek/Haw - Cape Fear River Basin - Holly Springs, Wake County, NC July 6, 2007 - Revised March 4, 2008- Page 2 property. Maps with locations of the wetlands and streams based on the site assessment for the proposed project are enclosed with this letter. Based on the proposed development there are two separate projects proposed for the site. The first is a thoroughfare required by the Town of Holly Springs for the site. The second is a multi use development that will include retail and residential projects. We understand from conversations with the Corp of Engineers that because the acreage of impact to wetlands will likely be less than 1/2 acre and stream impacts will be less than 300 feet for both the roadway project and the development project the projects could be permitted by submitting two separate preconstruction notifications under NWP 39. Because the USGS map and the Wake County Soil Survey maps show streams on the site a field visit was performed by Lauren Witherspoon of the NCDENR. Her stream and buffer determination is attached. The site has been surveyed for sign off by the USACOE. Once the delineation is finalized by the USACOE this will be signed off. ATC is also submitting a draft permit for both the thoroughfare project and the development project for the Corp of Engineers comment prior to actual submission.
