Dear Mr. Thornburg:
The Louisiana-Pacific Corporation's Roaring River facility (LP) has discontinued the land application of sludge and would
like to rescind Land Application Permit No. WQ0000461. The facility recently discontinued major manufacturing
operations at the facility and now only applies finishes to strand siding products that are manufactured elsewhere. The
site also chips logs for selling. As a result, the amount of wastewater generated has substantially decreased, and the
facility has discontinued the land application of wastewater biosolids. Based on an April 17, 2019, email communication
from Ms. Poonam Giri, LP understands that before the permit can be rescinded due to the cessation of land application
activities, the permit will first need to be renewed in order to facilitate abandonment of the associated groundwater
monitoring wells. Ms. Giri also allowed an extension to the renewal due date in her April 17, 2020, email.
On behalf of LP, please accept this Land Application permit renewal application package for Permit Number
WQ0000461. LP owns the land application site. The following attachments are being provided with this submittal:

INSTRUCTIONS FOR FORM: RLAP 06-16 & SUPPORTING DOCUMENTATION
Please use the following instructions as a checklist in order to ensure all required items are submitted. Adherence to these
instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of additional
information requested. Failure to submit all of the required items will lead to additional processing and review time for the
permit application. Unless otherwise noted, the Applicant shall submit one original and two conies of the application and
supporting documentation

General — This application is for treatment, storage, transport, and/or land application of Class B residuals (may include residuals that
are generated from a water treatment plant or other type facilities) on the proposed or currently approved land application site(s) under
15A NCAC 02T .1100.
Unless otherwise noted, the Applicant shall submit one original and two copies of the application and supporting documentation listed
below.
A. Residuals Land Application Program (FORM: RLAP 06-16) Application: (All Application Packages):
® Submit the completed and appropriately executed Residuals Land Application Program (FORM: RLAP 06-16) form. Please
do not make any unauthorized content changes to this form. If necessary for clarity or due to space restrictions, attachments to
the application may be made, as long as the attachments are numbered to correspond to the section and item to which they
refer.
® The Applicant's Certification on Page 5 of this form shall be signed in accordance with 15A NCAC 02T .0106(b). An alternate
person may be designated as the signing official if a delegation letter is provided from a person who meets the criteria in 15A
NCAC 02T .0106(b).
❑ If this project is for a modification of an existing permit, submit one copy of the existing permit.
❑ Please submit this application form at least 180 days prior to the expiration date on the existing permit, or 90 days prior to
operation of proposed facility(ies) for application packages involving new or changes to treatment and storage units.
B. Application Fee (New and Major Modification Application Packages)

Quality (NCDEQ).

' - A major modification shall be defined as any permit modification that: increases the generating facility's residuals dry tonnage;
adds additional land application areas not previously approved for that particular program [including transferring of field(s) from
one program to another]; adds additional residuals sources; or includes the addition of new treatment or storage units/processes not
previously permitted. There is no fee for minor modifications to a permit.
C. Cover Letter (All Application Packages)
® List all items included in the application package, as well as a brief description of the requested permitting action.
D. Environmental Assessments (Maybe Required —See 15A NCAC 1C .0300)
❑ Submit a copy of the Findings of No Significant Impact (FONSI) or Environmental Impact Statement (EIS). Also, include
information on any mitigating factor(s) from the Environmental Assessment (EA) that impact the construction of the residuals
treatment and storage facilities. An EA may also be required for private systems if any public funds and/or lands are used for
the construction of the subject facilities.

E. Operation and Maintenance Plan (New and Renewal Application Packages)
❑ For Modification Application, if there are any changes to the existing plan, submit an updated O&M plan.
® Submit the O&M Plan in accordance with 15A NCAC 02T . 1110 and include at a minimum:
® Operational functions; describe the operation of the program to show what operations are necessary for the program to
function and by whom the functions are to be conducted.
® Maintenance schedules; may include equipment calibration, maintenance of signs, etc.
® Safety measures; may include safety training program, manuals, signs, etc.
® Spill response plan; including control, containment, remediation, emergency contact information, etc.
® Inspection plan including the following information;
® Names and titles of personnel responsible for conducting the inspections.
® Frequency and location of inspections, including those to be conducted by the ORC, and procedures to assure that the
selected location(s) and inspection frequency are representative of the residuals management program.
® Detailed description of inspection procedures including record keeping and actions to be taken by the inspector in the event
that noncompliance is observed.
® Sampling and monitoring plan including the following information;
® Names and titles of personnel responsible for conducting the sampling and monitoring.
® Detailed description of monitoring procedures including parameters to be monitored.
® Sampling frequency and procedures to assure that representative samples are being collected. Fluctuation in temperature,
flow, and other operating conditions can affect the quality of the residuals gathered during a particular sampling event. The
sampling plan shall account for any foreseen fluctuations in residuals quality and indicate the most limiting times for
residuals to meet pathogen and vector attraction reduction requirements (e.g. facilities that land apply multiple times per
year but have an annual sampling frequency, may need to sample during winter months when pathogen reduction is most
likely to be negatively affected by cold temperatures.
THE FOLLOWING ADDITIONAL ITEMS (G to M) ARE REQUIRED FOR DEDICATED PROGRAM ONLY.
F. Program Determination
❑ Dedicated residuals land application programs are ones in which land application sites meet the criteria in 15A NCAC 02T
.110202). Specifically, a residuals land application program is designated as dedicated if any of the following are applicable:
❑ Any land application site certified for the residuals land application program that receives residuals at rates or frequencies
greater than agronomic rates.
❑ Any land application site certified for the residuals land application program that is used primarily for residuals disposal,
and agricultural crop production is of secondary importance.
❑ Any land application site certified for the residuals land application program that receives residuals through fixed irrigation
facilities or irrigation facilities fed through a feed supply system.
❑ Please contact the Non -Discharge Permitting Unit if you need any assistance in determining whether your residuals program
falls under the dedicated program definitions.
G. Program Information
Provide an explanation of why a dedicated system is required instead of a conventional non -dedicated system.
❑ Provide an explanation of the dedicated system and its operation.
H. Detailed Site Maps (All New or Modification Application Packages)
❑ Submit three (3) sets of standard size plans and two (2) sets of I V by 17" plans (electronic format is acceptable - Adobe PDF
only). For Modifications, submit plans specific to the modification(s) only.
❑ Plans must include the following minimum items:
❑ A general location map, a vicinity map and a topographic map with contours not exceeding 10 feet or 25% of the total site
relief and showing all facility related structures and fences within the land application area.
❑ The location of all wells (including usage and construction details if available), streams (ephemeral, intermittent, and
perennial), springs, lakes, ponds, and other surface drainage features within 500 feet of the land application site(s).
❑ Delineation of the review and compliance boundaries
❑ Setbacks as required by 15A NCAC 02T .1108
❑ Site property boundaries within 500 feet of all waste treatment, storage, and disposal site(s).
❑ A map showing the entire irrigation area with an overlay of the suitable irrigation area depicted by the soil scientist's
evaluation. The irrigation plans shall show each nozzle/emitter and wetted area (when applicable). Clearly label spray
irrigation zones as they will be operated.
❑ Plans must depict a completed design and not be labeled with preliminary phrases (e.g., FOR REVIEW ONLY, NOT FOR
CONSTRUCTION, etc.) that indicate that they are anything other than final plans. However, the plans may be labeled with
the phrase: FINAL DESIGN - NOT RELEASED FOR CONSTRUCTION

I. Project Evaluation and Receiver Site Management Plan (All New Application Packages or Modifications that include new sites)
❑ Submit a project evaluation and a receiver site management plan (if applicable) with recommendations concerning cover crops
and their ability to accept the proposed application rates.
J. Hydrogeologic Report (All New Application Packages or Modifications involving increasing the total design capacity)
❑ Submit a detailed hydrogeologic evaluation in accordance with 15A NCAC 02T .1104(d)(4) and current Division Policy
available at: http://www.ncwater.org/Rules_ Policies_ and_Regulations/. The document shall be signed, sealed and dated by a
qualified professional.
K. Engineering Design Documents (All New or Modification Application Packages with fixed irrigation facilities or irrigation
facilities fed through fixed supply system)
Submit engineering design documents that have been signed, sealed, and dated by a NC licensed Professional Engineer and/or
Professional Land Surveyor in accordance with 15A NCAC 02T .I 104(d)(2). For Modifications, submit an updated site map
specific to the modification(s) only.
❑ The design documents must include the following minimum items:
❑ Engineering plans for the facility and equipment except those previously permitted unless they are directly tied into the new
units or are critical to the understanding of the complete process;
❑ Specifications describing materials to be used, method of construction, and means for ensuring quality and integrity of the
finished product including leaking testing; and
❑ Engineering calculations including hydraulic and pollutant loading, sizing criteria, hydraulic profile, total dynamic head
curve analysis for each pump, and irrigation design.
❑ Soil mapping units shown on all disposal sites.
L. Water Balance (All New Application Packages or Modifications that include new sites utilizing fixed irrigation facilities or
irrigation facilities fed through fixed supply systems)
❑ Submit a completed and accurate water balance in accordance with 15A NCAC 02T .1104(d)(5) and current Division Policy
available at: http://www.ncwater.org/Rules_ Policies_ and Regulations/.
M. Property Ownership Documentation (All New or Modification Application Packages involving new and/or relocated treatment
or irrigation components)

❑ Legal documentation of ownership (i.e., GIS, deed or article of incorporation), or
❑ Written notarized intent to purchase agreement signed by both parties with a plat or survey map, or
❑ An easement running with the land specifically indicating the intended use of the property and meeting the requirements of
15A NCAC 02L .0107(f), or
❑ A written notarized lease agreement signed by both parties, indicating the intended use of the property, as well as a plat or
survey map.

General — This certification provides detailed information of residuals source generating facility and its residuals quality for land
application, distribution, or disposal in accordance with 15A NCAC 02T .1100. Do not submit this certification for review without
a corresponding application form (FORM: RLAP 11-15, FORM: DCAR 11-15, or FORM: SDR 11-15).
Unless otherwise noted, the Applicant shall submit one original and two copies of the application and supporting documentation listed

application may be made, as long as the attachments are numbered to correspond to the section and item to which they refer.
® For new or renewed permits, submit a separate certification for each source facility.
❑ For modified permits, submit a separate certification for only those facilities that are affected by the proposed modification.
® Complete the residuals source facility summary page. List all new, renewed, or modified facilities.
B. Residuals Source -Generating Facility Information:
® For each source facility, attach the following:
® Vicinity map - A vicinity map that shows the location of the facility and meets all of the criteria in the "Map Guidance for
Residuals Land Application Permits".
® Process flow diagram and/or narrative - A detailed narrative and/or process flow diagram that describes how the residuals
are to be generated, treated, processed, and stored at the facility.
❑ Quantitative justification for residuals production rate - A quantitative justification for the value provided in Item I. 8.
Ensure that the amount of residuals listed is the maximum amount expected to be generated by the facility for the life of
the permit. In addition, ensure that this amount is equivalent to that which is actually to be land applied, distributed,
and/or disposed, including any chemicals, amendments, or other additives that are added to the residuals during
processing.
❑ Sampling plan - A detailed sampling plan for the residuals source -generating facility. Ensure that the plan identifies
sampling points, sampling frequency, sample type, as well as the Division -certified laboratory to be used. In addition,
ensure that the plan details how the facility and/or the residuals are monitored for any applicable pathogen reduction and
vector attraction reduction requirements. Note that all sampling and monitoring must be completed on the residuals as
they are to be land applied, distributed, and/or disposed.

without a corresponding application form (FORM: RLAP 06-16 or FORM: SDR 06-16).

information on both the soil series name and the slope of the soil), the Applicant may determine the representative slope
by using the average slope provided in the County Soil Survey (or equivalent). A soil type with a slope range of 4 - 8%
would have a representative slope of 6%.

Operation and Maintenance Plan
Operational Functions
1. General
The Louisiana Pacific (LP) Land Application program manages and applies the residuals
generated by the LP industrial wastewater treatment plant (WWTP). This facility does not treat
sanitary wastewaters so it is a non-503 process.
The residuals are generated by belt presses in the WWTP and conveyed to the residuals staging
area on the west end of the building. Residuals that cannot be immediately applied due to rain or
equipment malfunction are transported by loader to an on -site, concrete storage pit where the
residuals can be stored until able to be spread. This concrete facility captures all run-off or
stormwater that contacts the residuals. As necessary, the accumulated liquid is transported and
returned to the WWTP lagoon for processing. In the unlikely event that this facility's capacity is
reached, LP has identified several off -site locations that have acceptable storage facilities to
temporarily store residuals. These locations are:

All of these locations are designed as silage facilities and are concrete lined.
Residuals are transported and spread onto agricultural and pasture lands by LP owned and
operated spreader trucks. Residuals are loaded and moved on the LP site by the use of a front
end loader.
Personnel associated with the Land Application program include the ORC, the Back-up ORCs,
and the driver/operators who load and spread the residuals. The ORC and Back-up ORCs are
also driver/operators. All driver/operators are certified North Carolina Land Application or
Residuals Operators. All drivers hold current commercial drivers licenses and meet the DOT
requirements for their positions.

2. Land Application
At the beginning of each shift all land application vehicles are inspected to comply with Federal
Motor Carrier Safety Administration and U.S. Department of Transportation requirements.
Residuals are loaded onto the land application vehicles by the driver/operator using a front
loader. The driver/operator loads the land application vehicle to a level that ensures that no
residuals will spill from the truck or exceed GVWR.
Loaded land application vehicles are weighed on certified scales prior to leaving the site.
Fields selected for applications are buffered by the ORC or Back-up ORC prior to any residuals
being applied using the setback table contained in the permit for the type of residual being
applied.
Residuals are transported to the land application fields and are not applied unless the field has
met the requirements of the permit including those found in section III.9.
Residuals applied do not exceed agronomic rates for the crop being grown and are calculated as
specified in the permit.
The residuals solids % is measured every day that residuals are generated. If the % solids fall
below 15%, application is limited to fields where the slope is 10% or less.
Residuals are not applied during precipitation events (> 0.01"/hr) or within 24 hours of a 0.5" or
greater 24 hour precipitation event. Rain gauges are often placed at specific fields to accurately
assess the precipitation.
On fields where the pH is below 6.0, residuals are not applied unless the landowner can attest
that lime has been applied at recommended rates or that the pH is appropriate for the crop being
grown as indicated by an agronomist.
Land application vehicles are kept as clean as possible of residuals that can collect in the area
near the slinger discharge and the tires.
A copy of the Land Application permit, this O&M plan, and the spill prevention plan are
maintained in all Land Application vehicles at all times.

Maintenance Schedules
Preventive maintenance is performed per manufacturer's recommendations. These
recommendations are translated into PM requests in LP's EAM maintenance system which
generates work orders at the specified frequencies.
Corrective maintenance is performed as necessary and is usually the result of a vehicle
inspection or mechanical failure. The vehicle will be taken out of service until the repairs have
been completed. These repairs are also performed using the EAM maintenance system which
ensures that records of any maintenance are maintained.
The vast majority of maintenance is performed by the LP maintenance organization; however, on
some occasions and outside contractor may have to be utilized. In these cases, records will be
kept of any work performed within the maintenance department.
Safety Measures
Safe operating procedures (SOPS) have been written for the land application program. These
include safe: loading, driving, spreading, and field inspections and are used to train
driver/operators in the proper way to perform these functions safely and efficiently.
At the beginning of each shift, driver/operators perform an inspection of each vehicle that they
will use that shift using a checklist. If any item is found deficient, the vehicle will be taken out
of service and brought to the maintenance shop.
Land application is not performed after dark.
Drivers/operators must maintain valid drivers' licenses as well as DOT health cards to ensure
that they are capable of safely performing their job.
The ORC evaluates how the spreading trucks with enter and leave the fields for spreading. For
those fields where the ORC determines that the visibility of oncoming traffic is compromised,
signs warning oncoming traffic that Trucks Entering Roadway will be posted.
Spill Response Plan
LP has and maintains a spill plan for the Land Application program. A copy of this plan is kept
in each of the Land Application spreader trucks. The plan includes actions to be taken to
contain and clean up any released residuals, notification requirements, both internal and external,
and contact information. This plan is reviewed annually and after any incident where it is
implemented. Any changes or improvements identified will be incorporated into the plan.

Inspection Plan
Land Application of Residual Operators which includes the ORC and the back up ORCs conduct
all inspections.
At the beginning of each shift, driver/operators perform an inspection of each vehicle that they
will use that shift using a checklist. If any item is found deficient, the vehicle will be taken out
of service and brought to the maintenance shop and a work request entered into the EAM system.
Each day that spreading of residuals occurs; the application site and any residual storage facility
in use are inspected by the ORC or a certified North Carolina Land Application of Residual
Operator.
Inspections of storage facilities include verifying that all residuals are contained within the
storage facility and that there are no imminent risk of discharges to the environment.
Inspections of the Land Application site include all buffer setbacks to insure they are compliant
with permit requirements. Entrances and exit areas at all land application sites including the
roadways are inspected to insure they are clear of any residuals. The land application site is
observed to make sure that the land application of residuals is not causing a prolonged nuisance
condition.
The inspector signs the daily land application work sheet after each inspection. Any
noncompliance activity observed by the inspector is recorded in the daily land application work
sheet and signed by the inspector. The ORC and the EHS Manager are notified by the inspector
of any potential noncompliance activity or safety concern. All land application is stopped until
the issue is resolved.
If non-compliance is verified, notification will be made as specified in the permit. This
notification will normally be made by the ESH manager.
Inspection sheets or logs are maintained at the LP site for a minimum of 5 years.
Sampling and Monitoring
There are a number of sampling and analysis activities required by LP's land application permit.
These include residuals sampling, application sites, and groundwater monitoring.
The ORC or back up ORCs are responsible for conducting the sampling and monitoring for
residuals and land application sites.
Residuals are sampled as they are prepared for land application. The sampling location is off the
conveyer belt immediately after the residuals have exited the belt press. In the event wood ash

has been mixed into biological residuals, a sample of the mixture will be taken and analyzed per
section IV condition 2 of the permit.
A wastewater treatment plant operator collects residuals samples twice per shift and analyzes
them for the % solids content. The analyses (4/day) are averaged and the average is used as the
% solids for that day's spreading activities.
Once per permit cycle Residuals generated for land application are analyzed to demonstrate that
they are non -hazardous under the Resource Conservation and Recovery Act. A sample is
collected, processed, and shipped to a North Carolina Certified Laboratory. The sample is
analyzed for hazardous characteristics and Toxicity Characteristic Leaching Procedure (TCLP)
parameters as defined in section IV condition 3 of the permit.
Metals and Nutrients samples are collected, processed, and shipped to a North Carolina Certified
Laboratory every 60 days. Parameters for Metals and Nutrients include those defined in
condition IV section 2 of the permit.
Groundwater monitoring is performed three times per year as specified in the permit. Samples
may be taken by a number of different personnel and include the ESH Manager, the Plant
Environmental Manager, the ORC or back-up ORC, or an outside contractor may be hired to
perform this sampling. Whoever performs the sampling, the LP groundwater sampling
procedure will be utilized to ensure that valid samples are collected and proper sampling
protocols are followed.
Groundwater wells are monitored and sampled in March, July, and November. They include
GMW 3, GMW 5, and GMW 6. Samples will be analyzed as specified in Attachment C to LP's
permit.
Currently, NCDENR is performing an investigation on the LP Field 25 site which includes the
LP monitoring wells. In the event that NC DENR samples these wells at the same time that LP
is required to, LP may choose to split the samples with DENR. NC DENR personnel will follow
their approved sampling procedures.
As specified by Section IV condition 5 of LP's permit, soil analyses are conducted for each land
application site that residuals were applied on in the respective calendar year. Sampling protocol
varies depending upon the crop being grown on the field. Core sample locations are spread out
over a given field to provide a representative field soil sample. Sample core depth is determined
by crop. 8 inch depth for row crop and a 4 inch depth for perennial pasture or turf crops. Every
soil sample consists of 15 to 20 cores mixed together and a composite sample taken and placed
in a box provided by the NCDA & CS Agronomic Division, Soil Testing Section. Each Soil
analysis is shipped to the NCDA & CS Agronomic Division, Soil Test Section, 4300 Reedy
Road, NC 27607-6465.
All monitoring results are maintained for a minimum of five years per the permit.

In accordance with your perinit renewal request received April 23, 2015, we are forwarding
herewith Permit No. WQ0000461 dated September 11, 2015, to the Louisiana Pacific Corporation for the
continued operation of the subject residuals management program. Please note that this renewed permit
shall become effective on November 1, 2015 (i.e. the day after the expiration date of the existing permit),
which differs fi-om the date of this letter.
It is the understanding of the Division that the Permittee will apply the Class A residuals on their
own property and also on the properties of others. Although residuals are not currently distributed to other
parties for applications by such parties (i.e., in a bagged or bulk form), the Permittee wishes to retain this
option.
Modifications to the subject permit are as follows: Sampling and monitoring requirements for
verifying compliance with pathogen reduction and vector attraction reduction requirements have been
removed from the permit, as the Permittee has demonstrated to the satisfaction of the Division that the
residuals and processes do not contain or produce pathogens. The frequency of groundwater monitoring
has been reduced to once a year (September) for all parameters (see Attachment Q. Groundwater
monitoring for Volatile Compounds (PCS code 78732) has been changed to Volatile Compounds (PCS
code GWVOC). The description of the product has been expanded to include the occasional addition of
small amounts of wood -fired boiler ash and/or unprocessed sawdust,

has the right to request an adjudicatory hearing upon written request within 30 days following receipt of
this permit. This request shall be in the form of a written petition, conforming to Chapter 150E of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail
Service Center, Raleigh, NC 27699-6714. Unless such demands are made, this permit shall be final and
binding.

residuals, occasionally combined with small amounts of wood -fired boiler ash and/or unprocessed
sawdust, generated by the approved facilities listed in Attachment A with no discharge of wastes to
surface waters, pursuant to the application received April 23, 2015, and in conformity with other
supporting data subsequently filed and approved by the Department of Environment and Natural
Resources and considered a part of this permit. The use and disposal of residuals are regulated under Title
40 Code of Federal Regulations Part 257.This permit does not exempt the Pennittee from complying with
the federal regulations.
This permit shall be effective from November 1, 2015 until October 31, 2020, shall void Permit No.
WQ0000461 issued December 21, 2011, and shall be subject to the following specified conditions and
limitations:
No later than six months prior to the expiration of this permit, the Penuittee shall request renewal of
this permit on official Division forms. Upon receipt of the request, the Division will review the
adequacy of the facilities described therein, and if warranted, will renew the permit for such period of
time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A
NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal

The subject residuals management program shall be effectively maintained and operated at all tunes
so there is no discharge to surface waters, nor any contravention of groundwater or surface water
standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance
conditions due to improper operation and maintenance, the Permittee shall immediately cease land
applying residuals to the site or the distribution of residuals, contact the Winston-Salem regional
office supervisor, and take any immediate corrective actions. [G.S. 143-215.1]
2. This permit shall not relieve the Permittee of responsibility for damages to groundwater or surface
water resulting from the operation of this residuals management program. [15A NCAC 02B .0200,

3. All wells constructed for purposes of groundwater monitoring shall be constructed in accordance with
15A NCAC 02C .0108 (Standards of Construction for Wells Other than Water Supply), and any other

4. Only residuals generated by the facilities listed in Attachment A are approved for land application or

9. Land application areas shall be clearly marked on each site prior to and during any residuals
application event. [15A NCAC 02T .0108(b)(1)]
10. Bulk residuals and other sources of Plant Available Nitrogen (PAN) shall not be applied in
exceedance of agronomic rates. Appropriate agronomic rates shall be calculated using expected
nitrogen requirements based on the determined Realistic Yield Expectations (RYE) using any of the
following methods:
a. Division's pre -approved site specific historical data for specific crop or soil types by calculating
the mean of the best three yields of the last five consecutive crop harvests for each field.
b. North Carolina Historical Data for specific crop and soil types as provided by North Carolina
State University Department of Soil Science (httu://nutrients.soil.ncsu.edu/yields/index.php).
A copy shall be kept on file and reprinted every five years in accordance with Condition IVA.
c. If the RYE cannot be determined using methods (a) or (b) above, the Permittee may use the RYE
and appropriate nutrient application rates reported in any of the following documents:
i. Crop management plan as outlined by the local Cooperative Extension Office, the North
Carolina Department of Agriculture and Consumer Services, the Natural Resource
Conservation Service, or other agronomist.
ii. Waste Utilization Plan as outlined by the Senate Bill 1217 Interagency Group - Guidance
Document: Chapter 1

iii. Certified Nutrient Management Plan as outlined by the Natural Resources Conservation
Services (NRCS). These plans must meet the USDA-NRCS 590 Nutrient Management
Standards (ftp://ftp-fc.se.egov.usda.gov/NHQ/practice-standards/standards/590.pdf).
d. If the RYE and appropriate nutrient application rates cannot be determined, the Permittee shall
contact the Division to determine necessary action.

11. When residuals are land applied to grazed pasture, hay crop realistic nitrogen rate shall be reduced by
25% in accordance with the USDA-NRCS 590 Nutrient Management Standards. [15A NCAC 02T
.0108(b)(1)]
12. If land application sites are to be over -seeded or double -cropped (e.g., bermuda grass in the summer
and rye grass in the winter with both crops to receive residuals), then the second crop can receive an
application of PAN at a rate not to exceed 50 pounds per acre per year (lbs/ac/yr). This practice may
be allowed as long as the second crop is to be harvested or grazed. If the second crop is to be planted
for erosion control only and is to be tilled into the soil, then no additional PAN shall be applied. [15A
NCAC 02T .0108(b)(1)]
13. Prior to land application of residuals containing a sodium adsorption ratio (SAR) of 10 or higher, the
Permittee shall obtain and implement recommendations from at least one of the following: the local
Cooperative Extension Office; the Department of Agriculture and Consumer Services; the Natural
Resource Conservation Service; a North Carolina Licensed Soil Scientist; or an agronomist. The
recommendations shall address the sodium application rate, soil amendments (e.g., gypsum, etc.), or a
mechanism for maintaining site integrity and conditions conducive to crop growth. The Permittee
shall maintain written records of these recommendations and details of their implementation. [15A

14. The Permittee shall not distribute Class A Industrial Wastewater Treatment Plant residuals that have a
sodium adsorption ratio (SAR) of 10 or higher without prior written Division approval. The
Permittee may seek approval by demonstrating that the entity accepting the residuals is: aware of the
effects of a high SAR content; has agreed on proper residual application rates; and has agreed to
operational considerations to ensure that the high SAR content will not adversely impact the receiving
sites. Recommendations regarding sodium application rate, soil amendments (e.g., gypsum, etc.) or a
mechanism for maintaining site integrity and conditions conducive to crop growth, can be obtained
from the local Cooperative Extension Office, the Department of Agriculture and Consumer Services,
the Natural Resource Conservation Service, a North Carolina Licensed Soil Scientist, or an
agronomist. [15A NCAC 02T .0108(b)(1)]
15. These residuals land application sites were individually permitted on or after December 30, 1983;
therefore, the compliance boundary is established at either 250 feet from the residual land application
area, or 50 feet within the property boundary, whichever is closest to the residual land application
area. An exceedance of groundwater standards at or beyond the compliance boundary is subject to
remediation action according to 15A NCAC 02L .0106(d) (2) as well as enforcement actions in
accordance with North Carolina General Statute 143-215.6A through 143-215.6C. Any approved
relocation of the COMPLIANCE BOUNDARY will be noted in a modified permit. [15A NCAC 02L
.0107(a)]
16. The review boundary shall be established midway between the compliance boundary and the residual
land application area. Any exceedance of groundwater standards at the review boundary shall require
action in accordance with 15A NCAC 02L .0106. [15A NCAC 02L .0108]
M. OPERATION AND MAINTENANCE REQUIREMENTS
The residuals management program shall be properly, maintained and operated at all times. The
program shall be effectively maintained and operated as a non -discharge system to prevent any
contravention of surface water or groundwater standards. [15A NCAC 02T .1110]
2. The Permittee shall maintain an approved Operation and Maintenance Plan (O&M Plan)
Modifications to the O&M Plan shall be approved by the Division prior to utilization of the new plan.
The O&M Plan, at minimum; shall include:
a. Operational functions;

b. Maintenance schedules;
c. Safety measures;
d. Spill response plan;
e. Inspection plan including the following information:
i. Names and/or titles of personnel responsible for conducting the inspections;
ii. Frequency and location of inspections, including those to be conducted by the ORC, and
procedures to assure that the selected location(s) and inspection frequency are representative
of the residuals management program;
iii. Detailed description of inspection procedures including record keeping and actions to be
taken by the inspector in the event that noncompliance is observed pursuant to the
noncompliance notification requirements under the monitoring and reporting section of the
perinit;
£ Sampling and monitoring plan including the following information:
i. Names and/or titles of personnel responsible for conducting the sampling and monitoring;
ii. Detailed description of monitoring procedures including parameters to be monitored;
iii. Sampling frequency and procedures to assure that representative samples are being collected.
Fluctuation in temperature, flow, and other operating conditions can affect the quality of the
residuals gathered during a particular sampling event.

3. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC)
classification of the facility, tine Permittee shall designate and employ a certified operator in
responsible charge (ORC) and one or more certified operators as back-up ORCs in accordance with
15A NCAC 08G .0201. The ORC or his back-up shall visit the facilities in accordance with 15A
NCAC 08G. 0204, or as specified in the most recently approved O&M plan (i.e., see Condition
III.2.), and shall comply with all other conditions of 15A NCAC 08G. 0204. For more information
regarding classification and designation requirements, please contact the Division of Water
Resources' Protection and Enforcement Branch at (919) 707-9105. [15A NCAC 02T .0117]
4. When the Permittee land applies bulk residuals, a copy of this permit and a copy of O&M Plan shall
be maintained at the land application sites during land application activities. [15A NCAC 02T
.0108(b)(1)]
When the Permittee transports or land applies bulk residuals, the spill control provisions shall be
maintained in all residuals transport and application vehicles. [15A NCAC 02T .1110]
6. Bulk residuals shall not be stored for more than 30 days at any land application site, unless written
approval has been requested and received fi-on the Division. All residuals shall be adequately stored
to prevent leachate runoff until distributed or land applied. The finished product may be placed on a
concrete or lined pad, placed under shelter, or covered until such time as it is distributed. [G.S. 143-
215.1]
7. When the Permittee land applies bulk residuals, adequate measures shall be taken to prevent wind
erosion and surface runoff from conveying residuals from the land application sites onto adjacent
properties or into surface waters. [G.S. 143-215.1]
8. When the Permittee land applies bulk residuals, a suitable vegetative cover shall be maintained on
land application sites onto which residuals are applied, or application shall be in accordance with the
crop management plan outlined by the local Cooperative Extension Office, the Department of
Agriculture and Consumer Services, the Natural Resource Conservation Service, or an agronomist
and as approved by the Division. [15A NCAC 02T .1109(b)(1)]

9. Bulk residuals shall not be land applied under the following conditions:
a. If the residuals are likely to adversely affect a threatened or endangered species listed under
section 4 of the Endangered Species Act or its designated critical habitat;
b. If the application causes prolonged nuisance conditions;
c. If the land fails to assimilate the bulk residuals or the application causes the contravention of
surface water or groundwater standards;
d. If the land is flooded, frozen or snow-covered, or is otherwise in a condition such that runoff of
the residuals would occur;
e. Within the 100-year flood elevation, unless the bulk residuals are injected or incorporated within
a 24-hour period following a residuals land application event;
f. During a measurable precipitation event (i.e., greater than 0.01 inch per hour), or within 24 hours
following a rainfall event of 0.5 inches or greater in a 24-hour period;
g. If the slope is greater than 10% for surface applied liquid residuals, or if the slope is greater than
18% for injected or incorporated bulk liquid residuals;
h. If the soil pH is not maintained at 6.0 or greater, unless sufficient amounts of lime are applied to
achieve a final soil pH of at least 6.0, or if an agronomist provides information indicating that the
pH of the soil, residuals and lime mixture is suitable for the specified crop. Any approved
variations to the acceptable soil pH (6.0) will be noted in this permit;
i. If the land does not have an established vegetative cover unless the residuals are incorporated or
injected within a 24-hour period following a residuals land application event. Any field that is in
a USDA no -till program shall be exempted from meeting this vegetative cover requirement;
j. If the vertical separation between the seasonal high water table and the depth of residuals
application is less than one foot;
k. If the vertical separation of bedrock and the depth of residuals application is less than one foot;
1. Application exceeds agronomic rates.

10. A Utilization Agreement between the Permittee and the entity agreeing to accept and distribute Class
A bulls residuals shall be in place prior to distribution of the bulk residuals. The agreement shall
specify the agreeing entity's responsibilities. The. Pennittee or his designee and the person
responsible for application of the residuals shall sign the Utilization Agreement, which shall be
considered expired concurrent with the permit expiration date, and shall be renewed during the permit
renewal process. [15A NCAC 02T .0108(b)(1), 02T 1104]
11. At a minimum, the Utilization Agreement shall stipulate the following:
a. By agreeing to accept the bull,, Class A residuals, it is recognized that the application of these
residuals is allowed under the conditions of this agreement. Land application of Class A residuals
is considered the beneficial reuse of a waste under 15A NCAC 02T .1100, and has been deemed
permitted under 15A NCAC 02T .1103(4) provided the conditions of this agreement are met. Any
action resulting in damages to surface'water or groundwater, caused by failure to follow the
conditions of this agreement, is subject to Division enforcement action;
b. The person or entity accepting the bulk Class A residuals shall to the best of his knowledge meet
the following application requirements:
i. List all prohibitions under Condition 111.9 with a statement that bulk residuals shall not be
land applied under these conditions.
ii. Industrial Wastewater Treatment Plant Residuals shall not be stockpiled for more than 30
days prior to land application;

iii. Application of bulk residuals shall not occur within 100 feet of a public or private water
supply source;
iv. Application of bull: residuals shall not occur within 100 feet of any well, with the exception
of Division approved monitoring wells;
- - v_ Application of bulk residuals shall not occur within 25 feet of surface waters.
c. The generator of the Class A bulk residuals shall provide information on the proper use of the
residuals, including information on the nutrient quantities within the residuals and recommended
application rates. A copy of the label or information sheet attached to bags or other containers, as
specified in the labeling requirements tinder Condition III.15, is sufficient;
d. The applicator or party accepting bulk residuals from the Permittee shall supply all third parties
receiving bulk residuals with documentation specifying that application shall occur consistent
with the utilization agreement;
e. Instructions, including contact information for key personnel, shall be provided to the applicator
or party receiving bulk residuals in the event that any requirements specified in the utilization
agreement are not met.
f. A copy of the Utilization Agreement shall be maintained at the land application sites when bulk
residuals are being applied.

12. All residuals shall be adequately stored to prevent untreated leachate runoff. The finished product
may be placed on a concrete pad, placed under shelter or physically covered until it is distributed to
the buyer. If an alternate storage site is used, approval must be obtained from the Division. [15A
NCAC 02T .0108(b)(1)]
13. A label shall be affixed to the bag or other container in which residuals are sold or given away for
land application, or an information sheet shall be provided to the person who receives Class A
residuals. At a minimum, the label or information sheet shall contain the following:
a. The name and address of the person who prepared the residuals;
b. A statement that residual land application is prohibited except in accordance with the instructions
on the label or information sheet;
c. A statement identifying that this material shall be prevented from entering any public or private
water supply source (including wells) and any surface water (e.g., stream, lake, river, wetland,
etc.);
d. A statement that the residuals shall be applied at agronomic rates and recommended rates for its
intended use.

14. The Permittee shall not distribute bulk residuals to any person or entity known to be applying
residuals contrary to the condition of the signed Utilization Agreement. [15A NCAC 02T .1103(a)]

1. Any Division required monitoring (including groundwater, plant tissue, soil and surface water
analyses) necessary to ensure groundwater and surface water protection shall be established, and an
acceptable sample reporting schedule shall be followed. [15A NCAC 02T .0108(c)]

2. Residuals shall be analyzed to demonstrate they are non -hazardous under the Resource Conservation
and Recovery Act (RCRA). Residuals that tests or is classified as a hazardous or toxic waste
-under 40 CFR Part 261 shall not be used or disposed under this permit. The analyses
[corrosivity, ignitability, reactivity, and toxicity characteristic leaching procedure (TCLP)] shall
be perfonned at the frequency specified in Attachment A, and the Permittee shall maintain these
results for a minimum of five years. Any exceptions from the requirements in this condition shall be
specified in Attachment A.

4. An annual representative soils analysis (i.e., Standard Soil Fertility Analysis) shall be conducted on
each LP -owned land application site (or included area) on which a residuals land application event
will occur in the respective calendar year. This analysis shall be in accordance with the "Guidance on
Soil Sampling" located in the Sampling Instructions section of the NC Department of Agriculture &
Consumer Services' website(lnttp://www.ncagr.gov/agronomi/pubs.htm). The Permittee shall
- maintain these results and a description of the sampling methodologies used to determine soil fertility
for a period of no less than five years, and shall be made available to the Division upon request. At a
minimum, the Standard Soil Fertility Analysis shall include the following parameters:

7. Two copies of the monitoring well sampling and analysis results shall be submitted on a Compliance
Monitoring Form (GW-59), along with attached copies of laboratory analyses, on or before the last
working day of the month following the sampling month. The Compliance Monitoring Form (GW-
59) shall include this permit number, the appropriate well identification number, and one GW-59a
certification form shall be submitted with each set of sampling results. All information shall be

8. The Permittee shall maintain records tracking all bulk residual distribution or land application events
performed by the Permittee. At a minimum, these records shall include the following:
a. Source of residuals;
b. Date of distribution/land application;
c. Name and address of recipient of residuals;
d. Volume of residuals distributed to each recipient;
e. Intended use of residuals;
f. If land application events performed by the Permittee - Nitrogen Application Rate based on
RYEs (if using data obtained from the North Carolina State University Department of Soil
Science Website, the printout page shall be kept on file and reprinted every five years).

Three copies of an annual report shall be submitted on or before March I". The annual report shall
meet the requirements described in the Instructions for Residuals Application Annual Reporting

10. Noncompliance Notification
The Permittee shall report by telephone to the Winston-Salem Regional Office, telephone number
(336) 776-9800, as soon as possible, but in no case more than 24 hours or on the next working day
following the occurrence or first knowledge of the occurrence of any of the following:
a. Land application or distribution of residuals abnormal in quantity or characteristic.
b. Any failure of the land application or distribution program resulting in a release of material to
surface waters.
c. Any time self -monitoring indicates the facility has gone out of compliance with its permit
limitations.
d. Any process unit failure, due to known or unknown reasons, rendering the facility incapable of
adequate residual treatment.
e. Any spill or discharge from a vehicle or piping system during residuals transportation.
Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of
a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency
Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300.Persons
reporting such occurrences by telephone shall also file a written report in letter form within five days
following first knowledge of the occurrence. This report shall outline the actions taken or proposed to
betaken to ensure that the problem does not recur. [15A NCAC 02T .0105(1), 02T .0108(b) (1)]
V. INSPECTIONS
1. The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the
subject facilities and shall be in accordance with the approved O&M Plan. [15A NCAC 02T
.0108(b)]
2. Prior to each bulk residuals land application or distribution event, the Pennittee or his designee shall
inspect the residuals transport and application facilities to prevent malfunctions,facility' deterioration
and operator errors resulting in discharges, which may cause the release of wastes to the
environment, a threat to human health or a public nuisance. The Permittee shall maintain an
inspection log that includes, at a minimum, the date and time of inspection, observations made, and
any maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log
for a period of five years from the date of inspection, and this log shall be made available to the
Division upon request. [15A NCAC 02T .0108(b)]

3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect
any property, premises or place on or related to the land application sites or facilities permitted herein
at any reasonable time for the purpose of determining compliance with this permit; may inspect or
copy any records required to be maintained under the terms and conditions of this permit; and may
collect groundwater, surface water or leachate samples. [G.S. 143-2153(a)(2)]
1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to
an enforcement action by the Division in accordance with North Carolina General Statutes 143-
215.6A to 143-215.6C. [G.S. 143-215.6A to 143-215.6C]
This permit shall become voidable if the residuals land application events are not carried out in
accordance with the conditions of this permit. [15A NCAC 02T .0110]
This permit is effective only with respect to the nature and volume of residuals described in the
permit application and other supporting documentation. [G.S. 143-215.1]
4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies
(e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules
in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4
and under the Division's General Permit NCGO10000; any requirements pertaining to wetlands under
15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of
Chapter 143 of the General Statutes. [15A NCAC 02T .0105(c)(6)]
In the event the residuals program changes ownership or the Permittee changes his name, a formal
permit modification request shall be submitted to the Division. This request shall be made on official
Division forms, and shall include appropriate documentation from the parties involved and other
supporting documentation as necessary. The Permittee of record shall remain frilly responsible for
maintaining and operating the residuals program permitted herein until a permit is issued to the new
owner. [15A NCAC 02T .0104]
6. This permit is subject to revocation or unilateral modification upon 60 days notice from the Division
Director, in whole or part for the requirements listed in 15A NCAC 02T .0110. [15A NCAC 02T
.0110]
7. Unless the Division Director grants a variance, expansion of the permitted residuals program
contained herein shall not be granted if the Permittee exemplifies any of the criteria in 15A NCAC
02T .0120(b). [15A NCAC 02T .0120]
8. The Permittee shall pay the annual fee within 30 days after being billed by the Division. Failure to
pay the annual fee accordingly shall be cause for the Division to revoke this permit. [15A NCAC 02T

1. Annual monitoring shall be conducted every September.
2. The measurement of water levels shall be made prior to purging the wells. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measurement
of pH shall be made after purging and prior to sampling for the remaining parameters.

of casing) of all monitoring wells shall be surveyed relative to a common datum.
4. Volatile Organic Compounds (VOC) - Analyze by one of the following methods:
a. Standard Method 6230D, PQL at 0.5 µg/L or less
b. Standard Method 621 OD, PQL at 0.5 µg/L or less
c. EPA Method 8021, Low Concentration, PQL at 0.5 µg/L or less
d. EPA Method 8260, Low Concentration, PQL at 0.5 µg/L or less
e. Another method with prior approval by the Water Quality Permitting Section Chief
Any method used must meet the following qualifications:
a. A laboratory must be DWQ certified to run any method used.
b. The method used must, at a minimum; include all the constituents listed in Table VIII of Standard Method 6230D.
c. The method used must provide a PQL of 0.5 µg/L or less that must be supported by laboratory proficiency studies as required by the DWQ Laboratory Certification Unit. Any constituents
detected above the MDL but below the PQL of 0.5 µg/L must be qualified (estimated) and reported.
5. If any volatile organic compounds (VOC) are detected as a result of monitoring as provided in Attachment C, then the Winston-Salem Regional Office supervisor, telephone number (336) 776-
9800, must be contacted immediately for further instructions regarding any additional follow-up analyses required.
6. Where naturally occurring substances exceed the established standard, the Permittee shall submit supporting data and an Attachment C modification request to the Winston-Salem Regional
Office so that the naturally occurring concentration can be determined and the standard for the parameter can be adjusted in accordance with 15A NCAC 02L .0202(b)(3).
7. Monitoring wells shall be reported consistent with the nomenclature and location information provided in Figure 2 and this attachment.
