The North Carolina Department of Transportation (NCDOT) proposes to construct a four-lane median divided freeway with full control access, on new location to serve as a US 421INC 87 bypass of Sanford, North Carolina. The purpose of this submittal is to request another modification to the Section 404 permit and Section 401 Water Quality Certification for R-2417C. Please see the enclosed copies of the revised permit drawing sheets 20 - 23 of 31, revised summary tables (revised permit drawing sheets 4-8 of 31), and a copy of the EEP letter for the above-referenced project. The revised design does not compromise NCDOT's compliance with the existing permit conditions. The revision has been evaluated for compliance with the avoidance/minimization criteria and is in compliance with all previous issues, including the following: °. SUITE 116 RALEIGH NC 27604 Site 5 Station 87+90(LT/RT) The nylon net matting has been removed from the channel Although the pipe was initially installed properly at the correct invert of 1 foot below stream bed level subsequent work for grading and stabilization along the bank and in the channel by the subcontractor caused the pipe to become perched Additional grading work by the subcontractor has also impacted the stream from the permitted areas at both ends of the pipe out to the right of way limits (both ends) NCDOT has tentatively proposed that a series of log cross veins be installed to restore the proper invert of one foot below bed level by using the logs as grade control devices to raise the stream bed and then to gradually lower it back to the natural level as the cross veins progress downstream by lowering each subsequent vein by 8 inches It is possible that the depth to rock at this location may make this repair impractical As was /' /discussed during a phone conversation between Art King Division 8 DEO and Mason Herndon DWQ we may need to revisit this site at a future date after we have had a chance to observe the effects of flow through the site As you are aware this channel has intermittent flow limited primarily to rainfall events The actions above will cause an additional 50 feet of temporary stream impacts at Site 5 (30 feet upstream, and 20 feet downstream) to cover the areas impacted between the temporarily impacted area denoted in the plans on both ends of the pipe out to the right of way limits Site 6 Station 120+20(LT) and 120+57(LT/RT) An approved temporary stream crossing plan drawing was included in the construction plans (Sheet EC 2D) This plan is suitable for a crossing that does not require that flow be maintained by simply removing the pipe This plan was not followed by the contractor at this location Instead an earthen dike without a fabric liner was placed in the dewatered stream channel between the diversion device and the upstream end of the newly constructed culvert by the contractor This area was used as a crossing point to move equipment around the culvert during construction We acknowledge that the crossing was improperly installed and has impacted the existing stream channel The actions above will be an additional 30 feet of temporary stream impacts The earthen dike will be removed and the channel will be restored to its original contours re vegetated and allowed to stabilize before the stream is turned into the new culvert Site 9 Station 178+82(RT) Approximately 10 feet of the original stream channel was filled with an earthen dike by the contractor as a means to move his equipment around the culvert structure The actions above will be an additional 10 feet of temporary stream impacts The earthen dike will be removed and the channel will be restored to its original contours re vegetated and allowed to stabilize before the stream is turned into the new culvert There will be a total of 90 additional feet of temporary stream impacts from this permit modification 2 Changes in impacts are due to the proposed service road extension since the permit modification issued March 25, 2009 (see enclosed revised permit drawings). The proposed service road is to be extended from permit drawing sheet 20 of 31 (cul-de-sac in March 25, 2009 permit modification) and end at revised permit drawing sheet 22 of 31 near the pond at Site 10. The reason for the service road extension is to provide access to a large parcel of land (Thomas property) as a result of recent right-of-way negotiations. Changes in impacts occur at Site 9 resulting in an increase of 0.04 acres of permanent wetland (riparian) fill (totaling 0.15 acres) compared to the permit modification issued March 25, 2009 (0.11 acres). Please refer to the enclosed revised summary tables for details. EEP commits to implement sufficient compensatory riparian wetland mitigation in the appropriate cataloging unit in the amount listed in the above table to offset the impacts associated with this project by the end of the MOA year in which this project is permitted.
