LLC, c/o William Cameron, & City of Wilmington, 1201 Glen Meade Rd., Wilmington, NC 28401, Authorizing development in New Hanover County at adj. Burnt Mill Creek, 2200 JR Kennedy Rd.. Wilmington , as requested in the permittee's application dated 11/19/09 (MP-1, MP-3L and 12/7/09 (MP-2), including the attached drawings (5), S1.0, S2.0, S2.1 S3.0, and CIA all dated 11/9/09 This permit, issued on January 6, 2010 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Berm Rehabilitation 1) Unless specifically altered herein, this permit authorizes the repair of a breached berm, including but not limited to the construction of a vertical sheet pile wall and the placement of fill material, all as depicted in the attached permit application and workplan drawings. Any additional development activities associated with this project may require additional authorization. Contact a Division representative at (910) 796-7215 prior to the initiation of any such activities to determine additional permit requirements. 2) The authorized sheet pile wall shall adhere to the alignment depicted on the attached workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 25, 2014 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Cameron Properties LLC/City of Wilmington Permit #02-10 Page 2 of 3 ADDITIONAL CONDITIONS 3) The alignment of the authorized sheet pile wall shall be staked by the permittee and approved on site by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 4) The sheet pile wall shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by Division personnel. No excavation is permitted except for that which may be required for the construction of the sheet pile wall, deadmen cables, etc. 5) No vegetated wetlands shall be excavated or filled, even temporarily. 6) No fill material shall be placed at any time in any open water areas outside of the fill area indicated on the attached workplan drawing(s). 7) The fill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the sheet pile cap immediately following completion of backfilling activities. 10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3687 (DWQ Project No. 091302), which was issued on January 6, 2010. No. SAW-2008-00713) which was issued on 12/16/09.
