4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The Ward Mill Dam Removal Project site is located at 443 Old Watauga River Road, Watauga County near Sugar Grove. The project site includes two jurisdictional streams, Watauga
River and UT1. Watauga River has been historically dammed to generate power and has been in place in one form or another since the late 1890's. The dam's generation facilities
were decommissioned in 2017 as part of forfeiture of the FERC license. There is moderate sediment build up behind the dam. The river is in a confined valley with large colluvial
materials in the stream channel and flood prone area. The owners have indicated that the impoundment scours doom to rock after large flood events. The Land uses surrounding the
project area includes forest and residential.

4h. Explain the purpose of the proposed project:*
The purpose of the project is to remove Ward Mill Dam, a concrete and rock dam structure, on the Watauga River. It is estimated the dam removal will reconnect >100 miles of stream.
The project Will include stabilization of the left floodplain and mill structure, as well as streambank restoration activities as necessary in the vicinity of the dam where sediment has built
up behind the structure. Restoration of river continuity, organism passage, natural sediment movement and habitat redevelopment are anticipated outcomes.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The project approach proposed is to drawing down water behind the dam several weeks prior to mobilization for dam removal. This will facilitate access by dam removal equipment. Two
to three large track hoes with either hammer or bucket and hydraulic thumb attachments will be used to conduct the removal. The dam removal will be the first phase of a two-phase
project approach. During this first phase, the dam Will be deconstructed from the top down. Dam materials will be used to buttress the Mill structure and left floodprone area. Concrete
and other unnatural material will be buried below more natural or native materials. Floodplain sills and a single arm vane may be used to guide the reestablishing channel away from the
left valley wall. The channel will be allowed to naturally erode and reform. Temporary sediment impacts will occur as sediment moves and disperses downstream. After several months of
normal flows, or one or more larger flows, a 2nd phase of streambank restoration efforts will complete bank grading, benching, matting, toe stabilization, and bioengineering measures,
followed by planting. Native riparian vegetation Will be reestablished through seeding, Iivestaking and container or bare root planting to enhance long-term stability.

All impacts are associated with the proposed dam removal and restoration activities. The Tennessee Valley Authority (TVA) and NC Dam Safety were
contacted and do not have concerns or requirements. The dam is not classified as a high hazard dam.

The purpose of the project is to conduct stream restoration activities that will result in reestablishment of aquatic passage and increased habitat
function. The design approach, sequence and methods will attempt to minimize temporary and permanent impacts through use of best management
practices and proven techniques. Potential sediment impacts have been evaluated in reports being provided separately.
16. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Construction practices will follow guidelines from the NC Erosion and Sediment Control Planning and Design Manual. The natural erosion of the
sediment wedge will be allowed to occur. R concerns develop during the course of removal, the rate of removal may be reduced or some of the wedge
sediment may be stockpiled on the floodprone area. During construction, floodplain fill areas will be seeded and temporary measures will be
implemented to reduce runoff from upgradient sources include staging and access. Banks being permanently stabilized during phase 1 will be seeded
and matted. During phase 2, bank restoration will be stabilized the same day and areas will be reseeded and planted. Matting and bioengineering
techniques will be use where possible, although the use of rock is appropriate to the setting as an alternative stabilization measure.

Wildlands reviewed the USFWS Information for Planning Conservation (IPaC) online tool to identify federally listed endangered plant and animal
species that might be impacted by the project. The IPaC review listed these potential endangered species: Bog Turtle (Glyptemys muhlenbergii),
Carolina northern flying squirrel (Glauoomys sabrinus coloratus), Gray bat (Myotis grisescens), Northern long-eared bat (Myotis septentrionalis),
Virginia big -eared bat (Corynorhinus townsendii virgin ianus), Rusty -patched bumble bee (Bombus affinis), Spruce -fir moss spider (Microhexura
montivaga), Blue Ridge Goldenrod (Solidago spithamaea), Heller's blazing star (Liatris helleri), Roam mountain bluet (Hedyotis purpurea var,
montana), Spreading Avens (Geum radiatum). No critical habitats were identified by the IPaC review. The USFWS was invited to a regulatory meeting
held on December 4, 2019 at the project location. No representatives from the USFWS attended. A scoping letter was sent to the USFWS Service on
February 28, 2020. No reply was received within 30 days. We assume they have no comments regarding associated laws and that they do not have
any information relevant to this project at this time. The scoping letter is available for review.
A scoping letter was also sent to the North Carolina Wildlife Resource Commission (NCWRC) on February 28, 2020. The NCWRC responded on
March 23, 2020. The letter states Hellbender and Green Floaters have been found in the river near the vicinity of the dam. The project should not
impact wild trout, and project activities do not need to be avoided during trout moratorium. In addition, they performed sediment modeling that showed
the loss from the impounded section of the river will likely only be a portion of annual sediment volume transported by the river. The NCWRC
recommends surveying the area below the dam for hellbenders before dam removal and relocating any animals captured. They also recommend
closely monitoring the river for stability for several years after construction. Correspondence is attached in appendix of pJD.

The NC State Historic Preservation Office (SHPO) GIS Service (HPOWEB) was reviewed for historic resources. The B. O. Ward House & Mill (WT0358)
came up on the HPOWEB GIS service. The Mill house is attached to the eAsting dam structure to be removed. The project proposes to remove the
epsting dam while leaving the epsting mill house structure intact. Once the dam is removed the epsting structure will be buttressed with rock and river
sediment to train the river away from the building. A scoping letter was sent to SHPO on February 7, 2020 and SHPO responded on March 9, 2020.
The letter request Wildlands to hire an experienced archaeologist to identify and evaluate areas of proposed disturbance prior to any ground
disturbing activities. In addition, SHPO was unable to accurately assess impacts to The B. O. Ward House & Mill complex They requested Wildlands
have the site evaluated by a Secretary of the Interior qualified Architectural Historian. Correspondence is attached in appendix A of the pJD. The
project team has hired the requested consultants to prepare reports for SHPO. The archaeologist and Architectural historian reports have yet to be
completed. These documents can be provided once complete.

LAND ACCESS LICENSE AGREEMENT
THIS LAND ACCESS LICENSE AGREEMENT ("License Agreement") is by and between Mr.
Ray F. Ward ("Licensor"), and American Rivers, Inc. ("Licensee"), ("the Parties").
WHEREAS, the Licensor is the owner of the property Ward Mill Dam located at 443 Old
Watauga River Rd. Sugar Grove, North Carolina 28679 ("Property");
WHEREAS, the Property contains the dam and certain related property;
WHEREAS, the Licensor and the Licensee agree to review and evaluate the facilities for the
purpose of considering the removal of the dam and restoring the river flow;
WHEREAS, the Licensee has requested access to the Property for the purpose of consideration
and evaluation of the dam removal and stream restoration (the "Work");
NOW THEREFORE, in consideration of the mutual premises, promises and covenants, that are
hereby acknowledged by the parties, the parties agree as follows:
Licensor grants to Licensee, its employees, representatives, contractors, and subcontractors,
including but not limited to Blue Ridge Resource Conservation and Development Council,
MountainTrue, and the US Fish and Wildlife Service ("Project Partners") the right to access the
Property at all reasonable times for the purpose of performing the Work.
2. This License Agreement shall commence on the date that it is fully executed by the Parties and
shall continue until Licensee completes the Work, but no later than December 31, 2020 The
rights granted by this License are specifically designed to inure to the benefit of the Licensee and
its contractors, subcontractors, employees and representatives, including the Project Partners.
3. The Licensor and the Licensee agree that this License Agreement does not convey any right, title,
easement or interest of a permanent nature in the Property to the Licensee or any other person.
The Licensor and Licensee agree that this License Agreement does not waive other rights either
party may have under federal, state, and local law.
4. Upon termination of the Work, Licensee shall restore any portions of the Property disturbed by
the Work, as set forth in a detailed site plan to be provided at a later date, with the understanding
that the Dams will have been removed and associated habitat restoration activities will have been
completed.
5. Licensee shall, at its own cost and expense, maintain and keep in force at all times during the
License Period: (1) commercial general liability insurance, which shall include contractual
liability coverage against third -party claims for bodily injury or property damage occurring on the
Property as a result of Licensee or Project Partners' Work; primary coverage will be a minimum
aggregate limit of not less than $1,000,000 and excess umbrella aggregate limit of not less than

$2,000,000; and (2) Employers' Liability and Workers' Compensation Insurance to the extent
required by law.
Licensee accepts the condition of the Property "as is" and acknowledges that Licensor has not
made and makes no warranty of any kind as to the condition of the Property for the use intended
under this License.
Licensee assumes no liability for any existing or future environmental conditions of the Property.
Licensor indemnifies and holds harmless Licensee for any pollutants, hazardous materials and/or
substances on the Property from acts or omissions of Licensor and/or past owners, operators, or
tenants of the Property, and acts or omissions of any transporters and/or arrangers of any
pollutants, hazardous materials and/or substances on the Property, which may be disturbed as a
result of the Work. Licensee agrees to notify Licensor of any such pollutants, hazardous
materials and/or substances discovered on the Property in accordance with, or as a result of, the
Work. The Licensor's obligations under this section shall survive the termination of this License
Agreement.
Neither party shall be liable to the other for any liability for consequential, special or incidental
damages including, without limitation, any damages arising out of business interruption, lost
profits, loss of rental income, or loss of the use of the Property whether any such claim is brought
by Licensor, Licensor's tenants or any other third party.
This License Agreement shall be governed and construed under and in accordance with the laws
of the State of North Carolina
10. This License Agreement constitutes the entire agreement by and between the parties hereto and
no other oral or written agreements, arrangements, representations or understandings, unless
specifically noted herein, shall be deemed to be in existence. This License Agreement, for all
purposes, supersedes all prior agreements, written or oral, if any, between the parties hereto, and
may not be amended or modified except by an instrument in writing signed by all parties to be
bound.
11. The license granted hereby is personal to Licensee and shall not be assigned or sub -licensed
without the prior written consent of Licensor. Licensor shall transfer the rights and obligations of
this License Agreement to any successors, heirs, executors, lessees, or assigns of the Property for
the remainder of the License Period, including but not limited to the remainder of Work to be
completed by Licensee and its Project Partners. This Agreement shall be binding upon the parties
hereto, and their respective successors and assigns.
