Upon review of your request for Water Quality Certification
to place fill material wetlands or waters in Pumpkin Run Creek
for road improvement located at SR 1303 in Wilkes County, we have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2665 issued January 21, 1992. A copy
of the General Certification is attached. This Certification may
be used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 13. Additional conditions are that 1) work
in the 25 foot trout buffer shall not be done from Nov. 1 to
April 15 and 2) the culvert replaced from 80-83 shall be no
larger than the existing culvert and shall be placed at the same
invert elevation so as not to drain the adjacent marsh.

SUBJECT: A review of an application by NCDOT for bank
stabilization inside the 25 foot trout buffer zone on
SR 1303, Pumpkin Run Road, Wilkes County
Dear Mr. Jolly:
The North Carolina Department of Transportation (NCDOT) is
requesting a letter of concurrence from the North Carolina
Wildlife Resources Commission (NCWRC) to obtain a 404 permit
(Nationwide Permit 13) from the U.S. Army Corps of Engineers.
The NCWRC has reviewed information provided by the applicant and
field biologists on our staff are familiar with habitat values of
the project area. These comments are provided in accordance with
provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et.
seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661-667d).
The NCDOT is proposing to grade, drain base and pave SR
1303, Pumpkin Run Road, Wilkes County. It will be necessary to
work inside the trout stream buffer zone at several locations,
requiring bank stabilization with Class II riprap for armor
protection.
Pumpkin Run Creek is a tributary of the South Fork Lewis
Fork Creek which is Designated Public Mountain Trout Water.
Pumkin Run Creek contains populations of brook trout, creek
chubs, bluehead chubs and rosyside dace (NCWRC 3/12/92 data).
The stream has an average width of 6 feet bankfull and a
substrate of silt, sand, gravel, cobble and boulders. Trout
habitat is considered fair.

Based on the information provided by the applicant and our
information on the range of trout in the project area, we have no
objection to work inside the 25 foot trout buffer zone as
proposed provided the following conditions are implemented:
1. Work is prohibited during the brook trout spawning
period of November 1 through April 15 in order to
protect the egg and fry stages from sedimentation.
2. When working inside the 25 foot trout buffer zone, care
must be taken not to disturb streamside vegetation
except where absolutely necessary.

The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of
SR 1303, Pumpkin Run Rd., in Wilkes county during the 1992-
1993 fiscal year. Due to the proximity of a trout stream
(Pumpkin Run Creek class-c trout) and bank stabilization with
Class II Rip/Rap for armor protection, we are requesting a
404 Nationwide permit no. 13.
Attached is a straight line sketch with proposed erosion
control, stream, stream embankment, and construction limits.
In addition I am sending sketch of areas along the road,
with cross sections to cover same where project encroaches
inside the 25 ft. trout buffer zone, and marked county map.
By copy of this letter I am asking Mr. Joe Mickey, Jr., of
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning the
404 Nationwide Permit request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of Pumpkin Run
ck., and I am asking Mr. Mickey to comment directly to me
concerning the Trout water buffer zone encroachment.
Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall be installed in a timely
manner.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) As project progresses, request will promptly be made to
the Division Roadside Environmental Unit for stage and
permanent seeding.
(5) Any removal of siltation devices will be based on the
condition of established ground cover of that area the
device is serving.

Subject: Nationwide Permit No. 13 for Bank Stabilization
on SR 1303 Pumpkin Run Rd. in Wilkes County
Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of
SR 1303, Pumpkin Run Rd., in Wilkes county during the 1992-
1993 fiscal year. Due to the proximity of a trout stream
(Pumpkin Run Creek class-c trout) and bank stabilization with
Class II Rip/Rap for armor protection, we are requesting a
404 Nationwide permit no. 13.
Attached is a straight line sketch with proposed erosion
control, stream, stream embankment, and construction limits.
In addition I am sending sketch of areas along the road,
with cross sections to cover same where project encroaches
inside the 25 ft. trout buffer zone, and marked county map.
By copy of this letter I am asking Mr. Joe Mickey, Jr., of
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning the
404 Nationwide Permit request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of Pumpkin Run
ck., and I am asking Mr. Mickey to comment directly to me
concerning the Trout water buffer zone encroachment.
Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.
