Discharge of wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Your letter also requested that the permit be placed in inactive status until such time that the manufacturing facility and WWTP reopen. The Division's Central Office replied to your request with correspondence dated May 12, 2010, which granted your requests, with the provision that we continue to receive monthly DMRs through April, 2010. We then received an email reply from you informing us that because the manufacturing plant and WWTP were actually shutdown effective December 31, 2009, there was no further, discharge from the WWTP and therefore no data to report on DMRs past that date. 3. In light of the above circumstances, you, as the representative for the Wek facility, are no longer required to submit the monthly DMRs for the Wek facility through April, 2010. The Division has received DMRs up to, and including December, 2009, and that is all that is currently required. You are reminded however that you must request that the permit be reactivated prior to the WWTP restarting and discharging. Failure to do so would result in a violation of "Discharge Without a Valid Permit". 4. Thank you for your attention to this matter. Market St, Reidsville, NC 27320. The facility the above referenced permit refers to was closed effective 31 December, 2009. While there is still limited activity at the site, mainly storage, the flow of water was less than required to keep the WWTP functioning properly. Holding tanks have been pumped out. Water service has been shut off at the site and Porta Johns provided for employees that are, occasionally, on site. I am requesting that the facility be placed on inactive status, however, I would prefer that the permit remained in place, in the event reactivation was ever necessary. Meritech, Inc. stopped their certified testing service in December. Please send the request approval to me at the address listed below for retention in our files. Franklin L. The facility will still be maintained for storage of equipment for the balance of 2010. However, there will be very limited activity. We plan on shutting down all sanitary sewer systems in the building and this in turn will eliminate any flow in to the WWTP. This activity will not allow the WWTP to stay alive and function properly, once the facility is shut down we will have the holding tanks pumped out and no flow will be permitted to go to the waste water treatment facility. We would like to put the facility on "Inactive Status" at that time and do wish to keep the permit #NC0002828 in place but on this inactive status. We will locate a Porta John on the facility for any limited personnel use while working at the facility. However, after further consideration, we have concluded that inactivating the permit would not be the best course of action under these circumstances. 2. If Wek wishes to keep the permit for possible future reactivation of the wastewater treatment plant (WWTP) and discharge, it would be more appropriate to consider temporarily waiving the permit requirements to submit monthly discharge monitoring reports (DMR) and employ and assign an operator in responsible charge (ORC) and backup ORC (BORC) for the WWTP. Doing so would keep the permit active, yet temporarily relieve Wek of the DMR and ORC requirements for as long as they can maintain compliance with the waiver. Also, during the waiver period, Wek would still be required to pay the annual permit fees. Once Wek becomes aware of the need to reactivate the WWTP and discharge, they would only need to notify us far enough in advance to allow us to perform a pre- operational site inspection, allow Wek to fully address and fix any identified issues and/or problems, allow Wek to identify and reassign the new ORC and BORC, and then allow us to rescind the waiver and grant permission to begin discharging again. 3. Please note that during the waiver period, discharge from the WWTP would be strictly prohibited, including the discharge of any accumulated stormwater. Once a waiver is approved and issued, if the plant fills to capacity and threatens to discharge and Wek wishes to continue to maintain the waiver under non -discharge status, then Wek would have to request and acquire a pump and haul permit from the Division to allow them to pump and haul the accumulated stormwater/wastewater/solids for proper disposal. Discharge of any kind during the waiver period would immediately render the waiver null and void and automatically reinstitute all conditions of the discharge permit, possibly resulting in severe permit violations. Furthermore, during the waiver period, all other conditions of the NPDES permit would remain in full force and effect. 4. Obviously, a waiver cannot be issued until it is verified that the WWTP is not discharging and that conditions are most favorable to completely cease all flow to the plant to prepare it for the extended period of inactivity. Evacuating all components of all wastewater and solids currently in the plant and disposing of them properly by applying for and acquiring a pump and haul permit from the Division; C. Preventing, by whatever means practical, the inflow and/or infiltration of precipitation, into the plant during the period of inactivity; d. Completely isolating the plant by closing all valves that are installed on and between the influent and effluent extremities of the plant; e. Verifying that all DMRs will be completed and submitted on time as usual through the discharge termination date, and; f. Verifying that Wek will continue to employ a ORC and BORC through the discharge termination date. 5. Item 6 — This is a discharge line from the bleed off from one of the tower systems, this tower is not in use and there is no bleed off going in to the old polishing pond. Item 7 — A new box for all records has been installed at the WWTP and records will be maintained by our licensed operator, Mr. Patrick Merritt but will be the property of WEK. Item 9 — Monthly DMR reports are now being signed by myself for WEK Industries. Item 10 — All discharges from pipes penetrating the building have been shut off and equipment is in the process of being removed. Pipes will be removed and holes through the wall will be patched. 002 has been identified and marked with a sign at the location. Item 11 — Storm Water Permit. A storm water management plan has been developed and SWMP training has been conducted. Water samples have been collected and been given to Mr. Patrick Merritt for testing. I have attached a copy of our current Storm Water Permit. With regard to item #6 — I contacted the engineer in charge of this for WEK as he has recently retired to inquire about the 2" PVC drain line. He advises that this is a cooling tower bleed off line (currently no flow as the towers are not running) the tower water is treated with EPA approved treatment. Mr. Murrel stated that this was done some time ago because it was felt that the old polishing pond was the best way to handle any discharge. If there was any over flow it would be treated at the chlorinator which is the only discharge from the WWTP. If this is not acceptable I would like to work on finding a suitable discharge for the tower bleed off. I have met with Mr. Patrick Merritt of Meritech and he will bring all monthly DMR reports to me for my signature. With respect to Outfall 002, I did walk the property with Mr. Murrell our engineer and he showed me the locations for both 001 and 002. These are indicated on the attached drawing. Mr. Ron Boone of the Winston-Salem Regional Office (WSRO) of the NC Division of Water Quality (DWQ or Division) conducted compliance evaluation inspections (CEI) at the Wek Industries Reidsville Plant for both the individual NPDES. wastewater permit, NC0002828 and the general NPDES stormwater permit, NCG050140, on 20 February 2008. Your cooperation and assistance, as well as that of Mr. Pat Merritt, of Meritech, Inc., Operator in Responsible Charge (ORC) of the wastewater treatment plant (WWTP), was greatly appreciated. Inspection findings are summarized below and inspection reports are attached for your records. Individual NPDES Wastewater Permit NC0002828, Outfalls 001 & 002 2. NC0002828 authorizes Wek Industries to discharge 1.) Treated domestic wastewater through outfall 001, and 2.) Non -contact cooling water through outfall 002. Both waste streams are discharged to and unnamed tributary of Lick Fork Creek, which is currently classified as Class C waters in the Roanoke River basin. 3. The manufacturing facility is located at 1001 Northeast Market Street, in Reidsville, Rockingham County, North Carolina. The WWTP is located on the south end of the manufacturing plant and currently consists of an equalization basin, bar screen, aeration basin, clarifier, disinfection using tablet chlorination, flow measurement and tablet dechlorination. The plant description currently in the permit is inaccurate; it states that there is a sludge digester and polishing pond at the plant. There is no sludge digester and the polishing pond has since been removed from the treatment process. Effluent flows directly from the clarifier overflow weir to the chlorine contact chamber. From the contact chamber it flows to the dechlorinator and is then discharged. Mr. Merritt did not know at what point in time the polishing pond was removed from the treatment process. You must update the plant description when you submit the permit renewal application during the next permit renewal cycle. Site Review_- Wastewater Treatment Plant, Outfall 001 4. There were no significant issues noted at the WWTP. You did express concern during the inspection about fines that Wek recently received as a result of permit limit violations. Wek must do everything it can to prevent such violations. DWQ will continue to assess civil penalties for such violations unless Wek can demonstrate a good reason why such penalties are not warranted. It is noted that the further reduction of employees at the manufacturing facility, and the resultant ' reduction in domestic waste production, can adversely affect the WWTP and its ability to effectively treat the waste. This reduction in flow can have the effect of "starving" the plant for the nutrients it needs to treat the waste. Additionally, the plant is quite small, with a permitted flow of only five -thousand gallons per day. Release of non -domestic wastes into the drains that lead to the WWTP can also detrimentally affect the plant's ability to treat the waste. All such discharges of non - domestic wastes into the WWTP should be identified and stopped. 5. Mr. Merritt stated during the inspection that he currently does not monitor upstream as required by the permit because there is no upstream flow. However, examination of the stream during the inspection revealed that there is some upstream flow that Mr. Merritt can sample. He agreed to begin conducting the upstream sampling, when there is flow from upstream. 6. There is currently a two-inch PVC pipe that discharges into the former polishing pond at the WWTP. Neither you nor Mr. Merritt knew what the pipe was for or what is discharged from it. Mr. Merritt stated that he thought it was the 002 discharge, until he was shown Wek's permit map that shows 002 to the east of the manufacturing facility. Wek must identify what this pipe is for and what is discharged from it. Once this is positively identified, appropriate actions can be taken to either permit or eliminate the discharge. Please note that, at this point, this is considered an illicit discharge. All discharges from this pipe must be stopped immediately. Failure to do so may result in enforcement actions against Wek. Documentation Review - Wastewater Treatment Plant, Outfall 001 7. Mr. Merritt's operator visitation records were reviewed and found to be complete and current. Mr. Merritt also had an operation/maintenance log that he just recently implemented. Please note that this is his responsibility as the ORC, however Wek is ultimately responsible for all such records. Should operation of the facility change to another operator at any time in the future, Wek must retain all operation and maintenance records. 8. Discharge monitoring reports (DMR) were reviewed and compared with laboratory reports. No mistakes or transcription errors were noted. Meritech, Inc. performs all field and non -field analysis for the permit. Meritech's field lab certification is current and Mr. Merritt's field lab records were reviewed and found to be complete. 9. Mr. Merritt is currently signing the reverse side of the DMRs, however he does not have a delegation letter from Wek authorizing him to do so as required by Part II, Section B, Paragraph 11 of the permit. Please provide Mr. Merritt a delegation letter authorizing him to sign the reverse side of the DMRs and provide this office a courtesy copy as well. Alternatively, an appropriate company officer should review and sign the monthly DMRs after. Mr. Merritt produces them and before they are submitted to DWQ. It may be more beneficial for a company official to review and sign the monthly DMRs before they are submitted so that the company is aware of violations that occurred during the month, well before DWQ issues any fines for such violations. Please review the above -mentioned section of the permit for further details. Site & Documentation Review - Non -contact Cooling Water Discharge, Outfal1 002 10. As stated above, Mr. Merritt formerly was under the impression that the two-inch PVC pipe that discharges into the former polishing pond was 002. However, the location map in the permit shows 002 to be east of the manufacturing facility. Furthermore, you stated during the inspection that you were unaware of any non -contact cooling water discharge at the site. However, the existence of outfall 002 in the permit shows that there was in fact such a discharge at some point in time. Outfall 002 could not be located during the . inspection. Wek must investigate the existence. of 002 and report back to us. It is noted that there are several mechanical systems located throughout the building, many of which do discharge through pipes that penetrate the outer wall of the building. There are also many mechanical systems in the basement of the facility and outside on the eastern side of the building that either discharge or have a strong potential to do so. All such discharges must be identified and properly permitted or permanently eliminated. Failure to do so will lead to violations and/or civil penalty assessments for unpermitted discharges. Wek may need to conduct a full inspection of the entire facility and inventory all such discharging systems. Some of the systems that were noted during the inspection were cooling systems and air compression systems. Please note that Wek has generated reporting violations for nearly every month since December 2004, for failure to submit DMRs for 002. This situation must be definitively resolved in short order. General NPDES Stormwater Permit NCG050140 11. You were unaware of the stormwater permit at the time of the inspection and did not know the location of any of the required documentation. You did state that the individual who would have administered this program recently retired and that you would contact him to assist you in this endeavor. A copy of the general permit NCG050000 can be downloaded from DWQ's website at http://h2o.enr.state.nc.us/su/Forms Documents.htm. The general permit contains all requirements you must meet to comply with your NCG050140 general stormwater permit. Please note that Wek is considered to be in violation of the NCG050140 permit until this and all related matters are resolved and Wek has fully developed and implemented its complete stormwater management plan as required by the permit.
