McKerall U.S. Navy Public Works Offices Marine Corps Base PSC Box 20004 Camp Lejeune, NC 28542-0004 Dear Mr. McKerall: You have our approval to place temporary fill in 0.01 acres of wetlands or waters for the purpose of constructing a temporary ferry during repairs to the swing bridge over the AIWW at Onslow Beach, as you described in your application dated 25 October 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2727. This certification allows you to use Nationwide Permit Number 33 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Fill material must be completely removed after completion of the bridge repairs and the area revegetated with native vegetation. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. These repairs require keeping the bridge in the open position for approximately two months. In order to allow access to Onslow Beach during this period, the Marine Corps proposes to construct a temporary ferry, which will be dismantled upon completion of repairs. All construction will be consistent with the North Carolina Coastal Management Program and 15 CFR 930 and the conditions for construction of temporary structures in estuarine Areas of Environmental Concern contained in 15A NCAC 7H.1900. SAM CONSTRUCTION OF TEMPORARY FERRY LANDINGS AT THE ONSLOW BEACH SWING BRIDGE'' " Repairs of the existing swing bridge at Onslow Beach shall include removal of the existing electro-mechanical operating system, providing an electro-hydraulic operating system, miscellaneous structural repairs, electrical repairs, replacing the controls, replacing fenders and dolphins, removal of potentially hazardous waste paint, painting a swing span bridge and approaches and incidental work. While the work is being performed, the swing bridge will be kept in the "open" position. In order to maintain access to Onslow Beach, a temporary ferry landing will be constructed, and passenger and vehicle ferry service will be provided until the bridge is operable. Upon completion of the bridge repairs, the landing will be dismantled and the site shall be restored to its original condition. The following conditions, specified in 15A NCAC 7H.1900 shall be observed during the construction, operation and demolition phases of the project: There shall be no fill activity below the plane of mean high water associated with the project. 2. The structure shall not be located in such a manner that will directly or indirectly adversely impact coastal wetlands. 3. The structures shall not disrupt the movement of those species of aquatic life indigenous to the waterbody. 4. Representatives of the Department of Environment, Health and Natural Resources may make periodic inspections at any time necessary to ensure that the activity being performed under authority of the general permit is in accordance with the stated terms and conditions. 5. All aspects of the structure shall be removed and the site returned to pre-project conditions at the termination of the repair project. 6. There will be no work within productive shellfish beds. 7. The proposed project will not involve the disturbance of marsh, submerged aquatic vegetation, or other wetlands including excavation and or filling of these areas. 8. The proposed project shall not disrupt normal navigation and transportation channels and shall be properly marked to prevent being a hazard to navigation. 9.
