Dear Mr. Bennett:
Reference is made to your letter of October 6, 1992, regarding your
plans to discharge dredged/fill material into the waters/wetlands of two
unnamed tributaries of the Yadkin River, associated with the construction
of an additional "northbound" 12 foot lane along the north side of the
project length on US 421 west located at the intersection of US 421 Bypass
and US 421 Business, North Wilkesboro, Wilkes County, North Carolina,
TIP No. W-2817, State Project No. 8.7376002. Plans included with your
letter showed that the project will cross two unnamed tributaries to the
Yadkin River. Pipe extension will be required at one location. Reference
is also made to Mr. Joe Mickey's letter of October 9, 1992, in which the North
Carolina Wildlife Resources Commission expressed no objections to the planned
road improvements provided that:
a. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants, and
b. Erosion control measures should be in>plemented where soil is disturbed
and maintained until project omipletion.
For the purposes of the U.S. Army Corps of Engineers" Regulatory Program,
Title 33, Code of Federal Regulations (CPR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for activities
undertaken, assisted, authorized, regulated, funded orarfimrxmd, in whole or
in part, by another Federal agency or department where that agency or

department has determined, pursuant to the CDQ Regulation for the Implementing
the Procedural Provisions of the National Ewixnniwtal Policy Act, that the
activity; work or discharge is categorically excluded from envirornmerital
documentation because it is included within a category of actions which
neither individually nor cLmulatively have a significant effect on the human
environment, and the Office of the Chief of Eng?inxeers has been furnished
notice of the agency's or department's application for the categorical
exclusion and concurs with that determination.
Special regional conditions of this nationwide permit state that before
discharging dredged or fill material into waters of the United States
occurring within the 25 mountain counties of North Carolina that Contain trout
waters, the applicant will obtain a letter of approval from the North Carolina
Wildlife Resource Commission. Review of the information you have provided,
and the comments submitted by the North Carolina Wildlife Resources
Commission, reveals that your proposed work, is authorized by nationwide
permit provided it is accomplished in strict accordance with the enclosed
conditions and the recommendations set forth by the Wildlife Resources
Commission. This nationwide permit dose not relieve you of the responsibility
to obtain any required State or local approval.
Your work is authorized by this nationwide permit provided it is
accoaplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.
This verification will be valid for 2 years fram the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modifcation or the
activity Complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer Comply with the terms and conditions of the nationwide permit,
activities which have ccuuenced (i.e., are under construction) or are under
contract to Camienoe in reliance upon the nationwide permit will remain
authorized provided the activity is cmPleted within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Attached for your information is a copy of the project planning report for
the subject project. The project is being processed by the Federal Highway
Administration as a "Categorical Exclusion" in accordance with
23 CFR 771.115(b). Therefore, we do not anticipate requesting an
individual permit but propose to proceed under a Nationwide Permit in
accordance with 33 CFR 330 Appendix A (B-23) issued November 22, 1991, by
the Corps of Engineers. The provisions of Section 330.4 and Appendix A (C)
of these regulations will be followed in the construction of the project.
We do not anticipate that a permit will be required from the North Carolina
Department of Environment, Health and Natural Resources for this project.

PROPOSED ACTION
The proposed project consists of the following:
1. Construction of an additional "northbound" 12-foot through lane
along the north side of the project length. Total project length
is approximately 0.85 mile.
2. Realignment and channelization of the US 421 Bypass/US 421
Business intersection.
3. Signalization of the intersections of US 421 with SR 1322
(Winkler Mill Road) and US 421 Business.
4. Coordination of these two traffic signals and other signals on
US 421 and US 421 Business in a closed loop signal system.
Note: This project is to be coordinated with Project W-2861, 9.8112931
(100% State Funds). W-2861 will widen US 421 along the south
side from SR 1323 to SR 1322 to provide an additional
"southbound" through lane.
PURPOSE AND NEED: US 421 east of SR 1322 is a four-lane divided section
with US 421 Business merging into US 421. US 421 northbound reduces from
two lanes to a single lane at SR 1322. A traffic signal is needed at
SR 1322, but cannot be installed without an additional travel lane. The
new signal at SR 1322 should be coordinated with existing traffic signals
along US 421 and US 421 Business to reduce accidents and congestion.

ENVIRONMENTAL EFFECTS
A. NATURAL RESOURCES
1. Plant Communities
The study area is dominated by grassy road shoulders. Portions
of pavement will be removed when the intersection is rechannelized,
and sections of pavement exist where the 12.-foot lane will be added.
Conversations with the project engineer and project review indicate
that no forested communities will be impacted by the proposed
project.
2. Protected Species
Information on federal and state protected species was obtained
from the US Fish and Wildlife Service (USFWS) and the North Carolina
Natural Heritage Program (NCNHP). As of March 16, 1992, the USFWS
lists one federally protected species for Wilkes County, the American
Peregrine falcon (Falco peregrinus anatum). Discussion of this
species as it related to the study area follows.
American Peregrine falcon Federally Endangered
The peregrine falcon is slightly larger than a crow, with the
females larger than males. Typical coloring of the adult bird is a
solid slate-gray above and off-white to orange below, with horizontal
brown barrings. Two habitat requirements of the peregrine falcon
include cliffs for nesting and open country for hunting. Peregrine
falcons have also been reported in cities where abundant skyscrapers
and bridges simulate cliff type habitat. The study area and project
vicinity are developed and do not support cliffs or skyscrapers that
are suitable nesting habitat for the peregrine falcon. No impacts to
the peregrine falcon will occur.
3. Water Resources
According to the USGS quadrant map (Wilkesboro) dated 1966, two
streams are crossed by the project. Both streams are unnamed and are
tributaries of the Yadkin River. The "best usage" classification of
these streams is the same as the river to which is is a tributary; in
this case the Yadkin River. This section of the Yadkin River is
classified WS-III. Best usage classification of WS-III waters is
defined as a water supply segment with no categorical restrictions on
watershed development or discharges; suitable for all Class C uses.
The "best usage" classification of Class C waters is aquatic life
propagation and survival, fishing, wildlife, secondary recreation and
agriculture.

No High Quality Waters, Outstanding Resource Waters or waters
classified WS-I and WS-II are located in the study area or within 1
mile downstream. The Yadkin River is not designated a Public
Mountain trout water.
4. Wetlands
Any action that proposes to impact "Waters of the US" falls
under the jurisdiction of the Corps of Engineers and a federal permit
is required. Generally, "Waters of the US" are subdivided into
"wetlands" and "surface waters".
Two streams are crossed by the project. One is located at the
US 421 Bypass/421 Business intersection and the second is located
approximately 1000' west of the intersection. No surface water or
wetland impacts are anticipated at the stream located at the
intersection, since the proposed project calls for pavement removal
in the vicinity of the stream crossing.
The second stream is not visible on the video tape of the study
area. It is marked as an intermittent stream on the USGS quadrant
map. Minor wetland and surface water impacts are likely from
proposed construction. This is based on moderately steep topography
in the study area and minor impacts associated with similar streams
located in Wilkes County. Total wetland impacts are not likely to
exceed 0.3 acre. One note - this stream may have been rechannelized
in the past and may not be impacted at all by the proposed project.
If "Waters of the US" will be impacted upon proposed
construction, a Nationwide Permit 33 CFR 330.5(a))23) is likely to be
applicable. This permit authorizes any activities undertaken,
assisted, authorized, regulated, funded, or financed, in whole or in
part, by another federal agency or department has determined pursuant
to the Council of Environmental Quality regulation for implementing
the procedural provisions of the National Environmental Policy Act,
that the activity, work, or discharge is Categorically Excluded from
environmental documentation because it is individually nor
cumulatively have a significant effect on the human environment and
the office of the Chief of Engineers has been furnished notice of the
agency's or department's application for the CE and concurs with that
determination.
In addition, the project is located in a designated "trout"
county. If surface water and wetland impacts are anticipated from
proposed construction NCDOT is required to obtain a letter of
approval from the North Carolina Wildlife Resources Commission to
fulfill its section 404 permit obligations. The final permit
decision rests with the Corps of Engineers.

A Section 404 General Water Quality Certification is required
for any activity which may result in a discharge and for which a
federal permit is required. State permits are administered through
the Department of Environment, Health and Natural Resources (DEHNR).
B. CULTURAL RESOURCES
1. Historic Architectural Resources

This project is subject to compliance with Section 406 of the
National Historic Preservation Act of 1966, as amended, implemented
by the Advisory Council on Historic Preservation's Regulations for
Compliance with Section 106, codified at 36 CFR Part 800. Section
106 requires that if a federally funded, licensed, or permitted
project has an effect on a property listed on or eligible for the
National Register of Historic Places, the Advisory Council on
Historic Preservation be given an opportunity to comment.
The area of potential effect (APE) was surveyed. The project
area is modern strip development. No properties over fifty years old
were found, and therefore, no properties in the APE are eligible for
the National Register.
Since there are no properties either listed or eligible for the
National Register within the APE, no further complaints with Section
106 is required.
2. Archaeological Study
This project was reviewed internally by NCDOT staff
archaeologist Tom Padgett for possible impacts upon significant
archaeological resources. Due to the highly disturbed urban
landscape in the project area, there is almost no possibility of the
project affecting any sites that are eligible for the National
Register of Historic Places. Therefore, no archaeological survey of
the project was conducted.
C. Traffic Noise/Air Quality
The project is located with the Eastern Mountain Air Quality Control
Region. The ambient air quality for Wilkes County has been determined to
be in compliance with the National Ambient Air Quality Standards. Since
this project is located in an area where the State Implementation Plan
(SIP) does not contain any transportation control measures, the conformity
procedures of 23 CFR 770 do not apply to this project.
The project proposed to widen the existing roadway by the addition of
a 12-foot lane on the north side. The land use in the vicinity of the
project is commercial. Numerous right turn lanes presently line the north
side of the facility for access to the businesses. The addition of the
12-foot lane will provide a continuous lane for right turns. The proposed

project will not substantially increase traffic volumes, but will provide
a safer facility. Hence, the project's impact on noise and air quality
will be insignificant.
If vegetation is disposed of by burning, all burning shall be done in
accordance with applicable local laws and regulations of the North
Carolina SIP for air quality in compliance with 15 NCAC 2D.0520. This
evaluation completes the assessment requirements in Title 23 of the Code
of Federal Regulations, Part 772 (highway traffic noise) and Part 770 (air
quality) and no additional reports are required.

growth on the remaining roadway frontage. The speed limit along this
section of US 421 is 45 mph.
