for General Permit Number 198200031 for DOT bridges. This
General Certification states that written DEM. concurrence with
GP031 is needed only if there is wetland fill.

projects. Since these projects do not involve any wetland fill,
they are in compliance with our new General Certification Number
2735 are hereby approved.

On March 10, 1992, I received a letter from the Corps of
Engineers advising that your project entitled Bridge Replacment
#5 on NC 88 at Maxwell in Ashe County qualifies for a General
Permit 31. Please be advised that this General Permit is not
valid until a letter of concurrence is issued by the State of
North Carolina.
Our existing regulations (15A NCAC 2H .0501(a)) require that
all applicants for 401 Certifications submit seven complete
copies of 401 Applications. These copies must be supplied by the
Division of Environmental Management to various state and federal
agencies.
Therefore, please complete the attached form and send six
additional copies (a total of seven copies) of your 401
Certification application so we can initiate the comprehensive
review required by our rules. If you have any questions, please

Dear Mr. Holderman:
Reference is made to your letter of February 20, 1992, requesting
Department of the Army permit authorization for the placement of fill material
into Brush Fork Creek in association with the replacement of bridge no. 5 with
a triple barrel reinforced concrete box culvert on N.C. 88, west of Maxwell,
Ashe County, North Carolina. Included with the project is the construction of
a temporary detour consisting of two culverts to be placed in Brush Fork Creek
north of the existing bridge. Reference is also made to Mr. Dennis Stewart's
letter of February 17, 1992, in which the North Carolina Wildlife Resources
Commission expressed no objections to the planned road improvements provided
that:
a. NCWRC is concerned that three culverts on the same grade will result
in very shallow sheet flows during drought conditions, preventing upstream
fish migrations. It is requested that riprap be placed at the openings of the
two side barrels to direct low flows through the center barrel of the three
barrel box culvert.
b. The temporary detour culverts should not impede upstream fish
migrations.
C. During box culvert construction, care must be taken to prohibit raw
concrete from entering the stream as this material can be toxic to aquatic
life.
d. Any construction that will cause sedimentation of the stream
(footings, temporary crossing, etc.) is prohibited during the trout spawning
period of November 1 to April 15 in order to protect the egg and fry stages
from elevated turbidity and sedimentation.
e. Vegetation reestablishment should be undertaken on any phase of the
project as it is brought up to grade (seed as you go) to provide long term
erosion control.

On January 1, 1992, we renewed general permit, Action ID No. 19820 031,
(enclosed), that authorizes the placement of fill material associated the
construction, repair, or replacement of bridges across navigable waters and
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Special conditions of this regional general permit state that before
discharging dredged or fill material into waters of the United States
occurring within the 25 mountain counties of North Carolina that contain trout
waters, the applicant will obtain a letter of approval from the North Carolina
Wildlife Resource Commission. Review of the information you have provided,
and the comments submitted by the North Carolina Wildlife Resources
Commission, reveals that your proposed bridge replacement with culverts can be
authorized by this general permit provided you comply with all permit
conditions and the recommendations set forth by the Wildlife Resources
Commission.
Please read the enclosed permit to prevent an unintentional violation of
Federal law. As this Department of the Army.general permit does not relieve
you of the responsibility to obtain any other required approvals, you should
contact appropriate State and local agencies before beginning work.

The North Carolina Department Of Transportation Bridge Maintenance
Unit, proposes the following project for your issuance of a Section 404
Permit. The project involves Designated Trout Waters in Western North
Carolina and we believe this project can be accomplished under General
Permit No. SAWC082-N-400-0031.
COUNTY: Ashe
ROUTE: NC 88
STREAM: Brush Fork (Tributary to North Fork New River)
DESCRIPTION: Replace existing bridge with triple 10'x8' RCBC (no lowering
of center barrel floor slab below outside floor slabs).
Less than 50 C.Y. of fill material below normal highwater.
No wetlands involved.
Temporary detour immediately upstream from existing bridge.
With a copy of this letter, we are also requesting issuance of 401
Water Quality Certification from the N. C. Division Of Environmental
Management.
We have attached a site location map, sketch of planned activities,
and Wildlife Resources Commission concurrence letter. A stringent
erosion and sedimentation control program will be implemented during
the project construction and every effort will be made to complete
work in a timely manner. See note on WRC letter dated 2-17-92.

Subject: NCDOT Proposed Bridge No. 5 Replacement with Triple Culverts, Highway
88, Ashe County Trout Exclusion.
Dear Mr. Jolly:
The North Carolina Department of Transportation (NCDOT) is requesting a letter
of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to
obtain General Permit No. 31 from the U.S. Army Corps of Engineers (USCOE). These
comments are provided in accordance with provisions of the Clean Water Act of 1977 (33
U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended;
16 U.S.C. 661-667d).
The NCDOT is recommending that Bridge No. 5 over Brush Fork Creek on
Highway 88 at Maxwell, Ashe County, be replaced with a triple barrel reinforced concrete
box culvert, with invert to be placed 1 foot below the natural stream bottom. A temporary
detour consisting of two culverts will be placed in Brush Fork north of the existing bridge.
Brush Fork (NEW 1-8-17) is a tributary to North Fork New River (Designated
Public Mountain Trout Waters) and may serve as a trout nursery stream. This section of
Brush Fork has a width of 6 feet bankfull and substrate of large and small gravel. Trout
habitat is good in this area.
The site was visited by staff biologist on October 16, 1990, with NCWRC
recommending to the USCOE that Bridge No. 5 be replaced with another spanning
structure. Since our initial comments on this project, extensive study by NCDOT
Geotechnical and Hydrographics Departments has indicated that replacing the bridge with
another bridge would create safety problems associated with turning and sight distance.
Also, borings indicated that rock footings necessary for a new bridge were 4 to 10 feet
below the stream bed making piles impractical and requiring cofferdams and channel
excavation to found footings on rock. Based on these studies, NCDOT has recommended
the triple barrel box culvert.

This project has the potential to impact aquatic resources through sedimentation.
Sedimentation has the potential to reduce fish numbers through habitat destruction,
reduced oxygen levels, and lower levels of food and reduced reproduction. Use of
equipment in and near the stream also has the potential for introduction of pollutants into
the stream. Physical alteration to stream habitat has the potential to alter aquatic
communities and restrict fish movements.
Based on the fact that NCDOT has tried to accommodate our recommendation of
replacing Bridge No. 5 with a like structure, but after extensive study found it impractical to
do so, we will not object to the project as proposed provided that the following stipulations
are implemented:
