Reference the application of the North Carolina Department of
Transportation, Division of Highways, for a Department of the Army permit to
replace and backfill bulkheads, place riprap material and install cluster
piles on the Pamlico River, at the ferry basins near Bath and Aurora, Beaufort
County, North Carolina, State Project No. 2.110013.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. The bulkheads and riprap material will be positioned in strict
accordance with permit plans.
C. All backfill materials will be obtained from a highground source and
confined landward of the permitted bulkhead.
d. The fill and riprap materials will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials, or unsightly
debris will not be used.
e. The permittee must install and maintain, at his expense, any signal
lights and signals prescribed by the U.S. Coast Guard, through regulations or
otherwise, on authorized facilities.
f. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit.

g. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
h. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less will not be considered significant.

Upon review of your request for Water Quality Certification
to place fill material in 0.004 acres of wetlands or waters in
Pamlico River for bulkhead repair and riprap installation located
at ferry basins near Bath and Aurora in Beaufort County, we have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2665 issued January 21, 1992. A copy
of the General Certification is attached. This Certification may
be used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 13.

Environmental setting
During the early 1960'x, the NC-DOT established the Pamlico River Ferry in
Beaufort County. The Ferry transverses the Pamlico River from Gaylords Bay just
east of the Town of Bath on the north side of the river to the east of the Town
of Aurora on the south side of the river. NC 306 is located at each ferry site.
The north side consists of a bulkheaded basin with loading ramps and
dolphin clusters. Also, riprap has been historically placed at both the west end
and the east end of the bulkhead. At the east end a large area of Spartina
cynosuroides marsh is present; upland development consists of a office complex,
parking lots and a approach road.
The south side site also consists of a bulkheaded basin with loading ramps
and dolphin clusters. As with the north side some riprap is present at both of
the east and west ends of the bulkhead. Also, at both ends of the bulkhead areas
vegetated with Phragmites spp. are present; upland development on the south side
consists of restrooms and a approach road.
Project proposal
(A) North Side - The applicant is proposing the following:
(1) To construct ±585' of steel sheet pile bulkhead. The new bulkhead
will be 3 1/21 waterward of the face of the existing bulkhead or 3'
waterward of the existing support pilings.
(2) To place ±501 of riprap waterward of a portion of existing bulkhead.
This area of riprap will average 91 beyond the NWL.
(3) To place ±301 of riprap waterward of the NWL at the western end of
the existing bulkhead. This riprap will be placed partially atop
existing riprap and will average ±9' beyond the NWL.
(4) To place ±1501 of riprap waterward of the NWL beginning at the east
end of the existing bulkhead. A portion of this riprap will be atop
existing riprap and a portion will be placed waterward and to the
same elevation of an area of Spartina cynosuroides marsh. No riprap
will be placed atop the marsh. This 150' section of riprap will
average 21 beyond the NWL.
(5) To place five (5) new cluster piles within the ferry basin. Four
(4) of these piles will be west of the loading ramp and one (1) will
be to the east of the riprap.
(B) South Side - The applicant is proposing the following:
(1) To construct ±2451 of steel sheet pile bulkhead. The new bulkhead
will be 3 1/21 waterward of the face of the existing bulkhead or 2'
waterward of the existing support pilings.

(2) To place ±300' of riprap waterward of a portion of the existing
bulkhead. This area of riprap will average 10' beyond the NWL.
(3) To place t65' of riprap waterward of the NWL at the western end of
the existing bulkhead. This riprap will be placed partially atop
existing riprap a portion will be placed waterward and to the same
elevation of an area of Phragmites spp.. This section of riprap
will average t2' beyond the NWL.
(4) To place ±180' of riprap waterward of the NWL at the eastern end of
the existing bulkhead. This riprap will be placed partially atop an
area of Phragmites sp . which is existing beyond the NWL at this
location. This section of riprap will average ±2' beyond the NWL.
(5) To place two (2) new cluster piles within the ferry basin. One (1)
set of piles will be on the west side of the loading and one (1) set
will be on the east side of the loading ramp.
Environmental impact

(1) ±1,755 square feet of open water area will be filled landward of the
proposed bulkhead.
(2) ±1,020 square feet of openwater area will be filled by the placement
of the proposed riprap.
(3) No wetland vegetation will be excavated or filled.
(4) Some short term turbidity will exist during project construction.
South Side
(1) ±735 square feet of open water area will be filled landward of the
proposed bulkhead.
(2) ±4,010 square feet of open water area will be filled by the
placement of the proposed riprap.
(3) ±450 square feet of Phragmites spp. will be filled by riprap
placement at the eastern end of the existing bulkhead.
(4) Some short term turbidity will exist during project construction.

The North Carolina Department of Transportation proposes
to replace deteriorating bulkheads and provide additional
shoreline stabilization at the Pamlico River ferry basins
near Bath and Aurora on NC 306 in Beaufort County.
Additional dolphin cluster piles are also proposed at each
basin.
North Side
At the ferry basin on the north side of the Pamlico
River, 585 feet of bulkhead replacement is proposed. The new
bulkhead will extend into the water 31 feet from the face of
the existing bulkhead, or 2 feet waterward of the existing
support pilings (see sheet 5 of 8). The proposed bulkhead
will consist of 12" wide steel sheet piling with a 2.5'x2.5'
concrete cap. The area between the front of the existing
bulkhead and the rear of the proposed piling will be filled
with select backfill material supplied by a local borrow pit.
A small stretch of existing bulkhead on the west end of
the basin will not be replaced with a new bulkhead, but will
be stabilized by the use of class II rip rap (see sheet 2 of
8). NCDOT does not believe that it is necessary to extend
the more expensive bulkhead construction into this area.
During a permit coordination meeting with Mr. Dave
Gossett (DCM-Washington), concerns were raised over the
amount of open water habitat that would be impacted by the
rip rap in this area based on original plans to create a 3
foot flat cap at the top of the rip rap, and the use of 3:1
side slopes. NCDOT therefore agreed to delete the 3 foot
flat cap and change the slope to 2:1 (see section A-A, sheet
4 of 8). This modification has resulted in an approximate
40% reduction in impact to waters of the U.S. at this site.
On the east side of the north basin, rip rap will be
used to stabilize a stretch of shoreline that is prone to
erosion (see sheets 3 of 8, 4 of 8 section C-C). Without
this stabilization, land behind the bulkhead could be eroded
away, threatening the bulkhead structure. Again, the
proposed slope has been changed from 3:1 to 2:1 to reduce
impacts to waters of the U.S. In the area bordering the
coastal marsh, rip rap will be placed in front of the erosion
escarpment no higher than the elevation of the existing marsh
(see sheet 3 of 8, Section D-D). No fill will be placed in
the marsh. This stabilization should slow down the erosion
of the current marsh habitat, while also helping to stabilize
the bulkhead.
Three new large cluster piles and two three-pile
clusters are proposed for this basin (see sheets 2 of 8 and 3
of 8). No construction activity landward of the existing
bulkhead is proposed.
Construction activities at the north ferry facility will
result in 165 CY total rip rap fill, 75 CY of rip rap total
fill below MHT, 260 CY of fill behind proposed bulkhead, with
0.01635 acres of fill in waters of the US. No coastal wetland
habitat will be filled.
South Side
At the ferry basin on the south side of the Pamlico
River, 250 feet of bulkhead replacement is proposed. The new
bulkhead will extend into the water 31 feet from the face of
the existing bulkhead, or 2 feet waterward of the existing
support pilings (see sheet 8 of 8). The proposed bulkhead
will consist of 12" wide steel sheet piling with a 2.5'x2.5'
concrete cap. The area between the front of the existing
bulkhead and the rear of the proposed piling will be filled
with select backfill material supplied by a local borrow pit.
A stretch of existing bulkhead on the west end of the
basin will not be replaced with a new bulkhead, but will be
stabilized by the use of class II rip rap (see sheet 6 of 8).
NCDOT does not believe that it is necessary to extend the
more expensive bulkhead construction into this area. Mr.
Gossett again expressed concerns over the amount of open
water habitat that would be impacted by the rip rap in this
area based on original plans. As was the case with the north
side rip rap, NCDOT will agree to delete the 3 foot flat cap
and change the slope from 3:1 to 2:1 (see section A-A, sheet
7 of 8). This modification has resulted in an approximate
40% reduction in impact to waters of the U.S. at this site.
In the area bordering the marsh on the backside of the
western point of the basin, rip rap will be placed in front
of the erosion escarpment no higher than the elevation of the
existing marsh (see sheet 6 of 8, Section D-D). No fill will
be placed in the marsh at this site. This stabilization
should slow down the erosion of the current marsh habitat,
while also helping to stabilize the bulkhead.
On the east end of basin, rip rap will be used to
stabilize a stretch of shoreline that is prone to erosion
(see sheet 6 of 8). Marsh grasses are presently growing in
front of the erosion escarpment, and in order to stabilize
the shoreline and protect the bulkhead, a portion of this
area must be filled. The rip rap activities in this area
will lead to an unavoidable loss of 0.004 acres of wetland
habitat.
A small drainage canal directly west of the ferry ramp
approach road which presently leads to a 18" corrugated steel
pipe will be modified to direct flow into a 18" corrugated
steel pipe underneath the approachway (see sheets 6 of 8, 7
of 8 section C-C). The existing pipe will be plugged, and
the canal regraded from the plug back approximately 45 feet
to the opening of the proposed pipe.
Two new large cluster piles are proposed for this basin.
No construction activity landward of the existing bulkhead is
proposed. Four small cluster piles adjacent to the westward
bulkhead will be removed to allow for placement of the rip
rap material (see sheet 6 of 8).
Construction activities at the south ferry facility will
result in 515 CY total rip rap fill, 420 CY total rip rap
fill below MHT, 110 CY of fill behind proposed bulkhead, with
0.10 acres of fill in waters of the US. Additionally, 0.004
acres of wetland will be impacted due to rip rap placement on
the east end of the basin. Due to the small acreage of
wetland impacted by this activity, as well as the benefits
associated with reducing erosion of marsh habitat, no
mitigation for the loss of 0.004 acres of coastal marsh is
proposed.
The North Carolina Department of Transportation is requesting
that the proposed work be authorized under the appropriate CAMA
permit as indicated by the above mentioned activities. Enclosed
please find a permit application and permit drawings. A
processing fee has been requested from our Fiscal Unit, and will
be forwarded to your office as soon as possible. By copy of this
letter, we are also requesting issuance of 401 Water Quality
Certification from the N.C. Division of Environmental Management
and a U.S. Army Corps of Engineers 404 Permit. If you have any

Environmental setting
During the early 1960's, the NC-DOT established the Pamlico River Ferry in
Beaufort County. The Ferry transverses the Pamlico River from Gaylords Bay just
east of the Town of Bath on the north side of the river to the east of the Town
of Aurora on the south side of the river. NC 306 is located at each ferry site.
The north side consists of a bulkheaded basin with loading ramps and
dolphin clusters. Also, riprap has been historically placed at both the west end
and the east end of the bulkhead. At the east end a large area of Spartina
cynosuroides marsh is present; upland development consists of a office complex,
parking lots and a approach road.
The south side site also consists of a bulkheaded basin with loading ramps
and dolphin clusters. As with the north side some riprap is present at both of
the east and west ends of the bulkhead. Also, at both ends of the bulkhead areas
vegetated with Phragmites spp. are present; upland development on the south side
consists of restrooms and a approach road.
Project proposal
(A) North Side - The applicant is proposing the following:
(1) To construct ±585' of steel sheet pile bulkhead. The new bulkhead
will be 3 1/2' waterward of the face of the existing bulkhead or 3'
waterward of the existing support pilings.
(2) To place ±50' of riprap waterward of a portion of existing bulkhead.
This area of riprap will average 9' beyond the NWL.
(3) To place ±30' of riprap waterward of the NWL at the western end of
the existing bulkhead. This riprap will be placed partially atop
existing riprap and will average ±9' beyond the NWL.
(4) To place ±150' of riprap waterward of the NWL beginning at the east
end of the existing bulkhead. A portion of this riprap will be atop
existing riprap and a portion will be placed waterward and to the
same elevation of an area of Spartina cynosuroides marsh. No riprap
will be placed atop the marsh. This 150' section of riprap will
average 2' beyond the NWL.
(5) To place five (5) new cluster piles within the ferry basin. Four
(4) of these piles will be west of the loading ramp and one (1) will
be to the east of the riprap.
(B) South Side - The applicant is proposing the following:
(1) To construct ±245' of steel sheet pile bulkhead. The new bulkhead
will be 3 1/2' waterward of the face of the existing bulkhead or 2'
waterward of the existing support pilings.

(2) To place ±300' of riprap waterward of a portion of the existing
bulkhead. This area of riprap will average 10' beyond the NWL.
(3) To place ±65' of riprap waterward of the NWL at the western end of
the existing bulkhead. This riprap will be placed partially atop
existing riprap a portion will be placed waterward and to the same
elevation of an area of Phragmites spp.. This section of riprap
will average ±2' beyond the NWL.
(4) To place ±180' of riprap waterward of the NWL at the eastern end of
the existing bulkhead. This riprap will be placed partially atop an
area of Phragmites spp. which is existing beyond the NWL at this
location. This section of riprap will average ±2' beyond the NWL.
(5) To place two (2) new cluster piles within the ferry basin. One (1)
set of piles will be on the west side of the loading and one (1) set
will be on the east side of the loading ramp.
Environmental impact

(1) ±1,755 square feet of open water area will be filled landward of the
,)roposed bulkheav.
(2) ±1,020 square feet of openwater area will be filled by the placement
of the proposed riprap.
(3) No wetland vegetation will be excavated or filled.
(4) Some short term turbidity will exist during project construction.
(1) ±735 square feet of open water area will be filled landward of the
proposed bulkhead.
(2) ±4,010 square feet of open water area will be filled by the
placement of the proposed riprap.
(3) ±450 square feet of Phragmites spp. will be filled by riprap
placement at the eastern end of the existing bulkhead.
(4) Sonic short term turbidity will exist during project construction.

(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received November 18, 1992, for Department of
the Army authorization to replace and backfill bulkheads, place riprap
material and install cluster piles on the Pamlico River, at the ferry basins
near Bath and Aurora, Beaufort County, North Carolina, State Project No.
2.110013, indicates it to be a candidate for Federal authorization under this
general permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the

Reference your application for Department of the Army (DA) authorization
to replace and backfill bulkheads, place riprap material and install cluster
piles on the Pamlico River, at the ferry basins near Bath and Aurora, Beaufort
County, North Carolina.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.
C. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.

This information is essential to our expeditious processing of your
application and it should be forwarded to us by December 30, 1992. Also, a
copy of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.

The North Carolina Department of Transportation proposes
to replace deteriorating bulkheads and provide additional
shoreline stabilization at the Pamlico River ferry basins
near Bath and Aurora on NC 306 in Beaufort County.
Additional dolphin cluster piles are also proposed at each
basin.
North Side
At the ferry basin on the north side of the Pamlico
River, 585 feet of bulkhead replacement is proposed. The new
bulkhead will extend into the water 31 feet from the face of
the existing bulkhead, or 2 feet waterward of the existing
support pilings (see sheet 5 of 8). The proposed bulkhead
will consist of 12" wide steel sheet piling with a 2.51x2.5'
concrete cap. The area between the front of the existing
bulkhead and the rear of the proposed piling will be filled
with select backfill material supplied by a local borrow pit.
A small stretch of existing bulkhead on the west end of
the basin will not be replaced with a new bulkhead, but will
be stabilized by the use of class II rip rap (see sheet 2 of
8). NCDOT does not believe that it is necessary to extend
the more expensive bulkhead construction into this area.
During a permit coordination meeting with Mr. Dave
Gossett (DCM-Washington), concerns were raised over the
amount of open water habitat that would be impacted by the
rip rap in this area based on original plans to create a 3
foot flat cap at the top of the rip rap, and the use of 3:1
side slopes. NCDOT therefore agreed to delete the 3 foot
flat cap and change the slope to 2:1 (see section A-A, sheet
4 of 8). This modification has resulted in an approximate
40% reduction in impact to waters of the U.S. at this site.
On the east side of the north basin, rip rap will be
used to stabilize a stretch of shoreline that is prone to
erosion (see sheets 3 of 8, 4 of 8 section C-C). Without
this stabilization, land behind the bulkhead could be eroded
away, threatening the bulkhead structure. Again, the
proposed slope has been changed from 3:1 to 2:1 to reduce
impacts to waters of the U.S. In the area bordering the
coastal marsh, rip rap will be placed in front of the erosion
escarpment no higher than the elevation of the existing marsh
(see sheet 3 of 8, Section D-D). No fill will be placed in
the marsh. This stabilization should slow down the erosion
of the current marsh habitat, while also helping to stabilize
the bulkhead.
Three new large cluster piles and two three-pile
clusters are proposed for this basin (see sheets 2 of 8 and 3
of 8). No construction activity landward of the existing
bulkhead is proposed.
Construction activities at the north ferry facility will
result in 165 CY total rip rap fill, 75 CY of rip rap total
fill below MHT, 260 CY of fill behind proposed bulkhead, with
0.0235 acres of fill in waters of the US. No coastal wetland
habitat will be filled.
South Side
At the ferry basin on the south side of the Pamlico
River, 250 feet of bulkhead replacement is proposed. The new
bulkhead will extend into the water 31 feet from the face of
the existing bulkhead, or 2 feet waterward of the existing
support pilings (see sheet 8 of 8). The proposed bulkhead
will consist of 12" wide steel sheet piling with a 2.51x2.5'
concrete cap. The area between the front of the existing
bulkhead and the rear of the proposed piling will be filled
with select backfill material supplied by a local borrow pit.
A stretch of existing bulkhead on the west end of the
basin will not be replaced with a new bulkhead, but will be
stabilized by the use of class II rip rap (see sheet 6 of 8).

7 of 8). This modification has resulted in an approximate

In the area bordering the marsh on the backside of the
western point of the basin, rip rap will be placed in front
of the erosion escarpment no higher than the elevation of the
existing marsh (see sheet 6 of 8, Section D-D). No fill will
be placed in the marsh at this site. This stabilization
should slow down the erosion of the current marsh habitat,
while also helping to stabilize the bulkhead.
On the east end of basin, rip rap will be used to
stabilize a stretch of shoreline that is prone to erosion
(see sheet 6 of 8). Marsh grasses are presently growing in
front of the erosion escarpment, and in order to stabilize
the shoreline and protect the bulkhead, a portion of this
area must be filled. The rip rap activities in this area
will lead to an unavoidable loss of 0.004 acres of wetland
habitat.
A small drainage canal directly west of the ferry ramp
approach road which presently leads to a 18" corrugated steel
pipe will be modified to direct flow into a 18" corrugated
steel pipe underneath the approachway (see sheets 6 of 8, 7
of 8 section C-C). The existing pipe will be plugged, and
the canal regraded from the plug back approximately 45 feet
to the opening of the proposed pipe.
Two new large cluster piles are proposed for this basin.
No construction activity landward of the existing bulkhead is
proposed. Four small cluster piles adjacent to the westward
bulkhead will be removed to allow for placement of the rip
rap material (see sheet 6 of 8).
Construction activities at the south ferry facility will
result in 515 CY total rip rap fill, 420 CY total rip rap
fill below MHT, 110 CY of fill behind proposed bulkhead, with
0.10 acres of fill in waters of the US. Additionally, 0.004
acres of wetland will be impa a ",due to rip rap placement on

proposed.
The North Carolina Department of Transportation is requesting
that the proposed work be authorized under the appropriate CAMA
permit as indicated by the above mentioned activities. Enclosed
please find a permit application and permit drawings. A
processing fee has been requested from our Fiscal Unit, and will
be forwarded to your office as soon as possible. By copy of this
letter, we are also requesting issuance of 401 Water Quality
Certification from the N.C. Division of Environmental Management
and a U.S. Army Corps of Engineers 404 Permit. If you have any

SUBJECT: Beaufort County, Pamlico River Ferry Basins near
Bath (North Side) and Aurora (South Side) on NC
306, Proposed Bulkhead Replacement and Shoreline
Stabilization, State Project No. 2.110013.
The North Carolina Department of Transportation proposes
to replace deteriorating bulkheads and provide additional
shoreline stabilization at the Pamlico River ferry basins
near Bath and Aurora on NC 306 in Beaufort County.
Additional dolphin cluster piles are also proposed at each
basin.
North Side
At the ferry basin on the north side of the Pamlico
River, 585 feet of bulkhead replacement is proposed. The new
bulkhead will extend into the water 31 feet from the face of
the existing bulkhead, or 2 feet waterward of the existing
support pilings (see sheet 5 of 8). The proposed bulkhead
will consist of 12" wide steel sheet piling with a 2.51x2.5'
concrete cap. The area between the front of the existing
bulkhead and the rear of the proposed piling will be filled
with select backfill material supplied by a local borrow pit.
A small stretch of existing bulkhead on the west end of
the basin will not be replaced with a new bulkhead, but will
be stabilized by the use of class II rip rap (see sheet 2 of
A.- C.....-1l1.-.-.._,....-:..., A f[:__.-.-,:. ..- l1_.:__ I__,__-
8). NCDOT does not believe that it is necessary to extend
the more expensive bulkhead construction into this area.
During a permit coordination meeting with Mr. Dave
Gossett (DCM-Washington), concerns were raised over the
amount of open water habitat that would be impacted by the
rip rap in this area based on original plans to create a 3
foot flat cap at the top of the rip rap, and the use of 3:1
side slopes. NCDOT therefore agreed to delete the 3 foot
flat cap and change the slope to 2:1 (see section A-A, sheet
4 of 8). This modification has resulted in an approximate
40% reduction in impact to waters of the U.S. at this site.
On the east side of the north basin, rip rap will be
used to stabilize a stretch of shoreline that is prone to
erosion (see sheets 3 of 8, 4 of 8 section C-C). Without
this stabilization, land behind the bulkhead could be eroded
away, threatening the bulkhead structure. Again, the
proposed slope has been changed from 3:1 to 2:1 to reduce
impacts to waters of the U.S. In the area bordering the
coastal marsh, rip rap will be placed in front of the erosion
escarpment no higher than the elevation of the existing marsh
(see sheet 3 of 8, Section D-D). No fill will be placed in
the marsh. This stabilization should slow down the erosion
of the current marsh habitat, while also helping to stabilize
the bulkhead.
Three new large cluster piles and two three-pile
clusters are proposed for this basin (see sheets 2 of 8 and 3
of 8). No construction activity landward of the existing
bulkhead is proposed.
Construction activities at the north ferry facility will
result in 165 CY total rip rap fill, 75 CY of rip rap total
fill below MHT, 260 CY of fill behind proposed bulkhead, with
0.0235 acres of fill in waters of the US. No coastal wetland
habitat will be filled.
South Side
At the ferry basin on the south side of the Pamlico
River, 250 feet of bulkhead replacement is proposed. The new
bulkhead will extend into the water 31 feet from the face of
the existing bulkhead, or 2 feet waterward of the existing
support pilings (see sheet 8 of 8). The proposed bulkhead
will consist of 12" wide steel sheet piling with a 2.51x2.5'
concrete cap. The area between the front of the existing
bulkhead and the rear of the proposed piling will be filled
with select backfill material supplied by a local borrow pit.
A stretch of existing bulkhead on the west end of the
basin will not be replaced with a new bulkhead, but will be
stabilized by the use of class II rip rap (see sheet 6 of 8).
NCDOT does not believe that it is necessary to extend the

Gossett again expressed concerns over the amount of open

area based on original plans. As was the case with the north
side rip rap, NCDOT will agree to delete the 3 foot flat cap

7 of 8). This modification has resulted in an approximate
40% reduction in impact to waters of the U.S. at this site.
In the area bordering the marsh on the backside of the
western point of the basin, rip rap will be placed in front
of the erosion escarpment no higher than the elevation of the
existing marsh (see sheet 6 of 8, Section D-D). No fill will
be placed in the marsh at this site. This stabilization
should slow down the erosion of the current marsh habitat,
while also helping to stabilize the bulkhead.
On the east end of basin, rip rap will be used to
stabilize a stretch of shoreline that is prone to erosion
(see sheet 6 of 8). Marsh grasses are presently growing in
front of the erosion escarpment, and in order to stabilize
the shoreline and protect the bulkhead, a portion of this
area must be filled. The rip rap activities in this area
will lead to an unavoidable loss of 0.004 acres of wetland
habitat.
A small drainage canal directly west of the ferry ramp
approach road which presently leads to a 18" corrugated steel
pipe will be modified to direct flow into a 18" corrugated
steel pipe underneath the approachway (see sheets 6 of 8, 7
of 8 section C-C). The existing pipe will be plugged, and
the canal regraded from the plug back approximately 45 feet
to the opening of the proposed pipe.
Two new large cluster piles are proposed for this basin.
No construction activity landward of the existing bulkhead is
proposed. Four small cluster piles adjacent to the westward
bulkhead will be removed to allow for placement of the rip
rap material (see sheet 6 of 8).
Construction activities at the south ferry facility will
result in 515 CY total rip rap fill, 420 CY total rip rap
fill below MHT, 110 CY of fill behind proposed bulkhead, with
0.10 acres of fill in waters of the US. Additionally, 0.004
acres of wetland will be impacted due to rip rap placement on
the east end of the basin. Due to the small acreage of
wetland impacted by this activity, as well as the benefits
associated with reducing erosion of marsh habitat, no
mitigation for the loss of 0.004 acres of coastal marsh is
proposed.

The North Carolina Department of Transportation is requesting
that the proposed work be authorized under the appropriate CAMA
permit as indicated by the above mentioned activities. Enclosed
please find a permit application and permit drawings. A
processing fee has been requested from our Fiscal Unit, and will
be forwarded to your office as soon as possible. By copy of this
letter, we are also requesting issuance of 401 Water Quality
Certification from the N.C. Division of Environmental Management
and a U.S. Army Corps of Engineers 404 Permit. If you have any

Dear Mr. Dorney:
Enclosed is the application of the North Carolina Department of
Transportation, Division of Highways, for Department of the Army authorization
and a State Water Quality Certification to replace and backfill bulkheads,
place riprap material and install cluster piles on the Pamlico River, at the
ferry basins near Bath and Aurora, Beaufort County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a reggr+et for certification is a reasonable time for state
action. Therefore, you h6veW n acted on the request, or asked for an

9 CERTIFICATION AND PERMISSION

SUBJECT: Beaufort County, Pamlico River Ferry Basins near
Bath (North Side) and Aurora (South Side) on NC
306, Proposed Bulkhead Replacement and Shoreline
Stabilization, State Project No. 2.110013.
The North Carolina Department of Transportation proposes
to replace deteriorating bulkheads and provide additional
shoreline stabilization at the Pamlico River ferry basins
near Bath and Aurora on NC 306 in Beaufort County.
Additional dolphin cluster piles are also proposed at each
basin.
North Side
At the ferry basin on the north side of the Pamlico
River, 585 feet of bulkhead replacement is proposed. The new
bulkhead will extend into the water 31 feet from the face of
the existing bulkhead, or 2 feet waterward of the existing
support pilings (see sheet 5 of 8). The proposed bulkhead
will consist of 12" wide steel sheet piling with a 2.5'x2.5'
concrete cap. The area between the front of the existing
bulkhead and the rear of the proposed piling will be filled
with select backfill material supplied by a local borrow pit.
A small stretch of existing bulkhead on the west end of
the basin will not be replaced with a new bulkhead, but will
be stabilized by the use of class II rip rap (see sheet 2 of

The North Carolina Department of Transportation
submitted a CAMA permit application for the subject project
to The Division of Coastal Management on November 13, 1992.
On November 23, 1992, Mr. David Gosset (DCM-Washington)
requested that some clarifications and revisions be made to
the permit application. In accordance with this request, we
are providing the enclosed revised permit application. All
information provided in the November 13, 1992 cover letter
(enclosed) remains correct.

SUBJECT: CAMA/DREDGE & FILL Permit Application Review, Pamlico
River Ferry, NC 306, Gaylords Bay, Beaufort County,
North Carolina.
The N. C. Wildlife Resources Commission (NCWRC) has
completed a review of the proposed project and possible impacts
on existing wildlife and fishery resources on the area. Our
comments are provided in accordance with provisions of the Fish
and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661-667d).
The N. C. Department of Transportation (NCDOT) plans to
replace bulkheads and riprap and install new dolphin clusters at
the ferry landings, with approximately 0.4 acres of fill in
estuarine waters and 0.004 acres of fill in marsh wetlands. All
fill will occur along existing bulkhead and riprap in areas which
have been previously disturbed. The amount of impervious surface
on the site will not be significantly changed by the proposed
work. No high quality fish or wildlife habitats will be
significantly affected by the project.
The NCWRC offers no objection to issuance of a CAMA/Dredge
and Fill Permit for this project, provided the following
recommendations are included as conditions of the permit:

sediment and chemical contaminants.
