Colonel Suermann: March 1, 1991 MAR dS This responds to your February 15, 1991, Notice of Intent to Issue (NII) a permit to the North Carolina Department of Transportation (NCDOT), Division of Highways (Action ID. 199000326), for the placement of fill material in wetlands adjacent to the Tar River associated with construction of the Greenville Bypass, U.S. Highway 264, Pitt County, North Carolina. Attached to your February 15, 1991 letter was a copy of the NCDOT's February 12, 1991 response addressing Service concerns. This is the report of the Service and the U.S. Department of the Interior and is submitted in accordance with provisions of the Fish and Wildlife Coordination Act (16 U.S.C. 661-667e) and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543). This supplements our previous reports dated September 14, 1990, and January 7, 1991. The Service continues to believe that the lack of or infeasibility of upland alternative has not been fully documented and thus, mitigation commitments seem premature. For this reason, the Service continues to recommend that no Department of the Army permit be issued for the proposed work. In the event the Corps determines that this project is in the overall public interest and intends to issue above our recommendations, we have determined that according to the 1985 Memorandum of Agreement between our agencies that we will not elevate this permit. We do, however, recommend that at a minimum any permit issued over our objections should stipulate that mitigation will be provided on a two-to-one basis as this amount more approaches a compensation level for the habitat values at this site. The Service concurs with the stated permit conditions b. - f. The Service looks forward to the DOT's submittal of the mitigation bank plan in early April, 1991, as stated in their February 12, 1991 letter. Sincerely yours, L.K. CESAW-C090-N-074-0455 PUBLIC NOTICE THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION (NCDOT), DIVISION OF HIGHWAYS, Post Office Box 25201, Raleigh, North Carolina 27611-5201, has applied for a modification to Department of the Army (DA) permit which authorized PLACEMENT OF FILL MATERIALS IN OF WETLANDS ADJACENT TO LITTLE CONTENTNEA CREEK AND VARIOUS TRIBUTARIES IN CONNECTION WITH THE RELOCATION OF U.S. HIGHWAY 264 NEAR FARMVILLE in Pitt County, North Carolina. The modification is TO PLACE FILL MATERIAL IN 0.3 ACRE OF WETLANDS ADJACENT TO THOMPSON CANAL TO FACILITATE CONSTRUCTION OF AN ADDITIONAL RAMP ("RAMP C") AT SITE "A". The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed placement of fill material, obtained from a high ground source, in 0.3 acre of wetlands to construct an additional highway access ramp. Surface flows, including Thompson Canal, are to be passed through the roadway fill by a triple 9-foot by 7-foot R.C. box culvert and three 48-inch diameter R.C.P.'s. The NCDOT intends to compensate for this unavoidable loss of wetlands by debit of 0.3 acre from the NCDOT Company Swamp Wetlands Bank. The purpose of the work is to provide improved, safer public transportation facilities. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (DEM) has determined whether Water Quality Certificate No. 2182, issued November 18, 1987, needs modification, pursuant to PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National -2- Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archaeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and, if so, the conditions under which it will be allowed to occur are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, culturai values, fish and wildlife values, flood hazards•and flood plain values.(in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used -3- in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of.the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the DEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serve as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The DEM plans to take final action in the issuance of the Clean Water Act certification on or after October 5, 1990. Mitigation involved debiting the NCDOT Company Swamp Bank. The project is now being constructed and a design change to add one ramp has become necessary. This additional ramp would involve 0.3 acre of wetland fill at Site "A". The ramp is labeled "Ramp C" on the enclosed drawing titled "Sheet 2 of 20". A modification to the above permit is hereby requested in order for this work to go forward. The design process for the ramp attempted to avoid the wetland areas, but this could not be accomplished: Next, the wetland area impacted was minimized. This was accomplished by changing the US 264 end of the ramp from approximately Station 300 to approximately Station 305 (see attached drawing). This left an unavoidable wetland loss of 0.3 acre. We propose debiting 0.3 acre from the NCDOT Company Swamp Wetland Bank for this additional loss.
