Thorpe, Ph.D. Environmental Management Director Project Development and Environmental Analysis Branch North Carolina Department of Transportation 1548 Mail Service Center Raleigh, North Carolina 27699-1548 Dear Dr. Thorpe: o ro ?? `'O O e Subject: Long Swamp Wetland Mitigation Site Deficit Lumber River Basin, Cataloging Unit 03040203 Hoke County, NCDOT Division 8 The purpose of this letter is to notify you that the Ecosystem Enhancement Program (EEP) will provide the additional mitigation required to offset mitigation deficit associated with the Long Swamp Wetland Mitigation site. According to information provided by you in a letter dated April 14, 2005, the remaining mitigation amount required is 20.0 acres riverine wetland restoration and 43.10 acres non-riverine wetland restoration. EEP agrees to provide these outstanding mitigation requirements with 20 riparian restoration credits and 43.10 non-riparian restoration credits. The Long Swamp Wetland Mitigation site was constructed by the NCDOT in August 1998 to offset unavoidable impacts associated with the construction of the Rockingham/Hamlet Bypass (TIP Number R-512). Some areas within the mitigation site failed to reach optimum hydrology after the required five year monitoring period; therefore, maximum mitigation credit for this site was not possible. Post-construction monitoring has been completed per the approved mitigation plan for this site and the NCDOT has requested the USACE and NCDWQ concur with the recommendation to "close out' the site and to provide additional wetland mitigation to offset the deficits through another source. The NCDOT elected to request mitigation assistance from the EEP for the riverine and non-riverine wetland deficits associated with the Long Swamp Wetland Mitigation site. The NCDOT has discussed this recommendation with the proper environmental regulatory agencies; however, EEP has not received any additional correspondence from the USACE to indicate if concurrence to "close out" the mitigation North Carolina Ecosystem Enhancement Program, 1652 Mail Service Center, Raleigh, NC 27699-1652 / 919-715-0476 / www.nceep.net site was granted. The EEP will need verification from the USACE that the Long Swamp Wetland Mitigation site has been "closed out" and a final total of the wetland mitigation deficits associated with the site. EEP is discussing this issue with the USACE to determine the appropriate timeframe that the mitigation debit is required. The additional mitigation associated with the Long Swamp Wetland Mitigation site deficit was included in the EEP's 2006 - 2008 Biennial Budget that was submitted to the NCDOT in April 2006. Department of Transportation closely analyze the success criteria, as described in the mitigation plan, for the above mentioned mitigation site. Based on past year's hydrology and vegetation data, some areas of the site that were projected to meet wetland hydrology criteria have yet to perform as such. In June 2002, the Department. dispatched a team of biologists to evaluate/delineate the areas of the property that had not performed favorably. This delineation was reviewed by the regulatory agencies in late June 2002. At that field meeting, state and federal regulatory agencies requested that the Department evaluate an additional section of the property. This field investigation took place in August 2002. Since that time the Department has drafted plans detailing the delineation that was performed in the previous months. The preliminary results were shared with the COE office and with Mr. John Hennessey, NCDWQ, in September 2002. The existing project files have been researched and it appears that this mitigation site was offered and accepted as a total compensation for the R-512 (Rockingham-Hamlet Bypass) project with the exception of approximately 20 acres of riverine restoration. Based on conversations with COE and DWQ, the department has included a detailed map illustrating the projected performance, as outlined in the Mitigation Plan dated June 1997, and a map of the mitigation areas that are currently meeting expectations on this property. .w swc aw. In addition to these deficiencies, the Department is also obligated for the additional 20 Ac. of riverine restoration that was not included within this site. Currently, the Department is working to solicit "Full Delivery" submittals from private engineering firms to compensate for the difference in the non-riverine and riverine components to fully offset the impacts for the R-512, Rockingham-Hamlet Bypass Roadway Construction Project. This report details the hydrologic and vegetation monitoring activities over the past year at the site, which was originally constructed in 1998. A meeting to discuss this and other sites evaluated by the Wilmington and Washington Regulatory Offices has been scheduled for Friday, February 18, 2000 at 9:00am in Room 470 of the Transportation Building.
