Dear Mr. Plate:
On December 3, 2009 a 401 Water Quality Certification Inspection and Construction Stormwater
Inspection was conducted at the subject site. This letter is being issued as a Notice of Violation for the failure
to contact the Division of Water Quality upon initiation of construction pursuant to Additional Condition
Number 1 of the Certification issued on December 18, 2008 (#08-1722) and March 3, 2009 (#08-1767).
During the construction stormwater inspection (permit #: NCR002155, Airport Extension; NCR002156,
Goldmine Rd. relocation; and NCR00 2157, Airport Borrow Pit) the site appeared to be, generally, compliant
with sediment and erosion control issues. However, there were some issues regarding turbidity at the south end
of the runway extension. Specifically, at the upstream side of the newly install culverts, some silt fencing and
matting is required. In addition, please address a similar problem at the north end of the project for the
Goldmine Road relocation. The water leaving the site was highly turbid and must be corrected.
You are reminded that your State General Storm Water Permit (#NCR002155/2156) requires the
following:
Part I, Section B, #1: All erosion and sediment control facilities shall be inspected by or
under the direction of the permittee at least once every seven calendar days and within 24
hours after any storm event greater than 0.5 inches of rain per 24 hour period. A rain gauge
shall be maintained on the site and a record of the rainfall amounts and dates shall be kept by
the permittee. The inspection for each measure must be listed/identified separately.

Part I, Section B, #2: The operator shall keep a record of all inspections as required by
Section B, #1 noted above. These records shall be made available to DWQ upon request.
Part II, Section D, #5,B: Permittee shall provide access to and copy, at reasonable times,
records that must be kept per conditions of this permit.
Part I, Section C, #2: The permittee shall provide the operation and maintenance necessary
to operate the storm water control measures at optimum efficiency.
Violations are subject to civil penalty assessments of up to $25,000.00 per day for each violation. Thank
