The Application provides adequate assurance that the discharge of fill material into the waters of Swan Quarter Canal in conjunction with the proposed crab shedding expansion in Hyde County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. Marsh restoration should.be.carried out on a 1:1 acreage basis as described in the applicant's proposal. Violations of any condition herein set forth shall result in revocation of this Certification. PROJECT SUMMARY: The applicant is proposing to fill 3 , 600 sa ft. of existing marsh in order to expand his seafood business He proposes to maintain the existing 180' by 50' mooring basin to a -6' NWL A total of 425' of dock is proposed as well as 105' of bulkhead around the interior of the mooring basin. He is proposing two shelters, a 20' by 25' adjacent the existing building and an 80' by 32' covering crab shedders. In lieu of marsh filled the applicant is proposing to restore 3,600 sq.ft. of marsh wetlands filled-prior to Dredge & Fill: and LAMA. Project setting The applicant's property is located in Hyde County on SR 1129 at Swan Quarter adjacent the Swan Quarter Cana].. The site varies from 1' to 4.5' above NWL and is bordered on the west by SR 1129 and on the east by 4.5 acres of predominantly Juncus roemerianus marsh. A seafood business is located on the project site. it consists of a building and adjoining shelter, a. dock, parking area, and existing crab shedders. Sixteen percent of the project site (3,600 square feet) is covered by high marsh which is a mixture of the following species: Spartina alterniflora, J. roemerianus, Di.stichlis spicata, S. patens, Typha spp. and Scirpus spp. The eastern end of the project site borders the mooring basin and is an old spoi.i. bank which is 3,600 square feet. This spoil bank is composed of two spoil piles which are on top of old marsh and are the result of dredging the mooring basin which occurred prior to the State Dredge and Fill Law as well as the CAMA Act. The spoil bank is on the opposite side of the mooring basin from the high marsh and seafood business. The spoil bank is vegetated with Japanese honeysuckle, southern red oak., pines, blackberry briar; youpon, poison ivy, :;j.id cherry, anal wax myrtle. Behind the spoil bank is a 41: acre predominantly J. roemerianus miarsh. The moorincT basin is manmade and connects to the largo basil: at th hecid of the S?:an Quarter Canal which is classified as SA waters by t'ie Environmental ManacTement Commission. Project description The applicant is proposing to fill 3,600 square feet (to 3' above W L) of existing high marsh in order to expand his seafood business. The marsh to be filled is surrounded by highground, parking lot and the highway, except for a ± 30' wide area of connection to the existing mooring basin. The fill for thi., marsh will be taken from the existing spoil bank. which is proposed to be removed. The applicant proposes to bulkhead ± 105' of shoreline adjacent to the mooring basin and backfill the resulting area to the level of the filled marsh. The applicant proposes to do maintenance excavation of the mooring basin. The mooring basin is 180' by 50' and is to be excavated from its present average of -.2.5' down to -6' MIL. A floating silt fence is proposed to be placed at the mouth of the mooring basin during excavation. The spoil from the mooring basin excavation will be placed in an approved offsite highg.round disposal area. A 20' by 25' shelter adjacent to the existing building is proposed as well as a 36' by 24' freezer. A LAMA Minor Permit has been obtained for the construction of the freezer and construction is underway. An 80' by 32' shelter to cover the expanded crab shedding operation has also been proposed. The applicant is proposing to restore 3,600 square feet of an existing spoil bank to the adjacent marsh elevation in order to allow more direct inundation of the 41 acre J. roemerianus marsh with rising water level in the adjacent mooring basin. Anticipated impacts The project would result in the filling of 3,600 square feet of coastal marsh. The project would cause localized turbidity associated with the maintenance excavation of the mooring basin, as well as the installation of the bulkhead and piers. The applicant's proposal to use a silt fence at the mouth of the mooring 4 basin should further localize turbidity. The project as proposed would result in a less restrictive exchange of water into the 4.5 acre J. r_oemerianus marsh adjacent the mooring basin. The removed spoil pile area (3,600 square feet) would be expected to revegetate with the same type species as the adjacent marsh. David W.
