The following is in response to your letter of July 9,1992 requesting additional
information on the referenced application.
Item a. Justification for and alternatives to the selected plan.
1. The proposed plan allows development of existing upland areas
with the minimum disturbance to adjacent wetlands. Access roads
are designed to avoid wetlands wherever possible, and to minimize
impacts on wetlands in those areas where avoidance is not possible,
while maintaining safety standards.
2. Non-isolated wetland areas are preserved, except for necessary
road access, where upland alternative alignments do not exist.
3. The proposed road alignment minimizes potential disturbance to
and erosion of the lake shore.
4. Only non-contiguous, isolated wetland areas, (Permit Areas 6 and
10), totalling 0.319 acres are proposed for residential lot development.
These areas will be replaced, at a ratio of 2:1, with wetland
restoration contiguous to existing wetlands.
We have concluded that there are no practicable alternatives to the
proposed plan for access to the existing upland areas of the property.

Item b. Minimization of wetland losses.
1. Proposed private access roads and driveways are of minimum safe
widths and curvature, while maintaining safe roadway design, in
order to minimize wetland losses. Proposed driveway entrances,
(Details, Sheet 3 of 3), are 24 ft. wide, shoulder to shoulder. Permit
Areas 2, 3, 4, and 5, (Sheet 1 of 3), are located at existing wetland road
crossings. Proposed private access roads are 18 ft. wide.
2. The alignments of the proposed private access roads are placed
primarily in uplands to avoid impacting wetlands wherever possible.
3. The location of the Permit Area 9 channel excavation, (Sheet 2 of 3),
adjacent to and including uplands, minimizes wetland impacts.
4. The wetland delineation was based on the 1989 Delineation
Manual. The delineated areas exceed the actual wetland areas
according to the currently used 1987 Manual.
Item c. Mitigation Plans
1. We are proposing 1.24 acres of restoration of filled upland areas to
wetland conditions, as mitigation for the proposed 0.62 acres of
wetlands disturbance. These areas are indicated on Sheets 1 and 2 of
3, as revised July 8, 1992.
2. The proposed restoration areas are contiguous with existing
wetlands. We propose excavating these areas to the level of adjacent
wetlands, and planting a species mix of overstory and understory
species comparable to existing species in adjacent wetlands.
Revised plans showing proposed mitigation areas are enclosed. Please call if
you have any questions, or need additional information.

AND TO EXCAVATE AN AREA OF ADJACENT WETLANDS OF BIG CREEK, OFF S.R. 1947, Lake
Waccamaw, Columbus County, North Carolina that was recently advertised in our
public notice of July 2, 1992.
In reference to the previously submitted permit application, the
applicant has deleted work in permit areas 7, 8, 9, 10, and 11 and revised her
mitigation plan accordingly. Plans showing the deletions and revised
mitigations are enclosed.
Written comments pertinent to the revised proposal, as outlined above,
will be received in this office, Attention: Ms. Jean Benton, until 4:15 p.m

In response to concerns of field staff of the Corps of Engineers, Wilmington
Field Office, and the NC Division of Environmental Management, we are
revising our application for a permit to discharge fill material and excavate
wetland areas of the referenced project.
We are removing Permit Areas 7,8,9, 10, and 11 from the application. The
remaining Permit Areas 2, 3, 4, 5, and 6 affect 0.128 acres and require an
estimated 298 cu. yds. of discharged fill material:

Pull development of the proposed single family lots will require connection to
the Town of Lake Waccamaw sanitary sewer system. Financing for the sewer
line extension will require prior approval of the requested discharge permit.
Individual lots may be developed with septic tank/ drain field systems, as
approved by applicable local and state agencies. When sanitary sewer service
is extended to the area, any lots on septic systems will be connected to the
sewer system.

SUBJECT: Groundwater Monitoring Wells at Lake Waccamaw Mitigation
Areas, DEM Project #92420, COE #199201747 and DEM

Dear John:
The work associated with these permits was completed in April of this year.
Groundwater wells installed in April have been measured monthly.
Following are the readings to date:
April 15,1993 4" above ground surface
May 21,1993 8" below ground surface
June 22, 1993 12" below ground surface
(Rainfall for May and June has been well below normal.)
Because the work was not completed until April, we are delaying the
installation of the seedlings until this fall. I will keep you informed of our
schedule later this year and keep you up to date on the well readings.

Wetlands mitigation in conjunction with proposed discharge of fill material,
covering 0.128 acres adjacent to Big Creek and Lake Waccamaw, Columbus
County, NC.
Wetlands mitigation, totaling 0.257 acres is proposed in two areas, each adjacent
to and contiguous with existing wetlands of Big Creek. Refer to Permit
Application Plan Sheet 2 of 3, dated 23 July 1992. Both areas are former wetlands
that were filled prior to Section 401/404 legislation. Mitigation Area 1 consists of
0.138 acres. Mitigation Area 2 consists of 0.119 acres.
Grading
Both areas shall be excavated to the elevation of the wetlands adjacent to them.
Wetland hydrology is supplied by Big Creek.
Vegetation
Both areas shall be planted with seedlings of wetland tree and shrub species,
typical to the adjacent wetlands. Trees shall be planted at a density of 400 trees
per acre:
Bald Cypress
Red Maple
Black Gum
Taxodium distichum
Acer rubrum
Nyssa sylvatica
Mitigation Area 1 shall receive 56 trees. Mitigation Area 2 shall receive 48 trees.
In addition, a mixture of the following shrubs will be planted along the
periphery of the mitigation areas, staggered, approximately 5 ft. on center:
Wax Myrtle Myrica cerifera
Titi Cyrilla racemiflora
Button Ball Bush Cephalantus occidentalis
Monitoring
Inspections of wetland mitigation areas shall be made twice yearly for 3 years.
During the monitoring period, written records shall be maintained, documenting
vegetation and hydrology conditions. If tree planting failures occur during the
monitoring period, additional plantings will be made.

Enclosed is the application of Ms. Mary Sue Prescott for Department of the
Army authorization and a State Water Quality Certification to excavate a
channel and place excavated/fill material in wetlands on Big Pond and Lake
Waccamaw, Lake Waccamaw, Columbus County, North Carolina. Your receipt of
this letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by August 10, 1992, the
District Engineer will deem that waiver has occurred.

MEMORANDUM

28450 has modified her Department of the Army (DA) permit application TO
DISCHARGE FILL MATERIAL INTO ADJACENT WATERS AND WETLANDS OF LAKE WACCAMAW,
AND TO EXCAVATE AN AREA OF ADJACENT WETLANDS OF BIG CREEK, OFF S.R. 1947, Lake
Waccamaw, Columbus County, North Carolina that was recently advertised in our
public notice of July 2, 1992.
In reference to the previously submitted permit application, the
applicant has deleted work in permit areas 7, 8, 9, 10, and 11 and revised her
mitigation plan accordingly. Plans showing the deletions and revised
mitigations are enclosed.
Written comments pertinent to the revised proposal, as outlined above,
will be received in this office, Attention: Ms. Jean Benton, until 4:15 p.m.,
August 24, 1992, or telephone (919) 251-4511.

wetlands on Big Creek and Lake Waccamaw, Lake Waccamaw, Columbus County, North
Carolina.
I have reviewed this application and conclude that the proposed work may
affect the Waccamaw silverside Menidia extensa, a threatened species which
resides in both Lake Waccamaw and Big Creek; and therefore, I am hereby
requesting initiation of formal consultation pursuant to Section 7 of the
Endangered Species Act of 1973, as amended.

Reference the application of Ms. Mary Sue Prescott for Department of the
Army authorization to excavate a channel and place excavated/fill material in
wetlands on Big Creek and Lake Waccamaw, Lake Waccamaw, Columbus County, North
Carolina. Also, reference our letter to you of October 7, 1992, requesting
the initiation of formal consultation pursuant to Section 7 of the Endangered
Species Act of 1973, as amended.
Since our last correspondence with you, the permittee has informed us that
plans will not include any septic tank/drain field wastewater disposal
systems. A condition disallowing such systems would be included in any issued
Department of the Army (DA) permit. Both supply of water and disposal of
waste water are to be effected by extension of existing area supply and
collection systems. Thus, major concerns regarding possible adverse effects
on water quality and the Waccamaw silverside Menidia extensa have been
lessened. As the project site would be effected by the 100-year flood, our
position remains that proposed activities may effect the threatened species.
Expedious completion of formal consultation under Section 7 of the Endangered
Species Act of 1973 will be appreciated.
