This permit, issued on September 12, 1991 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) Prior to the filling of the man-made ditch, a silt fence shall be placed across the mouth of the ditch and across the ditch immediately landward of the area to be filled. 2) All fill material to be placed in the man-made ditch and/or wetlands shall be clean sand free of any pollutants or organic material and shall be from an upland source. 3) Prior to any fill being placed in wetlands, the mitigation sites shall be reduced to appropriate wetland grade. The elevations shall be verified by a representative of DCM or the USA COE. 4) The alignment/location of the fill road shall be staked and verified by a representative of DCM and/or the USA COE prior to any fill being placed in the wetlands. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Signature of Permittee Mr. Ralph Barco ADDITIONAL CONDITIONS Permit #122-91 Page 2 of 2 5) Silt fences shall be installed along the toe of the entire proposed road prior to any fill being placed in the wetlands. The silt fences shall be left in place until the shoulders of the fill road exhibit well-established vegetation. 6) A written monitoring report of the vegetative establishment of the mitigation sites shall be submitted to the DCM after 12 months but no later than 15 months from the date of creation of the mitigation sites. Should establishment of appropriate wetland vegetation on the mitigation sites be less than 50%, the DCM will require the mitigation sites to be planted with vegetation recommended by DCM. Monitoring of the mitigation sites shall continue until the sites are 75% or greater vegetated. 7) The permittee will be responsible for the upkeep and maintenance of the mitigation sites so as to prevent debris, grass clippings, fill, etc. from being placed into the sites. 8) The activity shall be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction-related discharge (increases such that the turbidity in the stream is 25 NTUs or less are not considered significant). 9) A permanent ground cover sufficient to restrain erosion shall be provided on all exposed areas within the shorter of 30 working or 120 calendar days after project completion. 10) Appropriate erosion and sedimentation control devices, measures, or structures shall be used to prevent sediment from entering the adjacent wetlands/watercourses/property (e.g., silt fence, diversion swales/berms, sand fence, etc.). 11) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 12) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of 'this permit. The permittee is not relieved of this requirement if he abandons.the permitted activity without having the permit transferred to a third party. Box 366 Grandy, North Carolina 27939 Mr. David Griffin District Manager, CAMA Rt. 6, Box 203 Elizabeth City, North Carolina 27909 2 Addendum to Mitigation Proposal in Alternatives Analysis, Soundside Estates The first sentence of the second paragraph (below the table) should be changed to: "Due to the narrow and level nature of the mitigation site, no immediate planting is pro- posed". The rationale for this statement follows: • The permit can not be issued until late summer. • This is not a good time for transplanting due to the poor survival rates this time of year. • Nursery plants grown during the spring should have higher survival rates than for transplants. • Transplanting is not the most efficient means of revegetation. • There are 16 species (see attachment) in the adjacent wetlands to chose for planting. • Mitigation site preparation should be completed at the earliest time to facilitate: Fall seeding from adjacent wetland areas. Rhizomes from adjacent wetland areas. • Spring vegetative sampling to determine if the mitigation site exceeds 50% vegeta- tive coverage. • The 50% criteria reflects that only late fall of 1991 and early spring of 1992 will be available for natural revegetation. If the site, observed at less than 1 growing season, exceeds 50% cover there seems little need for additional planting. • Should coverage be less than 50% - A list of invading species should indicate those species most likely to survive if planted. • Implementation, if necessary, during early summer 1992. • Should planting be necessary, it will be at 2'x 2' centers in areas devoid of vegeta- tion. • Most of the adjacent species listed are prolific seed producers, i.e. invaders. • If planting is necessary, we suggest Rose Mallow, Soft Rush, and Duck Potato. e . , I_. The Application provides adequate assurance that the discharge of fill material into the waters of Currituck Sound in conjunction with the proposed Soundside Estates in Currituck County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303,_306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. Mitigation shall be as described in your letter of 13 August 1991. 3. The area where stumps are to be removed shall only be bush hogged at most once a year and not mowed or converted to lawn. Violations of any condition herein set forth shall result in revocation of this Certification.
