In accordance with 15A NCAC 2H .0506, a thorough review of your application has been conducted by Mr. Tom Steffens of the DWQ Washington Regional Office. Based on this review, we have determined that significant uses could be removed or degraded by this project. Insufficient evidence is provided in your application to conclude that your project must be built as planned. Therefore, unless modifications of the proposal are made, we will move toward denial of the 401 Certification as required in 15A NCAC 2H .0507(e). Specifically, please investigate the following so that we may further review your application for avoidance and minimization of impacts as required in 15A NCAC 2H .0506(b): 1. We concur with Mr. T. Barrett's internal Division of Coastal Management memorandum to Mr. Doug Huggett discussing the anticipated effects of your proposal to construct a breakwater 47' from an existing and newly installed bulkhead. We do not believe that the proposed location, design and construction of your project is in accordance with 15A NCAC 7H .0200. Please investigate design alternatives that would not lead to scouring effects which would make the design unfeasible for shoreline stabilization and which would thereby minimize adverse impacts on water quality and aquatic habitat. Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H .0507(h)). Thank you for your attention. Barrett 4 SUBJECT: Modification to State Permit #42-00, Issued to the NC Coastal Federation and NC Sea Grant DATE: August 25, 2003 Please find attached a requested modification to the aforementioned CAMA Major Permit. As you may recall, this permit was issued on March 22, 2000 as a blanket authorization to allow for the installation of "experimental" shoreline stabilization projects. The intent is to document the effectiveness of these methods over the traditional vertical bulkhead. A brief description of the current proposal and site characteristics follows: APPLICANT: Ronald Ordas 124 Sunrise Lane Kill Devil Hills, NC 27948 Rover #D081118A SITE CHARACTERISTICS: Water Quality - SB Shellfish - Closed PNA - No Land Use Plan Classification - Conservation 2000 Photo 183-2143, Grid 14-R; 1995 Photo 187-1968, Grid 14-I,H This is the Collington area of Kill Devil Hills, Dare County, a residential area extensively segregated by canals. The canal system connects to Albemarle Sound on the northwest side of the development. The property in question, 124 Sunrise Lane, is owned by Mr. Ron Ordas. Mr. Ordas has entered into an agreement with NC Sea Grant to construct an 80' wooden sill adjacent to his shoreline under the umbrella of State Permit #42-00. The Ordas propertywas stabilized by a traditional vertical bulkhead under a CAMA Regulatory Exemption issued December 15, 2000. The shoreline in this area indicates a high level of energy and erosive action, as is evidenced by the uprooted trees below the water line and ridged sand bottom. During normal tides, the shoreline features a 5'- 10' wide sandy beach beyond the bulkhead. Looking north and south along the shoreline from the subject property, three small patches of Juncus roemerianus with S artina alterniflora are visible. PROPOSAL: The applicant proposes to construct a wooden sill approximately 47' waterward of the existing bulkhead. This location was chosen as the waterward location of the remaining patches of marsh grass along this same shoreline. This represents a line approximately 37' waterward of the normal water level. The sill is proposed to extend no greater than 6" above the normal water level, and span the width of the property, or 80'. A gap of .5" to .75"will be left between each board. The area between the bulkhead and the new sill will be planted with S artina alterniflora. No fill is proposed. The applicant has received a waiver of the 15' riparian corridor setback from the property owner to the north, which is presently unstabilized and eroding rapidly. No waiver has been received from the south side, which has a timber bulkhead. POTENTIAL IMPACTS: Direct impacts will be from the loss of public trust area between the bulkhead and the sill in the amount of approximately 2960 sf. Turbidity should not be a concern with the marsh proposal due to the lack of fill material. Additional energy may be produced along the shoreline by a funneling effect created by currents passing through the two vertical walls. The intent of the gaps in the sill is to diffuse energy, but the diffusion may be offset by the relation of the two walls. ******* Please see the field report dated December 23, 1999, associated with permit #42-00, for additional information. Ross Jr., Secretary MEMORANDUM: TO: DOUG HUGGETT FROM: T. BARRETT SUBJECT: COMMENTS & RECOMMENDATIONS - MAJOR PERMIT MINOR MODIFICATION - NCCF & NC SEA GRANT, RONALD ORDAS DATE: AUGUST 25, 2003. The following are my comments and recommendations regarding the aforementioned proposal: State Permit #42-00 was issued to the NCCF and NC Sea Grant for the installation of 30 alternative shoreline measures. The sites and specific designs were all to be submitted at later dates, and reviewed individually. This proposal is located in Kill Devil Hills, NC, adjacent to Albemarle Sound within the community of Collington. The proposal is for a vertical board breakwater approximately 47' offshore. There is a shoreline stabilization bulkhead presently on the site, which was installed during 2001, undera regulatory exemption authorization issued on 12/15/2000. On December 9, 1999, the NCCF submitted the application to allow for alternative shoreline stabilization measures to be located statewide, to allow for documentation of their effectiveness over traditional stabilization methods. In the cover letter submitted with that application, Ms Tracy Skrabal, senior scientist for the NCCF, stated that the NCCF and NC Sea Grant were "committed to providing education on alternatives for shoreline erosion control that provide effective erosion control and enhance our remaining marsh species." This intentwas the understanding of the Division in issuing State Permit #42-00. It is my opinion that the proposal for a breakwater 47' from an existing and newly installed bulkhead does not meet with the intended purpose of this permit, as the shoreline has already been stabilized by a traditional structure, recently enough that the structural integrity of the bulkhead is excellent. Consequently, the breakwater would not be an "alternative" to traditional methods. Furthermore, in a system with the energy of Albemarle Sound at the site location, it is difficult to accept the assertion that marsh will repopulate an 80' section of shoreline with continuing high energy levels along the adjacent shoreline. The combination of the 2 walls is more likely to create increased energy between them, causing a scouring effect that disallows marsh survival. This effect was seen on an earlier project under this same permit by the placement of a rock sill offshore of an existing bulkhead (Hammock's Beach State Park) and the agencies have since been forced to authorize modifications to join the 2 structures in order to remedy the scour problem. This allowance causes an incorporation of public trust waters and inhibits species mobility. Lastly, the applicant proposes to construct this breakwater for the 80' width of his property without having received a waiver of the riparian corridor setback on the south side. Condition #13 of the issued permit states that all proposals will honor this setback unless waived by the adjacent property owner. For the reasons stated above I recommend denial based on the use standards located in 15A NCAC 07H .0200 and the conditions in place on State Permit #42-00. It is my opinion that the project meets the conditions outlined in CAMA permit #42-00. I recommend that the Division of Coastal Management modify the existing permit to include the project as shown in the plans provided, with the appropriate conditions in the original permit.. The sill extends 80 feet along the shoreline and will be located 47 feet waterward of the existing bulkhead. The selected location is based on the seaward limit of an existing smooth cordgrass marsh on the adjacent property. Beach width varies but averages around 10 feet seaward of the bulkhead. The area between the normal high water line and the new wooden sill is to be planted with smooth cordgrass following construction of the sill. The sill will extend no more than 6 inches above either the normal high water line or the highest elevation where marsh grass is growing. The sheathing and posts in the wooden sill will be at least 8 feet long and imbedded at least 5 feet below grade. A gap will be left between each sheathing board of 1/2 to 3/4 inches.
