This is to inform you that the Division of Water Quality has not received your quarterly monitoring report
for the first quarter 2012. This is in violation of Part II, condition D(2) of the NPDES permit, as well as
15A NCAC 2B .506(a), which requires the submittal of Discharge Monitoring Reports no later than the
last calendar day following the reporting period. Failure to submit reports as required will subject the
violator to the assessment of a civil penalty of up to $25,000 per violation. You will be considered
noncompliant with the self -monitoring requirements of your NPDES permit until the report has been
submitted.
To prevent further action, please submit said report within fifteen (15) days of receipt of this notice.
Additionally, this letter provides notice that this office will recommend the assessment of civil penalties if
future reports are not received within the required time frame during the next twelve (12) reporting
months. The Division must take these steps because timely submittal of discharge monitoring reports is
essential to the efficient operation of our water quality programs. We appreciate your assistance in this

first apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES permit

SUBJECT: Compliance Evaluation Inspection — NPDES Permit No. NCO059625
South Saxapahaw Homeowners Association WTP, Alamance County
Dear Ms. McNamara:
Jenny Graznak of this office performed a Compliance Evaluation Inspection of the filter
backwash discharge from the green sandfilter treatment system for the South Saxapahaw
Homeowners Association WTP in Alamance County on September 20, 2011. The facility is located
at 1735 Moores Chapel Cemetery Road. This type of inspection consists of two basic parts: an in -
office review of facility files and self -monitoring data and an on -site inspection of the facility and its
discharge. This particular inspection evaluated eight (8) areas, and observations from each area are
addressed below:
1. Permit
The permit became effective June 1, 2006 and expired May 31, 2011. The permit is currently being
held by our Central Office while you await a final decision on the future of this dischhrge. Our office
understands that you are pursuing an alternative solution for the disposal of the system backwash,
specifically in the form of a subsurface septic tank and drain field on site. Ms. Graznak is aware of
the recent approval by the Alamance County Health Department for such a system. Please keep our
office updated on this process. Once the installed septic system is permitted and approved by
Alamance County, and the backwash is no longer discharging to waters of the State, you may apply
for a permit rescission.
2. Self -Monitoring Program
A review of the quarterly self -monitoring reports from September 2010 through June 2011 showed
no limit or monitoring frequency violations.
3. Laboratory
Meritech Laboratory collects quarterly samples at the site and performs all analyses. According to
lab data, the system continues to meet the Total Residual Chlorine (TRC) limit of 17 micrograms/liter
(0.017 milligrams/liter). Therefore, a dechlorination system is not necessary.
4. Flow Measurement
Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. The
operator measures the flow instantaneously using a bucket and a ruler.
5. Facility Site Review
The green sand filter system discharges filter backwash water from a well treatment system. The
community well provides drinking water for 42 households. Chemicals used in the treatment process
are chlorine and potassium permanganate.

'q The well system is currently being upgraded, and the site is in the middle of construction. Part of the
old well house building has been razed, and a section of the new building has been erected. The
new green sand filters are expected to go online soon. The construction is scheduled to be
completed in November 2011.
6. Operations & Maintenance
The supervising facility operator is Albert Mills. He and Donnie Wood perform daily operations at the
facility, including weekly backwashing. No major problems were noted with respect to facility
operation and maintenance. The Homeowners Association has two workdays per year for
maintenance of the facility where sand is raked and replaced if necessary. Sand was raked during
the workday in Spring 2011. Every three years the Association recharges one of the sandfilters,
making sure that there is at least 19 inches of sand.
7. Records/Reports
The Discharge Monitoring Reports (DMRs) and lab data are maintained according to the permit. A
copy of lab data and chain of custody reports were available for review. An annual report (Consumer
Confidence Report) is available to homeowners at their regularly scheduled meetings and is
mentioned in the HOA newsletter.
8. Effluent/Receiving Waters
The effluent is discharged into a small ditch, which leads to an unnamed tributary to Haw River.
There was no effluent at the time of the inspection, as discharge only occurs during weekly
backwash events.

We are contacting Terri to determine the next step.
Mark Averette is also preparing a letter for you to send to the permitting agency to advise them of the proposed course of
action to eliminate the discharge and make sure there are no other issues that relate to this change.
Also, the SSHOA will need an easement for this application area.
Do you want to make sure the property owner is still OK with the proposal, and then we can provide an easement/map for
his signature?
When we get additional information on the design/permitting/construction requirements, we will provide an estimate of
cost to amend our engineering agreement for these additional services.

We are requesting a renewal for our sand filtration system. Our community well of 42 households uses a
green sand filtration with a backwash. Chemicals used are chlorine and potassium permanganate.
We have two work days a year in which we clear any weeds from the sand bed and maintain proper
drainage of the bed.
Meritech Inc, visit's the site on a quarterly basis to test for total residue chlorine, PH, Iron, Manganese and
Total suspended solids. We are in compliant on all results.
Hopefully our water system will be updated by 2012. We are in the process of working with the USDA and
a local contractor. At this time no changes or updates have occurred.

Just wanted to let you know that I spoke with Greg yesterday. I gave him David
Goodrich's number in aquifer protection and told him any type of infiltration system that
would result in a discharge to groundwater instead of surface water would require approval
and a non -discharge permit from the aquifer protection group. It sounded like he already
had some conversations with someone in the group.

Jenny — if they are just installing new equipment for the drinking -water side, they need approval from DEH / Public
Water Supply. That would NOT require an AtC from us.
If they are changing the way they treat the drinking water, they will need to request a major permit mod. Going from
green sand to ion -exchange or softener recharge would change many limits, etc.
An AtC from us would be required if they change any components directly related to discharge of their backwash /
wastewater.
I'm copying Julie Grzyb, our resident WTP expert, on this. Contact Julie directly if you have more questions on this one.
Julie's worked hard to improve the WTP permitting guidance, so she'll have definitive answers that I might not.

I inspected the South Saxapahaw HOA Water Treatment Plant (NC0059625) yesterday. They have received a grant from
USDA and Rural Water to upgrade their well system. It is a fairly small system that provides drinking water to
approximately 25 homes. (You might remember their request last year to waive TRC testing.) As their engineer is
designing plans for the new system, I assume they should get in touch with NPDES permitting to determine if a
modification will be required for their permit? Would an A to C be required. I'm not sure if they will be building a new
green sand filter (like their current system) or something different. They are still in the planning phase with the
engineer. Thanks!

Dear Ms. McNamara:
Jenny Graznak and Mike Thomas of this office performed a Compliance Evaluation Inspection
of the filter backwash discharge from the green sandfilter treatment system for the South
Saxapahaw Homeowners Association WTP in Alamance County on September 16, 2010. The
facility is located at 1735 Moores Chapel Cemetery Road. Greg Germino from the Homeowners
Association was present for the inspection. This type of inspection consists of two basic parts: an in -
office review of facility files and self -monitoring data and an on -site inspection of the facility and its
discharge. This particular inspection evaluated eight (8) areas, and observations from each area are
addressed below:
1. Permit
The permit became effective June 1, 2006 and expires May 31, 2011. You should receive
information regarding the renewal of this permit in the coming months.
2. Self -Monitoring Program
A review of the quarterly self -monitoring reports from June 2009 through June 2010 showed no limit
or frequency violations.
3. Laboratory
As of April 2009, Donnie Wood is no longer collected the quarterly samples and sending to Pace
Analytical Laboratories for analysis. Instead, Meritech Laboratory is collecting samples at the site
and performing all analyses. According to lab data, the system has been meeting the new Total
Residual Chlorine (TRC) limit of 17 micrograms/liter (0.017 milligrams/liter) that took effect on
February 1, 2008. Therefore, a dechlorination system is not necessary at this time.
4. Flow Measurement
Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. The
operator measures the flow instantaneously using a bucket and a ruler.

operation and maintenance. The Homeowners Association has two workdays per year for
maintenance of the facility where sand is raked and replaced if necessary. Sand was raked during
the workday in Spring 2010. Every three years the Association recharges one of the sandfilters,
making sure that there is at least 19 inches of sand.
7. Records/Reports
The Discharge Monitoring Reports (DMRs) and lab data are maintained at the site according to the
permit. A copy of lab data and chain of custody reports were available for review during the
inspection.
An annual report (Consumer Confidence Report) is available to homeowners at their regularly
scheduled meetings and is mentioned in the HOA newsletter.
8. Effluent/Receiving Waters
The effluent is discharged into a small ditch, which leads to an unnamed tributary to Haw River.
There was no effluent at the time of the inspection, as discharge only occurs during weekly
backwash events.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.
The South Saxapahaw Homeowners Association is hereby authorized to:
1. Continue to operate a water treatment facility to treat the filter backwash from a
greensand filter system.

This letter is in response to your request letter to Charles Weaver, received March 9. Your request has
been discussed internally and also with the Winston-Salem Regional Office.
The Division cannot find sufficient justification to allow your request. Total Residual Chlorine (TRC)
monitoring is an important part of NPDES permitting, serving to keep excess chlorine out of the environment.
To be fair and consistent with Division policy, we must require you to adhere to the conditions of your permit,
monitoring for TRC on a quarterly basis. You should contact certified laboratories in your area for a quote to
accomplish this task.
Please be aware that if you do not currently have a dechlorination process, this must be added in order
to achieve the permit limit of 17 micrograms per liter allowable TRC. If you show consistent compliance with
this TRC limit, you may request a permit modification for a decrease in the required frequency of monitoring.

I have discussed this with Jenny and I just can;t find sufficient justification for their request. I'm sure there are hundreds others out there with the 17 ug limit that would like
the same break but we have a standard, we have a policy and we thus have to be consistent (whether its right or wrong).
They do discharge to a 0 flow stream. If they discharged to the middle of a field and had 100 yards of grass to the nearest ditch, I'd consider it, but that is not the case here.
I think to be fair and consistent with our actions to date, you guys need to deny her request in writing and pretty quickly and encourage her to contact multiple contract labs
to gets bids on their quarterly sampling. I think they collect the samples and take to Pace Analytical now. I do not think Pace is certified for field parameters. They
probably need to get up with R&A or other lab that is certified for their normal parameters and the field ones for a quote as well as Pace. They will have to add the
de-chlor no matter what. There are a lot of folks certified for field parameters. Might also give her the lab web site for lab certification that will have a listing of field

Only other thing I can think of would be to consider reducing the monitoring frequency to semi-annually or I'd be Rood with annually. I do not have a concern with this
discharge but if we accept the arguments they have made, we will have to deal with other requests as the word spreads.

Best advice I can come up with this morning.

Hi, Steve:
I'm looking for some advice on how to handle this request - see attached.
With their good compliance history, are we being unreasonable to require
these guys to do the low-level TRC testing? I think they could find a
spectrophotometer for cheaper than what they said, which was $4500.
I may be willing to consider them using some other, cheaper measurement
equipment, but that wouldn't get down to the number on their permit. Any
thoughts?

We request a waiver from performing Total Residual Chlorine test on our small nonprofit community water
system supporting 40 moderate to low income households. We believe the evidence shows the current system's
impact is negligible on the local tributary while the cost to comply with this additional protective testing would pose
a significant burden on our community with little to no benefit.
Our water system uses a greensand filter system and then discharge the backwash from these filters into a
contained concrete sand filtration system. The sand we use is a uniformity to efficient<1.70% with an effective
size of 0.35mm to 0.55mm with a minimum dust content. Routine maintenance of the sand filtration is done by
the homeowners during our community work days. At the low end of the filtration system is a 4 inch pipe that
drains into an unnamed tributary. This maybe a slow drip to no flow most of the time. Moreover, at the time of
backwash which occurs only twice a month, our operator turns off the chlorine pump to further ensure any levels
are minimal.
Pace Labs collects our quarterly grab samples. The time restraint of 15 minutes with the residual chlorine test
does not allow Pace Labs to run this test. This would require our purchase of a $4500 machine to do onsite
testing. Our well operator would need to be certified plus meet the yearly competency requirements. This
additional cost would pose an enormous undo burden on our small community.
Our system has been operational for 26 years. We have not had any violations of limits. We did have a failure to
turn in the DMR on time 2 years ago. We made a corrective action plan and have been in compliance since.
Our unnamed tributary is 1467 feet from the Haw River and the tributary shows a healthy supply of flower and
fauna growth indicating the lack of any adverse impact due our minor effluent flow.

As we talked about on the phone earlier, you should send a request to Charles Weaver
in the NPDES Unit of DWQ (in our central office) for a waiver from Total Residual
Chlorine monitoring. In the letter, explain the situation and the hardship and try
to make a case for why there is so little risk from your facility's discharge. Tell
him about how the chlorine is turned off before backwashing events. And tell him
that you guys have never had problems meeting your other limits. As far as I can
tell, you have never had a Violation of limits, just for failure to turn in the DMRs
on time.
I looked on a topographical map and determined that the discharge point for your
system is 1468 feet from the Haw River, that's about a quarter of a mile. The
central office makes determinations like these in large part by evaluating a "7Q10,"
which is the streamflow that occurs over 7 consecutive days and has a 10-year
recurrence interval period, or a 1 in 10 chance of occurring in any one year. Daily
streamflows in the 7Q10 range are general indicators of prevalent drought conditions
which normally cover large areas. In other words, if there was no flow in the stream
due to drought conditions, would the facility's discharge have a negative impact on
the stream? The only 7Q10 data I could find for the Haw River was at the Graham
Wastewater Treatment Plant (at Haw River & NC-54), which is about 8 miles north of
Saxapahaw, with a result of 34 cubic feet per second. That's somewhat low, so I'm
wondering if that will be a problem for you. But it certainly does not hurt to try!

Dear Ms. McNamara:
Jenny Graznak of this office performed a Compliance Evaluation Inspection of the filter
backwash discharge from the green sandfilter treatment system for the South Saxapahaw
Homeowners Association WTP in Alamance County on November 5, 2008. The facility is
located at 1735 Moores Chapel Cemetery Road. This type of inspection consists of two basic
parts: an in -office review of facility files and self -monitoring data and an on -site inspection of the
facility and its discharge. This particular inspection evaluated eight (8) areas, and observations
from each area are addressed below:
1. Permit
The permit became effective June 1, 2006 and expires May 31, 2011.
2. Self -Monitoring Program
A review of the quarterly self -monitoring reports from September 2007 through June 2008
showed no limit or frequency violations.
3. Laboratory
Donnie Wood collects the quarterly samples and sends them to Pace Analytical Laboratories for
analysis. Please note that the new Total Residual Chlorine (TRC) limit is 17 micrograms/liter
(0.017 milligrams/liter) and took effect on February 1, 2008. Therefore you are required to use a
meter that can detect this low level of TRC. During a phone conversation on November 6,
2008, operator Donnie Wood believed he would be able to borrow such a meter for the quarterly
monitoring events. Therefore, Mr. Wood will need to acquire a field parameter certification for
TRC measurements. Guidance and an application for this certification are attached to this
letter. Please note that this certification requires a $100 annual fee.
As discussed during the inspection, the operator switches off the chlorine pump prior to and
during the weekly backwash events in order to maintain a low level of chlorine in the effluent.
Therefore, a dechlorination system is not necessary at this time.
4. Flow Measurement
Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. The
operator measures the flow instantaneously using a bucket and a ruler.
5. Facility Site Review
The sand filter system discharges filter backwash water from a drinking well treatment system.

6. Operations & Maintenance
The supervising facility operator is Jim Gile and the Back -Up Operator is Albert Mills. Donnie
Wood performs most daily operations at the facility, including weekly backwashing. No major
problems were noted with respect to facility operation and maintenance. The Homeowners
Association has two workdays per year for maintenance of the facility where sand is raked and
replaced if necessary. Sand was raked in July 2008. Every three years the Association
recharges one of the sandfilters, making sure that there is at least 19 inches of sand.
7. Records/Reports
The Discharge Monitoring Reports (DMRs) and lab data are maintained at the site according to
the permit. A copy of lab data and chain of custody reports were available for review during the
inspection.
An annual report (Consumer Confidence Report) is available to homeowners at their regularly
scheduled meetings and is mentioned in the HOA newsletter.
8. Effluent/Receivinq Waters
The effluent is discharged into a small ditch, which leads to an unnamed tributary to Haw River.
There was no effluent at the time of the inspection, as discharge only occurs during weekly
backwash events.

1. Permit
The permit became effective June 1, 2006 and expires May 31, 2011.
2. Self -Monitoring Program
A review of the quarterly self -monitoring reports from September 2007 through June 2008 showed no limit
or frequency violations.
3. Laboratory
Donnie Wood collects the quarterly samples and sends them to Pace Analytical Laboratories for analysis.
Please note that the new Total Residual Chlorine (TRC) limit is 17 micrograms/liter (0.017 milligrams/liter)
and took effect on February 1, 2008. Therefore you are required to use a meter that can detect this low
level of TRC. During a phone conversation on November 6, 2008, operator Donnie Wood believed he
would be able to borrow such a meter for the quarterly monitoring events. Therefore, Mr. Wood will need to
acquire a field parameter certification for TRC measurements. Guidance and an application for this
certification are attached to this letter. Please note that this certification requires a $100 annual fee.
As discussed during the inspection, the operator switches off the chlorine pump prior to and during the
weekly backwash events in order to maintain a low level of chlorine in the effluent. Therefore, a
dechlorination system is not necessary at this time.
4. Flow Measurement
Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. The operator
measures the flow instantaneously using a bucket and a ruler.
5. Facility Site Review
The sand filter system discharges filter backwash water from a drinking well treatment system.
6. Operations & Maintenance
The supervising facility operator is Jim Gile and the Back -Up Operator is Albert Mills. Donnie Wood
performs most daily operations at the facility, including weekly backwashing. No major problems were
noted with respect to facility operation and maintenance. The Homeowners Association has two workdays
per year for maintenance of the facility where sand is raked and replaced if necessary. Sand was raked in
July 2008. Every three years the Association recharges one of the sandfilters, making sure that there is at
least 19 inches of sand.
7. Records/Reports
The Discharge Monitoring Reports (DMRs) and lab data are maintained at the site according to the permit.
A copy of lab data and chain of custody reports were available for review during the inspection.
An annual report (Consumer Confidence Report) is available to homeowners at their regularly scheduled
meetings and is mentioned in the HOA newsletter.
8. Effluent/Receiving Waters
The effluent is discharged into a small ditch, which leads to an unnamed tributary to Haw River. There was
no effluent at the time of the inspection, as discharge only occurs during weekly backwash events.

Dear Ms. McNamara:
Jenny Freeman of this office performed a Compliance Evaluation Inspection filter
backwash discharge from the green sandfilter treatment system for the South Saxapahaw
Homeowners Association WTP in Alamance County on October 25, 2007. As the designated
permittee, you were present for the inspection. This type of inspection consists of two basic
parts: an in -office review of facility files and self -monitoring data and an on -site inspection of the
facility. This particular inspection evaluated eight (8) areas, and observations from each area
are addressed below:
1. Permit
The permit became effective June 1, 2006 and expires May 31, 2011. A copy of the current
permit was available during the inspection.
2. Self -Monitoring Program
This facility received a Notice of Incomplete DMR dated November 16, 2006 from the NPDES
Unit in DWQ Central Office. Please make certain that DMRs to be submitted to DWQ are
complete and legible.
A review of the monthly self -monitoring reports from September 2006 through August 2007
showed no limit violations. Please note in the current permit text that monitoring for zinc is
required only if the facility uses any zinc -based additive in the water treatment process. If not,
you can remove this parameter from your monitoring requirements.
The new TRC limit is 17 micrograms/liter (0.017 milligrams/liter) and takes effect on February 1,
2008. As discussed during the inspection, you are not reaching detectable levels of TRC since
the operator switches off the chlorine pump prior to and during the weekly backwash events.
3. Laboratory
Donnie Wood collects the samples. Pace Analytical picks samples up at the facility and
performs all analyses.
4. Flow Measurement
Effluent flow is estimated by the operator on a quarterly basis, as required by the permit.
Operator measures the flow instantaneously using a bucket and a ruler.

Monitoring Report (DMR) from your facility. As you may know, the data recorded on your DMR is keyed
into the Division's database. Our data entry staff has informed me of problems with your recent DMR
submittal. Until these problems have been corrected, your DMR will be considered incomplete. Please
see the attached form along with a copy of the problem DMR for details regarding the DMR's deficiency.
Incomplete or illegible DMRs affect our staffs ability to provide a timely and effective evaluation of DMR
submittals. Please be aware that until the Division receives a corrected DMR, you may be considered
noncompliant with your NPDES permit and 15A NCAC 02B .0506, and you may be subject to further
enforcement action. Please take the necessary steps to correct the problems and submit two copies of the

DMR submitted for December 2005. Please re -submit this DMR with the appropriate codes and
units.
A review of the monthly self -monitoring reports from September 2005 through August 2006
showed no limit violations. In the new permit, monitoring for Turbidity and Settleable Solids has
been deleted. New limits for Total Residual Chlorine and pH have been added. The monitoring
requirements for this permit are as follows: flow, total suspended solids, total residual chlorine
(TRC), iron, manganese, zinc and pH.
The new TRC limit is 17 micrograms/liter (0.017 milligrams/liter) and takes effect on February 1,
2008. Between now and then, you will need to set up a dechlorination system at your facility. I
have attached the necessary paperwork you will need to start this process. You will need to
seek the services of a certified engineer to design the system. Please contact our office with

1. Permit
The current permit became effective June 1, 2006 and expires May 31, 2011. A copy of the permit was
available during the inspection.
2. Self -Monitoring Program
This facility received a Notice of Incomplete DMR dated February 1, 2006 from the NPDES Unit in DWQ
Central Office for failure to include correct Parameter Codes or Units of Measure for the DMR submitted for
December 2005. Please re -submit this DMR with the appropriate codes and units.
A review of the monthly self -monitoring reports from September 2005 through August 2006 showed no limit
violations. In the new permit, monitoring for Turbidity and Settleable Solids has been deleted. New limits
for Total Residual Chlorine and pH have been added.The monitoring requirements for this permit are as
follows: flow, total suspended solids, total residual chlorine (TRC), iron, manganese, zinc and pH.
The new TRC limit is 17 micrograms/liter (0.017 milligrams/liter) and takes effect on February 1, 2008.
Between now and then, you will need to set up a dechlorination system at your facility. I have attached the
necessary paperwork you will need to start this process. You will need to seek the services of a certified
engineer to design the system. Please contact our office with any questions.
3. Laboratory
Donnie Wood collects the samples. Pace Analytical picks samples up at the facility and performs all
analyses.
4. Flow Measurement
Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. Operator
measures the flow instantaneously using a bucket and.a ruler.
5. Facility Site Review
The sand filter system discharges filter backwash water from a drinking well treatment system.
6. Operations & Maintenance
The supervising facility operator is Jim Gile. Donnie Wood performs most daily operations at the facility,
including weekly backwashing. No major problems were noted with respect to facility operation and
maintenance. The Homeowners Association has two workdays per year for maintenance of the facility
where sand is raked and replaced if necessary. Sand was replaced in summer of 2006. Every three years
the Association recharges one of the sandfilters.
7. Records/Reports
The Discharge Monitoring Reports (DMRs) and lab data are maintained at the site according to the permit.
A copy of lab data and chain of custody reports were available for review during the inspection.
An annual report (Consumer Confidence Report) is available to homeowners at their regularly scheduled
meetings.
8. Effluent/Receiving Waters
The effluent is discharged into a small ditch, which leads to an unnamed tributary to Haw River. There was
no effluent at the time of the inspection, as discharge only occurs during weekly backwash events.

The draft permit contains the following significant changes from your current
permit:
➢ The Division's revised policy for greensand systems has been applied to this permit. New
limits for Total Residual Chlorine and pH have been added. Monitoring for Turbidity and
Settleable Solids has been deleted. See the attached permitting strategy document for
details.
Be aware that the Haw River is listed as an impaired stream on North Carolina's 303(d) list.
This means that the stream does not meet all water quality standards. Although the Division
believes multiple sources are causing degradation to the Haw River, we will continue to monitor
compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a
direct cause of stream degradation, the Division will recommend removal of your discharge. Part
III of your permit requires you to "continually evaluate all wastewater disposal alternatives and
pursue the most environmentally sound alternative of the reasonably cost effective alternatives"
to surface water discharge. Such an evaluation may help you find an alternative to surface water
discharge that is more appropriate for your facility.
Your facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water
Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of
nutrients from all discharges to NSW waters. Any new (or expanding) discharge will be subject to
nutrient limitations for total nitrogen and total phosphorus according to House Bill 515
requirements. Since modifications to treatment systems are expensive and time consuming, it is

PERMITTING STRATEGY FOR GREENSAND FILTRATION WATER TREATMENT PLANTS
January 2004
Applicability: The following permitting strategy applies to new and existing water treatment plants using
greensand filtration to generate potable water from groundwater. This permitting strategy does not apply to any
other kind of cationic exchange unit used in water treatment. If any portion of the water treatment process
includes an ion exchange/water softener unit, then the RO-IE Permitting Strategy will apply as well.
A sample effluent limits page is attached to this strategy for guidance purposes.
Description of Technology: Typically, the greensand filtration unit is preceded by the use of an aeration tower
along with potassium permanganate to oxidize dissolved iron in the ground water. The particulate ferric
hydroxide (and some minor quantities of soluble ferrous material) is then removed via filtration through a
manganese based "greensand" media. Greensand'is a proprietary material that does not require sodium cycle
regeneration, only backwash with finished (potable) water. Since the discharge from such a facility is not as
saline as that from a sodium cycle cationic exchange unit, this may be considered a more environmentally -
friendly technology for the treatment of groundwater. Filter backwash water is usually collected in a settling
basin, and the supernatant is then discharged to surface waters or a regional treatment works.
Typical chemical additives to such treatment systems are an anti-scalant (such as zinc orthophosphate), fluoride
(to help prevent dental cavities), chlorine and potassium permanganate.
Application Requirements for New Permittees: In addition to the appropriate NPDES application and fee,
new Permittees should also include the following in the application package:
• Description of the proposed water treatment system with a process schematic
• Map of proposed discharge location, indicating precise latitude and longitude
• Proposed flow rate for treated potable water and filter backwash water
• List of proposed chemical additives
• Chemical analyses of the source water (most notably, heavy metals and other parameters as
described in "Assessment and Recommendations for Water Treatment Plant Permitting," an
amended version is provided in Table 1, below)
• Description of proposed treatment for filter backwash
• Residuals Management Plan
• Engineering Alternatives Analysis

If any of the above requirements are missing, the application package should be returned. Unlike other cationic
exchange systems, the filter backwash from these systems is not saline, so non -discharge options are considered
potentially viable options for the Engineering Alternatives Analysis. The Residuals Management Plan should, at
a minimum, describe the frequency with which solids will be removed from the settling basin and their ultimate
disposal method.
Permitting Requirements: Some permitting decisions may be made on a site -specific basis, but the following
provides a list of required monitoring parameters:
• Flow
• Total Suspended Solids
• pH
• Iron
• Manganese
• Fluoride
• Chlorine
• Zinc
Flow
Flow should be monitored (as per Table 2). Intermittent dischargers should also report the duration of
discharge.
Total Suspended Solids
Total Suspended Solids (TSS) is a parameter that, although a general indicator, ensures proper operation and
maintenance are maintained. Specifically, TSS documents that the settling basin is properly designed and
operated. Moreover, if the source water well screens are not well installed, the raw water will be more turbid
than normal, which will in turn increase the TSS in the filter backwash. TSS will be limited at a monthly
average value of 30.0 mg/L and a daily maximum value of 45.0 mg/L.
pH
Some of the chemicals used in water treatment can depress or raise pH, and as such, it should be monitored and
limited. For discharges to fresh waters, pH will be limited in the range of 6-9 standard units. For salt waters,
pH should be limited between 6.8 and 8.5 standard units. This is consistent with the permitting strategies for all
other types of water treatment plants.
Iron and Manganese
Iron and manganese are considered the primary pollutants of concern for such discharges. Present in the
groundwater and removed through filtration by the greensand media, iron and manganese are ultimately
concentrated in the filter backwash. These parameters are monitored only; see Table 2, as no standards exist for
either pollutant.
Fluoride
Since fluoride is an additive to finished water, which in turn is used for backwash water, it is considered a
pollutant of concern. The permit writer should verify the proposed dosing rate for the system in order to
determine the necessity of a limit for fluoride.
Chlorine
As with fluoride, chlorine is a chemical additive to finished water and is therefore a pollutant of concern. Since
chlorine can have severe effects on instream toxicity, it must be limited, as with all other water treatment plants
in the state. Chlorine limits should be between 17-28 µg/L, as per Division of Water Quality policy.

Zinc
Zinc should be included as a monitoring parameter with a footnote stating, "Zinc shall be monitored if the
permittee uses any zinc -based additive in the water treatment process." Since many water treatment facilities
have traditionally used zinc orthophosphate as an anti-scalant, zinc can be a pollutant of concern depending on
the selection of water treatment additives.
Additional Parameters of Concern
Additional parameters of concern, most notably metals, may be identified in the application package and source
water data. Source water data should be entered into a Reasonable Potential Analysis (RPA) in order to assess
the need for limits. Such determinations are to be made on a case -by -case basis.
Monitoring Frequencies: Monitoring frequencies for the above listed parameters are summarized in Table 2.
Since discharges from greensand filtration water treatment plants do not tend to be continuous, grab samples
should be adequate to characterize the discharge.

This letter transmits a notice of a civil penalty assessed against South Saxapahaw Home Owners in the
amount of $ f o o . b G (including $100.00 in enforcement costs).
This assessment is based upon the following facts: the third quarter 2005 discharge monitoring report
("DMR") was not filed with the Division of Water Quality within the thirty (30) day reporting period
in accordance with the monitoring and reporting requirements contained in the subject NPDES permit.
A Notice of Violation was sent to the facility dated September 8, 2005, for failure to submit the 2nd
quarter 2005 DMR. Within said notice, you were informed that future reports not received within the
required timeframe would result in a recommendation for assessment of civil penalties. As of the date
of this document, DWQ has not received the Yd quarter 2005 DMR.
The State's enforcement costs in this matter may be assessed against South Saxapahaw Home Owners
pursuant to NCGS. 143-215.3(a)(9) and NCGS 143B-282.1(b)(8).
Based upon the above facts, I conclude as a matter of law that South Saxapahaw Home Owners
violated the terms, conditions or requirements of NPDES Permit NCO059625 and G.S. 143-215.65 in
the manner and extent shown above. In accordance with the maximums established by G.S. 143-
215.6A(a)(2), a civil penalty may be assessed against any person who violates the terms, conditions or
requirements of a permit required by G.S. 143-215. 1 (a).
Based upon the above findings of fact and conclusions of law, and in accordance with authority
provided by the Secretary of the Department of Environment and Natural Resources and the Director
of the Division of Water Quality, I hereby make the following civil penalty assessment against South
Saxapahaw Home Owners:

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the
Findings of Fact and Conclusions of Law and the factors set forth at G.S. 143B-282. I (b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the public health, or to
private property resulting from the violation;
(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs over which
the Environmental Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.
Within thirty days of receipt of this notice, you must do one of the following:

2. Submit a written request for remission or mitigation including a detailed justification for
such request:
Please be aware that a request for remission is limited to consideration of the five factors listed
below as they may relate to the reasonableness of the amount of the civil penalty assessed.
Requesting remission is not the proper procedure for contesting whether the violation(s) occurred or
the accuracy of any of the factual statements contained in the civil penalty assessment document.
Because a remission request forecloses the option of an administrative hearing, such a request must
be accompanied by a waiver of your right to an administrative hearing and a stipulation and
agreement that no factual or legal issues are in dispute. Please prepare a detailed statement that
establishes why you believe the civil penalty should be remitted, and submit it to the Division of
Water Quality at the address listed below. In determining whether a remission request will be
approved, the following factors shall be considered:
(1) whether one or more of the civil penalty assessment factors in NCGS 143B-282. I (b) was
wrongfully applied to the detriment of the petitioner;
(2) whether the violator promptly abated continuing environmental damage resulting from the
violation;
(3) whether the violation was inadvertent or a result of an accident;
(4) whether the violator had been assessed civil penalties for any previous violations; or
(5) whether payment of the civil penalty will prevent payment for the remaining necessary remedial
actions.

Please note that all evidence presented in support of your request for remission must be submitted in
writing. The Director of the Division of the Division of Water Quality will review your evidence and
inform you of his decision in the matter of your remission request. The response will provide details
regarding the case status, directions for payment, and provision for further appeal of the penalty to the
Environmental Management Commission's Committee on Civil Penalty Remissions (Committee).
Please be advised that the Committee cannot consider information that was not part of the original
remission request considered by the Director. Therefore, it is very important that you prepare a
complete and thorough statement in support of your request for remission.
In order to request remission, you must complete and submit the enclosed "Request for Remission of
Civil Penalties, Waiver of Right to an Administrative Hearing, and Stipulation of Facts" form within
thirty (30) days of receipt of this notice. The Division of Water Quality also requests that you

Dear Permittee:
Your NPDES permit expires on May 31, 2006. Federal (40 CFR 122.41) and North Carolina (15A NCAC
2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior to expiration of
the current permit. If you have already mailed your renewal application, you may disregard this notice.
To satisfy this requirement, your renewal package must be sent to the Division postmarked no later than
December 2, 2005. Failure to request renewal by this date may result in a civil assessment of at least $500.00.
Larger penalties may be assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after May 31, 2006, the current permit must be renewed. Discharge of
wastewater without a valid permit would violate North Carolina General Statute 143-215.1; unpermitted discharges of
wastewater may be assessed civil penalties of up to $25,000 per day.

The following items are REQUIRED for all renewal packages:
o A cover letter requesting renewal of the permit and documenting any changes at the facility since
issuance of the last permit. Submit one signed original and two copies.
o The completed application form (copy attached), signed by the permittee or an Authorized
Representative. Submit one signed original and two copies.
o If an Authorized Representative (such as a consulting engineer or environmental consultant) prepares
the renewal package, written documentation must be provided showing the authority delegated to any
such Authorized Representative (see Part II.B.11.b of the existing NPDES permit).
o A narrative description of the sludge management plan for the facility. Describe how sludge (or other
solids) generated during wastewater treatment are handled and disposed. If your facility has no such
plan (or the permitted facility does not generate any solids), explain this in writing. Submit one signed
original and two copies.
The following items must be submitted by any Municipal or Industrial facilities discharging
process wastewater:
Industrial facilities classified as Primary Industries (see Appendices A-D to Title 40 of the Code of Federal
Regulations, Part 122) and ALL Municipal facilities with a permitted flow > 1.0 MGD must submit a
Priority Pollutant Analysis (PPA) in accordance with 40 CFR Part 122.21.
The above requirement does NOT apply to privately owned facilities treating 100%
domestic wastewater, or facilities which discharge non process wastewater (cooling
water, filter backwash, etc.)

Due to a change in fees effective January 1, 1999, there is no renewal fee required with your

Dear Ms. McNamara:
Jenny Freeman of this office performed a Compliance Evaluation Inspection filter
backwash discharge from the green sandfilter treatment system for the South Saxapahaw
Homeowners Association WTP in Alamance County on August 1, 2005. As the designated
permittee, you were present for the inspection. This type of inspection consists of two basic
parts: an in -office review of facility files and self -monitoring data and an on -site inspection of the
facility. This particular inspection evaluated eight (8) areas, and observations from each area
are addressed below:
1. Permit
The permit became effective June 1, 2001 and expires May 31, 2006. A copy of the permit was
available during the inspection.
2. Self -Monitoring Program
The facility received a Notice of Violation dated May 27, 2005 from the NPDES Unit in DWQ
Central Office for failure to submit the first quarter monitoring report for 2005. This report was
received by DWQ in July 2005. Please note that timely submittal of discharge submittal reports
is essential to the efficient operation of our water quality programs.
The monitoring requirements for this permit are as follows: flow, total suspended residue,
settleable solids, turbidity, total residual chlorine, and iron. A review of the monthly self -
monitoring reports from March 2004 through March 2005 showed no limit violations. However,
it was noted during a file review that laboratory results from total suspended residue analysis
were not transcribed onto the discharge monitoring reports for the period of March 2004 through
March 2005. Please re -submit these reports, with results for ALL required parameters.
3. Laboratory
Pace Analytical picks up effluent and upstream/downstream samples at the facility and performs
all analyses.
4. Flow Measurement
Effluent flow is estimated by the operator on a quarterly basis, as required by the permit.
5. Facility Site Review
The sand filter system discharges filter backwash water from a drinking well treatment system.

The supervising facility operator is Jim Gile. Donnie Wood performs most daily operations at
the facility, including weekly backwashing. No major problems were noted with respect to
facility operation and maintenance. There was some vegetation growing in the bed of the sand
filter. The Homeowners Association has two workdays per year for maintenance of the facility
where sand is raked and replaced if necessary.
7. Records/Reports
The Discharge Monitoring Reports (DMRs) and lab data are maintained according to the permit.
DMRs include all permit parameters, except total suspended residue data. A copy of lab data
was available for review during the inspection.
An annual report has not been prepared for this facility. Please refer to the attached sheets for
information regarding this requirement.
8. Effluent/Receiving Waters
The effluent is discharged into a small drainage ditch, which leads to an unnamed tributary to
Haw River. At the time of the inspection, the effluent appeared clear with no traceable solids.

thirtieth (30th) day following the reporting period. Failure to submit reports as required will subject the
violator to the assessment of a civil penalty of up to $25,000 per violation. You will be considered

A Compliance Evaluation Inspection was performed on the filter backwash discharge
from the green sandfilter treatment system for the South Saxapahaw Homeowners Association
in Alamance County by Jenny Freeman of this office on July 29, 2004. You were present for the
inspection. This type of inspection consists of two basic parts: an in -office review of facility files
and self -monitoring data; and an on -site inspection of the facility.
A review of the self -monitoring data submitted for the period March 2003 through March
2004 showed that all parameters were sampled and analyzed per the requirements of the
permit, with the exception of flow. The permit requires that instantaneous effluent flow
measurements be taken on a quarterly basis. This can be an estimate based on backwash
events (time and volume). Please take the necessary corrective actions for this deficiency. In
regards to compliance with effluent limits, an evaluation of the effluent data for the same time
period revealed complete compliance.
This letter is being issued as a Notice of Deficiency because of the deficiencies noted in
regards to effluent flow measurement. Attached you will find a Water Pollution Control System
ORC Designation Form. Please complete and return to the address specified on the form. This
will update our database of ORC/Back-Up ORC changes. Please refer to the attached report
for specific details from the inspection. If you have any questions concerning this report, please

All monitoring, except effluent flow, is performed per the frequencies specified in the permit. The
Association would like to request a reduction in monitoring frequency at the next permit renewal. Ms. McNamara
would prefer bi-annual monitoring if possible to reduce costs.

Let's plan on 10am July 29. I will need to see the following during the inpsection:
(1) Lab data from the quarterly monitoring that is required by the permit for the last year with chain
of custoday forms, etc.
(2) Operator logs (might need to get from the well operator prior to inspection time)
(3) complete copy of the NPDES permit
(4) Operator and Back-up Operator names, contact info, and certification numbers
(5) Flow meter calibration records (if applicable)
(6) Field parameter certification # for the operator (might need to get from the well operator prior to
inspection time)
(7) Maintenance records for the facility
