This is in violation of Part II, condition D(2) of the NPDES permit, as well as 15A NCAC 2B .506(a), which requires the submittal of Discharge Monitoring Reports no later than the last calendar day following the reporting period. Failure to submit reports as required will subject the violator to the assessment of a civil penalty of up to $25,000 per violation. You will be considered noncompliant with the self -monitoring requirements of your NPDES permit until the report has been submitted. To prevent further action, please submit said report within fifteen (15) days of receipt of this notice. Additionally, this letter provides notice that this office will recommend the assessment of civil penalties if future reports are not received within the required time frame during the next twelve (12) reporting months. The Division must take these steps because timely submittal of discharge monitoring reports is essential to the efficient operation of our water quality programs. Sullins Dee Freeman Governor Director Secretary September 30, 2011 Ms. Lorraine McNamara South Saxapahaw Homeowners Association Post Office Box 217 Saxapahaw, North Carolina 27340 SUBJECT: Compliance Evaluation Inspection — NPDES Permit No. NCO059625 South Saxapahaw Homeowners Association WTP, Alamance County Dear Ms. McNamara: Jenny Graznak of this office performed a Compliance Evaluation Inspection of the filter backwash discharge from the green sandfilter treatment system for the South Saxapahaw Homeowners Association WTP in Alamance County on September 20, 2011. The facility is located at 1735 Moores Chapel Cemetery Road. This type of inspection consists of two basic parts: an in - office review of facility files and self -monitoring data and an on -site inspection of the facility and its discharge. This particular inspection evaluated eight (8) areas, and observations from each area are addressed below: 1. Permit The permit became effective June 1, 2006 and expired May 31, 2011. The permit is currently being held by our Central Office while you await a final decision on the future of this dischhrge. Our office understands that you are pursuing an alternative solution for the disposal of the system backwash, specifically in the form of a subsurface septic tank and drain field on site. Ms. Graznak is aware of the recent approval by the Alamance County Health Department for such a system. Please keep our office updated on this process. Once the installed septic system is permitted and approved by Alamance County, and the backwash is no longer discharging to waters of the State, you may apply for a permit rescission. 2. Self -Monitoring Program A review of the quarterly self -monitoring reports from September 2010 through June 2011 showed no limit or monitoring frequency violations. 3. Laboratory Meritech Laboratory collects quarterly samples at the site and performs all analyses. According to lab data, the system continues to meet the Total Residual Chlorine (TRC) limit of 17 micrograms/liter (0.017 milligrams/liter). Therefore, a dechlorination system is not necessary. 4. Flow Measurement Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. The operator measures the flow instantaneously using a bucket and a ruler. 5. Facility Site Review The green sand filter system discharges filter backwash water from a well treatment system. The community well provides drinking water for 42 households. Chemicals used in the treatment process are chlorine and potassium permanganate. Part of the old well house building has been razed, and a section of the new building has been erected. The new green sand filters are expected to go online soon. The construction is scheduled to be completed in November 2011. 6. Operations & Maintenance The supervising facility operator is Albert Mills. He and Donnie Wood perform daily operations at the facility, including weekly backwashing. No major problems were noted with respect to facility operation and maintenance. The Homeowners Association has two workdays per year for maintenance of the facility where sand is raked and replaced if necessary. Sand was raked during the workday in Spring 2011. Every three years the Association recharges one of the sandfilters, making sure that there is at least 19 inches of sand. 7. Records/Reports The Discharge Monitoring Reports (DMRs) and lab data are maintained according to the permit. A copy of lab data and chain of custody reports were available for review. An annual report (Consumer Confidence Report) is available to homeowners at their regularly scheduled meetings and is mentioned in the HOA newsletter. 8. Effluent/Receiving Waters The effluent is discharged into a small ditch, which leads to an unnamed tributary to Haw River. There was no effluent at the time of the inspection, as discharge only occurs during weekly backwash events. Please refer to the attached report for specific details from the inspection. They have received a grant from USDA and Rural Water to upgrade their well system. It is a fairly small system that provides drinking water to approximately 25 homes. (You might remember their request last year to waive TRC testing.) As their engineer is designing plans for the new system, I assume they should get in touch with NPDES permitting to determine if a modification will be required for their permit? Would an A to C be required. I'm not sure if they will be building a new green sand filter (like their current system) or something different. They are still in the planning phase with the engineer. The facility is located at 1735 Moores Chapel Cemetery Road. Greg Germino from the Homeowners Association was present for the inspection. This type of inspection consists of two basic parts: an in - office review of facility files and self -monitoring data and an on -site inspection of the facility and its discharge. This particular inspection evaluated eight (8) areas, and observations from each area are addressed below: 1. Permit The permit became effective June 1, 2006 and expires May 31, 2011. You should receive information regarding the renewal of this permit in the coming months. 2. Self -Monitoring Program A review of the quarterly self -monitoring reports from June 2009 through June 2010 showed no limit or frequency violations. 3. Laboratory As of April 2009, Donnie Wood is no longer collected the quarterly samples and sending to Pace Analytical Laboratories for analysis. Instead, Meritech Laboratory is collecting samples at the site and performing all analyses. According to lab data, the system has been meeting the new Total Residual Chlorine (TRC) limit of 17 micrograms/liter (0.017 milligrams/liter) that took effect on February 1, 2008. Therefore, a dechlorination system is not necessary at this time. 4. Flow Measurement Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. I'm sure there are hundreds others out there with the 17 ug limit that would like the same break but we have a standard, we have a policy and we thus have to be consistent (whether its right or wrong). They do discharge to a 0 flow stream. If they discharged to the middle of a field and had 100 yards of grass to the nearest ditch, I'd consider it, but that is not the case here. I think to be fair and consistent with our actions to date, you guys need to deny her request in writing and pretty quickly and encourage her to contact multiple contract labs to gets bids on their quarterly sampling. I think they collect the samples and take to Pace Analytical now. I do not think Pace is certified for field parameters. They probably need to get up with R&A or other lab that is certified for their normal parameters and the field ones for a quote as well as Pace. They will have to add the de-chlor no matter what. There are a lot of folks certified for field parameters. Might also give her the lab web site for lab certification that will have a listing of field certified labs and or individuals.<http://h2o.enr.state.nc.us/lab/CertifiedLaboratoryLists.htm> Only other thing I can think of would be to consider reducing the monitoring frequency to semi-annually or I'd be Rood with annually. In the letter, explain the situation and the hardship and try to make a case for why there is so little risk from your facility's discharge. Tell him about how the chlorine is turned off before backwashing events. And tell him that you guys have never had problems meeting your other limits. As far as I can tell, you have never had a Violation of limits, just for failure to turn in the DMRs on time. I looked on a topographical map and determined that the discharge point for your system is 1468 feet from the Haw River, that's about a quarter of a mile. The central office makes determinations like these in large part by evaluating a "7Q10," which is the streamflow that occurs over 7 consecutive days and has a 10-year recurrence interval period, or a 1 in 10 chance of occurring in any one year. Daily streamflows in the 7Q10 range are general indicators of prevalent drought conditions which normally cover large areas. In other words, if there was no flow in the stream due to drought conditions, would the facility's discharge have a negative impact on the stream? The only 7Q10 data I could find for the Haw River was at the Graham Wastewater Treatment Plant (at Haw River & NC-54), which is about 8 miles north of Saxapahaw, with a result of 34 cubic feet per second. That's somewhat low, so I'm wondering if that will be a problem for you. But it certainly does not hurt to try! Good luck! And call with any questions. This permitting strategy does not apply to any other kind of cationic exchange unit used in water treatment. If any portion of the water treatment process includes an ion exchange/water softener unit, then the RO-IE Permitting Strategy will apply as well. A sample effluent limits page is attached to this strategy for guidance purposes. Description of Technology: Typically, the greensand filtration unit is preceded by the use of an aeration tower along with potassium permanganate to oxidize dissolved iron in the ground water. The particulate ferric hydroxide (and some minor quantities of soluble ferrous material) is then removed via filtration through a manganese based "greensand" media. Greensand'is a proprietary material that does not require sodium cycle regeneration, only backwash with finished (potable) water. Since the discharge from such a facility is not as saline as that from a sodium cycle cationic exchange unit, this may be considered a more environmentally - friendly technology for the treatment of groundwater. Filter backwash water is usually collected in a settling basin, and the supernatant is then discharged to surface waters or a regional treatment works. Typical chemical additives to such treatment systems are an anti-scalant (such as zinc orthophosphate), fluoride (to help prevent dental cavities), chlorine and potassium permanganate. Application Requirements for New Permittees: In addition to the appropriate NPDES application and fee, new Permittees should also include the following in the application package: • Description of the proposed water treatment system with a process schematic • Map of proposed discharge location, indicating precise latitude and longitude • Proposed flow rate for treated potable water and filter backwash water • List of proposed chemical additives • Chemical analyses of the source water (most notably, heavy metals and other parameters as described in "Assessment and Recommendations for Water Treatment Plant Permitting," an amended version is provided in Table 1, below) • Description of proposed treatment for filter backwash • Residuals Management Plan • Engineering Alternatives Analysis Table 1. Unlike other cationic exchange systems, the filter backwash from these systems is not saline, so non -discharge options are considered potentially viable options for the Engineering Alternatives Analysis. The Residuals Management Plan should, at a minimum, describe the frequency with which solids will be removed from the settling basin and their ultimate disposal method. Permitting Requirements: Some permitting decisions may be made on a site -specific basis, but the following provides a list of required monitoring parameters: • Flow • Total Suspended Solids • pH • Iron • Manganese • Fluoride • Chlorine • Zinc Flow Flow should be monitored (as per Table 2). Intermittent dischargers should also report the duration of discharge. Total Suspended Solids Total Suspended Solids (TSS) is a parameter that, although a general indicator, ensures proper operation and maintenance are maintained. Specifically, TSS documents that the settling basin is properly designed and operated. Moreover, if the source water well screens are not well installed, the raw water will be more turbid than normal, which will in turn increase the TSS in the filter backwash. TSS will be limited at a monthly average value of 30.0 mg/L and a daily maximum value of 45.0 mg/L. pH Some of the chemicals used in water treatment can depress or raise pH, and as such, it should be monitored and limited. For discharges to fresh waters, pH will be limited in the range of 6-9 standard units. For salt waters, pH should be limited between 6.8 and 8.5 standard units. This is consistent with the permitting strategies for all other types of water treatment plants. Iron and Manganese Iron and manganese are considered the primary pollutants of concern for such discharges. Present in the groundwater and removed through filtration by the greensand media, iron and manganese are ultimately concentrated in the filter backwash. These parameters are monitored only; see Table 2, as no standards exist for either pollutant. Fluoride Since fluoride is an additive to finished water, which in turn is used for backwash water, it is considered a pollutant of concern. The permit writer should verify the proposed dosing rate for the system in order to determine the necessity of a limit for fluoride. Chlorine As with fluoride, chlorine is a chemical additive to finished water and is therefore a pollutant of concern. Since chlorine can have severe effects on instream toxicity, it must be limited, as with all other water treatment plants in the state. Chlorine limits should be between 17-28 µg/L, as per Division of Water Quality policy. E Ppppppp, Zinc Zinc should be included as a monitoring parameter with a footnote stating, "Zinc shall be monitored if the permittee uses any zinc -based additive in the water treatment process." Since many water treatment facilities have traditionally used zinc orthophosphate as an anti-scalant, zinc can be a pollutant of concern depending on the selection of water treatment additives. Additional Parameters of Concern Additional parameters of concern, most notably metals, may be identified in the application package and source water data. Source water data should be entered into a Reasonable Potential Analysis (RPA) in order to assess the need for limits. Such determinations are to be made on a case -by -case basis. Monitoring Frequencies: Monitoring frequencies for the above listed parameters are summarized in Table 2. Since discharges from greensand filtration water treatment plants do not tend to be continuous, grab samples should be adequate to characterize the discharge. Table 2. As the designated permittee, you were present for the inspection. This type of inspection consists of two basic parts: an in -office review of facility files and self -monitoring data and an on -site inspection of the facility. This particular inspection evaluated eight (8) areas, and observations from each area are addressed below: 1. Permit The permit became effective June 1, 2001 and expires May 31, 2006. A copy of the permit was available during the inspection. 2. Self -Monitoring Program The facility received a Notice of Violation dated May 27, 2005 from the NPDES Unit in DWQ Central Office for failure to submit the first quarter monitoring report for 2005. This report was received by DWQ in July 2005. Please note that timely submittal of discharge submittal reports is essential to the efficient operation of our water quality programs. The monitoring requirements for this permit are as follows: flow, total suspended residue, settleable solids, turbidity, total residual chlorine, and iron. A review of the monthly self - monitoring reports from March 2004 through March 2005 showed no limit violations. However, it was noted during a file review that laboratory results from total suspended residue analysis were not transcribed onto the discharge monitoring reports for the period of March 2004 through March 2005. Please re -submit these reports, with results for ALL required parameters. 3. Laboratory Pace Analytical picks up effluent and upstream/downstream samples at the facility and performs all analyses. 4. Flow Measurement Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. 5. No major problems were noted with respect to facility operation and maintenance. There was some vegetation growing in the bed of the sand filter. The Homeowners Association has two workdays per year for maintenance of the facility where sand is raked and replaced if necessary. 7. Records/Reports The Discharge Monitoring Reports (DMRs) and lab data are maintained according to the permit. DMRs include all permit parameters, except total suspended residue data. A copy of lab data was available for review during the inspection. An annual report has not been prepared for this facility. Effluent/Receiving Waters The effluent is discharged into a small drainage ditch, which leads to an unnamed tributary to Haw River. Self -Monitoring Program The facility received a Notice of Violation dated May 27, 2005 from the NPDES Unit in DWQ Central Office for failure to submit the first quarter monitoring report for 2005. This report was received by DWQ in July 2005. Please note that timely submittal of discharge submittal reports is essential to the efficient operation of our water quality programs. The monitoring requirements for this permit are as follows: flow, total suspended residue, settleable solids, turbidity, total residual chlorine, and iron. A review of the monthly self -monitoring reports from March 2004 through March 2005 showed no limit violations. However, it was noted during a file review that laboratory results from total suspended residue analysis were not transcribed onto the discharge monitoring reports for the period of March 2004 through March 2005. Laboratory Pace Analytical picks up effluent and upstream/downstream samples at the facility and performs all analyses. 4. Flow Measurement Effluent flow is estimated by the operator on a quarterly basis, as required by the permit. 5. Facility Site Review The sand filter system discharges filter backwash water from a drinking well treatment system. 6. Operations & Maintenance The supervising facility operator is Jim Gile. Donnie Wood performs most daily operations at the facility, including weekly backwashing. No major problems were noted with respect to facility operation and maintenance. There was some vegetation growing in the bed of the sand filter. The Homeowners Association has two workdays per year for maintenance of the facility where sand is raked and replaced if necessary. 7. Records/Reports The Discharge Monitoring Reports (DMRs) and lab data are maintained according to the permit. DMRs include all permit parameters, except total suspended residue data. A copy of lab data was available for review during the inspection. An annual report has not been prepared for this facility.
