On January 3rd, 2007, the Raleigh Regional Office received from the 401 Wetlands and
Stormwater Branch a copy of your Pre-Construction Notification Application for your project
known as Spring Garden Estates.
On January 18th, 2007 Mr. Michael Horan spoke with Mr. David Boaz of B & B Consultants,
Inc. concerning the sequencing of the restoration plan. The following sequenced items were
discussed and which require more information.
4. "Begin Work, Sequenced as follows:"
(b.) 48-inch culvert must be changed in narrative stating that a 54-inch culvert will be
used
1.) Explain why the step pool system is needed before entering the inlet of the
proposed 54-inch culvert
(h.) Show on site plan all areas where sediment is to be removed down to Butler Road
Mr. Boaz has agreed to make these changes detailed above and plans to send the revised
restoration plan to the Raleigh Regional Office and to Mr. Danny Smith at the Wetlands and
Stormwater Branch, NPS Assistance and Compliance Oversight Unit to satisfy the Raleigh
Regional Office requirements of a response to the Notice of Violation.
As of this moment the Raleigh Regional Office does not find your plan acceptable nor does it
satisfy the restoration plan that was required to be submitted to the Raleigh Regional Office by
Dec. 22nd, 2006.
Respond in writing within 10 days of receipt. Submit (2) copies of your revised restoration plan
to this office at the address located in the footnote and (1) copy to Mr. Danny Smith at the
Wetlands and Stormwater Branch, NPS Assistance and Compliance Oversight Unit, 1617 Mail
