501 Lyles Court Maintenance Project

Dear Ms. Karoly:
The City of Charlotte Storm Water Services (CSWS) is hereby contacting the NCDWQ
401/Wetlands Unit regarding jurisdictional impacts associated with the 501 Lyles Court
Maintenance Project. On November 28, 2005, NCDWQ approved this project under
Water Quality General Certification Numbers 3494 and 3495 (DWQ# 04-0587).
Authorized jurisdictional impacts to the on-site perennial stream channel consisted of:
4001inear feet (400 bank feet) of gabion wall installation along the right bank, an
additional 140 linear feet (140 bank feet) of right bank reshaping with soft stabilization
(permanent erosion control matting), and the installation of a 10-linear foot rip rap apron
at the outlet of a storm drainage pipe replacement. On October 31, 2006, CSWS's Isaac
Hinson inspected the project for Nationwide Permit/Water Quality Certification
compliance. Actual project impacts consisted o£ 4001inear feet (400 bank feet) of
gabion wall installation along the right bank, an additional 1401inear feet (140 bank feet)
of right bank reshaping with soft stabilization (permanent erosion control matting),
placement of rip rap along the bottom half of 65 linear feet (65 bank feet) of reshaped
bank, placement of an additional 18 linear feet (18 bank feet) of rip rap on the bank, and
the installation of a 10-linear foot rip rap apron at the outlet of a storm drainage pipe
replacement. Authorized and actual project impacts are summarized in the following
table:

Remedial corrective actions are not practicable as the project has been completed and
fencing has subsequently been installed along the affected properties, which precludes site
access. Since this project was not in compliance with its authorized impacts, CSWS is
submitting this letter in lieu of the NCDWQ Certificate of Completion form. Please review
and contact me with any comments or concerns.
