Horton Street Raleigh, NC 27602 Zebulon, NC 27597 Subject Property: Five County Stadium, Old 64, Zebulon, NC Little Creek (Vilest Side) [03-04-07, 27-86-2-2, C NSW (nutrient sensitive)] DWQ # 03-0848 Wake County Page 1 of 2 On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B .0233) Dear Sirs: On June 11, 2003, at your request I conducted an on-site determination to review four surface water features located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The surface waters are labeled as "A", "B", "C" and "D" on the "Map" below. Drainage "A": An intermittent stream is depicted on the Wake County Soil Survey within this drainage. I evaluated the drainage and determined that it did not contain an intermittent stream. I determined that an ephemeral (stormwater) channel does exist within the drainage. Based on this information, the DWQ has determined that drainage feature "A" is ephemeral and is therefore "exempt"from the Neuse Buffer Rule. Drainage "B": A perennial stream is depicted on the Wake County Soil Survey within this drainage. An intermittent stream and pond is depicted on the USGS Zebulon topographic map within this drainage. I evaluated the drainage and determined that a pond does exist within the drainage and that a stream exists below the pond that is at least intermittent. Based on this information, the DWQ has determined that the pond and stream below the pond within drainage feature "B" are subject to the Neuse Buffer Rule. This stream, pond and their associated buffers should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. Drainage "C": A pond is depicted on both the Wake County Soil Survey and USGS Zebulon topographic map within this drainage. evaluated the drainage and determined that a pond does exist. However, it was determined that the pond was a man- made pond constructed within an ephemeral (stormwater) drainage and has no direct connection to an intermittent or perennial stream. Based on this information, the DWQ has determined that the pond located within drainage feature "C" is "exemDt" from the Neuse Buffer Rule. Drainage "D": A pond is depicted on the USGS Zebulon topographic map within this drainage. I evaluated the drainage and determined that the pond does not exist. Based on this information, the DWQ has determined that drainage feature "D" does not contain a pond or other surface water and is therefore "exempt" from the Neuse Buffer Rule. Surface waters beyond the boundaries of the subject property were not evaluated for applicability to the Neuse Buffer Rule. In addition, this letter does not approve any activity within Waters of the United States or Waters of the State. This office recommends that you have a wetland delineation approved by the U.S. Army Corps of Engineers.
