The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. No vegetated wetlands will be excavated or filled. 4. Excavation will not exceed - 7 feet below the elevation of mean low water (MLW). i + -2- 5. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands are not authorized. 6. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 7. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that. the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. Box 908 Ocracoke, NC, 27960 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. and Ms. Wright: You have our approval, in accordance with the attached conditions, to dredge and/or shade 0.023 acre of vegetated and non- vegetated wetlands in order to excavate a basin in Silver Lake and construct a pier and boat lift, as described in your application received by the Division of Water Quality on June 3, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at htto://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: Applicant proposes to excavate a 20'x 30' basin in Silver Lake and construct a 6'wide x 60'long pier with a 12' x 13' boat lift. L.S. And Mary Wright Hyde County Ocracoke Island Project Setting The project site is located off SR 1328, locally referred to as the lake road, on the south side of Silver Lake off the Pamlico Sound on Ocracoke Island in Hyde County, North Carolina. The site is a 5,100 ft2 residential lot on Silver Lake with a two story town house located immediately landward of a bulkhead and boardwalk that is contiguous to across the adjoining property to the west owned by the Castle Condo Association. The septic system is a peat pod system located in an earthen mound on the west side of the townhouse. This area is landscaped with various ornamental plants with the remainder of the yard maintained lawn grass. There is an area of Spartina alterniflora and Scirpus sp. marsh ±25' wide between the bulkhead and the Normal Water Level (NWL) of Silver Lake. There is a shallow sand flat ±2' deep, ±15' wide around the perimeter of the marsh before tapering at a ±2:1 slope to a depth of 8'. The bottom substrate consists of course sand and shell with no rooted submerged aquatic vegetation present. Although shellfish, mainly oysters in small opportunistic clusters, inhabit t1-As area, Silver Lake remains closed to harvest. The project site is located between two commercial properties with multi slip docking facilities in a curved shoreline creating a somewhat congested riparian area. The adjacent docking facilities are for use by patrons of the motel on the east side and patrons of the condo rentals on the west side. Both of the docking facilities were subject to permitted hydraulic dredging operations conducted within the last five years in and around the project site. Silver Lake is classified -as SC waters by the Environmental Management Commission and Coastal Waters, by the Marine Fisheries Commission. Project Description The applicant proposes to excavate an area of Silver Lake bottom 20'wide x 30'long to a proposed final depth of -7' to facilitate the mooring of an outboard vessel in a proposed 12' x 13' boatlift. Access to the lift will be facilitated by a 6'wide x 60'long pier proposed to be constructed over the marsh fringe, immediately adjacent to the property line and docking facility on the. west side.... .. . Anticipated Impacts The excavation will result in the loss of 600 ft' of shallow water habitat. The pier will shade 240 ft2 of coastal wetlands. and 150 ftz of Silver Lake bottom. The construction activities will result in some localized short-term turbidity.
