The project area consists primarily of upland mixed hardwood/pine forest . A sanitary sewer easement runs on the northeast side of Walnut Creek. Figure 1 depicts the location of the
property on the US Geological Survey (USGS) Raleigh West, NC 7.5-minute quadrangle topographic maps. Figure 2 shows the location of the site on the Wake County Soil Survey map
(1970). Figure 3, attached at the end of the application, depicts the subject property on an aerial photograph of the area. Land use in the vicinity of the project consists of commercial,
residential, recreational and forested areas.

The purpose of the project is provide retail/commercial and residential space to meet the market demand in the Cary area.
This is a mixed-use development to provide retail/commercial and multi-family space with attendant roads, parking decks and surface lots, stormwater infrastructure, urban open space,
sanitary sewer and greenways. As part of the project, the existing Trinity Road will be upgraded to a partially divided four-lane. Trinity Road is a thoroughfare road that will eventually
cross Walnut Creek but will be permitted separately by the Town of Cary when a logical terminus is established in the future. The project will be completed in phases, and this
application only includes impacts related to the first permitting phase of the project. Future phases have been conceptually planned but have not been fully designed for permitting.
Phase 1 consists of development of the project area east of Trinity Road except for a future development pod on the southwest side of the buffered stream and wetland in this corner of
the site and a pod in northern most portion of the site (See Overall Impact Exhibit O-1). The only impacts associated with this phase of the project are due to a sanitary sewer
connection and replacement, stormwater outlet and greenway along Cary Towne Boulevard. Impacts to Walnut Creek and wetlands in this phase are temporary. Phase 2 of the project
involves construction of a greenway on the northeast side of Walnut Creek. Boardwalks will be used to avoid and minimize impacts to wetlands present on the floodplain of Walnut Creek
to the maximum extent practical. Phase 3 of the project will involve construction of a loop road to access the future development pod on the southwest side of the buffered stream and
wetland in this corner of the site (See Overall Impact Exhibit O-2). Impacts estimated for Phase 3 of the project consist of 80 linear feet (lf) of stream and 0.18 acre (ac). Therefore,
these future impacts for the entire project would qualify for a Nationwide permit.
For this phase of the project, the existing sanitary sewer will be replaced to increase the depth in order to connect the sanitary sewer from the proposed development. The replacement
will temporarily impact 0.184 acre of herbaceous wetland. Even with increasing the depth of the existing sewer, there isn’t enough depth to complete the connection by directional bore.
The sanitary sewer connection will be installed by excavation and will require a diversion ditch to install the line across the stream in the dry temporarily impacting 146 lf of stream and
the riparian buffer. A stormwater outlet from a stormwater control measure (SCM) will also impact the riparian buffer (See Impact Inset E-1 and E-2 and Erosion Control Plan Stage 4 -
Area "C" - EC-16). Another sanitary sewer connect across Cary Towne Boulevard will not impact the Neuse Riparian Buffer as shown on Impact Inset E-3. A streetside trail (greenway) is
proposed along Cary Towne Boulevard will impact the riparian buffer that runs along this section of Cary Towne Boulevard (See Impact Inset E-4).
Typical construction equipment will be used consisting of front-end loaders, bulldozers, paving equipment, graders, and earth movers.

E. Impact Justification and Mitigation
The applicant requested a delineation of surface waters and wetlands prior to designing a site plan to avoid and minimize impacts to these resources
to the maximum extent practicable. Temporary impacts to wetlands from the sanitary sewer replacement are unavoidable due to work occurring on the
existing line. Temporary impact to Walnut Creek from the sanitary sewer connection is also unavoidable due to the location and depth of the existing
sanitary sewer to which the project connects. The sanitary sewer connection was planned to cross the riparian buffer perpendicularly to minimize the
impact. Impacts to the riparian buffer by the streetside trail (greenway) are unavoidable due to the location of riparian buffer along Cary Towne
Boulevard.
A Sediment and Erosion Control Plan will be developed and approved by the Town of Cary, and the project will comply with the supplementary NPDES
Construction Stormwater Permit (NCG010000) including a plan to pump the stream flow around the sanitary sewer excavation area during
construction.

In the attached letter dated September 25, 2017, USFWS indicated the proposed project is not likely to adversely affect any federally-listed
endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act. Since this letter
was issued, Neuse River Waterdog (Necturus lewisi), Carolina Madtom (Noturus furiosus) and Atlantic Pigtoe (Fusconaia masoni) have been listed as
proposed threatened or endangered as shown on the attached, updated Official Species List. The attached NHP report did not report any element
occurrences of these species within one-mile of the project area. The watershed in this area contains a large amount of impervious area that does not
receive stormwater treatment to the age of the development, which has degraded the water quality of Walnut Creek in this area. Therefore, the project
is not likely to adversely affected these newly listed species.

C. Project Information and Prior Project History
4. Project Description and History
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be
used:*
This is a mixed-use development to provide retail/commercial and multi -family space with attendant
roads, public road expansion, parking decks and surface lots, stormwater infrastructure, urban open
space, sanitary sewer and greenways. As part of the project, the existing Trinity Road will be upgraded
to a partially divided four-lane road. Trinity Road is a thoroughfare road that will eventually cross
Walnut Creek but will be permitted separately by th e Town of Cary when a logical terminus is
established in the future. The project will be completed in phases, but all impacts are included in this
application.
The first phase consists of development of the most of project area between Trinity Road and the
western property line/stream channel and construction of a greenway along Walnut Creek. Impacts
associated with this phase of the project are due to a sanitary sewer connection and replacement,
stormwater outlet and greenways along Cary Towne Boulevard and the northeast side of Walnut Creek.
All impacts to Walnut Creek and wetlands in this phase are temporary. A pedestrian bridge and
boardwalks have been used to avoid impacts to Walnut Creek and wetlands present on the floodplain of
Walnut Creek from construction of the proposed greenway. The primary project area is shown on the
attached Overall Impact Exhibit O-1, and the sanitary sewer replacement and Walnut Creek greenway
are shown on Overall Impact Exhibit O-2. These Overall Impact Exhibits provide a key for the detailed
impact area exhibits.
On the northeast side of the Walnut Creek, the existing sanitary sewer will be replaced to increase the
depth in order to connect the sanitary sewer from the proposed development. The replacement will
temporarily impact 0.189 acre of herbaceous wetland. Even with increasing the depth of the existing
sewer, there isn’t enough depth to complete the connection by directional bore. The sanitary sewer
connection will be installed by excavation and will require a divers ion ditch to install the line across the
stream in the dry temporarily impacting 146 lf of stream and the riparian buffer. A stormwater outlet
from a stormwater control measure (SCM) will also impact the riparian buffer (See Impact Inset E -1 and
E-2 and Erosion Control Plan Stage 4 - Area "C" - EC-16). Another sanitary sewer connect across Cary
Towne Boulevard will not impact the Neuse Riparian Buffer as shown on Impact Inset E -3.
A street side trail (greenway) is proposed along Cary Towne Boulevard will im pact the riparian buffer
that runs along this section of Cary Towne Boulevard (See Impact Inset E -4). Additional planning for the
expansion of Cary Towne Boulevard to accommodate the proposed development resulted in two
changes from the previous provided future impact and permit impact maps. The future impact estimate
showing a culvert extension (25 lf) was prompted by the traffic engineer believing that the proposed
retaining wall along the street side trail would not be acceptable to NCDOT. Since the last submittal of
additional information, project engineers have consulted with NCDOT, which is the reason for the delay
in responding the additional information requested from James Lastinger on April 7, 2020. Project
engineers negotiated replacement of the retaining wall with steeper slopes and a headwall to avoid
additional stream impacts but required additional buffer impacts.
A greenway trail is proposed to connect the development to another greenway trail along Walnut Creek.
The Walnut Creek greenway connects the existing WakeMed Soccer Park to the future Trinity Road
location. A pedestrian bridge and boardwalks have been used to avoid stream and wetland impacts, but
the trail will impact riparian buffers as shown on Overall Impact Map (O-2) and Impact Insets E-5
through E-7.
As mentioned above, a later phase of the project will involve the expansion of Cary Towne Boulevard.
This will require an extension to the existing culvert under Walnut Creek and will impact a wetland area
located at the toe of the existing fill slope for the road as shown on Impact Inset E-8.
Another future phase of the project will involve development of an upland area west of the stream and
wetland area that bisects this corner of the property. This will require two road crossings of these
features to ensure safe egress as shown on Impact Inset E-9.
Typical construction equipment will be used consisting of excavators, front -end loaders, bulldozers,
paving equipment, graders, and earth movers.
6. Future Project Plans

Three future development pods shown on the Overall Impact Map (O-1) consist entirely of uplands but
are not anticipated to begin until 2023 or later. Specific development plans for these areas will be
designed later.

1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:*
The applicant requested a delineation of surface waters and wetlands prior to designing a site plan to avoid and
minimize impacts to these resources to the maximum extent practicable. Temporary impacts to wetlands from the
sanitary sewer replacement are unavoidable due to work occurring on the existing line. Temporary impact to
Walnut Creek from the sanitary sewer connection is also unavoidable due to the location and depth of the existing
sanitary sewer to which the project connects. The sanitary sewer connection was planned to cross the riparian
buffer perpendicularly to minimize the impact.
Impacts to the riparian buffer by the street side trail (greenway) are unavoidable due to the location of riparian
buffer along Cary Towne Boulevard. As discussed in the project description, a retaining wall to limit the amount of
impact was not acceptable to NCDOT due to safety concerns. A headwall at the existing culvert under the road has
been used to avoid 25 LF of additional stream impact in this location.
The greenway trail along Walnut Creek and trail connecting the development to this trail utilizes a pedestrian
bridge and boardwalks to avoid impacts to Walnut Creek and wetlands. The trail crosses Walnut Creek and
buffered tributaries perpendicularly and utilizing an existing footpath and sanitary sewer where possible to
minimize the impact to riparian buffers.
Impacts to Walnut Creek and the wetland at the toe of slope of Cary Towne Boulevard cannot be avoided by the
road widening required to accommodate the development. Road crossing 1 and 2 were also aligned to cross the
stream, wetlands and buffer perpendicularly to minimize their impact to these resources. The culvert for Road
Crossing #1 will be set and surface elevation of the wetland. The culvert for Road Crossing #2 will be buried 1 foot
to maintain aquatic life passage.

service area (HUC 03020201) of the Bank.
Credits may be reserved for a period of 12 months upon the receipt of a non-refundable deposit of 10%
of the purchase price. Should credits not be reserved, they will be sold on a first come, first serve basis.
Credit prices will be guaranteed for a period of 6 months from the date of this letter and are then
subject to change.
An invoice for this transaction will be sent upon your request and we will reserve the credits and price
for a period of 30 days from invoice. This letter is a Statement of Availability as of the date provided – it
is not a reservation of credits nor a guarantee of price. Credits will be sold on a first come, first serve
basis.
Final transfer of credits will occur upon completion of the Mitigation Responsibility Transfer Form within
the completed 404 permit.
