the Coastal Area Management Act with ADDITIONAL CONDITIONS
Dear Mr. Myers and Ms. Heine:
You have our approval, in accordance with the conditions listed below, to impact 572 square feet (fe) of Zone 2 (only) of
the protected riparian buffers for the purpose of constructing a single family residence on the subject property as
described within your application dated April 16, 2003. This letter shall act as your approval for the use of the "General"
Major Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on
Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL
CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission
(EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed
with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall
expire when the variance expires on April 11, 2006 unless it is renewed before that time by the EMC.
This approval is only valid for the purpose and design that you described in your variance request. If you change your
project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the
new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this
approval to be valid, you must follow the conditions listed below.
Conditions:
1. No Impacts to Zone 1
No impacts shall occur to Zone 1 of the protected riparian buffers (except for uses and activities designated
as "exempt" within 15A NCAC 02B.0233), unless otherwise approved by the DWQ.
2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules,
and any subsequent modifications, the applicant is required to return the attached certificate of completion to
the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC,
27699-1650.
3. Diffuse Flow
All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive velocities
prior to entering the protected riparian buffers as identified within 15A NCAC 2B .0233(5). No new ditching or
piping of stormwater through the protected buffers is allowed.
4. Protective Fencing

The outside buffer boundary and along the construction corridor within these boundaries approved under this
authorization shall be clearly marked with orange fabric fencing (or similar high visibility material) for the areas
that have been approved to infringe within the buffer. This fencing shall be installed prior to any land
disturbing activities to ensure compliance with 15A NCAC 2B .0233. The protective fencing should be
removed once construction is complete.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within
60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection Rules

Last Tuesday I left a voice message for yourself and Mr. Steffans. I inquired about the status of my
variance application DWQ project # 03-0509. 1 have not yet heard anything back from you or Mr. Steffans
concerning my inquiry.
The original application for variance was delivered to DWQ on 17 April 2003, or, 68 days ago.
I have attempted to contact Mr. Dorney, but he is apparently unavailable for several days.
I have also tried to contact Mr. Steffans, but he is on leave until July 1 rst.
Please let us know what is currently happening with this application so that we know what our future
course of action should be.

Dear Mr. Zarzecki,
In reference to the letter which we received may 27`I' and which was dated may 16`h, please consider
the following.
Originally our house was sited on our lot so that there would be no encroachment into either zone
one or zone two of the wetland areas. We have made every attempt to conform to North Carolina code as it
concerns protection of wetland habitat.
However, when we visited the site with our builder on April 11"' of this year to site the house for building,
he (Mr. Stuart Hardy), and the surveyor, pointed out to us that the current orientation of our house would
most probably give us a view of the front of the house in lot 920 (our lot is #21 and the end lot) vice a water
view. At that point, we jointly concluded that there was no alternative but to rotate the position of the
house on the lot. Consequently, we reoriented the house to face directly across the creek which put us into
zone two of the wetland area and a variance was subsequently applied for.
We would appreciate your consideration in this matter. At this point we have invested at least $3000 in
house plans, approximately $57,000 for a lot with a water view, our own home has been sold, and we have
committed in a contract to moving out of our current residence before the end of this calendar year. We
would be placed in a most difficult position if the variance is not approved as submitted
We therefore request a waiver so that the house may be situated as shown on the original plan which was
submitted on April 16, 2003, to your office.

On April 17, 2003, the Division of Water Quality (DWQ) Wetlands/401 Unit received your minor variance request dated April
16, 2003. The DWQ has determined that your project is eligible for the use of the "General" Major Variance From the
Neuse and Tar-Pamlico Riparian Buffer Rules for residential structures on existing lots within the coastal counties as
defined by the Coastal Area Management Act, Approved 51912001, because the lot was platted and a septic permit was
issued before August 1, 2000. However, the DWQ needs additional information in order to complete the approval process
of your variance. Therefore, unless additional information is provided as described below, we will have to move toward
denial of your request per 15A NCAC 2B.0259(9) and will place this project on hold as incomplete until we receive this
additional information. Specifically:

Based on the "Preliminary Environmental Map and Staking Plan" provided with your application, it appears that the
house could be relocated or otherwise reconfigured such that impacts to the buffers could be avoided or minimized.
Please relocate or reconfigure the house to avoid or minimize the impacts or provide additional information as to why
this is not practicable.
Please respond in writing within three weeks of the date of this letter by sending a copy of this information to me and Mr.
Tom Steffens of the DWQ Washington Regional Office at (252) 946-6481. If we do not hear from you in three weeks, we
