Dear Mr. Whitmire:
Division personnel have reviewed and approved your application for modification of the subject
permit. This permit modification is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated October 15, 2007 (or as subsequently amended).
This modification is to allow the mill's wastewater treatment system to receive stormwater pumped
from the Cape Fear Woodyard holding pond during and after heavy rain events. All other terms and
conditions contained in the original permit remain unchanged and in full effect.
If any parts, measurement frequencies or sampling requirements contained in this permit
modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the, Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.

Dear Mr. Chernikov:
As you are aware, the Cape Fear Woodyard, which is located at our mill site, maintains a
holding pond used for storage of non -potable water that has been re -circulated through the
yard's spraying system. The woodyard is required to keep 12 inches of freeboard on the pond
at all times. In heavy rain events, excess stormwater must be pumped out to avoid overflow.
Please accept this letter as a formal request for a minor modification of the abovementioned
NPDES permit to allow the mill's wastewater treatment system (WTS) to receive stormwater
pumped from the Cape Fear Woodyard holding pond (closed -loop recycle system permit
WQ0031879) during and after heavy rain events. The mill's WTS discharges an average of 35
million gallons daily, and can easily treat the infrequent additional flow of 400,000 to 1.54
million gallons per day from the woodyard.
A counterpart permit modification request is being submitted by the Cape Fear Woodyard for
their closed -loop recycle system. If you have any questions or would like to discuss in more

Received NPDES Mod Request from IP (dated 1/17/14) to pump stormwater from holding pond (covered by WQ00
closed loop recycle permit) to WWTP (NPDES Permit NC00). Complementary request went to Non-D Unit for WQ00
mod. I've assigned NPDES request to Sergei. Please coordinate Region/Non-D/NPDES response so all are on same
page.
Sergei- from receiving water quality perspective, I don't see an issue with request. If we move forward, I think this
would just be a mod to Supplement to Cover Sheet.
PS- letter requests were copied to WIRO (Dean), and Jon should have received original WQ00 mod request.

Tom,
Back in January, we received a letter requesting a minor modification to the Closed -Loop Recycle System (Pen -nit No.
WQ0031879) at Riegelwood Mill in Columbus County. International Paper Company is requesting permission to pump
excess precipitation from their recycle pond to the NPDES wastewater treatment system (Permit No. NC0003298) in
order to better manage their freeboard.
I have drafted the subject non -discharge permit, and I would like your unit to review the language, since it is directly
applicable to one of your permits. The proposed language is as follows:
"In order to manage freeboard during times of heavy precipitation, the Permittee may pump excess stormwater from the 9
million gallon clay lined storage pond to the Riegelwood Mill wastewater treatment system (Permit No. NC0003298) for
subsequent treatment and disposal. This allowance to convey excess stormwater from the 9 million gallon clay lined
storage pond to the Riegelwood Mill wastewater treatment system is subject to NPDES Program approval, and in
no way negates, precludes, or invalidates the most recent issuance of the Permittee's NPDES permit (Permit No.
NCO003298), and the Permittee shall continue to comply with all conditions provided for therein."
Please let me know if this language is acceptable.
