PROJECT SUMMARY: The applicant is proposing to repair a breached berm by constructing a vertical sheet pile wall and rehabilitate the shoreline along the northern tip of the existing berm. PROJECT DESCRIPTION Criser Troutman Tanner Consulting Engineers, on behalf of Cameron Property, LLC and the City of Wilmington, has requested that the attached application be processed under the Express Permit Review Program. The subject property is located 2200 JR Kennedy Road, adjacent to Burnt Mill Creek, in Wilmington, New Hanover County. To access the project site from the Wilmington Regional office, turn left onto Market Street (Hwy 17) from Cardinal Drive. Continue west along Highway 17 south towards downtown Wilmington and turn right onto North 23`d Street. Cross the rail-road tracks and turn left onto JR Kennedy Road, (adjacent to the Budweiser Distribution Co.) Continue along JR Kennedy and merge left at the end of the asphalt road. Continue along the dirt path (electrical easement) and the project site will be located on the right hand side of the road (at the very end), adjacent to Burnt Mill Creek. The property is approximately 14.27 acres in size with approximately 900 linear feet of water frontage. Elevation at the property varies from 4'-6' above normal high water. Commercial, industrial and residential properties border the site to the east, west and south and Burnt Mill Creek borders the property to the north. The high ground portion of the tract includes species such as Live Oak (Quercus virginiana), Cypress (T. distichum var. nutans), Wax myrtle (Myrica cerifera), Long-leaf Pine (Pinus palustris), Sweet Gum (Liquidamber styraciua) Sycamore (Platanus occidentalis), Magnolia (Magnolia grandijlora), Red Maple (Acer rubrum), Poplar (Liriodendron tulipifera) and Birch (Betula Nigra). Scrub vegetation and rip-rap material are located along the western property boundary, within the transitional zone, and complete the near shore edge, or Coastal Shoreline, along the bank of Burnt Mill Creek. With the exception of the area contained by rip-rap and broken concrete, the remaining northwestern portion of the property consists of "404 type" wetlands, intermixed with two Coastal Wetland species. Coastal wetlands vegetation consists primarily of Cattail (Typha), intermixed with Sawgrass (Cladium jamaicense). A massive berm consisting of natural soil and granite boulders is located in the far southwest corner of the property. The berm used to extend further west and connect to a now isolated island, located between the main portion of the property and the tidal gate serving Burnt Mill Creek. The City of Wilmington has historically used the property as a means of accessing the existing sewer lines that intersect this particular portion of Burnt Mill Creek. The waters of Burnt Mill Creek, adjacent to the proposed project area, are classified "SC" by the Division of Water Quality. This section of Burnt Mill Creek is NOT designated as a Primary Nursery Area by the Division of Marine Fisheries, and according to maps provided by Shellfish Sanitation, the area is CLOSED to the harvesting of shellfish. Please note that this area is classified by the Division of Marine Fisheries as "inland waters", and therefore the site is subject only to the 30' Coastal Shoreline Buffer, Area of Environmental Concern. PROPOSED PROJECT: As proposed, the applicant is requesting approval to repair a breached berm by constructing a vertical sheet pile wall and rehabilitate the shoreline along the northern tip of the existing berm, adjacent to the tide gate. City of Wilmington Page Three Prior to repairing the berm, the applicant's are proposing to haul in clean fill material to raise the elevation of the existing berm located along the southern property line. According to the application package, approximately 266 cubic yards of material would be hauled to the site and placed within a 208' x 23' area along the southwest property boundary. The property elevations are slightly lower in this area and because heavy equipment would be brought on-site, the elevation needs to be raised. As shown on the Corp of Engineers approved "404" wetlands delineation map, the area for which fill is proposed does not contain any "404" type wetlands. Following deposition of the soil, the applicant's proposed to grade and seed the area. Once the access way is finished, the applicant's propose to remove an old timber bulkhead that is located in the immediate vicinity of the proposed wall (breached area). Once the old timber wall is removed, the applicant's proposed to install a sheet pile wall across the breached section of the berm. The sheet pile wall would span approximately 40' of open water and would connect to the isolated island located just west of the breached area. The wall would be toed in approximately 8'-10' along its eastern end and approximately 30' along its western end. According to the site drawings, the applicant's may need to remove some material from the existing berm in order to install the new wall. The excavated material would remain on-site and would be placed back in its original location once the wall installation is complete. The applicant states that no fill material would be placed on either side of the wall section spanning the open water body (i.e. no rip- rap on either side of the wall in open water or wetlands). The sheet piles would be driven to a minimum depth of 30' below the substrate, or to a depth necessary to retain the flow of water. The height of the wall, above normal high water, would be slightly higher than the surrounding landscape. The final phase of work in relation to this project includes the rehabilitation of the western most shoreline bordering the Burnt Mill Creek tide gate. Approximately 31 linear feet of steel sheet pile abutment would be placed behind the existing timber abutment, immediately adjacent to the tide gate. Currently, the shoreline is stabilized by a timber abutment, concrete slab and loose granite aggregate. The applicant states that some of the concrete would need to be removed in order to install the new sheet piles. The disturbed area behind the new wall would be graded to match the surrounding topography. New sections of chain-link fencing would be installed along the western most property line bordering Burnt Mill Creek and along the western shoreline bordering the breached area. Both the fencing and shoreline stabilization would be located above normal high water, but within the 30' Coastal Shoreline Buffer/AEC. 10. ANTICIPATED IMPACTS: The proposed fill activities and shoreline rehabilitation would result in the disturbance of approximately 13,951 sq. ft. of high ground. The vertical sheet pile wall installed to repair a breached section of berm would result in the incorporation of approximately 80 sq. ft. of public trust water. Additionally, the wall installed along the breached section would result in filling approximately 80 sq. ft. of previous disturbed high ground. The vertical sheet pile wall construction/rehabilitiation, debris removal chain-link fence installation would be located within the 30' Coastal. Shoreline Buffer. No impacts are proposed within any Coastal or "404" type wetlands. By eliminating the short-circuiting of tidal water around the City of Wilmington's Love Grove Tidegate, concerns of property damage and life safety due to flooding can be reduced. Rehabilitation of 31 LF of sheetpile along the eastern bank of Burnt Mill Creek at the location of the Love Grove Tidegate. Construction of 208 LF of earthen berm consisting of approximately 266 CY of compacted fill material, stabilized with vegetative cover on top. The re-establishment of the pre-existing continuous berm will connect adjacent high areas and elimanate concerns pertaining to future tidegate breach scenarios through this low-lying vulnerable location. e.
