(Mid -Atlantic) is pleased to submit the following response to the Notice of Deficiency NOD-2020-PC-0108 issued by the North Carolina Department of Environmental Quality (NCDEQ) on March 12, 2020. This correspondence was issued based on the results of a recent compliance evaluation inspection conducted at the above -referenced facility on March 11, 2020. As requested, the following response has been prepared to address the findings identified during the NCDEQ inspection. A review of eDMRs for 2019 revealed several errors with reporting. Monitoring results were not reported for the quarters starting in January 2019 and October 2019 despite there being discharge events. There also appears to be no evidence of Acute WET Toxicity being performed In January or April. Lab results were present on site, and no discrepancies were found fnr data that had been reported for eDMRs However, we recommend revising and resubmitting your eDMRs for 2019 to include missing parameters. Since flow measurement is episodic, we also recommend leaving the No Reporting Reason column blank In the future instead of putting no flow. January/October 2019 Discharge SamDling: Please note that no discharges occurred from the facility in January -February 2019. Quarterly effluent samples were collected during the first discharge event of Q1 on March 13, 2019 and during the second discharge event of Q4 on December 3, 2019. The effluent samples were analyzed for pH, oil and grease and Total Suspended Solids and have been reported to NCDEQ on the appropriate eDMR. The results of the sampling events are also provided for reference as an attachment. EXPERIENCED CUSTOMER FOCUSED INNOVATIVE — Response to Notice of Deficiency Ergon Asphalt and Emulsions, Inc. Wilson, North Carolina April 7, 2020 Page 2 Quarterly Acute WET Toxicity Testing: The facility's current NPDES permit established a new quarterly sampling protocol for Acute WET Toxicity parameters beginning in January 2019. Please note that prior to January 2019, Ergon was only required to perform Acute WET Toxicity testing on an annual basis in accordance with the facility's previous NPDES permit. As such, the samples collected during the first discharge event under the new permit (March 2019) were inadvertently collected in accordance with the previous permit's sampling protocol (i.e. pH, oil and grease and TSS). Upon further review of the updated permit requirements, Acute WET Toxicity testing was then completed on a quarterly basis during subsequent discharge sampling events conducted on April 23, 2019, July 9, 2019, December 3, 2019 and February 4, 2020. The facility received passing results for each of these events, and a copy of the April 2020 Acute WET Toxicity sampling results are provided as an attachment, as requested. The next quarterly Acute WET Toxicity sampling event is currently scheduled to be conducted at the facility on April 14, 2020. Revision/Resubmittal of eDMRs: As requested, since flow measurement is episodic, the 2019 eDMRs have been revised and resubmitted with the "No Reporting Reason" column left blank. Gary Fischer (ORC) and Frederick Ammons (bORC) currently perform pH testing on effluent during discharge events and transport samples to a certified lab. As stated in Subchapter OSG of the North Carolina Administrative Code and Statutes, Grade 1 physicaUchemical systems should have weekly visitations by operators (15A NCAC 08G .0204 (2)(h)(i). The operator should come and view the treatment system at least once a week, even during no discharge. Mid -Atlantic previously reached out to NCDEQ regarding the weekly ORC visits outlined in Subchapter 08G of the NC Administrative Code and Statutes, which state that "the ORC of each Class I Facility (or the Backup ORC, when acting as surrogate for the ORC) must: visit the facility as often is necessary to ensure proper operation of the treatment system; the treatment facility must be visited at least weekly." During our initial discussions with NCDEQ, the response we received was that we should be following the permit requirements, and the facility complied as directed. However, following a weekly site visit conducted at the facility in June 2017, Mid Atlantic reached back out to NCDEQ to request additional feedback as to why weekly site visits would be required given the specific nature of the site (i.e. an on -site retention pond strictly associated with stormwater runoff and controlled discharges only). During our subsequent discussions, NCDEQ indicated that we would need to discuss this with the permit writer, since he/she would have reviewed all of the facility's information during the renewal process and would therefore be best prepared to answer our question. As such, Mid -Atlantic reached out to the permit writer (Mr. Joe Corporon) on June 13, 2017 and received a verbal waiver for the weekly ORC site visit requirements. Mid -Atlantic then issued a subsequent e-mail correspondence to NCDEQ documenting the results of this conversation, and confirming that "Mid -Atlantic will be providing ORC oversight and certification in accordance with the current permit requirements, with site visits conducted prior to discharge events in lieu of weekly ORC visits." However, it is recommended that you remove woody vegetation and weeds from the banks of the pond. Following the March 2020 compliance inspection, the vegetation and weeds have been removed from the banks of the pond, as recommended. The facility is currently covered under NPDES Wastewater Permit NCO0089087 (pending final determination of the permit application for coverage under a stormwater permit) and will continue to operate in compliance with the current wastewater permit: until an outcome has been determined and/or the facility is instructed otherwise by DEQ. During this time, Mid -Atlantic be providing ORC oversight and certification in accordance with the current permit requirements, with site visits conducted prior to discharge events in lieu of weekly visits. We will also be certifying the results of the April and May DMRs (which have been previously entered into the eDMR system) and submitting hardcopy DMRs as discussed.
