Klimek, PE, Director Division of Water Quality July 3, 2003 DWQ Project # 02-1263 Pamlico County John D. & Kathleen Buck 121 Steeplechase Road Chapel Hill, NC 27514 Subject Property: Buck Residence, Lot 18, West Buccaneer Bay, 9346 Doris Drive, Oriental, NC Kershaw Creek [03-04-10; 27-129-5; SC HQW (High Quality) NSW (Nutrient Sensitive)] APPROVAL for the use of the "General" MAJOR VARIANCE; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS Dear Mr. & Mrs. Buck: You have our approval, in accordance with the conditions listed below, to impact 1,204 square feet (ft) of Zone 2 and 758 fe of Zone 1 of the protected riparian buffers for the purpose of constructing a single family residence on the subject property as described within your application dated August 7, 2002 including additional information provided on July 2, 2003. This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall expire when the variance expires on April 11, 2006 unless it is renewed before that time by the EMC. This approval is only valid for the purpose and design that you described in your variance request. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions: 1. Buffer Mitigation / Additional Plantings You are required to mitigate for your Zone 1 impacts. To satisfy this mitigation, woody vegetation (native shrubs and trees) shall be planted in the retained portions of the protected riparian buffer on the property where practicable. The preferred number of individual plants shall be such that there are at least 200 to 300 trees or shrubs per acre at maturity within the buffer and shall include planting no less than five (5) trees and ten (10) woody shrubs. You must ensure their survival for a period of a least five (5) years. You are required to replace any of these trees or shrubs that die within this five (5) year period. You are required to provide proof in writing that the trees have been planted or a schedule for when the planting will occur within one year of the date of this letter. The proof of plantings shall be submitted to the Wetlands/401 Unit and copied to the Washington Regional Office. If these plantings are not practicable, then you may satisfy this mitigation condition by making a payment into the Riparian Buffer Restoration Fund for 758 square feet of riparian buffer. If you choose this option, then call this office for information regarding this payment. 2. Diffuse Flow All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive velocities prior to entering the protected riparian buffers as identified within 15A NCAC 2B.0233(5). No new ditching or piping of stormwater through the protected buffers is allowed. 4. Protective Fencing The outside buffer boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange fabric fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer. This fencing shall be installed prior to any land disturbing activities to ensure compliance with 15A NCAC 2B .0233. The protective fencing should be removed once construction is complete. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection Rules (15A NCAC 213.0233 (9)(b)). I was requested to provide a revised site plan depicting the impact area, which follows. Of our 60' x 40' footprint of the planned residence, we estimate that 758 square feet will be inside the 30' zonel buffer and that 1204 square will be inside the 50' zone 2 impact area. Please do not close this file / request. I have only been on the property briefly since October and have not had the opportunity to get the builder and a surveyor on site to meet your request. In an earlier conversation with Mr. Zarzecki, who was most helpful, I was the one that suggested a revision of the site plan might be necessary. It was my understanding the original plan was conditionally approved. I withdraw my request for a revision and request the application be approved as submitted. I left a voice mail on March 31, 2003 for Mr. Zarzecki removing by request for a revision. Mr. Zarzecki had done some calculations for buffer mitigation (I'm recalling around $1000), which are acceptable (although, not preferable). Hopefully this meets your requirements. On October 16, 2002, the WaRO recommended that the request be issued with the conditions of stormwater control and buffer mitigation for the Zone 1 impacts. On October 17, 2002, the Wetlands/401 Unit called you to request a revised site plan depicting the area of impact (in square feet) to both Zones 1 and 2 of the protected buffers. You stated in the phone conversation that you would be providing this information via fax. The Wetlands/401 Unit recently conducted a review of applications that have been placed on hold. It was determined during this review that this additional information was never received. The DWQ needs this information in order to complete the approval process of your variance. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B.0259(9) and will place this project on hold as incomplete until we receive this additional information.
