PROJECT SUMMARY: The applicant is proposing to construct a water-based amenity park to serve Oyster Harbour Subdivision. This proposed waterway park is on the Atlantic Intracoastal Waterway and has several proposed structures as well as 9 boat slips associated with it. Oyster Harbour Waterway Park Page #2 9. NARRATIVE DESCRIPTION: Oyster Harbour Subdivision is a project that is currently being developed at the end of Boones Neck Road in Brunswick County. The subdivision is located on the mainland side of the Intracoastal Waterway from Holden Beach. Oyster Harbour borders the Shallotte River to the west, Windy Point Road to the south, Boones Neck Road to the east and private property to the north. A parcel or tract on the other side of Windy Point Road borders the Atlantic Intracoastal Waterway. This parcel is slated to be the Waterway Park for Oyster Harbour Subdivision and is the subject of this application. This parcel is approximately .9 acres in size. The property is located at the intersection of Boone's Neck Road (SR 1137) and Windy Point Road (SR 1138). The property has approximately 140' of road frontage on Windy Point Road, a state maintained road. The property has approximately 99' of natural shoreline along the Atlantic Intracoastal Waterway. The shoreline is comprised of federal wetlands and coastal marsh. The coastal marsh along the shoreline is 50' to 60' wide +-. Species present are 7uncus roemedanu and Spartina alterni ora. The property slopes from the road towards the Waterway. Vegetation on the tract consists of weeds, grasses, and live oak trees. There are no man-made features on the site at this time, although it was the location of an old store building that has been demolished. The Oyster Harbour project is very near to an identified archaeological site as denoted on the Archives and History Quad Maps. The project borders the waters of the AIWW which have been classified as SA by the Division of Water Quality. The Division of Marine Fisheries has not designated this area as Primary Nursery Area (PNA). The nearest PNA is located 1/2-1 mile to the west nearer to the mouth of the Shallotte River. The project area is open to the harvesting of shellfish. Existing water depths along the shoreline range from 0' nearer to the shore to -2.5' mean low tide at the 80' setback from the AIWW channel. The applicant for this project proposes to develop the high ground portion of this tract into an amenity area for the Oyster Harbour Subdivision across the road. Proposed features include an open deck, gazebo, parking lot, mulch playground and covered pavilion. The structures, as laid out, are landward of the 30' estuarine shoreline buffer from mean high water, except for a 25' by 5' open deck attached to the gazebo and the proposed boat ramp which extends through the buffer and connects to a parking lot. The stormwater section, Division of Water Quality, has approved this project based upon the installation of a retention basin, grassed swales and subsurface infiltration trenches as a requirement of Stormwater Permit #SW8 020411, issued on August 1, 2002. The layout of the land-based amenities can best be seen on sheet 10 of 11 of the plans. A 65' long bulkhead wall that would be landward of wetlands and landward of the 30' shoreline buffer is proposed along the shoreline. The wall would extend underneath the gazebo terminating at the proposed boat ramp. See sheet 9 of 11 of the plans for the bulkhead cross-section. The applicant is also requesting authorization to construct water amenities for Oyster Harbour. An elevated, wood fixed pier, 6' wide by 165' long is proposed to access the waters of the AIWW (195' from float to gazebo deck). The pier would provide access across the marsh and across the water to a floating dock platform (6' by 52') with 9 boat slips. See the site plan for the layout of the proposed boat slips. The existing low tide water depth in the vicinity of the proposed slips ranges from -1.5' to -2.5'. The applicant has also requested a 3' by 20' finger pier extending waterward from the floating dock. All of the proposed structures would terminate at the 80' setback line from the AIWW channel. The finger pier, mooring pilings, and boat ramp, as proposed, exceed the 1/4 width of the open water body limitation by eight feet, (15 NCAC 07H.0208 (b) (6)). However, the proposed structures do comply with the 15' setback off of the riparian corridor lines and the 80' setback off of the AIWW channel. Oyster Harbour Waterway Park Page #3 The applicant proposes a 12' wide by 215' long boat ramp for the residents of the Oyster Harbour Subdivision. To install the boat ramp the consultant estimates that about 1740 square feet of coastal marsh would be filled. The fill includes a rock base for a 12' wide concrete travel area and a 6' to 10' wide rip-rap rock side slope on each side of the 12' wide ramp to provide stability. Pre-cast concrete slabs would be used for the ramp. The proposed fill area in the marsh is 65' long by 24' to 32' wide. The proposed shallow bottom to be filled, outside of the marsh is 150' long by 20' to 40' wide. As the boat ramp extends waterward, past the marsh into open water towards the Waterway channel, approximately 5,000 square feet of shallow bottom would be filled to construct the open water section of the ramp (12' wide by 150' long ramp plus rip-rap side slopes from 4' to 14' wide on each side). See sheet 8 of 11 of the plans for the boat ramp details. Once the proposed concrete ramp reaches the 80' setback from the AIWW channel, the applicant proposes to stop construction and dredge an area approximately 24' by 40' down to an existing mean low water depth of -5' The dredge spoil would be dug with a barge-mounted excavator, dewatered on the barge and off-loaded onto the Oyster Harbour site. The proposed dredging would result in 912 square feet of shallow bottom disturbance. 10. ANTICIPATED IMPACTS- The proposed shallow bottom dredging would result in the excavation of 55 cubic yards of bottom sediments over an area 960 square feet in size. Temporary turbidity in the surrounding area will result from the digging and the dewatering from the barge. Impacts to living organisms can be minimized by timing the work to be done in the winter, use of a closed bucket backhoe, and equipping the barge with side slats and filter fabric to provide some filtration of the water before it re-enters the AIWW. Construction of the boat ramp, as designed, would result in the filling of approximately 5000 square feet of submerged shallow bottom. Also, approximately 1740 square feet of coastal marsh would be filled and permanently lost as result of the ramp and side slopes. Impacts could be minimized by use of vertical retaining wall along the ramp rather than side slope rock fill. By using the pre-cast concrete slabs, no live concrete would come into contact with the water. This structure could be a navigation hazard when submerged at high tide due to the proposed length. The pier, floating dock, finger pier, and boat slips will result in the shading of 360 square feet of vegetated wetlands and 2600 square feet of open water. , Approximately 15,000 square feet of high ground would be disturbed to construct and install the land-based amenities. Stormwater control devices are being required to control runoff. The Division of Marine Fisheries may provide an assessment of the shellfish resource in this area and how shellfish harvest might be impacted by the proposed dredging, fill, new boat slips and overall development. Archives and History may wish to follow-up on the exact location and specifics with regard to any archaeological resources in the vicinity. Janet M. Russell / Wilmington / 9-30-02 CAMA Major Application Oyster Harbour Waterway Park Narrative Oyster Harbour LLC, proposes to develop a waterfront park to serve as an amenity for the existing Oyster Harbour subdivision. The Waterfront Park would be located on a 0.9- acre parcel with approximately ninety-six linear feet of waterfront shoreline along the Atlantic Intracoastal Waterway (AIWW) in southern Brunswick County. The parcel is bounded to the north by Windy Point Road, to the east by Boone's Neck Road, and to the south by the AIWW. The Oyster Harbour subdivision these amenities would be serving is a four hundred ninety lot subdivision located at the intersection of Windy Point and Boone's Neck Roads (on the northern side of Windy Point and the western side of Boone's Neck Road). All lots within the subdivision are platted and recorded. Construction of phases I - III are complete, and construction of phase IV is currently underway. Upland development of the Waterway Park will include a parking area, a mulch playground with a roofed pavilion, and a gazebo with surrounding open deck. State approval of a sedimentation and erosion control and a stormwater management plan has been obtained for all upland development (copies of approval letters enclosed with application materials). Proposed water dependent development includes a community boat ramp and dock. The community dock would provide mooring structures for up to nine boats. The boat slips will be available as temporary tie-up for Oyster Harbour residents and their invited guests. Subdivision policy will establish the length of time a boat may remain docked in a slip (it is expected to be no more than 24 hours). Slips will be available on a "first come first serve" basis. Installation of the proposed ramp would require excavation of approximately 55 cy of material at the end of the ramp. Excavation would be performed with a clam-digger or similar bucket mounted on a barge. The exact method for de-watering the material may vary among potential contractors, but material will likely be contained within walls or boards with drainage pipes. De-watered material would be moved from the barge to the land via tract hoe and/or small back hoe and movement would be contained within in the corridor of the requested ramp. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant.
