Ross Dairy Farm Facility No. 44-15, Permit No. AWC440015 General Permit No. AWG200000 Haywood County Dear Mr. Ross: On October 15' the Division of Water Resources (DWR) received a complaint of a water quality concern near the confluence of Jonathan Creek and an unnamed tributary to Jonathan Creek. On October 16', staff, of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS), conducted a complaint investigation of Ross Dairy and the permitted waste disposal system. We wish to thank you for your assistance during the investigation. On October 16, 2018 staff of the Division of Water Resources witnessed a silage leachate discharge in the unnamed tributary to Jonathan's Creek. The source originated from the silage storage area. During the investigation corrective action was taken to place a temporary sand bag to divert all silage leachate to the storage tank. DWR appreciates the action taken to correct this incident with temporary measures until a permanent deign can be implemented. Required Corrective action for Violation: If you have not already done so, take all action necessary to abate any damages and to prevent recurrence of such a discharge event again. Contact the Haywood County Soil & Water Conservation District for assistance in implementing Best Management Plans (BMPs) for your farm. You are required to provide a written response to this Notice within 15 days of receipt. Please include in your response all corrective actions already taken. As I stated last time, three major areas of runoff have been fixed permanently. Our last stream sample had greatly improved since back in the summer. We are only 300 points from being below the threshold. The third and final area of potential run off is still being managed with a temporary solution. All of the run off is being channeled into an open ditch and directed to the center of a 2 acre field that is grassed over. There it can filter out and go down before it even gets remotely close to any open water. A permanent solution for this problem is going to be costly. We are still waiting on engineering assistance from NRCS. We have to have an approved plan from them before we can seek funding from the recently passed senate bill 99. To eliminate the risk of a water quality violation in this area until funding is approved I can offer the following: Notify DWR when funding is approved Monitor the site and field daily to ensure no waste or discharge enters the stream. I will communicate with Soil and water and DWR to provide a permanent plan and a timeline for completion as it becomes available. With regard to our waste utilization plan, it is complete and I have it in hand. All of the soil samples have been taken and fields have been updated and everything is in working order for my inspection this winter. Since the problems on our farm became known, we have taken every reasonable step that we can to try and correct them and I think that every sample that has been taken down stream of our farm will reflect that. We have been cooperative with all agencies involved this includes several on site meetings, phone conversations, emails etc. We also have met with NC State engineers that will be also be assisting us on the pending project. JAY ZIMMERMAN Direct., Manure Hauler Requirements According to 15A NCAC 02T .1400, manure hauler operations are deemed permitted. This means that while these operations do not have to apply for permits, they do have to follow a list of general requirements. These requirements are similar to the requirements for generator of dry litter. A summary of these requirements is provided below. 1. Litter shall not be stockpiled within 100 feet of perennial streams or wells. 2. Litter shall not be left uncovered for more than 15 days. Note that even if the requirements of # 1 and #2 are met, it is still the responsibility of the hauler to make sure that there is no discharge to waters of the State. 3. For land application, a setback of 25 feet from perennial streams or water bodies must be maintained. However, land appliers should be aware of setbacks from all ditches and intermittent streams. Runoff of litter due to improper land application can lead to discharges which can result in violations or enforcement actions. 4. Litter shall be applied at rates that do not exceed the agronomic rate of the receiving crop. The rates may be based on NCDA&CS soil test recommendations or NRCS Standards (realistic yield expectations). For more information on realistic yield expectations, contact a technical specialist with the Cooperative Extension Service, NRCS, NCDA&CS, or your local Soil and Water Conservation District. The State average N content for dry litter as shown in the North Carolina Agricultural Chemical Manual published annually by NCSU may be used to calculate application rates in lieu of individual waste analysis; however, waste analysis is still required. Fields that receive litter from a manure hauler must have a soil analysis that is less than three years old. The standard soil fertility analysis is available from NCDA&CS. Registration Requirements: All manure haulers that haul over 100 tons of litter in a calendar year must register with the Division of Water Resources. For dry litter operations that give away/sell all litter to a 3'd party or hauler: • If the 3`d party applies litter to land that is owned by the litter generator, then that land must be included in the litter generator's Waste Utilization Plan. • If the 3`d party hauls litter away, and applies it to fields not owned by the litter generator, then the litter generator does not need to have fields listed in the Waste Utilization Plan.
