Dear Mr. Doherty:
The Pretreatment, Emergency Response and Collection Systems (PERCS) Unit has reviewed the
updated Sewer Use Ordinance (SUO) submitted by Franklin County. This submission was received by
the Division on November 22, 2019. The SUO was adopted by local council on April 18, 2016. We
apologize for the late response.
The review indicates that with the following comments, the SUO is adequate and meets the
minimum requirements of 15A NCAC 2H .0900 and 40 CFR 403.
1. Section 1.2(a)(35) should reference (a)(35) instead of (b)(35).
2. Section 9 should reference .0903(b)(31) instead of (b)(10).
3. Sections 8.1(c) and 8.2(c) should reference [10] instead of 4.2(h).
According to our records, we have never received the attorneys statement for your SUO adopted in
2013. We are not going to require that you submit one at this time, but you may want to check with
your attorney to ensure that your SUO is compatible with your legal authority, particularly section 10
(adjudicatory hearings) of the SUO.
