Director >_ y Division of Water Quality O December 9, 2002 DWQ# 02-1760 Iredell County Mr. J: Reid Gray 182 Gray House Road Stony Point, NC, 28678 APPROVAL of 401 Water Quality Certification Dear Mr. Gray: You have our approval, in accordance with the attached conditions, to place fill in 140 linear feet of streams and to flood 820 linear feet of streams in order to create a farm pond on your property in Iredell County, as described in your application received by the Division of Water Quality on November 1, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3362, which can be downloaded from our web site at http://h2o.enr.state.nc.us . This Certification allows you to use Nationwide Permit Number 39 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. You should send an application to the Division of Land Resources for their review of your project under dam safety rules as well as erosion and sediment control. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when- necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP. concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at httu://h2o.enr.state.nc.us/ncwetlands/strmgide html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment-into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. Reid Gray Farm Pond Dam Iredell County Yadkin-Pee Dee River Basin Dear Mr. Gray: This letter is in response to plans, specifications and design data submitted under transmittal letter dated April 8, 2002 and received by this office on June 5, 2002 for the construction of the referenced dam, which is located on a tributary to Buffalo Shoals Creek in Iredell County. These plans and specifications were prepared under the supervision of Mr. Samuel C. Bingham, PE, with the Natural Resource Conservation Service. Also, check number 5981 for $200.00 was received as the initial plan review fee. This letter constitutes approval of your proposal to construct the subject dam according to the plans and specifications received by this Division on June 5, 2002 with the following stipulations: 1. The Natural Resources Conservation Service shall supervise the project construction. 2. During construction the Division of Land Resources may require such progress reports as are deemed necessary. 3. Applicable NRCS (SCS) standards for the installation of seepage diaphragms for conduits through dams shall be met. 6. Stream flow shall be piped or otherwise diverted around or through the construction site without being contaminated with sediment. 7. The North Carolina Division of Water Resources has determined that this project is subject to NC Administrative Code 15A 2K .0500 Minimum Stream Flows to Maintain Aquatic Habitat. The project is under study by the Division of Water Quality (DWQ) to locate any existing point discharges downstream and determine if a minimum release will be required. When the Division of Land Resources receives a determination from DWQ, stipulations reflecting it may be included in the permit to impound or subsequent amendments. 8. Land disturbing activities in the impoundment area shall be limited to those necessary for construction of the dam until a permit to impound is issued and impoundment begins such that sediment will be retained in the impoundment. 8. You must notify Mr. G. Douglas Miller, PE, Regional Engineer, Land Quality Section, 919 North Main Street, Mooresville, North Carolina 28115, and telephone number (704) 663-1699, ten days before the start of construction. In addition, we suggest you contact the US Army Corps of Engineers to determine if a Section 404 permit will be required. Also, the Water Quality Division of this Department may require a Section 401 permit. I am enclosing a copy of a cost certification form and an explanation of the final processing fee calculation. An additional fee will be required when the engineer's certification is submitted if the construction cost exceeds $10,001.00. In any event, the cost certification must be completed and returned with the engineer's certification before an approval to impound can be processed. An example is a diversion located uphill of a borrow area slope. A typical diversion is 1.5 ft deep and shaped to easily mow. DEPARTMENT OF AGRICULTURE Soil Conservation Service NC-ENC-13b Rev. 5/83 SPECIFICATIONS FOR CONSTRUCTION OF PONDS AND RESERVOIRS Clearing: All trees and brush shall be removed from the impoundment area before any water is - impounded. Whenever practical, this clearing should be delayed until after the dam is built to hold erosion and downs tream-sedimentation to a minimum. Studs may be removed or trees may be - sawed off as low as practical and stumps left standing. The foundation of the impoundment structure (dam) shall be cleared of all trees, stumps, roots, brush, sod, and debris. All stumps and all roots exceeding one (1) inch in diameter shall be removed to a minimrm depth of one (1) foot. Satisfactory disposition will be made of all debris. After clearing is completed the foundation area shall be loosened thoroughly and roughly leveled, with suitable equipment, before placement of any embankment material. Cutoff Trench: A cutoff trench shall be excavated as shown on the plans. The cutoff trench shall be backfilled in thin layers, not to exceed 8 inches in depth. All standing water shall be removed from the trench before backfilling is started. Embankment Construction: The material placed in the embankment shall be free of sod, roots, stones over 6 inches in diameter, and other objectionable materials. The fill material shall be placed and spread over the entire fill in layers not to exceed 8 inches in thickness. Con- struction of the fill shall be undertaken only at such times that the moisture content of the fill material will permit a reasonable degree of compaction. Fill Materials: Borrow areas will be designated on the plans and assigned priority (1, 2, 3, etc.). All fill material shall be taken from these designated areas. SCS technicians will advise the contractor regarding the maximum depth of cut in each borrow area. The contractor will not exceed this depth. In the event this depth is exceeded in the impoundment area, it shall be the responsibility of the contractor, without additional" cost to the landowner, to cover the exposed area with a minimum of 2 feet of impervious material. Riser b Conduit Pipe: When it is indicated on the plans that a riser and conduit pipe are re- quired, they must be installed as a complete unit. The inlet of the riser shall be protected. by an inverted bucket-type, or an equally effective type, of trash rack. The conduit shall be placed on a firm foundation. Selected backfill material shall be placed around the riser and conduit pipe in layers not exceeding 4 inches and each successive layer thoroughly compacted. Anti-Seep Collars:. Anti-seep collars will be of materials and dimensions, and located as shown in the plans where specified. Vegetated Spillwav(s): Spillway(s) will be excavated in undisturbed earth to the dimensions, grades, slopes, and location as shown in the plans and as staked upon the ground. Pollution Control During Construction: Stripping of embankment and borrow areas shall be dole as they are needed in a normal sequence of construction. Use temporary mulch protection on all disturbed areas that are subject to erosion and will not have substantial additional work per- formed for 30 days or more. Temporary stream crossing structures will be used where fording of streams will cause excessive sediment pollution. Protection against pollutants such as chemicals, fuel, lubricants, sewage. etc., will be provided during construction. SCOPE This work shall consist of furnishing all materials, equipment and labor necessary for the installation of geotextile fabric filter cloth under rock riprap and as a load stabilizer under surfacing materials on roadbeds and other heavy use areas. 2. MATERIALS Fabric filter cloth shall be manufactured from synthetic long chain or continuous polymeric filaments or yarns such as polypropylene, polyethylene, polyester, polyamide, or polyvinyl idene -chloride. The fabric filter cloth shall. be formed into a stable network of filaments or yarns that retain their relative position to each other, are inert to commonly encountered chemicals, and are resistant to ultraviolet light exposure, heat, hydrocarbons, mildew, rodents and insects. The fabric filter cloth shall be free of any chemical treatment or coating that might significantly reduce its permeability and shall have no flaws or defects that would significantly alter its physical properties. Fabric filter cloth shall be of the. non-woven type and shall conform. to the physical properties listed in Table 1, based on the average roll minimum value. Non-woven fabric filter cloth shall be manufactured from randomly oriented fibers bonded together by the. needle punched process. Prior to installation of any fabric filter cloth, the Contractor shall furnish the Contracting Officer the following information: (1) Name of product and manufacturer. (2) Product description, chemical composition, and copies of typical laboratory test values. (3) Statement of compliance attesting that the fabric filter cloth meets the chemical, physical, and manufacturing requirements stated in this specification. SHIPMENT AND STORAGE The fabric filter cloth shall be supplied in rolls wrapped with a protective covering to keep out mud, dirt, dust, debris, and direct sunlight. PLACEMENT The fabric filter cloth shall be placed on the approved prepared surface at the locations and in accordance with the details shown on the drawings. The fabric shall be unrolled along the placement area- and loosely laid (not stretched) in such a manner that it will conform to the surface irregularities when the stone or other material is placed on it. No cuts will be permitted in the fabric panel unless otherwise specified. The panel may be folded and overlapped to permit proper placement in the designated areas. The orientation of the width and length of the fabric panels shall be as shown on the drawings. The fabric length shall be placed parallel to the direction of water flow unless otherwise indicated on the drawings. The overlaps of panels and end roll details shall be as specified. The minimum overlap shall be 18 inches. Securing staples shall be placed along the edge of the panel and at abrupt changes in contour to adequately secure the fabric filter cloth to the soil surface. At overlaps, securing staples shall be inserted through both layers along a line through the approximate midpoint of the overlap. Securing pins shall be placed along a line approximately two inches in from the edge of the outer limits of the completed filter cloth area at intervals not greater than 12 feet. Additional staples shall be installed as necessary to prevent any slippage of the fabric, regardless of location. Staples shall be machine made of No.-11 gauge or larger new steel wire formed into a "U" shape. The size when formed shall not be less than 6-inches.in length with a throat of not less than 1 inch in width. Staples normally used for securing erosion control netting may be acceptable if approved by the engineer prior to installation. Rock riprap and other surfacing material shall be placed in a manner that prevents damage to the fabric filter cloth. In no case will riprap be dropped on uncovered material from a height greater than three feet. 7. Installation shall be performed in a skillful and workmanlike manner in accordance with the manufacturer's recommendations and the following requirements. The contractor may elect to overfill the conduit foundation and the adjoining area prior to laying the pipe. The amount of overfill will be limited to two feet vertically above the planned pipe grade. Excavations for the conduit trench shall have a minimum bottom width of four feet with 3:1 or flatter side slopes. Prior to laying the pipe, a bedding trench shall be prepared for the pipe by filling approximately two inches above grade with a compacted material. The foundation area for the pipe shall then be excavated to approximately one inch below the planned invert elevation for the pipe. As it is critical that this area is properly shaped to conform to the pipe, the shaping shall be performed by hand unless the engineer approves an alternative method. Also, a template equivalent to the outside diameter of the pipe (with screed), shall be used to check the shaped area to insure that it conforms to the pipe diameter. One inch of select impervious moist material shall be placed in the shaped bedding trench immediately prior to placing the pipe. The pipe shall then be placed to line and grade and firmly and uniformly bedded in the bedding trench throughout its entire length with select impervious moist fill material. The area supporting the joints shall be over excavated as necessary to allow for assembly and to insure that the pipe barrel is uniformly supported by the soil bedding. Select moist backfill material shall be placed and hand compacted around the pipe conduit at approximately the same rate on both sides of the pipe. Compaction around the bottom half of the pipe must be firm to fill all voids, but extreme caution must be exercised to prevent damage, movement, uplift or defection of the pipe. Routine main- tenance is considered to be normal good care of the pond. Good maintenance adds to beauty, usefullness, and permanence. In addition severe storms that cause flow in-the vegetated spillway will likely call for maintenance, such as, replacing and compacting soil in washes or gullies., reestablishment of vegetation, removal of debris and the like. When such work is necessary, the Soil Conservation Service, if requested, will provide technical assistance to help with the repair. This type of maintenance should be done as soon as possible after damage is discovered. The routine maintenance of this pond involves the following: 1. Maintenance of a vegetative cover on the dam and in the spillway: Fes cm,e (Type of Vegetation) is being established on these areas. Beginning in 7_<)1o3 (Year) and each year thereafter, the dam and spillway should be fertilized with --?n C) pounds of /O-ZO-Zo per acre to maintain a vigorous stand. 2. Removal of logs, brush, or other trash from the entrance of the pipe spillway, the grass spillway, and the face of the dam: This should be done after each rise in the pond surface that deposits such material. Unless this material is removed, the pipe spillway is likely to become clogged and the vegetation killed in the affected areas. 3. Control of weeds, brush, and trees in the grass spillway on the dam and in the outlet channel for a short distance below the pipe outlet: This may be done by mowing, spraying, or chopping, or-a combination of all three. This will need to be done at least once each year and possibly twice in years favorable to heavy growth-of vegetation. You may check with the local Extension Agent or SCS office for the latest information on spray material and the best time to-apply them. 4. If the dam and §pillway are to be grazed, be sure to remove all live- stock when grass has been grazed down to a height of 4 inches. Also, remove livestock when the dam and spillway are wet and soft. Severe damage can be done by livestock at such times. 5. Protection of the Grass Spillway: The spillway can be severely damaged by uncontrolled vehicular traffic. Trails or ruts made by such traffic could become large gullies when outflow occurs in the spillway.
