The Division of Water Quality received your request to withdraw your Notice of Intent to be
covered under NCGO2000O, and rescind your previously expired coverage under Certificate of
Coverage (CDC) No. NCGO2053O. In accordance with your request dated June 29, 2012, CDC No.
NCGO20530 is rescinded and NOI NCGO2O782 is withdrawn effective immediately.
Operating a treatment facility, discharging mine dewatering wastewater or discharging specific
types of stormwater to waters of the State without valid coverage under an NPDES permit is against
federal and state laws and could result in fines. If something changes and your facility would again
require stormwater or wastewater discharge permit coverage, you should notify this office
immediately. We will be happy to assist you in assuring the proper permit coverage.

This is to advise you that the above referenced mining expired on August 18, 2010 and has not
been renewed. It has been in the process of being renewed, but additional information has not been
provided for the mine permit application as requested in the letter sent on April 18, 2011 and in the
Notice of Deficiency sent on January 13, 2012. The mine permit renewal is now considered
withdrawn as of February 13, 2012: An inspection by personnel of the Department on February 23,
2012 noted that some reclamation efforts had been completed, but additional reclamation is needed.
Expiration of the permit only precludes further mining operations; reclamation requirements continue
to remain in effect. Section 74-56 of the Mining Act of 1971 mandates initiation of bond forfeiture
proceedings for failure to reclaim in accordance with the reclamation plan. Also, civil penalties of up
to $500.00 per day for each day of the violation may be assessed under G.S. 74-64.
Additionally, under G.S. 74-64, the penalty for operating a mine without a permit is.a civil
penalty of up to $5,000.00 per day for each day of the violation. Please contact this office
immediately at Land Quality Section, Fayetteville Regional Office, 225 Green Street, Suite 714,
Fayetteville, North Carolina 28301, 910-433-3300, to clarify your intention at this site. Only the
issuance of a mining permit, and not the mere submittal of an application, will enable you to lawfully
resume the mining operation. You are required to submit an application for a new mining permit and
it must be approved if you will continue mining. You may elect to close and completely reclaim the
mine and not apply for a new permit.

In light of the above, you have two options to maintain compliance at this site:

(1) Complete and file an original and 6 (six) copies of an application form for a
new mining permit for this site along with the required corresponding mine
maps. The appropriate mining permit application processing fee is also
required. The application for a mining permit, The Mining Act of 1971, the
Administrative Rules, and other forms may be downloaded by visiting:
http://portal.ncdenr.org/web/Ir/, the web page for the Division of Land
Resources' Mining Program. No mining operations may be conducted
until a mining permit is issued for this site.
This corrective action must be completed WITHIN 60 DAYS OF RECEIPT
OF THIS NOTICE.
(2) Commence adequate reclamation activities on the inactive sections of the
affected areas at the site and continue said activities until all affected
areas where mining has terminated have been sufficiently reclaimed.

(B) If you desire to permanently close the mine, you must:

On January 5, 2012, an inspection of the subject mine was performed by Melissa Joyner
of this office. Deficiencies were observed that require your prompt attention.
The deficiencies discovered and the necessary corrective actions are as follows:

2. .RC2.-The.specifications for surface gradient restoration to a surface suitable
for the planned future use are as follows:
A. The lake area (s) shall be excavated to maintain a minimum water
depth of four feet measured from the low water table elevation.
In "Mine Areas No. 1 and 2" the ponds are not excavated to a minimum
water depth of four feet.
3. RC3 - Revegetation Plan: After site preparation, all disturbed land areas shall
be revegetated as per the Revegetation/Reclamation plan with the permanent
seeding specifications.
Exposed, graded slopes within the mine area are to be revegetated according
to the permanent seeding specifications in the approved mining permit.
4. RC4 — Reclamation Plan: Reclamation shall be conducted simultaneously with
mining to the extent feasible. In any event, reclamation shall be initiated as soon as
feasible after completion or termination of mining of any mine segment under permit.
Final reclamation, including revegetation, shall be completed within two years of
completion or termination of mining.
Reclamation is not being conducted simultaneously with mining.
If the previously described deficiencies are not corrected within 30 days following your
receipt of this Notice this matter will be referred to the Director, Division of Land
Resources/Department of Environment and Natural Resources, for issuance of a "Notice of
Violations" in an effort to secure compliance. In addition, failure to correct the deficiencies may
result in the assessment of civil penalties and/or injunctive relief against you.

Dear Mr. Patterson:
On behalf of ES&J Enterprises, Inc., the following responds to your letter dated October
26, 2010. The accompanying maps have been modified to the items addressed in this
letter.
1. Sheet 2 of 3 shows the outfalls for the mine point discharges to be at the existing
8 inch PVC pipe (Discharge Point 1) and the 12 inch concrete culvert (Discharge
Point 2). Dewatering discharge will be to one of the excavations not being
actively mined.
2. The mine excavations contain the runoff and act as the erosion control structures
(see Sheets 1, 2, and 3).
3. Sheet 3 shows the topographic elevation near the wetlands and the estimated
depths of final excavation.
4. The attached Figures l and 2 are from the USGS Quadrangle Map and the USDA
Soil Survey. In comparison of the two figures, drainage through the site has been
altered. The older USDA map shows the ditch passing through the middle of the
site corresponding with the Roanoke Soils while the newer USGS map shows that
the drainage had been altered to it present location. The wetlands delineated on
the property are within the old ditch and within the Roanoke Soils.
The USGS map shows two former existing sandpits near the Jireh Material Mine.
One excavation is about 2000 feet east, and the other excavation is about 11,000
feet west of the subject site. Water levels at the adjacent excavations are near 65
feet to 70 feet and are about 5 or more feet below the adjacent original
groundsurface. These water levels are similar to groundwater levels at the Jireh
Material Mine. Per the USDA map similar soil types (primarily Roanoke,
Tarboro, Wickham, and Altavista) are present at the Jireh Material Mine and the
adjacent excavations.

In general the site observations at the Jireh Material Mine and the information
collected from the USDA and USGS maps indicate a water table at least 5 feet
below groundsurface. The wet land conditions noted at the mine are a result of
water perched near groundsurface. The Roanoke soils have slow draining clay soil
(CH and CL per the Unified Soil Classification System) near the groundsurface.
Therefore, the groundwater table and the wetlands are not hydrologically
connected, and dewatering of the mine will not impact the wetlands.

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for Jireh Material Mine on October 15, 2010. The
application included a copy of an expired mining permit from the Division of Land Resources (DLR). Please
be aware that the issuance.of an NPDES permit is contingent upon the renewal of the associated mining
permit from DLR. Our office will process your stormwater permit application once a DLR mining permit
has been issued for your project.
Please provide the following additional information:
1. The site plans must clearly identify and label each stormwater outfalls and dewatering outfalls.
2. All sediment basins or other BMPs need to be shown and labeled on the plans.
3. Existing and proposed elevations of each mine pit and the wetlands must be shown.
4. Information must be provided to demonstrate that mine dewatering will not have adverse effects

dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities .

on our website, http://portal.ncdenr.org/web/wq/ws/su/npdessw. See Part III, Section E of the permit. An
approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities and may be
required prior to permit issuance. Discharging mine dewatering wastewater without Plan approval will be
subject to enforcement action. A Plan for your facility must be submitted to the Washington Regional Office
within 60 days of your receipt of an NPDES permit. We encourage you to contact Mike Lawyer at the

This letter serves as a follow-up to the telephone conversations we have had regarding the need for coverage under the
NCG020000 general permit for the Jireh Material Mine located on Gainey Road in Cumberland County. Coverage under
the NCG020000 general permit is required to discharge stormwater, mine dewatering, and process wastewater from
active and inactive mining sites. Permit conditions include, but are not limited to. the development of a Stormwater
Pollution Prevention Plan, Analytical and Qualitative Monitoring requirements for stormwater only discharges, and
Monitoring requirements for mine dewatering and other process wastewater discharges. Based on information provided in
the recent application for renewal of the mining permit issued by the Division of Land Resources, the Jireh Material Mine
is subject to the requirement to obtain coverage under the NCG020000 general permit. Enclosed with this letter is a copy
of the Notice of Intent application form for coverage under the NCG020000 general permit. Our office requests that you
submit the Notice of Intent form to the Stormwater Permitting Unit within 30 calendar days from receipt of this
letter. Please be advised that continued operation of your facility without proper permit coverage could result in
the issuance of a Notice of Violation as well as the assessment of civil penalties of up to $25,000 per day, per
violation.
In addition to your submittal of the Notice of Intent application form, please include a written request to have expired
Certificate of Coverage-NCG020530 be rescinded.

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1 a) and (1 b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
enforcement authority of the Division of Water Quality. Your payment should be sent to:

Hearings, Post Office Drawer 27447, Raleigh, North Carolina, 27611-7447. Unless such request for hearing is made or

In accordance with your application for discharge permit received on May 11, 2000, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
