In accordance with your request dated June 29, 2012, CDC No. NCGO20530 is rescinded and NOI NCGO2O782 is withdrawn effective immediately. Operating a treatment facility, discharging mine dewatering wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. It has been in the process of being renewed, but additional information has not been provided for the mine permit application as requested in the letter sent on April 18, 2011 and in the Notice of Deficiency sent on January 13, 2012. The mine permit renewal is now considered withdrawn as of February 13, 2012: An inspection by personnel of the Department on February 23, 2012 noted that some reclamation efforts had been completed, but additional reclamation is needed. Expiration of the permit only precludes further mining operations; reclamation requirements continue to remain in effect. Section 74-56 of the Mining Act of 1971 mandates initiation of bond forfeiture proceedings for failure to reclaim in accordance with the reclamation plan. Also, civil penalties of up to $500.00 per day for each day of the violation may be assessed under G.S. 74-64. Additionally, under G.S. 74-64, the penalty for operating a mine without a permit is.a civil penalty of up to $5,000.00 per day for each day of the violation. Deficiencies were observed that require your prompt attention. The deficiencies discovered and the necessary corrective actions are as follows: 1. If the previously described deficiencies are not corrected within 30 days following your receipt of this Notice this matter will be referred to the Director, Division of Land Resources/Department of Environment and Natural Resources, for issuance of a "Notice of Violations" in an effort to secure compliance. The accompanying maps have been modified to the items addressed in this letter. 1. Sheet 2 of 3 shows the outfalls for the mine point discharges to be at the existing 8 inch PVC pipe (Discharge Point 1) and the 12 inch concrete culvert (Discharge Point 2). Dewatering discharge will be to one of the excavations not being actively mined. 2. The mine excavations contain the runoff and act as the erosion control structures (see Sheets 1, 2, and 3). 3. Sheet 3 shows the topographic elevation near the wetlands and the estimated depths of final excavation. 4. The attached Figures l and 2 are from the USGS Quadrangle Map and the USDA Soil Survey. In comparison of the two figures, drainage through the site has been altered. The older USDA map shows the ditch passing through the middle of the site corresponding with the Roanoke Soils while the newer USGS map shows that the drainage had been altered to it present location. The wetlands delineated on the property are within the old ditch and within the Roanoke Soils. The USGS map shows two former existing sandpits near the Jireh Material Mine. One excavation is about 2000 feet east, and the other excavation is about 11,000 feet west of the subject site. Water levels at the adjacent excavations are near 65 feet to 70 feet and are about 5 or more feet below the adjacent original groundsurface. These water levels are similar to groundwater levels at the Jireh Material Mine. Per the USDA map similar soil types (primarily Roanoke, Tarboro, Wickham, and Altavista) are present at the Jireh Material Mine and the adjacent excavations. In general the site observations at the Jireh Material Mine and the information collected from the USDA and USGS maps indicate a water table at least 5 feet below groundsurface. The wet land conditions noted at the mine are a result of water perched near groundsurface. The Roanoke soils have slow draining clay soil (CH and CL per the Unified Soil Classification System) near the groundsurface. Therefore, the groundwater table and the wetlands are not hydrologically connected, and dewatering of the mine will not impact the wetlands.
