Dear Ms. King,
On August 15, 2002, DWQ staff met with you to conduct an appeal of an on-site determination to
review a drainage feature on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 213
.0233). As a result of this on-site determination, I confirmed that the determination made by Mr. Bob Zarzecki
on July 24, 2002 (letter to you dated August 2, 2002) was accurate in that the feature in question is at least an
intermittent stream starting at Flag Number "NBR 01" (flag from Soil and Environmental Consultants) and,
therefore, is subject to the Neuse Buffer Rules (North Carolina Administrative Code T15A:02B .0233.
This letter only addresses the applicability to the buffer rules and does not approve any activity within
the buffers. This determination is only applicable to the buffer rules (15A NCAC 2B .0233 and is not intended to
delineate Waters of the State or Waters of the United States subject to other State or Federal protection. If you
have any additional questions or require additional information you can reach me at 919-733-9646. You may
contest this final agency.decision within 60 days of the your receipt of this letter by sending a written request to
the NC Office of Administrative Hearings. They can be reached at 919-733-2698 for additional information.
Based on our conversation, DWQ staff will also work with you on any variance request to allow impact
to this stream channel. As you know, impacts to Zone 2 (the outer 20 feet) can be approved by DWQ staff with
a minor variance while impacts to Zone 1 (the inner 30 feet) will require a major variance issued by the NC
Environmental Management Commission. Procedures for those variances are listed in the Neuse River Buffer
rules (15A NCAC 2B .0233 (9).

On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B .0233)
Dear Ms. King:
On July 24, 2002, at your request Mr. Bob Zarzecki and Mr. Mike Horan of the Division of Water Quality (DWQ)
Wetlands/401 Unit conducted an on-site determination to review a drainage feature on the subject property for
applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). As a result of this on-site determination, the DWQ has
determined that the drainage feature located on the subject property contains an intermittent stream subject to the Neuse
Buffer Rules. It was determined that the stream starts at the location of the "NBROI" flag located on the stream and
approximated on the attached Wake County GIS map (stamped and initialed by DWQ staff on August 2, 2002). The
stream flows from this point east through the property until it enters a pipe at or near the southeastern property boundary
(as indicated on the attached map).
During this evaluation staff identified flagging that indicated that the stream has been evaluated in the past. Upon further
review it was discovered that the stream was evaluated by Soil & Environmental Consultants, Inc. (S&EC, Inc.) for a
perspective buyer (Mt. Zion Church). The evaluation performed by S&EC, Inc. was reviewed by Ms. Deborah Edwards
of the DWQ Raleigh Regional Office. Ms. Edwards determined that the feature was an intermittent stream subject to the
Neuse Buffer Rules starting at the S&EC, Inc. flag "NBROI". DWQ staff was unaware of Ms. Edwards evaluation at the
time of the July 24, 2002 on-site determination.
The DWQ has determined that you are eligible to request a variance from the buffer rules if it is determined that the
property can not be developed without impacting the buffers (except for activities that are classified as "exempt",
"allowable" or "allowable with mitigation" under the buffer rule). There are two types of variances available. You may
request a Minor Variance if your proposed development only proposes to impact Zone 2 (the outer 20 feet of the 50-foot
buffer). Minor Variances are reviewed and approved by DWQ staff. You may request a Major Variance if your proposed
development proposes to impact Zone 1 (the inner 30 feet closest to the stream of the 50-foot buffer). Major Variances
are reviewed and approved by the Water Quality Committee (WQC) of the N.C. Environmental Management Commission
during their regularly scheduled meetings. Please contact this office if you are proposing any impacts to the protected
buffers that are not classified as "exempt" under the buffer rule. We can meet with you at your request to discuss your .
options and the variance process. Please note that in order for the DWQ or the WQC to determine whether your property
can be developed without impacting the protected buffers you will need to provide at a minimum a proposed site
development plan for the property.
If you dispute the on-site determinations made by DWQ staff, then you may request a review in writing by the Director,
Mr. Alan W. Klimek. This written request should be sent to Mr. Alan W. Klimek c/o Mr. John Dorney at the address
below. The Director's determination is subject to review as provided in Articles 3 an 4 of G.S. 150B (Administrative

Looks like Debbie has already made the call. The owner did not inform me of
this until Mike and I reviewed it. I specifically asked her during our phone
conversation before the site visit and she said that no one from DWQ has been to lJ
the site. Mike and I called it at the same place as Debbie did. Please review
the file. I don't plan to send an on-site determination since one was already
performed by the RRO. I still think that you may want to look at it before we
go down the Major Variance road. The stream is bone dry now, but then again
everything is. I need to contact Ms. King to set up a pre-variance meeting or
advice her to send in a formal request for appeal to you, unless you plan to. \
