This letter shall act as your approved Authorization Certificate for impacts to the protected riparian buffers as required under the Tar-Pamlico River Buffer Protection Rules (15A NCAC 2B.0259). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and Tar-Pamlico Buffer Rules (15A NCAC 2B .0259). This approval is only valid for the purpose and design that you described in your application and additional information except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the Tar-Pamlico Buffer Rule and any additional conditions listed below. Conditions: 1. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0259(5). 2. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. The project is located outside of Belltown, North Carolina, approximately one mile southwest of the junction of U.S. Highway 15 and I-85 (See Figure 1). This project involves the development of a new county park with trails, playgrounds, ball fields, a wetland interpretive area, and an amphitheatre with parking. The project will not impact jurisdictional wetlands and/or streams. However, Riparian buffer impacts will be required to construct the proposed hiking trails. These trails are allowable uses without requiring mitigation under the Tar-Pamlico Riparian Area Protection and Maintenance Rule. Therefore, no mitigation for buffer impacts is being proposed at this time. The site is approximately 48 acres in size and is generally bound to the west by Hancock Road (SR 1161), to the northeast by open woods, and to the southeast by Belltown Road (SRI 133) (Attachment A - Figures 1 and 2). The project involves the development of a new county park with trails, playgrounds, ball fields, a wetland interpretive area, and an amphitheatre with parking. On behalf of our client, Granville County, Carolina Wetland Services, Inc. (CWS) is submitting a Pre- Construction Notification application with attachments (Attachment B) in response to a letter from Mr. John Holley, Jr. of the North Carolina Department of Environment and Natural Resources Division of Land Resources (NCDENR-DLR), dated May 21, 2002 regarding buffer encroachments associated with this project (Attachment Q. Approximately 4,194 sq ft of Zone 1 riparian buffer and 2,771 sq ft of Zone 2 riparian buffer will be impacted by the construction of a hiking trial and elevated boardwalk adjacent to jurisdictional waters within the Tar-Pamlico river basin (Attachment A - Figure 3). Impacts to the riparian zones have been minimized to the maximum extent practicable. Under the Tar-Pamlico Riparian Area Protection and Maintenance Rule (15A NCAC 213.0259) the construction of greenways and hiking trails is an allowable use for encroachment on Zones land 2 without mitigation. CWS is requesting a "no practical alternatives" determination for this project. I Jonesland Environmental Park Project July 19, 2002 Request for a "No Practical Alternatives" Determination Project No. 2001-0162 Existing Conditions The following sections describe the existing conditions of the Jonesland Environmental Park Project area. Introduction The site is located outside of Belltown, North Carolina, approximately one mile southwest of the junction of U.S. Highway 15 and Interstate 85. The site is approximately 48 acres in size and is generally bounded to the west by Hancock Road (SR 1161), to the northeast by the open woods, and to the southeast by Belltown Road (SRI 133) (Attachment A - Figures 1 and 2). The project involves the development of a new county park with trails, playgrounds, ball fields, a wetland interpretive area, and an amphitheatre with parking. On behalf of our client, Granville County, Carolina Wetland Services, Inc. Current Land Use The current land use for this project is mainly rural. The riparian canopy is dominated by sweetgum (Liquidambar styraciflua), green ash (Fraxinus pennsylvanica), tulip poplar (Liriodendron tulipifera), and red maple (Ater rubrum). The wetland areas are dominated by hydrophytic vegetation such as cinnamon fern (Osmunda cinnamomea), wool grass (Scirpus cyperinus), smilax (Smilax rotundifolia), arrowwood (Viburnum nudum), and various sedges (Carex spp.). Jurisdictional Waters CWS investigated on-site jurisdictional waters of the U.S.' on October 30, 2001, using the U.S. Army Corps of Engineers (USACE) - Routine On-site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manual.2 Three stream channels (Streams A, B, and C) were identified during this investigation, as well as three wetland areas (Wetlands AA, BB, and CC) (Attachment A - Figure 2). On-site jurisdictional waters of the U.S. include unnamed tributaries to Cattail Creek. Cattail Creek is located within Tar-Pamlico River Basin (HU# 03020101);, and is 1 "Jurisdictional waters of the U.S." includes essentially all surface waters such as: all navigable waters and their tributaries, all interstate waters and their tributaries, all wetlands adjacent to these waters, and all impoundments of these waters. 2 Environmental Laboratory. Jonesland Environmental Park Project July 19, 2002 Request for a "No Practical Alternatives" Determination Project No. 2001-0162 classified as "Class C" waters by the North Carolina Division of Water Quality (NCDWQ). CWS received written verification regarding the location and extent of on-site jurisdictional areas from Ms. Amanda Jones of the USACE on March 25, 2002 (Attachment D). NCDENR-DLR identified Stream B and Wetland BB as having 50-foot Tar-Pamlico riparian buffer requirements along both of their boundaries (Attachment A - Figure 3). Details regarding these features have been included in the following paragraphs. Stream B is an Unimportant Intermittent channel that begins on the north side of Wetland BB in the center of the property. It flows southeast into and out of Wetland BB for approximately 247 linear feet before leaving the property through a culvert under Belltown Road (SSR 1133) on the property's southeast boundary. This channel has a drainage area of approximately 32 acres. Stream B shows weak sinuosity and moderate braiding (Attachment E - SCP#1). This portion of Stream B rated 13.0 out of 71 possible points on the NCDWQ Stream Classification Form. Wetland BB is connected to Stream B and is approximately 0.38 acres in size. The majority of Wetland BB is dominated by hydrophytic vegetation consisting of wool grass (Scirpus cyperinus), various sedges (Carex spp.), arrowwood (Viburnum nudum), and smilax (Smilax rotundifolia) (Attachment F - DP 1). Hydric soils were observed within Wetland BB based on the presence of a low chroma soil with mottles. The hydrology sustaining Wetland BB appears to be a combination of ground water and Stream B, which flows into and then out of Wetland BB. A photograph taken during the site visit of Wetland BB is included as (Attachment G - Photographs A and B). Purpose and Need for the Project The proposed project involves the development of a new county park with trails, playgrounds, ball fields, a wetland interpretive area, and an amphitheatre with parking. The purpose of the park is to provide recreational facilities and environmental education opportunities for the surrounding communities. 3 Jonesland Environmental Park Project July 19, 2002 Request for a "No Practical Alternatives" Determination Project No. 2001-0162 Avoidance and Minimization The development of this park and the siting of its facilities will avoid directly impacting any jurisdictional waters of the U.S. The construction of hiking trails will utilize boardwalks to avoid impacting on-site wetland areas and stream channels. The extent of these aerial walkways and associated grading has been minimized to the maximum amount practicable. The hiking trail has been re-designed to avoid any unnecessary impacts to Stream B or Wetland BB. Proposed Impacts to Riparian Buffer Zones While avoiding direct impacts to jurisdictional waters, the construction of this project will impact approximately 4,194 sq ft of Zone 1 riparian buffer and 2,771 sq ft of Zone 2 riparian buffer adjacent to Stream B and Wetland BB (Attachment A - Figure 3). These impacts are associated with the construction of a hiking trail and elevated boardwalk that will traverse the wetland area. Table 1. The site is approximately 48 acres in size and is generally bound to the west by Hancock Road (SR 1161), to the northeast by open woods, and to the southeast by Belltown Road (SRI 133) (Attachment A - Figures 1 and 2). The project involves the development of a new county park with trails, playgrounds, ball fields, a wetland interpretive area, and an amphitheatre with parking. On behalf of our client, Granville County, Carolina Wetland Services, Inc. (CWS) is submitting a Pre- Construction Notification application with attachments (Attachment B) in response to a letter from Mr. John Holley, Jr. of the North Carolina Department of Environment and Natural Resources Division of Land Resources (NCDENR-DLR), dated May 21, 2002 regarding buffer encroachments associated with this project (Attachment Q. Approximately 4,194 sq ft of Zone 1 riparian buffer and 2,771 sq ft of Zone 2 riparian buffer will be impacted by the construction of a hiking trial and elevated boardwalk adjacent to jurisdictional waters within the Tar-Pamlico river basin (Attachment A - Figure 3). Impacts to the riparian zones have been minimized to the maximum extent practicable. Under the Tar-Pamlico Riparian Area Protection and Maintenance Rule (15A NCAC 213.0259) the construction of greenways and hiking trails is an allowable use for encroachment on Zones land 2 without mitigation. J 1 Jonesland Environmental Park Project July 19, 2002 Request for a "No Practical Alternatives" Determination Project No. 2001-0162 Existing Conditions The following sections describe the existing conditions of the Jonesland Environmental Park Project area. Current Land Use The current land use for this project is mainly rural. The riparian canopy is dominated by sweetgum (Liquidambar styraciua), green ash (Fraxinus pennsylvanica), tulip poplar (Liriodendron tulipifera), and red maple (Ater rubrum). The wetland areas are dominated by hydrophytic vegetation such as cinnamon fern (Osmunda cinnamomea), wool grass (Scirpus cyperinus), smilax (Smilax rotundifolia), arrowwood (Viburnum nudum), and various sedges (Carex spp.). Jurisdictional Waters CWS investigated on-site jurisdictional waters of the U.S.1 on October 30, 2001, using the U. S. Army Corps of Engineers (USACE) - Routine On-site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manual.2 Three stream channels (Streams A, B, and C) were identified during this investigation, as well as three wetland areas (Wetlands AA, BB, and CC) (Attachment A - Figure 2). On-site jurisdictional waters of the U.S. include unnamed tributaries to Cattail Creek. Cattail Creek is located within Tar-Pamlico River Basin (HU# 03020101)3, and is 1 "Jurisdictional waters of the U.S." includes essentially all surface waters such as: all navigable waters and their tributaries, all interstate waters and their tributaries, all wetlands adjacent to these waters, and all impoundments of these waters. 2 Environmental Laboratory. I Jonesland Environmental Park Project July 19, 2002 Request for a "No Practical Alternatives" Determination Project No. 2001-0162 classified as "Class C" waters by the North Carolina Division of Water Quality (NCDWQ). CWS received written verification regarding the location and extent of on-site jurisdictional areas from Ms. Amanda Jones of the USACE on March 25, 2002 (Attachment D). NCDENR-DLR identified Stream B and Wetland BB as having 50-foot Tar-Pamlico riparian buffer requirements along both of their boundaries (Attachment A - Figure 3). Details regarding these features have been included in the following paragraphs. Stream B is an Unimportant Intermittent channel that begins on the north side of Wetland BB in the center of the property. It flows southeast into and out of Wetland BB for approximately 247 linear feet before leaving the property through a culvert under Belltown Road (SSR 1133) on the property's southeast boundary. This channel has a drainage area of approximately 32 acres. Stream B shows weak sinuosity and moderate braiding (Attachment E - SCP#I). This portion of Stream B rated 13.0 out of 71 possible points on the NCDWQ Stream Classification Form. Wetland BB is connected to Stream B and is approximately 0.38 acres in size. The majority of Wetland BB is dominated by hydrophytic vegetation consisting of wool grass (Scirpus cyperinus), various sedges (Carex spp.), arrowwood (Viburnum nudum), and smilax (Smilax rotundifolia) (Attachment F - DPI). Hydric soils were observed within Wetland BB based on the presence of a low chroma soil with mottles. The hydrology sustaining Wetland BB appears to be a combination of ground water and Stream B, which flows into and then out of Wetland BB. A photograph taken during the site visit of Wetland BB is included as (Attachment G - Photographs A and B). Purpose and Need for the Project The proposed project involves the development of a new county park with trails, playgrounds, ball fields, a wetland interpretive area, and an amphitheatre with parking. The extent of these aerial walkways and ' associated grading has been minimized to the maximum amount practicable. The hiking trail has been re-designed to avoid any unnecessary impacts to Stream B or Wetland BB. I Proposed Impacts to Riparian Buffer Zones ' While avoiding direct impacts to jurisdictional waters, the construction of this project will impact approximately 4,194 sq ft of Zone 1 riparian buffer and 2,771 sq ft of Zone 2 riparian buffer adjacent ' to Stream B and Wetland BB (Attachment A - Figure 3).
